Abstract

The issue of the binding of the sale and purchase agreement (PPJB) in this case originates from the turmoil of buying and selling shop houses in Pasar Minggu, South Jakarta, between Harijanto Latifah and Tri Rahadian Sapta Pamarta, culminating in a civil lawsuit by Tri Rahadian at the South Jakarta District Court. The South Jakarta District Court decided that Tri Rahadian is the rightful owner of the land and shop house in Pasar Minggu, South Jakarta, and annulled the Deed of Agreement to Buy and Sell (PPJB) deemed defective and legally ineffective. The issue that will be the basis for analysis is the legal consequences for the aggrieved sellers due to the unlawful actions of the notary. The research results show legal protection for the sellers regarding changes to the Deed of Agreement to Buy and Sell (PPJB) by the Notary without their knowledge. Thus, the sellers have the right to annul changes made by the Notary without their approval, and ethical violations by the Notary can result in legal claims and sanctions in accordance with applicable regulations. Legal consequences that the Notary may face include the invalidation of the deed, ethical sanctions, and potential civil lawsuits. Sellers have the right to question the validity of changes made by the Notary and can file compensation claims. Administrative sanctions that may be imposed on the Notary emphasize the importance of compliance with professional ethical codes.

Abstract

Implications and Factors Affecting PPAT Delay in Registering APHT to the Land Office, with the object of research is APHT to be registered APHT, this article aims to find out the Implications and Factors Affecting PPAT Delay in Registering APHT to the Land Office, with normative methods. The result is that the Land Deed Official (PPAT) in making the Deed of Granting Mortgage Rights (APHT) starts from the process of checking juridical data and documents, here the PPAT must be careful in checking the documents and is responsible for the implications caused by the PPAT's inaccuracy in checking, The second is in the process of APHT registration to the Land Office where the PPAT must be responsible for being on time according to Article l3 Paragraph (2) which states that no later than 7 working days after signing the APHT, the PPAT must send the APHT and other necessary documents to the Land Office. The 7-day grace period is calculated from the time the APHT is signed. Factors influencing the delay in the implementation of APHT making are first, from the parties who take a long time in collecting documents or exceeding the time limit, second, checking the Land Rights certificate at the Land Office which is said to be too long, third, namely writing errors in the deed, fourth, namely delays in APHT registration

Abstract

Background General: Asset disclosure through the LHKPN system serves as a transparency mechanism to prevent corruption among state officials. Background Specific: In practice, several officials report granted assets without authentic deeds, even though Indonesian civil law requires notarial or PPAT deeds for the legal validity of grants. Knowledge Gap: No comprehensive study has specifically examined the legal certainty of reporting grants without authentic deeds in the LHKPN system or its interaction with civil law and anti-corruption regulations. Aims: This study analyzes the legal status of grants made without authentic deeds under Indonesian law and evaluates the legal certainty of their reporting within the LHKPN. Results: Findings indicate that grants lacking authentic deeds do not fulfill the formal requirements of Articles 1666, 1682, and 1868 of the Civil Code, rendering them invalid and lacking evidentiary strength. Their inclusion in the LHKPN creates legal uncertainty regarding ownership legitimacy and the accuracy of verification by the Corruption Eradication Commission. Novelty: The study provides an integrated analysis connecting civil law, administrative anti-corruption mechanisms, and legal certainty theory to the issue of non-authentic grant reporting. Implications: Normative clarification and regulatory harmonization are required to ensure that grants reported in the LHKPN possess lawful foundations, strengthening transparency, accountability, and the integrity of state officials. Abstract

