Abstract

This study aims to determine the Management of Village-Owned Enterprises(BUMDes) in Meranti Bunting Meranti Islands Village, and to determine the factors thatinfluence the Management of Village-Owned Enterprises (BUMDes) in Meranti BuntingMeranti Islands Village based on Government Regulation of the Republic of IndonesiaNumber 11 Year 2021 Concerning Village-Owned EnterprisesThis research is a sociological book research because it is based on field research,namely by collecting data from observations, interviews, and literature studies that provide arelationship with the problem assisted by primary, secondary, and tertiary data. The type ofresearch data is descriptive qualitative research. This research looks at the Role of theVillage Head in the Implementation of Village Owned Enterprises in Meranti Bunting Village.The data sources are primary and secondary data, the number of informants in this study is 6informants then draws the final conclusions from the interview results.Based on the research results, it can be seen that the Management of Village-OwnedEnterprises in Meranti Bunting Meranti Islands Village has 4 aspects that affect management,namely the Planning Aspect. In the Planning Aspect, BUMDes Meranti Bunting Village hasfollowed the procedures listed in the AD/ART and planned programs to be implemented andmanaged along with the budgets to be used and managed by BUMDes Meranti BuntingVillage. Second, Organizing, Meranti Bunting Village BUMDes appoint managers who areelements of the Meranti Bunting Meranti Islands Village community and do not have duties inVillage Government and in building good work communication cooperation is needed inorder to achieve a business unitary and organizational goals Third Direction, in achievingtargets according to the planning in the management of BUMDes Meranti Banting MerantiIslands Village the manager has directed and supervised the work of members who joined andmonitored so that they can achieve success in managing BUMDes in Meranti BuntingMeranti Islands Village. Evaluation Committee, in evaluating the results of the work ofmanagers and the community continues to carry out evaluations every 3 months, every 6months and annually. At the evaluation stage BUMDes Meranti Bunting Meranti IslandsVillage continues to carry out transparency of funds so that there are no misunderstandingsand problems. Then the factors that influence the management of Meranti Bunting MerantiIslands Village are the cooperation system to full support by the Village Government, equityand procurement of BUMDes business funds, but development cannot be said to be successfulbecause the management of BUMDes is still experiencing bottlenecks in the issue of capitalparticipation funds.Keyword : The role of-village head-village owned enterprises

Abstract

Cyber porn is a crime that is rife. One of the media for spreading pornographiccontent is through the form of instant message stickers containing pornography in theWhatsApp instant messaging application which is distributed by its users. As a crime,perpetrators who distribute pornographic stickers can be held criminally responsiblebased on existing laws. Therefore, writing this thesis formulates two problemformulations namely; first, how is the legal arrangement related to pornography inIndonesia. Second, what is the criminal responsibility for the perpetrators who distributestickers containing pornography based on Law Number 19 of 2016 concerningAmendments to Law Number 11 of 2008 concerning Information and ElectronicTransactions.This research is classified in the type of normative legal research. The researchwas carried out by examining secondary data as well as an approach to laws. Thisresearch examines the legal principles contained in Law Number 19 of 2016 concerningAmendments to Law Number 11 of 2008 concerning Information and ElectronicTransactions and statutory regulations. -other related invitations. The data sources usedare primary data, secondary data and tertiary data. The data collection technique in thisstudy was by means of interviews and literature review and this research is normativejuridical in nature. After the data has been collected, it is then analyzed qualitatively,then draws conclusions using a deductive thinking method, namely analyzing problemsfrom a general form to a special form.This research explains that the regulation of pornography law in Indonesia is quiteclear as positive law, as stipulated in the Criminal Code, Law No. 44 of 2008 concerningPornography, Law Number 19 of 2016 concerning Amendments to the Law Number 11 of2008 concerning Information and Electronic Transactions and Law no. 1 of 2023concerning the Criminal Code. The act of distributing stickers containing pornographybased on Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008concerning Information and Electronic Transactions can be held criminally liable withthe concept of criminal liability.Keywords: Pornography - Criminal Actions - Criminal Liability

