Abstract

This paper aims to examine the regulation of land use by the Limboto Lake community. This study uses an empirical juridical approach. The study results show that the regulation of land rights, especially land along the banks, has been regulated by the government and local governments, starting from laws and regulations, regional regulations, and other decisions. The existence of laws and regulations has given legitimacy to the state, in this case, the government, regarding the control and utilization of the land on the banks of the lake because the state legally owns the land on Lake Limboto. However, the fact is that the land on the banks of the lake has changed its function to become a community settlement. , making it difficult to carry out an inventory of the surrounding population. In order to prevent mismanagement or management that is not based on the rule of law, it is necessary to have clear and accurate boundaries regarding the allotment of areas/zones for various interests so that there is no overlap between the government and the land agency, considering that some community lands already have land rights (land certificate). Thus, an alternative solution to save the lake is establishing a zoning system.

Abstract

Waqf is a waqif legal act to separate and or give part of one's property to be used forever or for a certain period of time in accordance with the interests of worship and or general welfare according to sharia. In order to avoid disputes and problems related to waqf goods or land and to clarify their legal status, waqf goods must be registered and certified. Waqf Land Certification is the process by which the National Land Agency issues Waqf Land Certificates after Nazhir submits a Waqf Land Registration. Article 39 of Government Regulation Number 42 of 2006 concerning Implementation of Law Number 41 of 2004 concerning Waqf contains provisions concerning registration of land ownership certificates, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 2 of 2017 concerning Procedures for Land Registration Waqf at the Ministry of Agrarian Affairs and Spatial Planning. Related to the importance of the legitimacy of a land, it often triggers legal problems, namely that land owned by the community has not been registered as a result of a lack of understanding of the importance of waqf land certification. Taking into account the legal issues above, the Community Service Team at the Faculty of Law, State University of Gorontalo carried out this community service activity as an effort to increase Community Legal Awareness Regarding Waqf Land Certification to Guarantee Legal Certainty..

Abstract

A situation that is very unbalanced between consumers and business actors is a big potential that can lead to disputes between consumers and business actors. The government has issued laws that regulate consumer protection, in particular Law Number 8 of 1999 concerning Consumer Protection. The goal is to provide protection to consumers. This research is intended to: (1) to find out the role of the Consumer Dispute Settlement Agency (BPSK) in resolving Finance disputes (2) to find out what are the obstacles faced by the Consumer Dispute Settlement Agency (BPSK) in resolving Finance disputes. This research uses the type of empirical legal research, using a literature approach and research in the field. The sources of legal materials used are primary legal materials and secondary legal materials.The results of the study show that first, the Gorontalo City Consumer Dispute Settlement Agency (BPSK) has carried out its role, totaling 11 (eleven) of which is resolving consumer disputes in 3 (three) ways, namely mediation, conciliation and arbitration, opening consultations on consumer protection, if there is a violation the Consumer Protection Act (UUPK) the Consumer Dispute Settlement Agency (BPSK) is required to report to investigators, the Consumer Dispute Settlement Agency (BPSK) is required to receive complaints in writing or in writing, the Consumer Dispute Settlement Agency (BPSK) is tasked with conducting inspections and research related to consumer disputes, BPSK summons business actors suspected of violating the Consumer Protection Act (UUPK), the Consumer Dispute Settlement Agency (BPSK) has the right to present expert witnesses, witnesses or someone who is deemed to know of violations of the Consumer Protection Act (UUPK), examine the truth evidence, ascertaining whether or not there is a loss on the part of the consumer. The second research result is, What obstacles are faced by BPSK Gorontalo City in resolving Finance disputes in Gorotanlo City, these obstacles are divided into two parts, namely Internal and External. For internal ones, there is an inclusion of a standard clause, asking for help from investigators to summon business actors who do not want to attend invitations from the Gorontalo City Consumer Dispute Settlement Agency (BPSK), finally, financial constraints, namely the Gorontalo City Consumer Dispute Settlement Agency (BPSK) still cannot manage their funds in grants (self-managed).

Abstract

The purpose of this study was to identify the factors that cause the existence of the case of buloi boyot or women who are pregnant out of wedlock without a valid marriage engagement in the Village Community Tungoi one Lolayan District Bolaang Mongondow. This study was conducted using descriptive analysis method with empirical juridical research. The subjects in this study were 3 (three) informants, namely; Village Head, Head of customary institutions and head of the Office of Religious Affairs. In this case the researchers used interview data, documentation and field observations. The results in this study indicate that the factors that cause related cases buloi boyot, such as; adolescent promiscuity less positive, lack of attention from parents, the influence of technology and information and lack of understanding of religion that has been believed. The efforts made by the village apparatus in handling the case by providing sanctions in the form of fines for the perpetrator based on written rules in Tungoi village regulation I Number 2 of 2022 concerning marriage customs. Although the rules have been implemented for the village community, in fact it is still not enough to accommodate and does not provide a deterrent effect at all. Therefore, the role of village heads and customary institutions has a great task to narrow or even eliminate such cases by conducting legal counseling and revising village regulations with more stringent sanctions so that local communities feel the deterrent effect