This article analyzes the forms and effectiveness of legal protection for good-faith buyers in the purchase of uncertified land through notarial deeds and evaluates the legal validity of such deeds within Indonesia’s land law framework. The study is grounded in the urgency created by the widespread circulation of uncertified land, which generates legal uncertainty and exposes buyers to a high risk of disputes due to the absence of registered ownership. Using a normative juridical method with statutory and conceptual approaches, supported by analysis of Denpasar High Court Decision No. 75/Pdt/2016/PT.DPS, this research demonstrates that notarial deeds in uncertified land transactions possess only obligatory power and cannot serve as constitutive evidence for the transfer of rights, which falls under the authority of PPAT pursuant to Government Regulation No. 24 of 1997. The findings reveal that preventive and repressive legal protection remains limited as long as the land has not been registered, thereby requiring notaries to apply the prudential principle through document verification and disclosure of legal risks. The novelty of this study lies in its integrated analysis of notarial authority, deed validity, and legal protection mechanisms for good-faith buyers in uncertified land transactions, offering a conceptual foundation for agrarian and notarial law reform in the digital era.   Artikel ini menganalisis bentuk dan efektivitas perlindungan hukum bagi pembeli beriktikad baik dalam transaksi jual beli tanah belum bersertifikat melalui akta notaris serta menilai keabsahan akta tersebut dalam kerangka hukum pertanahan Indonesia. Penelitian ini dilatarbelakangi oleh maraknya tanah yang belum terdaftar sehingga menimbulkan ketidakpastian hukum dan meningkatkan potensi sengketa akibat tidak adanya bukti hak yang kuat. Dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undangan dan konseptual yang diperkuat analisis Putusan Pengadilan Tinggi Denpasar Nomor 75/Pdt/2016/PT.DPS, penelitian ini menunjukkan bahwa akta notaris dalam transaksi tanah belum bersertifikat hanya memiliki kekuatan obligatoir dan tidak dapat dijadikan dasar konstitutif pemindahan hak yang merupakan kewenangan PPAT berdasarkan PP Nomor 24 Tahun 1997. Hasil penelitian mengungkapkan bahwa perlindungan hukum baik preventif maupun represif masih terbatas selama tanah belum didaftarkan, sehingga notaris wajib menerapkan prinsip kehati-hatian melalui verifikasi dokumen dan pemberian penjelasan mengenai risiko hukum. Kebaruan penelitian ini terletak pada integrasi analisis mengenai peran notaris, keabsahan akta, dan perlindungan hukum pembeli beriktikad baik dalam transaksi tanah belum bersertifikat sebagai kontribusi terhadap pembaruan hukum agraria dan kenotariatan di era digital.

Abstract

This article examines the normative conflict between Law No. 6 of 2023 on the Establishment of Government Regulation in Lieu of Law on Job Creation and the Basic Agrarian Law (UUPA), specifically within the land law cluster. Using a normative approach and the theory of derogation, the article identifies three core areas of legal inconsistency: (1) the strengthening of Land Management Rights (Hak Pengelolaan), (2) foreign ownership of apartment units, and (3) the granting of land rights in aboveground and underground spaces. These legal inconsistencies not only create normative dualism but also generate legal uncertainty and threaten the principle of the rule of law. The article discusses the legal and policy implications of this dualism and proposes pathways for harmonization, including affirming the UUPA as a lex specialis, revising sectoral laws, or filing for judicial review. The analysis ultimately seeks to reclaim coherence in Indonesia’s land governance framework amidst the rising trend of autocratic legalism in pro-investment legislation.

Abstract

The growing emphasis on sustainability within the legal sector has given rise to the concept of the green notary, which promotes digitalization and the reduction of paper-based documentation in notarial practices. This study examines the legal protections afforded to Notaries who adopt green notary practices in Indonesia. Employing a normative juridical research method, this study reviews applicable laws, legal doctrines, and scholarly literature, with particular focus on the compatibility of green notary practices with the principles of legal certainty, professional responsibility, and notarial ethics. The findings indicate that although the green notary concept has not yet been expressly regulated, existing legal frameworks—namely the Notary Law, the Electronic Information and Transactions Law, and the Personal Data Protection Law—may serve as an implicit legal basis for its implementation. The application of green notary practices introduces important legal implications relating to the scope of notarial authority, professional accountability, data protection obligations, and ethical conduct. Accordingly, regulatory harmonization, the establishment of detailed operational guidelines, and the formulation of digital professional ethics standards are essential to ensure that green notary practices are legally valid, efficient, and sustainable in the contemporary digital era.

