Abstract

Pelanggaran HAM dalam kode etik tenaga kesehatan dapat meliputi berbagai tindakan seperti pelanggaran kerahasiaan pasien bahkan kekerasan fisik atau psikologis terhadap pasien. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban hukum terhadap tenaga medis dan tenaga kesehatan yang melakukan pelanggaran etik berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Penelitian menggunakan metode hukum normatif dengan pendekatan perundangan, konseptual, dan perbandingan. Sumber data diperoleh dari bahan hukum primer, sekunder, dan tersier melalui studi kepustakaan dan analisis deskriptif, komparatif, evaluatif, serta argumentatif. Hasil penelitian menunjukkan bahwa pelanggaran etik tenaga medis mencakup tindakan di luar kompetensi, pelanggaran kerahasiaan pasien, dan penyalahgunaan wewenang. Pertanggungjawaban hukum bagi pelanggaran etik ini terdiri atas tiga bentuk, yaitu administratif (teguran hingga pencabutan izin praktik), perdata (ganti rugi atas kerugian pasien), dan pidana (sanksi bagi pelanggaran berat seperti malpraktik). Pengaturan hukum yang tegas sangat penting untuk memastikan kepatuhan etika profesi, melindungi hak pasien, dan menjaga integritas tenaga medis serta kesehatan.

Abstract

Introduction: Efforts to advance the welfare of Indonesian society require the development of quality human resources. However, health issues such as stunting and obesity in children can hinder these aspirations, partly due to suboptimal breastfeeding from birth. Although there has been a significant increase in exclusive breastfeeding, there are still obstacles in its implementation, such as a lack of family support and violations of the International Code of Marketing of Breastmilk Substitutes. This study aims to analyze the implementation of the Ten Steps to Successful Breastfeeding (TSSB) advocated by WHO and UNICEF in Government Regulation Number 28 of 2024 to support the Exclusive Breastfeeding program in Indonesia.Method: This study used a descriptive-analytical method with a normative juridical approach, referring to Government Regulation Number 28 of 2024 concerning the Implementation Regulation of Law Number 17 of 2023 concerning health.Result: Almost all TSSB and all the rules of the International Code of Marketing of Breastmilk Substitutes have been included in the articles to subsequently serve as protection against inappropriate promotion of formula milk for infants and to achieve Exclusive Breastfeeding.Conclusion: It is necessary to immediately create specific follow-up regulations regarding the safe provision and administration of donor breast milk for infants in healthcare institutions and a sustainable data monitoring and management system.

Abstract

The sea is the boundary between a country and another country which is determined through extradition. On December 13, 1957 the government issued a statement known as the Djuanda Declaration with the intention of uniting the fragmented land areas so that the declaration would close the existence of the open sea between mainland islands by covering the problem of the ideal concept of regulating the authority to enforce maritime accident laws in indonesian territorial waters. The approach method in this research is normative juridical based on an analysis of the law. Then it is described in a descriptive-analytical description. The problem is investigated by describing/describing the condition of the subject/object of research, finding facts thoroughly, and systematically reviewing national regulations. Conclusion maritime law enforcement can cause potential friction between one institution and another. For this reason, this research provides a concept that maritime security and law enforcement institutions will be productive and effective-efficient if they are in accordance with Pancasila.

Abstract

The socialization related to the role of paralegals in fulfilling legal assistance is very important to be applied, especially in rural areas, so that the community in the village can know and understand the role of paralegals in fulfilling legal assistance, and subsequently, the community in the village can access legal assistance from paralegals. In addition, the importance of socialization regarding the Sustainable Development Goals (SDGs) in the field of Education is that it will provide knowledge to the community in the village about the access to education that can be obtained. The research method used in this study is a research method that utilizes references from books and journals related to the socialization regarding the role of paralegals in fulfilling legal assistance and the socialization about the Sustainable Development Goals (SDGs) in the field of Education. The research findings indicate that the issues faced by the community in the village regarding access to Paralegals in fulfilling Legal Aid include the need for socialization of regulations related to the Role of Paralegals in fulfilling Legal Aid as stipulated in Law No. 16 of 2011 on Legal Aid & Regulation of the Minister of Law and Human Rights No. 3 of 2021 on Paralegals in Providing Legal Aid. Furthermore, the Sustainable Development Goals (SDGs) in the field of Education is quality education, aimed at ensuring equitable distribution of quality education and increasing learning opportunities for all. Thus, with knowledge and higher education, individuals will directly understand the regulations related to access to legal aid.

Abstract

Hukum Administrasi Negara berperan penting dalam mencegah berbaggi bentuk kecurangan di Indonesia. Jurnal ini mengeksplorasi penguatan dari segi hukum administrasi untuk dapat mengurangi peluang terjadinya praktik korupsi dalam birokrasi. Penelitian ini menganalisis regulasi yang ada serta peran hukum administrasi dalam menciptakan pemerintahan yang transparan dan akuntabel. Lemahnya hukum administrasi sering kali menciptakan celah bagi praktik korupsi. Penelitian ini dilakukan dengan metode penelitian normatif, yang menggunakan teknik studi dokumen. Oleh karena itu, langkah-langkah strategis seperti penerapan prinsip good governance, peningkatan integritas dan etika dalam penyelenggaraan negara, serta pembentukan kesadaran masyarakat sangat diperlukan. Selain itu, pembentukan lembaga anti-korupsi di tingkat daerah juga menjadi kunci dalam memperkuat upaya pemberantasan korupsi. Dengan demikian, Hukum Administrasi Negara tidak hanya berfungsi sebagai alat regulasi, tetapi juga sebagai instrumen untuk membangun kepercayaan publik dan mendorong partisipasi masyarakat dalam pengawasan pemerintah. Hasil dari penelitian ini dapat disimulkan bahwa Hukum Administrasi Negara memiliki peran yang krusial untuk dapat memastikan tata Kelola pemerintahan yang bersih, transparan, dan akuntabel. Hukum administrasi dapat  membantu mencegah penyalahgunaan wewenang oleh pejabat pemerintah melalui pengawasan dan pembatasan kekuasaan.   Kata kunci : Hukum Administrasi Negara, Korupsi, Pemerintah.   ABSTRACT   Administrative Law plays a crucial role in preventing various forms of fraud in Indonesia. This paper explores the strengthening of administrative law to reduce the opportunities for corrupt practices within the bureaucracy. This study analyzes existing regulations and the role of administrative law in creating a transparent and accountable government. Weak administrative law often creates loopholes for corrupt practices. This study was conducted using a normative research method, utilizing document study techniques. Therefore, strategic steps such as implementing good governance principles, improving integrity and ethics in state administration, and fostering public awareness are essential. Furthermore, the establishment of anti-corruption institutions at the regional level is also key to strengthening corruption eradication efforts. Therefore, Administrative Law serves not only as a regulatory tool but also as an instrument for building public trust and encouraging public participation in government oversight. The results of this study can be concluded that Administrative Law plays a crucial role in ensuring clean, transparent, and accountable governance. Administrative law can help prevent abuse of authority by government officials through oversight and limitations on power.   Key Words : Law Administrative, Corruption, Government.
