Abstract

The implementation of parking policy authority by the Pekanbaru City Government is regulated under Pekanbaru City Regulation Number 20 of 2020 concerning Parking Organisation. According to this regulation, the Pekanbaru City Government is responsible for managing parking, which includes planning, implementation, supervision, and control. This research aims to examine the implementation of Article 19 of the regulation, the supporting factors, and the obstacles in supervising and managing parking officers in Pekanbaru City. The research findings highlight the importance of clear parking mechanisms and the protection of parking attendants. The applicable laws mandate that employers register parking attendants for employment social security. Failure to do so results in sanctions, including written warnings, fines, and restricted access to public services. However, the implementation faces challenges such as limited resources, lack of compliance, and enforcement difficulties. The study concludes that an effective parking policy requires a balance between authority and practical implementation. The government must ensure proper planning, supervision, and control over parking management while protecting the rights of parking attendants. Strengthening regulations, improving enforcement, and increasing public awareness are essential to achieving efficient parking governance in Pekanbaru City.

Abstract

Seiring perkembangan ilmu pengetahuan dan teknologi, cara serta alat peperangan juga ikut berkembang. Manusia mulai menciptakan senjata-senjata perang yang efektif dalam melumpuhkan lawannya, namun berjalannya waktu banyak lahir senjata-senjata yang tidak berperikemanusiaan, salah satunya adalah bom Cluster. Banyak negara-negara yang menentang penggunaan bom Cluster karena dianggap memberikan dampak yang buruk terhadap keselamatan masyarakat sipil baik disaat peperangan maupun setelah peperangan usai salah satunya Rusia yang menggunakan Cluster Bomb oleh militernya kepada Ukraina, oleh sebab itu maka masyarakat internasional menyatakan bahwa bom Cluster merupakan salah satu senjata yang dilarang penggunaannya dalam peperangan. Hal ini menarik untuk diteliti dan dianalisis yaitu terkait 1.) Bagaimanakah pengaturan hukum terhadap larangan penggunaan Cluster Bomb menurut Hukum Humaniter Internasional? dan 2.) Bagaimanakah penegakan hukum terhadap pelanggaran Hukum Humaniter Internasional dalam bentuk penggunaan Cluster Bombs oleh militer Rusia dalam konflik bersenjata Rusia-Ukraina? Penelitian ini menggunakan pendekatan yuridis normatif. Data penelitian dalam penulisan ini adalah data sekunder. Teknik pengumpulan data dengan studi dokumen dan analisis data menggunakan metode analisis kualitatif. Dari analisis yang dilakukan dapat disimpulkan bahwa pengaturan pelarangan penggunaan bom Cluster secara internasional diatur di dalam Konvensi Den Hague IV 1907 mengenai hukum dan kebiasaan perang di darat, Protokol Tambahan I Tahun 1977 Konvensi Jenewa tentang perlindungan terhadap penduduk sipil, Konvensi tentang pelarangan penggunaan senjata konvensional tertentu (Convention on Certain Conventional Weapon) pada tahun 1980 dan Convention on Cluster Munition 2008. Sedangkan upaya-upaya dalam penegakan hukum humaniter internasional terhadap penggunaan bom Cluster meliputi upaya preventif, upaya represif dan upaya rehabilitatif.

Abstract

Tindakan kekerasan dalam rumah tangga (KDRT) merupakan permasalahan serius yang sangat berdampak luas terhadap korban, khususnya perempuan. Minimnya pemahaman hukum di masyarakat menjadi salah satu faktor yang memperburuk kondisi korban KDRT. Kegiatan pengabdian ini bertujuan untuk meningkatkan pemahaman hukum kader PKK sebagai ujung tombak pencegahan KDRT di tingkat komunitas melalui sosialisasi Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga. Kegiatan dilaksanakan di Desa Pulau Busuk, Kabupaten Kuantan Singingi dengan melibatkan 20 kader PKK. Metode pelaksanaan menggunakan pendekatan partisipatif dan edukatif yang terdiri dari observasi awal, penyuluhan hukum, diskusi kelompok, serta evaluasi akhir. Hasil menunjukkan adanya peningkatan signifikan pemahaman peserta terhadap hak-hak korban dan prosedur pelaporan kekerasan dalam rumah tangga (KDRT), serta munculnya inisiatif pembentukan posko sahabat perempuan di desa. Pengabdian ini menegaskan bahwa dengan dukungan dan edukasi yang memadai, kader perempuan dapat berperan strategis dalam pencegahan kekerasan dalam rumah tangga (KDRT) di tingkat lokal.