Abstract

Land holds a crucial role in the lives of Indonesian people, serving not only as an economic asset but also as a social and cultural symbol. However, land ownership based on girik documents often leads to disputes due to the uncertainty of its legal status. This study aims to analyze the ratio legis behind the abolition of girik as evidence of land ownership based on Article 96 of Government Regulation Number 18 of 2021, which mandates the conversion of all customary lands into certificates no later than 2026. The research method employed is normative juridical, using statutory and conceptual approaches. The data sources include primary, secondary, and tertiary legal materials analyzed qualitatively. The results show that the abolition of girik is grounded in the principles of legal certainty, administrative justice, and the need to establish an orderly and integrated national land administration system. This policy is a logical consequence of the transition of Indonesia’s land law system toward a single system based on certificates as the only valid proof of ownership. The abolition of girik is expected to prevent agrarian disputes, reduce opportunities for land-related fraud, and promote a fair and modernized land administration system that ensures legal certainty.

Abstract

Perkembangan teknologi informasi mendorong munculnya sistem kerja berbasis platform digital yang mengubah pola hubungan antara penyedia dan pengguna jasa, termasuk dalam sektor transportasi daring. Pengemudi ojek online menjadi kelompok pekerja digital yang menghadapi persoalan hukum terkait ketidakjelasan status, karena perusahaan aplikasi menetapkan hubungan kemitraan meskipun mekanisme kerja dikendalikan sepenuhnya melalui algoritma. Penelitian ini bertujuan menganalisis kedudukan hukum pengemudi ojek online dengan menggunakan metode yuridis normatif melalui penelaahan peraturan perundang-undangan, doktrin, dan literatur. Hasil penelitian menunjukkan bahwa aktivitas pengemudi memenuhi unsur pekerjaan, upah, dan perintah sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan karena pengemudi memberikan layanan secara berulang, menerima pendapatan yang ditetapkan perusahaan, dan wajib mengikuti instruksi aplikasi untuk mempertahankan akses kerja. Dominasi kontrol perusahaan melalui standar operasional, distribusi pesanan, tarif, serta evaluasi berbasis algoritmik menimbulkan subordinasi yang tidak sejalan dengan prinsip kemitraan. Temuan tersebut menguatkan pandangan bahwa hubungan yang berlangsung bersifat hubungan kerja terselubung, serupa dengan pertimbangan dalam kasus Uber BV v Aslam di Inggris yang mengakui pengemudi sebagai pekerja karena tingkat kontrol perusahaan yang signifikan. Kondisi ini menunjukkan perlunya pengaturan khusus untuk memberikan kepastian hukum dan perlindungan yang sesuai bagi pengemudi ojek online sebagai bagian dari ekosistem kerja digital. Pembentukan regulasi menjadi urgensi agar kesenjangan antara konsep kemitraan dan praktik operasional tidak menimbulkan kerentanan bagi pengemudi dalam memperoleh hak-hak konstitusionalnya.

Abstract

Environmental degradation in Indonesia, driven by deforestation, land degradation, and uncontrolled exploitation of natural resources, requires an environmental law enforcement strategy that goes beyond national regulations and recognizes the essential role of indigenous local wisdom. This study aims to analyze the contribution of local wisdom to environmental preservation, identify challenges in the implementation of national law in indigenous territories, and formulate a synergy model between the two to strengthen environmental law enforcement. A qualitative approach with a case study method was employed, focusing on indigenous communities that actively practice traditional resource management. Data were collected through in-depth interviews, participatory observations, and document analysis of national regulations and customary laws. The findings reveal that local wisdom effectively maintains ecological balance through culturally rooted governance systems, yet its formal legal recognition remains limited, creating a gap between state policy and local practices. Strengthening the synergy between national law and local wisdom is essential to establish a more participatory, just, and sustainable environmental law enforcement system and to enhance the social legitimacy of environmental policies.
