Abstract

The smooth implementation of government tasks and national developmentis highly dependent on the working mechanism of the state apparatus, especiallycivil servants. Civil Servants, hereinafter abbreviated as PNS, are not onlyelements of the state apparatus, but also public servants who live in the midst ofsociety and work for the benefit of society. The position and role of civil servantsin every government organization is very decisive, because civil servants are thebackbone of the government in carrying out national development.This study is based on the fact that it is important to develop humanresources by increasing skills to create administrative officers who are competentin the field of human resource management. The purpose of this study was toexamine and analyze human resource development through capacity building atthe Human Resource Development Board of Riau Province.This research is sociological legal research, namely research that looks atthe relationship between law and society with the gap between the law that shouldand the law that actually occurs. This research was conducted at the HumanResources Development Board of Riau Province. This research also containsinterviews distributed to civil servants who participated in competencydevelopment and those who did not participate in competency development. Thedata collection technique was carried out by interviews and literature review.From the results of research that has been done, the implementation hasbeen going quite well. This is because the relevant agencies are moving throughupdates for employees in competency development. The inhibiting factors areadministrative sanctions that have not gone well and the limited budget of fundsowned.Keywords: Competency Development, Civil Servants.

Abstract

In order to realize good governance in state administration, it is necessaryto implement professional, open and responsible state financial management inaccordance with the principles of state financial management. The embodiment ofstate financial management is outlined in the State Revenue and ExpenditureBudget (APBN) and Regional Revenue and Expenditure Budget (APBD). Mistakesin using the budget can result in State/Regional Losses. Based on interviews withthe Regional Financial and Asset Management Agency, there were several non-treasurer civil servants who caused regional losses. Settlement of regional lossescarried out is regulated in Domestic Government Regulation Number 133 of2018. The aim of this research is to find out the extent of implementation relatedto settlement of losses carried out by non-treasurer civil servants in RiauProvince, what factors hinder the settlement of compensation for losses carriedout and what efforts will be made regarding the settlement of compensation forexisting regional financial losses.This research is sociological legal research, namely looking at therelationship between law and society with the gap between the law as it should beand the law as it actually occurs. This research was conducted at the RegionalAsset Finance Agency of Riau Province and at the Riau Inspectorate. Datacollection techniques through interviews.From the results of the research that has been carried out, implementationhas not been carried out well, the factor causing it not to be carried out well isthat new regulations have just been issued that are more detailed in regulatinglosses incurred by non-treasurer civil servants in Riau Province.Keywords : Regional Losses, Non-Treasurer Civil Servants, Loss Settlement.

Abstract

In an effort to create fulfillment of rights and special protection for children, the Convention On The Right Of The Child aims to encourage international cooperation among countries that have ratified the Convention On The Right Of The Child to improve a decent life for children, especially in developing countries. -developing countries and provide full protection for children to avoid crimes that can endanger their lives such as commercial sexual exploitation. The type of research used in this study is normative legal research, which is a type of legal research to find a rule of law, legal principles, or legal doctrines to answer the legal issues at hand. This research will describe to what extent the written positive laws are synchronous or in harmony with each other. Article 34 of the convention on the right of the child is the basis of international law regarding commercial sexual exploitation, in which it emphasizes that participating countries must strive to be able to provide protection to children, so as to avoid all forms of sexual exploitation, Indonesia as a country that has ratified the convention on the right of the child has attempted to develop national legal instruments to provide protection for children to avoid the dangers of sexual violence, but legal instruments have not been able to accommodate the dangers of commercial sexual exploitation of children, because there is still a lack of definition and cannot explain forms of commercial sexual exploitation in instruments existing laws.