Abstract

The establishment of places of worship is regulated under the “Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri Nomor 8 dan 9 Tahun 2006 tentang Panduan Pelaksanaan Tugas Kepala Daerah/Wakil Kepala Daerah dalam Mempertahankan Kerukunan Umat Beragama, Mendorong Forum Kerukunan Umat Beragama, dan Pendirian Rumah Ibadah”. In practice, this responsibility has been delegated to FKUB. In general, the construction of places of worship serves not only ritual worship purposes but also social activities aligned with religious understanding, thereby providing rights to adherents. This study aims to examine the extent of the implementation, impact, and government’s role in carrying out the “PBM Agama Dan Menteri Dalam Negeri Nomor 9 Dan 8 Tahun 2006” according to its rules. This research analyzes issues related to the establishment of places of worship in Kuantan Singingi Regency, focusing on inconsistencies with the Joint Regulation. Through sociological legal research, this study identifies emerging issues, including a lack of regulatory compliance, unmet technical requirements, and unclear government responsibilities. This phenomenon has led to legal uncertainty and the cancellation of construction permits by authorized authorities. The findings reveal that the implementation of the Joint Regulation has not been properly conducted. These findings highlight the need for greater regulatory compliance and clarity in government responsibilities related to the establishment of places of worship. This study contributes to understanding the dynamics of legal enforcement and governance in the development of places of worship within the context of Kuantan Singingi Regency

Abstract

This research analyzes the legal relevance of the formation of Supreme CourtRegulation (PERMA) Number 1 of 2019 concerning Case Administration and TrialElectronically in Court. Prior to the creation of PERMA No. 1 of 2019, traditional courtproceedings (in-person hearings) were conducted, as explained in the Indonesian Code ofCriminal Procedure (KUHAP) Article 230 paragraph 1, which states: “Court hearingsare conducted in the courthouse in the courtroom.” The theoretical framework used toanalyze the issues in this research are theory of legislative regulation formation and thelegal hierarchy theory introduced by Hans Kelsen, which posits that the legal system is ahierarchical ladder with layered norms. Norms determined by higher legal norms providethe validity basis for the entire legal framework that constitutes a unity.Using a normative juridical research method, the findings of this research indicate thatthe establishment of PERMA No. 1 of 2019 is not in conflict with the provisions ofArticle 230 of the Indonesian Code of Criminal Procedure. This regulation does notviolate the principle of the hierarchy of legislation in Indonesia, considering that PERMAis subordinate to laws with higher authority. Therefore, PERMA is consistent with theprinciple of lex superiori derogat legi inferiori, which stipulates that lower regulationsmust not contradict higher regulations. The authority of the Supreme Court to enactPERMA is a derivative (delegated) authority. Delegation of legislative authority to theSupreme Court is carried out with the intention of filling legal gaps that cannot always beaddressed by legislation. PERMA Number 1 of 2019 serves as a legal gap filler becauseprovisions of general and abstract laws still need to be detailed through lower-levelregulations that are concrete and technical.Keywords: relevance, hierarchy, Supreme Court regulation, Indonesian Code ofCriminal Procedure, trial.

Abstract

Local governments have an interest in building permits. In order to carry out the construction of a building, whether carried out by individuals or private parties who have business functions, they are required to have a Building Construction Permit (IMB) and this permit is needed to fulfill one of the construction requirements. However, since the Job Creation Law came into force, Building Construction Permits have changed to Building Construction Approvals. One of the provisions in building permits is the Building Boundary Line (GSB). For Jalan HR Soebratas, the building must have a GSB of 40 meters from the road axle. In reality, there are still many buildings, especially shophouses, adding buildings beyond the building boundaries. Some of the consequences are traffic jams because land that should be used for parking is used. Based on Pekanbaru City Regional Regulation Number 07 of 2012 concerning Building Permit Levy, specifically in Article 106, there are administrative sanctions imposed on violators of the Regional Regulation, especially shop owners who add buildings beyond the GSB. From the results of the research that has been carried out, implementation has gone quite well. This is because the relevant agencies move through reports or complaints.