Abstract

The Complete Systematic Land Registration Program (PTSL) carried out by the government based on Minister of Agrarian Regulation number 6 of 2018 is the first land registration activity carried out simultaneously for all land registration objects throughout the territory of the Republic of Indonesia in one village/kelurahan or other name. at the same level, which includes the collection of physical data and juridical data regarding one or several land registration objects for registration purposes with the aim of providing legal certainty and legal protection of land rights in a definite, simple, fast, smooth, safe, fair, equitable and open manner. and accountable so that it can improve the welfare and prosperity of society and the country's economy as well as reduce and prevent land disputes and conflicts. The research method used in this research is sociological juridical legal research and descriptive analysis with a qualitative approach. The results of this research show that the mechanism for implementing the Complete Systematic Land Registration Program (PTSL) by the Boalemo Regency Land Office has been carried out based on the procedures mandated in the Regulations. Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 6 of 2018 concerning Complete Systematic Land Registration which includes: Planning Stage, Location Determination, Preparation, Formation and Determination of the PTSL Adjudication Committee and Task Force (SATGAS), Counseling, Collection of Physical Data and Data Juridical, Juridical Data Research for Proving Rights, Announcement of Physical Data and Juridical Data and Validation, Completion of PTSL Activities, Confirmation of Conversion, Recognition of Rights and Granting of Rights, Bookkeeping and/or Issuance of Certificates, Documentation and Submission of Activity Results and Reporting of PTSL Activity Results. Although the mechanism for implementing the Complete Systematic Land Registration Program (PTSL) by the Boalemo Regency Land Office has been carried out in accordance with procedures. Thus, at the implementation level there are still obstacles in implementing the Complete Systematic Land Registration Program (PTSL) which is oriented towards quantity targets which makes it possible to ignore quality. As for the obstacles faced, both internal obstacles are obstacles faced by the Boalemo Regency Land Office that come from within the agency and External Obstacles are obstacles faced that come from outside the Boalemo Regency Land Office agency.

Abstract

The purpose of this study is to determine the legal protection of consumer rights and buying and selling transactions for reconditioned mobile phones according to Article 4 of Law Number 8 of 1999 concerning Consumer Protection. The research method used is empirical, namely a science based on real events or events that have been experienced by the five human senses obtained from observations, experiences and experiments that have been carried out. The results of this study are legal protection for consumers against trade in electronic reconditioned goods in Gorontalo City, one of which is regulated in Law Number 8 of 1999 concerning Consumer Protection in Article 8 paragraph (2) regulates and protects consumers from fraudulent actions that may be carried out by business actors, where protection is provided in the form of goods that are priced according to the information provided. The practice of buying and selling reconditioned mobile phones carried out by mobile phone traders in Gorontalo is not in accordance with Law Number 8 of 1999 concerning Consumer Protection Article 4 letter c which explains the rights that consumers have when buying and selling because in reality the seller does not provide information in full on the goods traded to prospective buyers.

Abstract

This research aims to find out the authority of the National Land Agency in the implementation of mediation on land disputes and the obstacles of the Gorontalo City National Land Agency in the implementation of mediation against land disputes. The research method used is empirical.  The results of the research obtained by the author include the Authority of the National Land Agency whose rights are attached to the Gorontalo City Land Office, is the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency of the Republic of Indonesia Number 11 of 2016 concerning the Settlement of Land Cases is valid based on applicable laws and regulations. So that the Land Agency must resolve disputes that are complained about by the community without having to go through the judiciary if the parties are willing to be mediated by officers in the Land Office in question. Furthermore, the obstacles of the Gorontalo City Land Agency are still a lack of public awareness and understanding of mediation, the absence of the parties to the dispute, as well as the appointed mediator parties, still, the lack of certified mediator personnel and administrative complaints filed by complainants are incomplete.

Abstract

the purpose of this study is to determine the legal protection of personal data of bank customers according to Law No. 8 of 1999 on Consumer Protection and how the implementation of the Financial Services Authority (OJK) Regulation No. 12/PJOK.03/2021.  The method used is using sociological juridical research method, using a descriptive qualitative research approach and interactive analysis techniques. The result of this research is that it arises because the issue of data protection and customer information in Indonesia has become a new problem in the banking world. On the other hand, adequate forms of protection for a customer's privacy rights have not been implemented into legal instruments. Similarly, the existence of various laws (UU) that have the authority to manage one's data and information, are not given limits to avoid violations that result in unprotected data and information of a person.

Abstract

This study aims to determine the transfer of child custody to a father. The method used in this study is normative research methodology and uses a statutory and shirt approach as well as descriptive analysis techniques. The results of this study indicate that according to the Compilation of Islamic Law, the custody of a child to a father after a divorce is the right of the mother to take care of a child who is not yet mumayyiz or not yet 12 (twelve) years old. But if you look at the contents of decision number 448/Pdt.G/2018/PA. But where the judge imposes child custody on a father, after analysis that the judge does not only refer to the applicable laws and regulations, but the judge has the authority to assess, analyze and decide under the facts presented in court and prioritize the interests and welfare of children.

Abstract

The purpose of this study is to determine and analyze the application of criminal sanctions against illegal mining actors according to Law Number 3 of 2020 in Dengilo District, Pohuwato Regency, and to determine and analyze the impact of illegal mining in Dengilo District, Pohuwato Regency. The type of research used in this study is empirical legal research using data collection techniques through direct observation and interviews with related parties. The results of this study show that the application of criminal sanctions in Kec. Dengilo is still not optimal, because there are still many perpetrators who continue to carry out activities secretly at the mine site. The miners carried out mining activities at night using heavy equipment even though it had been prohibited by the authorities. The government of Dengilo District, Pohuwato District, has made socialization efforts to the community regarding the provisions governing mining problems and sanctions for those who violate these provisions and has collaborated with the Pohuwato Regional Police in following up perpetrators of illegal gold mining crimes by the provisions of Law Number 3 of 2020. The impact caused by illegal gold mining in Dengilo District is positive: increasing local income, accommodating labor, and increasing community income. Negative impacts: river water pollution, damage to agricultural land, destruction of forest areas, causing casualties, causing landslides, and disrupting public health. Therefore, the government should facilitate and determine community mining areas.