Abstract

Many death row inmates spend years even decades before finally being executed, so that in the practice they not only receive the death penalty, but also imprisonment as an additional punishment. The large number of death row prisoners serving sentences in prisons, globally, causes another problem, namely there is a psychological disturbance in death row prisoners caused by several factors such as conditions in detention, to the pressure of waiting for execution whose time never comes. This is globally called the death row phenomenon. This research uses normative legal methods, which are carried out on various rules of international law, especially the relationship between the death row phenomenon and the Convention Against Torture and other Cruel. Research specifications are descriptive analytical. The data source used is secondary data from library materials that include primary and secondary legal materials. The results showed that international human rights law prohibits torture, which in this case includes psychological torture. This has been enshrined in the Convention Against Torture and Other Cruel. In addition, judging from other international human rights law clauses, the delay of execution with various other factors such as the state of prisons and detention centers in the countries that still impose the death penalty, which causes the deathrow phenomenon, can be considered a violation of international human rights law, although it is not stated descriptively.

Abstract

Introduction: The ethnic Rohingya are an ethnic Muslim minority group in Rakhine, which is among the most persecuted, vulnerable, and oppressed minorities in the world. In addition to losing their citizenship, the ethnic Rohingya also lost their home, where they have lived for decades. The United Nations High Commissioners for Refugees or UNHCR is an international organization that deals specifically with refugees. With the function of providing protection and finding long-term solutions for refugees.Purposes of the Research: Analyze Durable Solutions that are suitable to be applied to Stateless Rohingya ethnicity.Methods of the Research: The type of research that will be used is normative law research, which focuses on positive legal norms such as international law instruments relating to the issues contained in this study.Results of the Research: Of the three durable solutions available to UNHCR, the most viable long-term solution for Rohingya refugees is resettlement or relocation to a third country. Because of the conditions and laws relating to the citizenship of Bangladesh as a state of asylum, Rohingya refugees do not allow local integration into the nationality of Bangladesh, while voluntary repatriation is not possible for Rohingyas because of the state of the government of Myanmar and the lack of security and security guarantees as well as citizens' rights for rohingya. The protection and realization of the rights of refugees is the responsibility of UNHCR as an international organization formed and under the auspices of the United Nations (United Nations) specifically designed to deal with the refugee problem under the Statute of the Office of the High Commissioner for Refugees 1951 or the 1951 Convention. But UNHCR's authority is limited to providing protection, assistance, fulfilling the rights of refugees, and seeking solutions. This limitation of authority is what makes it difficult for UNHCR to carry out its tasks and missions.

Abstract

Pada tahun 2015, wilayah Uni Eropa mengalami keadaan yang disebut situasi krisis imigrasi massal, termasuk Hongaria yang mengalami keadaan ini. Untuk menanggapi situasi tersebut, pada Mei 2015, Hongaria memperkenalkan sistem pengaplikasian suaka terbaru yang dikeluarkan Pemerintahannya yang dituangkan dalam amandamen Act CXXVII of July 2015 dan Act CXL of 4 September 2015. Kedua kebijakan ini menyatakan adanya prosedur pengaplikasian suaka terbaru, dikenalkannya ‘prosedur perbatasan’ dengan dibangunnya pagar perbatasan di zona transit Hongaria-Serbia, dan juga diperkenalkannya pemidanaan kepada para pencari suaka yang melintasi perbatasan secara ilegal, pengrusakan pagar perbatasan secara sengaja, dan menghalangi pembangunan pagar perbatasan. Isi dari kebijakan ini banyak dikritik sebagai pelanggaran yang dilakukan Hongaria dibawah ketentuan Hukum Pengungsi Internasional maupun Hukum UE, terlebih pada Pasal 31 Konvensi 1951. Penelitian ini bertujuan untuk mengetahui apakah kebijakan dan tindakan yang dilakukan Hongaria ini sesuai atau melanggar Konvensi 1951 terlebih Prinsip Non-Penalization yang harus dipatuhi oleh Negara Anggota walaupun Hongaria dapat melakukannya berdasarkan kedaulatan negaranya. Jenis penelitian ini adalah penelitian hukum normatif yaitu suatu penelitian yang bersifat kualitatif dengan menggunakan metode kajian studi kepustakaan (library research). Hasil dari penelitian ini adalah penahanan yang dilakukan oleh Hongaria dengan alasan untuk melindungi kedaulatan mereka atau karena pengungsi memasuki wilayah Hongaria secara ilegal dan tidak sah menurut Pasal 31 Konvensi 1951 atau prinsip non-penalization adalah salah dan tidak dapat dibenarkan.