Abstract

Conditional death penalty aims to provide an opportunity for convicts to rehabilitate themselves and change for the better. Conditional death penalty also aims to reduce the risk of execution of innocent people, show a humanist attitude and respect for human rights, and accommodate various conflicting views and interests regarding the death penalty in Indonesia. Conditional death penalty is regulated in Article 100 Paragraph of Law Number 1 of 2023 concerning the Criminal Code. The type of research to be carried out is normative legal research. From the perspective of its objectives, normative legal research can be divided into 7 (seven) types, namely in this case research is carried out on the principles of law, namely regarding the Implementation of Conditional Death Penalty in Law Number 1 of 2023 concerning the Criminal Code in the Perspective of Legal Certainty.

Abstract

Climate change is one of the main issues in international environmental law that continues to receive global attention. One of the projects in the spotlight is the Willow Project, a fossil fuel exploitation project in the Arctic region that has sparked international controversy. This project is considered to have minimally conducted adequate environmental studies and shows an imbalance between economic interests and environmental protection, thus raising concerns from various parties in the international community. This research uses a normative method with a literature study approach to examine the principles contained in various international environmental law instruments. The research results show that the Willow Project presents major challenges in international environmental law, especially related to climate change mitigation obligations as regulated in the Paris Agreement, biodiversity conservation in the Convention on Biological Diversity (CBD), as well as the principles in the UNFCCC, UNDRIP, UDHR, Rio Declaration, and Stockholm Declaration. In addition, this project also reflects the United States' inconsistency in strengthening international partnerships. The research results show that the Willow Project presents a major challenge to the implementation of international environmental law. Carbon emissions generated during the project's operational period contribute significantly to global climate change, such as melting polar ice and rising sea levels. In addition, the ecological impacts of noise and light pollution also disrupt the life patterns of wildlife, especially endangered species such as polar bears. In addition to impacting the natural environment, the project also poses serious risks to the health of local communities and their right to live in a clean and healthy environment. Therefore, a review of similar projects is needed and stronger enforcement of environmental commitments in international forums.

Abstract

Dispute Settlement Body (DSB) as a dispute settlement body of the World Trade Organization (WTO) in the trade dispute between Indonesia and the European Union in the case of nickel ore export restrictions loaded by the Indonesian Government through domestic policies. Thus, on 22 November 2019 the European Union officially sued Indonesia to the WTO with violations of Article X, Article XI and could not be justified by Article XI Paragraph (2) point (a) of GATT 1994 and Article XX point (d) of GATT 1994, and the European Union claimed that Article III Paragraph (1) point (b) of the Agreement on Subsidies and Countervailing Measures (SCM) was not consistent. In the end, the Panel granted the EU's lawsuit against Indonesia through the Final Report of the Panel DS592 by recommending Indonesia to cancel the nickel ore export ban policy. The research method in this case uses a normative legal approach. Normative law in this research has two legal sources, namely primary and secondary legal sources. Primary legal sources refer to Dispute Settlement Body Decision Number DS592, the 1994 GATT Agreement, Minister of Energy and Mineral Resources Regulation No. 1 of 2014, and Minister of Energy and Mineral Resources Regulation No. 11 of 2019. Then, secondary legal sources refer to a book by Huala Adolf entitled International Trade Law and a book by Serlika Aprika and Rio Adhitya entitled International Trade Law. The results of this study indicate that the DSB decision through the Final Report of the Panel number DES592 does not have binding legal force for the Indonesian state and will not have any legal consequences on Indonesia's legal sovereignty. Because the decision is considered to have experienced errors in terms of interpreting Indonesia's nickel ore export ban policy in relation to the applicable rules in the GATT 1994. Thus, Indonesia demands that the WTO form an Appealate Body to appeal the DSB decision

Abstract

Background: The traditional blood cockle farm in Limau Kapas District, Riau Province, Indonesia, has high economic potency, yet it still needs to be developed. While it has great potential, this sector faces a range of long-held challenges (particularly vague regulations that hinder legal-based businesses and repeated claims of land ownership from local fishermen who often steal fish from harvests). Objective: To investigate the economic opportunities that can be achieved by adopting good governance and improving management capabilities. Methods: The research was conducted using the qualitative method, with observation, interviews, and a literature review. Results: The results suggest that improved governance can play a large role in alleviating these problems and increasing productivity. A collaborative effort between the government and the local community is key to developing a sustainable aquaculture ecosystem through education, favorable legislation, and access to capital for farmers. To gain those economic benefits of blood cockle aquaculture in the area, it is necessary to strengthen these aspects. Conclusion: In conclusion, traditional blood cockle farming in the Limau Kapas District has great economic prospects but is hindered by governance gaps, regulatory ambiguity and limited access to finance. Sustainable and equitable aquaculture development is possible only through effective institutional collaboration between government, universities, and local communities.
