Abstract

Arrangements regarding the crime of persecution are regulated in article 351of the Criminal Code. In Indonesia's positive law it is clear that if a person commitsan intentional act aimed at damaging the health of another person, he will be subjectto a prison sentence of 2 years and 8 months as stipulated in article 351 of theCriminal Code. But the settlement of the crime of persecution through the Petalangancustomary law is not the case. If the case of the crime of persecution is resolvedthrough the Petalangan customary law, it will be resolved peacefully throughdeliberation and bringing together the perpetrators and victims and improving orderin society.From the results of research and discussion, there are several points that canbe concluded. First, in the community in Bandar Petalangan subdistrict, cases ofcriminal acts of persecution were mostly resolved through Petalangan customary law.Second, the settlement through the Petalangan Customary Law fulfills the wishes ofthe people because it also improves the order to the previous situation. Third, thatthe resolution of the criminal act of persecution through the Petalangan CustomaryLaw does not have an element of revenge, rather it is about reconciling theperpetrator and the victim. The author's suggestion is that it is necessary to digdeeper and spread understanding about Petalangan Customary Law, so that theinjunctions about Customary Law, especially regarding criminal acts, continue to bepreserved by the community.Keywords: Settlement-Persecution-Customary Law

Abstract

AbstractThe purpose of this study was to find out the efforts made by the Government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people and the obstacles faced by the government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people. One of the local wisdoms in Riau Province is the local wisdom of the indigenous people of Petalangan in Pelalawan Regency which has been passed down from generation to generation, such as traditional Belian medicine, zapin dance, oral literature of the Petalang people, manumbai sialang and potang mogang. For this reason, local wisdom needs to get legal protection. This type of research is empirical research. Based on the results of the research, the efforts made by the government of Pelalawan Regency in maintaining the local wisdom of the Petalangan indigenous people are by making a Regional Regulation on indigenous peoples institutions, regularly holding local wisdom activities every year, and introducing local wisdom in Pelalawan Regency through domestic and regional events. abroad. The obstacle faced by the government of Pelalawan Regency in maintaining the local wisdom of the indigenous people of Petalangan is the erosion of local wisdom along with the development of technology which is followed by an increase in the process of adopting innovation and the diffusion of technology adoption. There is no local regulation that specifically provides protection for local wisdom in Pelalawan Regency, eliminated by style. a consumptive materialistic-hedonic life pursuing worldly pleasures, as well as the lack of funds from the Pelalawan Regency APBD in introducing local wisdom in Pelalawan Regency. AbstrakTujuan penelitian ini adalah untuk mengetahui upaya yang dilakukan oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan dan kendala yang dihadapi oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan. Salah satu kearifan lokal di Provinsi Riau adalah kearifan lokal masyarakat adat Petalangan di Kabupaten Pelalawan yang diwariskan secara turun-temurun, seperti pengobatan tradisional Belian, tari zapin, sastra lisan orang petalangan, manumbai sialang dan potang mogang. Untuk itu, kearifan lokal tersebut perlu mendapatkan perlindungan hukum. Jenis penelitian ini adalah penelitian empiris. Berdasarkan hasil penelitian, upaya yang dilakukan oleh Pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan adalah dengan membuat Peraturan Daerah (Perda) tentang kelembagaan masyarakat adat. Secara rutin setiap tahun mengadakan kegiatan kearifan lokal, serta mengenalkan kearifan lokal yang ada di Kabupaten Pelalawan melalui kegiatan dalam negeri maupun di luar negeri. Kendala yang dihadapi oleh pemerintah Kabupaten Pelalawan dalam mempertahankan kearifan lokal masyarakat adat Petalangan adalah terkikisnya kearifan lokal seiring berkembangnya teknologi yang diikuti sehingga meningkatnya proses adopsi inovasi serta difusi adopsi teknologi, belum ada perda yang secara khusus memberikan perlindungan terhadap kearifan lokal di Kabupaten Pelalawan, tereliminasi oleh gaya hidup matrealistis-hedonis yang konsumtif mengejar kesenangan duniawi semata, serta kurangnya dana APBD Kabupaten Pelalawan dalam mengenalkan kearifan lokal yang ada di Kabupaten Pelalawan.