Abstract

AMLAT pada dasarnya dibentuk untuk menghadapi kejahatan lintas negara yang terjadi di negara ASEAN, dan sesuai dengan namanya, kejahatan lintas negara, maka wilayah operasi para pelaku adalah kawasan Asia Tenggara. Tindak pidana yang bersifat transnasional mengakibatkan timbulnya permasalahan hukum suatu negara dengan negara lain. Sehingga upaya penanggulangan dan pemberantasannya sulit dilakukan tanpa kerjasama dan harmonisasi kebijakan dengan negara lain. Oleh karena itu, untuk menanggulangi dan memberantasnya, memerlukan hubungan baik dan kerjasama antar negara. Jenis penelitian yang digunakan oleh peneliti adalah penelitian hukum normatif, dengan menggunakan teori prinsip resiprositas dan asas double criminality. Kerjasama antar negara diperlukan untuk mempermudah penanganan proses penyidikan, penuntutan, dan pemeriksaan di sidang pengadilan atas suatu masalah pidana yang timbul baik di Negara Peminta maupun Negara Diminta. Dalam hal ini, dirasakan semakin penting perlunya kerjasama internasional secara efektif berkenaan dengan masalah-masalah kejahatan nasional dan transnasional. Salah satu jenis kerja sama internasional yang dapat digunakan dalam penegakan hukum dan dapat saling bertukar informasi adalah bantuan timbal balik pidana. Keberadan MLA sebagai instrumen alternatif dan saling melengkapi terhadap ekstradisi semakin relevan menyusul keberadaan ASEAN Treaty on Mutual Legal Assistance in Criminal Matter 2004 (MLAT 2004) yang sudah ditandatangani oleh semua negara anggota ASEAN. Sebelumnya Indonesia sendiri sudah menandatangni perjanjian ekstradisi bilateral dengan Malaysia, Philipina dan Thailand, sehingga keberadaan MLAT 2004 sejatinya semakin memperkokoh kerjasama hukum dengan negara-negara anggota ASEAN lainnya. Kata Kunci: MLA, Transnasional, Kejahatan.

Abstract

Social welfare development is an embodiment of efforts to achieve the nation's goalsmandated in the 1945 Republic of Indonesia Constitution. The emergence of the PMKS problem isstill a complex problem in every region in Indonesia. These social welfare problems show that thereare citizens whose rights to their basic needs have not been fulfilled properly because they have notreceived services from the state. Efforts to overcome PMKS are a priority that need to beimplemented in every development program implementation. In this regard, the local government ofLimapuluh Kota Regency has stipulated Limapuluh Kota Regent Regulation Number 37 of 2017concerning Guidelines for Implementing Handling of People with Social Welfare Problems(PMKS). In this writing the author focuses on the implementation of the Fifty Cities RegentRegulation Number 37 of 2017. The purpose of writing this thesis is; First, to find out how toimplement of the Fifty Cities Regent Regulation Number 37 of 2017 in Bukik Barisan District,Second, to find out the obstacles in implementing of the Fifty Cities Regent Regulation Number 37of 2017 in Bukik Barisan District, Third, to find out efforts In Overcoming Obstacles inImplementing of the Fifty Cities Regent Regulation Number 37 of 2017 in Bukik Barisan District.Based on the problems posed, the type of legal research used by researchers is empirical juridicalresearch or sociological legal research. The method used in this research is a survey methodbecause in this research the author went directly to the research location. The nature of thisresearch is descriptive, namely research that prioritizes observation of symptoms, events andcurrent events.From the results of research on the problem, there are three main things that can beconcluded. First, the implementation of handling PMKS in Bukik Barisan District is not going well.Second, obstacles in implementing PMKS handling are the lack of budget for carrying out PMKShandling programs, inaccurate validation of PMKS data, and errors in handling PMKS. Third,efforts to overcome obstacles to the implementation of handling PMKS, namely reviewing thedetermination of the Social Service budget, emphasizing the Social Service in Data Validation, andimplementing preventive efforts for several PMKS categories. The author's suggestions, First,Recommend that the Regent and DPRD in determining the Social Service budget be adjusted tocurrent conditions. Second, Suggest that the Regional Government and Social Service be moreactive and thorough in validating data and be more selective in selecting humanresources/apparatus in the Social Service. Third, recommend that every government agencyauthorized to administer social welfare coordinate with each other and work together as well aspossible in handling PMKS.Keywords: Implementation - Treatment - Persons - Problems - Welfare - Social