Abstract

Refugees are a classic problem that arises in human civilization as a resultof fear that threatens theis safety. The threat can be caused by natural disasters orman-made disasters. This large-scale population movement was initially only adomestic problem of country. The research objectives of this thesis are ; First, tofind out the cooperation between United Nations High Commission for Refugeesand International Organization for Migration with the Indonesian government indealing with refugee problems in Pekanbaru City in 2017-2021, Second, theIndonesian government’s efforts to urge United Nations High Commissioner forRefugees and International Organization for Migration to place refugees in thirdcountries.This research is a kind of sociological research. This research wasconducted at the Pekanbaru Immigration Detention Center and RepresentativeOffice of UNHCR and IOM Pekanbaru. While the overall population and thesample is related to the problems axamined in this study. The data used is primarydata and secondary data and data collection techniques using observation,interviews and literature study. Technical analysis of qualitative, inductiveinference techniques.From the research results, there are two things that can be concluded.First, the collaboration between UNHCR and IOM with the Indonesia governmentin deling with the refugee problem in Pekanbaru City in 2017-2021. Second, theefforts of the Indonesian government to urge UNHCR and IOM to place refugeesin third countries. Suggestions from the author, First, its is hoped that UNHCRand IOM will be more responsive in dealing with the problem of refugee inIndonesia, especially Pekanbaru. Second, the Indonesian government alwaysmonitors UNHCR and IOM and urges these refugees to be immediately sent totheir destination countries, because Indonesia is only a transit country. InIndonesia they only get housinh, eting and drinking faclilities, and their full rightsas citizens will only be obtained in the destination country, etc.Keywords : Refugees – UNHCR – IOM – Convention 1951 – Third Countries.

Abstract

Forests are a source of life for all living things, especially for communitiesaround the forest. With the birth of a social forestry policy, the government hopesto improve the standard of living of the economy and maintain the sustainability offorest areas. In implementing policies, supervision is needed in their management.In Kuantan Singingi Regency, it is one of the areas that received social forestrylicenses. However, the management of social forestry is still not optimal. This canbe seen from the still minimal area of social forestry so that there are still thosewho have not carried out management since the decree was issued, therefore thegovernment's attention is needed so that the objectives of targeted management canbe achieved. The type of research used is sociological legal research. Obstacles insupervising social forestry in Kuantan Singingi Regency include: Lack ofoperational staff, lack of budget, convoluted administrative reporting, lack ofcoordination of related parties, and lack of public knowledge of social forestry. Thesolutions provided include: adding operational personnel such as assistants,encouraging local government budgets in facilitating the implementation ofsupervision, increasing collaboration with PPS Working Groups, providingeducation to the community and assistants so that they can help people inmanagement and prevent forest utilization that is not in accordance with existingregulations .Keyword: Implementation-Social Forestry-Supervation

Abstract

Customary forest is a forest that is in the territory of customary lawcommunities and is a high heritage and is jointly owned by the adat community.Buluh Cina Village Tourism Forest is a customary right or what is called the RimboSeven Lakes Customary Forest which is managed by the Indigenous People ofBuluh Cina Village together with the Traditional Institution of Buluh Cina Village,Siak Hulu District, Kampar Regency. The Buluh Cina Village Government and thecommunity should be able to work together in protecting the existing customaryforest. The purpose of this thesis research is first, to find out the management ofthe Rimbo Tujuh Danau Customary Forest by the customary law communitythrough its existence in Buluh Cina Villageand to find out what are the obstacles inmanaging the Rimbo Tujuh Danau Customary Forest by the customary lawcommunity in Buluh China Village.This type of research is sociological legal research conducted in Buluh CinaVillage, Siak Hulu District, Kampar Regency, Riau Province. By using primary,secondary and tertiary data sources. Data collection techniques with interviewsand library research. Data processing was carried out qualitatively, namely datapresented in the form of discussions and presented in sentences.The results of this study indicate that the management of the Rimbo TujuhDanau customary forest by indigenous peoples through their existence in BuluhCina Village is known to have implemented customary regulations to preserve thecustomary forest they own. To maintain this existence, the people who live in theRimbo Tujuh Danau Customary Forest area carry out activities such as Maawuo(Fishing), Maintaining Forests, Maintaining Lakes, Using Traditional FishingEquipment and Using Fruit Trees and Medicinal Plants. Obstacles in themanagement of the Rimbo Tujuh Danau Customary Forest by the customary lawcommunity in Buluh Cina Village include land clearing without permits in theRimbo Tujuh Danau Customary Forest area, Extraction of timber and non-timberforest products such as illegal logging and hunting, The potential for forest fires.Keywords: Customary Law, Customary Forest, Buluh Cina Village

Abstract

Immunities and privileges of change offices aim to support performance and to avoidintervention from parties. Being unable to be arrested and immune from the power of law,whether criminal, civil law, or administrative law, is a form of impunity for destruction. Inthis thesis the case of protecting the rights of protection that occurred in England involvedthe replacement of a Saudi Arabian gun named Khalid Basfar. The official who overlaid ithad protected his right of immunity for exploiting his right to licence and traffic in humanbeings to his domestic worker named Josephine Wong. The domestic worker from thePhilippines also did not receive her wages while working at Basfar's residence. Freedom toprotect protections like this makes it necessary for the sending country to take legalresponsibility for the reduction.The research method used in this research is normative legal research. This researchis library law research. The focus of the discussion of this research is related to legalprinciples. The data sources used are primary, secondary and tertiary legal sources. In thislegal research, researchers use a case approach which will examine the 1961 ViennaConvention on Diplomatic Relations, the 1961 Vienna Optional Protocol, to the 2000Palermo Protocol on Trafficking in Persons.The result obtained is that there is an urgency for the responsibility of the sendingcountry in responding to the issue of securing immunity which can create better relationsbetween the receiving country and the sending country and the victim country. The forms thatare expressed in simple terms are the responsibility of the sending country, both in the formof recalling and removing the immunity from restrictions. Abstract