Abstract

The main pillar in every democratic system is the existence of a mechanism forchanneling opinions by the people through periodic elections, Regional Head Elections(Pilkada) starting from Governors, Regents and Mayors are guaranteed in the constitution inArticle 18 Paragraph (4) of the Constitution of the Republic of Indonesia 1945, in Law No. 10 of2016 which basically regulates the end of the term of office of the Head of the 2020 ElectionResults Region, in his capacity the Head of the 2020 Election Results Region should be sworn infor a term of 5 (five) years since being appointed in accordance with Article 162 paragraph (2)of Law No. 10 of 2016 and Article 60 of Law No. 23 of 2014 so that the term of office should endin 2026, not ending the term of office until 2024 as contained in the provisions of Article 201paragraph (7) of Law No. 10 of 2016. Whereas referring to the provisions of Article 201paragraph (7) of Law No. 10 of 2016, regional heads and deputy regional heads as a result ofthe simultaneous local elections in 2020 will only serve 4 years, some may even be lacking due todelays in inauguration .This type of research can be classified as normative juridical research, because thisresearch is carried out by examining secondary data and approaches to laws, this normativeresearch examines the applicable regulations and relates them to legal politics in the formationof a rule to achieve legal policy ideas. in the implementation of the regional head's term of officeas a result of the 2020 regional head election, the data sources used are primary data, secondarydata, tertiary data, the data collection technique in this research is normative juridical, the dataused is library research.The results of this study examine and analyze the regulations currently in force, namelyLaw No. 10 of 2016 as a legal umbrella regarding terms of office for regional heads where thearrangements and contents of Law No. 10 of 2016 are not achieved which results in notachieving the goal of maintaining people's sovereignty, justice, and certainty by law as well ascertainty from within the law itself. the formation of the ideal law (ius constituendum) regardingthe regulation of the term of office of regional heads in the 2020 regional head election byregulating and establishing technical regulations that really regulate in detail the term of officeof regional heads to avoid a legal vacuum and abuse of office which undermines the system ofpeople's sovereignty in Indonesia.Keywords : Term of Office of Regional Heads, 2020 Simultaneous Regional Elections,LegalPolitics.

Abstract

The act of burning land is prohibited under article 69 paragraph (1) letter h of Law No.32 of 2009 concerning Environmental Protection and Management, article 56 paragraph (1) ofLaw No. 39 of 2014 concerning Plantations, and articles 187 and 188 of the Criminal Code. Thecriminal act of burning land does not look at the area of land that has been burned, even thoughit is only a narrow size, the perpetrators can already be punished. In practice, as long as there isa fire that burns the land, it is a criminal act. And arrests were made immediately regardless ofthe area of land burned, the status of the perpetrators and the culture of the community. Thejudge decided to follow the consideration of the public prosecutor. In the case of burning, issue680/Pid.B-LH/2019/PN Rhl on behalf of Mujito, issue number 631/Pid.B-LH/2019/PN Rhl onbehalf of Muhammad Fauzi and issue number 29/Pid.B-LH/2019 /PN Rhl on behalf of Muarnialias Ujang Kulal Bin Kulal. Arson occurred in the same area, the public prosecutor was thesame and was decided by the same judge but the sentences were different.The purpose of this study is to find out how the application of criminal sanctions toperpetrators of land burning crimes. and how the laws and regulations against the perpetratorsof land burning. This research is structured using the type of normative juridical research,namely research that formulates the application of the principles or norms in positive law. Theapproach used is a normative approach, namely library law research.The judge decided to follow the consideration of the public prosecutor. In the case ofburning, issue 680/Pid.B-LH/2019/PN Rhl on behalf of Mujito, issue number 631/Pid.B-LH/2019/PN Rhl on behalf of Muhammad Fauzi and issue number 29/Pid.B-LH/2019 /PN Rhlon behalf of Muarni alias Ujang Kulal Bin Kulal. There was burning in the same area but thepunishment was different. That the imposition was based on the consideration of the publicprosecutor. And the public prosecutor determined the indictment based on the objectives of theperpetrators of the land burning and the status of land ownership. regardless of the area ofburned land, the type of burnt land, burned plants and community customs. Weaknesses in thelaws and regulations related to the criminal act of burning land are contained in the Legislationcontained in the removal of the prohibition of "clearing land by burning" which does not explainin detail how much land is burned in order to ensnare the perpetrators. Abstract

Money laundering crimes are included as white-collar crimes because theprocess of this crime is generally not carried out by ordinary people, but byintellectuals, bureaucrats, corporates, officials, politicians and criminal actorswho rely more on intellectual abilities. In writing, the author focuses on therelevance of the Law on Money Laundering in the Face of Money LaunderingCrimes in the Digital Age. The purpose of writing this thesis is first to find out therelevance of the law on money laundering in dealing with patterns of moneylaundering crimes in the current digital era. The second is to find out the idealarrangement for money laundering crimes in dealing with money launderingcrimes in today's digital era.The author conducted research using normative juridical methods orliterature studies in order to obtain secondary data through documentary studies,namely by studying and analyzing descriptively comparative laws and regulationswith theories that have a relationship to the problems studied.From the research results, there are two main things that can be concluded.First, Law no. 8 of 2010 concerning the Prevention and Eradication of MoneyLaundering Crimes has not explicitly regulated the tracking and confiscation ofthe assets of the predicate crime as well as the proceeds of money launderingusing Cryptocurrency facilities, the second is the Ideal Arrangement for MoneyLaundering Crimes in the Face of Crime Money Laundering in the Digital Era Itis necessary to reconstruct Indonesian Criminal Law by including, among otherthings, the confiscation and confiscation of proceeds and instruments of crime ina law.The author's suggestion, in this study, is to suggest that Law EnforcementOfficials (APH) make improvements to Law Number 8 of 2010 on restrictions onnon-criminal money laundering by adding rules related to money launderingwhich is carried out using digital currencies such as cryptocurrencies andcurrencies. other digital services so that law enforcement against moneylaundering crimes in this digital era can provide legal certainty.Keywords: Crime, Money Laundering, Digital Era