Abstract

Schools as an educational environment are mandated as a forum for developingstudents' potential and forming a dignified national character and civilization in order tomake the nation's generatuion more intelligent. However, unfortunately schools to datecannot be considered a completely safe environment for children. Reflecting on RiauProvince itself, recently violence has often occurred in the educational environment itself.However, it turns out that Riau Province does not have regulations governing children'sthat guarantees safety from acts of violence in educational environments. This research isaimed at finding out what is the urgency of forming Riau Province Regional RegulationsConcerning Prevention and Handling of Acts of Violence in Education Unit Environments,then to find out what things need to be regulated in the formation of Riau Province RegionalRegulations Concerning Prevention and Handling of Violence in Education UnitEnvironments.This research uses a sociological approach which will be carried out in RiauProvince, specifically at the Riau Province Education Official, the Women's Empowermentand Child Protection Service, the Riau Province Regional Secretary's Legal Bureau, andthe Riau Community Malay Traditional Institute. This research uses the interview method,then analyzes the data using qualitative analysis which is described into sentences that arearranged systematically. And in making decisions, researchers use deductive thinkingmethods that draw conclusions from a general statement to a specific statement.Based on the research results, there is a lot of urgencies to form a RegionalRegulation for Riau Province Concerning the Prevention and Management of Acts ofViolence in the Educational Unit Environment, namely the number of cases of violence inthe educational environment per year in Riau Province which massively increasing, theminimal contribution of schools in following standards "Child Friendly School" program,lack of school transparency, minimal contribution from the Education Department incarrying out supervision, limited authority of the STIU for the Protection of Women andChildren, child protection regulations in Riau Province which are considered to be laggingbehind, and minimal coordination between institutions responsible for education in RiauProvince.Keywords: Regional Regulation, Acts of Violence in Educational Environtment

Abstract

The issues with BUMDes and village funds include a lack of human resource competency, a vulnerability to financial mismanagement due to financial reports that don't follow government regulations, specifically SAK-ETAP, and the requirement for greater accountability from BUMDes and village funds. The governance of BUMDes and village funds truly needs innovation in digitalization, particularly when it comes to digitizing the financial reporting of these entities. The aim of the service is assistance in the operation of the innovation system for digitizing BUMDes financial reporting and village funds based on SAK-ETAP. Design and create a financial reporting system for BUMDes and village funds. The solution to this problem is to utilize financial and digital technology to speed up the financial management process of village and BUMDes funds. Problem identification and an evaluation of the actual and completed usage of village funds are two implementation strategies for resolving issues with managing BUMDes and village funds. interviews with residents and local officials to learn about the challenges encountered. arranging, establishing quantifiable and transparent management goals for the Village Fund. The creation of an integrated financial information system that is user-friendly is the outcome of the commitment to the usage of financial information systems. The advantages simplify record-keeping and financial management. Planning a budget and controlling financial risks. creation of a common, integrated financial reporting system for village funds and BUMDes.