Economic crisis of Sri Lanka is the lowest point in the history of this country, therefore chaos cannot be avoided. It makes Sri Lanka have to ask for help from The IMF, to provide financial assistance in overcoming the crisis. In accordance with the provisions of the IMF formation charter, the granting of assistance funds to member countries is one of the tasks of the IMF. However, the assistance must be accompanied by the terms and conditions that Sri Lanka must follow before finally receiving the assistance. The goal of this study is to identify the role of the IMF as an international organization that helps the Sri Lanka economy. This type of research is normative legal research, namely legal research carried out through examining library materials in the form of binding legal rules and secondary data such as other literature related to this research. As a result, according to the charter for the establishment of the IMF, the role of the IMF in providing financial assistance is in accordance with the duties of the organization and is a right for member countries. In the end the IMF did provide aid funds but the provision of these funds in reality seemed to hang Sri Lanka for about a year even though the country was in a state on the verge of collapse. The provision of assistance is also accompanied by various conditions on the grounds that the borrowing country must be able to ensure that they can return the funds according to the agreement, considering that these funds are the result of the quota of each member country. Sri Lanka as a borrowing country must follow the standards set by the IMF regarding the conditions of countries entitled to receive loans by implementing policies.

Abstract

Pertanggungjawaban atas tindak pidana kejahatan internasional akan sulit direalisasikan apabila suatu negara tersebut bukan merupakan negara yang terikat dengan suatu perjanjian. Sedangkan disisi lainnya, penegakan hukum harus dijalankan untuk mengaja, mengawal dan menghantarkan hukum agar tetap berdiri semestinya. Tindak pidana yang dilakukan oleh individu dari negara yang bukan peserta Statuta Roma 1998 menyebabkan terjadinya hambatan dalam penegakan hukum internasional. Tujuan dari penulisan ini ialah untuk mengetahui dan memecahkan permasalahan dari kedudukan suatu negara yang bukan peserta Statuta Roma di Mahkamah Pidana Internasional. Dengan menggunakan metode penelitian hukum normatif yang melakukan pendekatan berdasarkan norma-norma hukum dan membahas peraturan perundang-undangan yang berlaku. Penulisan ini menghasilkan kedudukan dari negara bukan peserta dapat dibawa ke Mahkamah Pidana Internasional melalui Resolusi Dewan Keamanan PBB atau warga negara bukan peserta melakukan kejahatan di yurisdiksi Mahkamah Pidana Internasional serta negara bukan peserta mengakui yurisdiksi dari Mahkamah tersebut.

Abstract

Investment is any form of investment activity, both by domestic investors and foreign investors to do business in the territory of the Republic of Indonesia. Riau Province has issued Regional Regulation No. 7 of 2018 concerning Investment in Riau Province (PMPR). But there are weaknesses and disharmony with the higher regulation, the 2007 Investment Act. The research method used is normative legal research. The regulation in the PMPR regulation is still unclear, especially if there is an obligation to resolve disputes that occur between the government and foreign investors through national arbitration. Whereas in accordance with the 2007 Investment Act, dispute resolution between the government and foreign investors is carried out through international arbitration institutions based on the agreement of the parties.

Abstract

In the election of the traditional datuk in Luhak Rambah, there is an arrangement inthe form of appointment. However, in this case, conflicts and controversies often occurbetween the children and nephews of tribal groups. Therefore, this research aims to find outthe electoral system, traditional leadership structure in Luhak Rambah, and so on. This iswhat ideally happens in the Luhak Rambah community and this research can be used as areference in making a policy. So, from this research, it was found that, in the legal system forthe election of traditional datuks in the customary law community of the Luhak Rambah tribe,the election was carried out due to several factors.The first was that the replacement of the dila was due to the condition of thetraditional datuk (age and illness), so the election was carried out by means of deliberationand an appointment process. /appointed in accordance with the order of descent of thenephew's children. Second, the election is because the traditional datuk dies, so the electionis carried out by determining which nephew's son will hold the body of the grandfather forthe first time (cleaning the genitals), then that is the person who will be appointed to be thedatuk next custom. From this research, ideas/mechanisms and more relevant regulationsfrom the government are needed as guidelines and implementation rules to overcomeproblems that have occurred so that they do not happen again and can be carried outaccording to existing customs.Keywords : Electoral System, Customs, Tribal People, Luhak Rambah