Abstract

In Indonesia, the number of dental artisans who are members of variousassociations such as the Independent Dental Artisans Association (ASTAGIRI),Indonesian Dental Artisans Association (ITGI), Indonesian Dental Artisans Union(PTGI), Indonesian Dental Artisans Group (HITGI), Indonesian Dental ArtisansForum (FTGI), and Dental Artisans Forum (FPG) is approximately 75,000individuals.This research can be classified as normative legal research, whichexamines the legislation related to the legal theories that are the focus of thestudy. The approach used is qualitative analysis, collecting data from books,journals, and other scholarly works relevant to this research. Primary andsecondary legal sources are utilized as data sources.The conclusion drawn from the research is as follows. Firstly, the urgencyof criminalizing dental artisans in cases of dental malpractice in Indonesia isbased on past cases experienced by victims of dental artisans, as well as illegaldental practices that exceed their authority. Actions are only subject toadministrative sanctions, such as warnings and license revocation. However, theurgency lies in permits and still make mistakes or engage in malpractice shouldbe subject to criminal punishment. The ambiguity of the current provisionnecessitates further study, criminal law reform, and more specific regulations toenable the criminalization of dental artisans. Secondly, the idea of criminalizingdental artisans in cases of dental malpractice in Indonesia was initially regulatedunder Article 78 of the Medical Practice Act.However, the Constitutional Court declared the criminalization of dentalartisans unconstitutional. The wording of Article 78 should be read as follows:"Any person who intentionally uses tools, methods, or other means to provideservices to the public, giving the impression that they are a registered doctor ordentist, except for dental artisans who have obtained practice permits from theGovernment as referred to in Article 73 paragraph (2), shall be liable toimprisonment for a maximum of 5 years or a fine of up to IDR 150 million."Keywords: Dental Artisans, Criminalization, Urgency, Idea, Criminal Offense.

Abstract

In an effort to create fulfillment of rights and special protection for children, the Convention On The Right Of The Child aims to encourage international cooperation among countries that have ratified the Convention On The Right Of The Child to improve a decent life for children, especially in developing countries. -developing countries and provide full protection for children to avoid crimes that can endanger their lives such as commercial sexual exploitation. The type of research used in this study is normative legal research, which is a type of legal research to find a rule of law, legal principles, or legal doctrines to answer the legal issues at hand. This research will describe to what extent the written positive laws are synchronous or in harmony with each other. Article 34 of the convention on the right of the child is the basis of international law regarding commercial sexual exploitation, in which it emphasizes that participating countries must strive to be able to provide protection to children, so as to avoid all forms of sexual exploitation, Indonesia as a country that has ratified the convention on the right of the child has attempted to develop national legal instruments to provide protection for children to avoid the dangers of sexual violence, but legal instruments have not been able to accommodate the dangers of commercial sexual exploitation of children, because there is still a lack of definition and cannot explain forms of commercial sexual exploitation in instruments existing laws.

Abstract

ASN actually has a position as an element of the state apparatus, which implements policiesset by the heads of government agencies that are free from the influence and intervention of allpolitical groups and parties. ASN also has a function as a tool for public policy, public servant andunifier of the nation. ASN plays the role of planner, executor and overseer of the implementation ofgeneral government and national development tasks through the implementation of policies and publicservices that are professional, free from political intervention, and clean from corruption, collusionand nepotism practices. Therefore, in order to maintain and strengthen the integrity of civil servants,it is necessary to have an oath of office for civil servants in carrying out their duties and roles. On thebasis of this, it is the author's special interest to conduct further research on the urgency of the oathand its benefits.This research is a normative legal research. This is based on library research which takesquotations from reading books, or supporting books that are related to the problem to be studied.Primary, secondary and tertiary data sources are characteristic of this study. This study also usesqualitative data analysis and produces descriptive data.From the results of the research conducted, there are several conclusions obtained, namely:First, the normative oath of office has no problems in it, the implementation of these norms should becarried out properly by civil servants through work attitudes. With this oath, civil servants arerequired to be more trustworthy in carrying out their positions. Second, there is a juridical implicationfor civil servants when the oath of office is violated. Theoretically normative, civil servants can bedishonorably dismissed if they are proven to have violated the oath, because the oath order hasbecome a norm that has permanent and binding legal force for all civil servants. Therefore, lawenforcement against civil servants who violate their oath of office must be upheld with all theconsequences in an objective and fair manner.Keywords : Oath Of Office-Government Employess
