Abstract

Brands contain a manufacturer's promise to consistently provide certain characteristics, benefits, and services to consumers. Economically, brands have a price that motivates producers in various ways so that the brand can compete and become popular among the public. The existence of legal rules on the protection of well-known trademarks can be applied to avoid losses to holders of trademark rights and for consumer protection against the purchase of counterfeit branded goods. The case contained in the Supreme Court Decision Number 1051 K/Pdt.Sus-HKI/2023 between Jolla and Jolla. Sus-HKI/2023 between Jollibee Food Corporation against Karsino in the "JOLLIBEE" trademark dispute is one example of bad faith in trademark registration in Indonesia. This research uses normative juridical method by using Statute Approach. The form of legal protection is in the form of cancellation of the Defendant's "JOLLIBEE" trademark from the General Register of Trademarks of the Directorate General of Intellectual Property Rights. The cancellation of the Defendant's "JOLLIBEE" trademark because there are similarities in essence with the Plaintiff's "JOLLIBEE" trademark.

Abstract

This study aims to analyze the legal consequences of minors' land certificates used as debt collateral by their biological mothers and legal protection for minors whose land rights are used as debt collateral by their biological mothers. The research method used is normative juridical using statutory, conceptual, and case approaches. Minors (minderjarig) according to the law are not capable of performing legal acts independently, including in terms of making their land rights as forest collateral. Legal actions of minors whose fathers die can be represented by their biological mothers who act as guardians based on court decisions. The urgency of this research is to provide a description and analysis of guardians who replace their parents to replace minors to carry out legal processes by analyzing the cases raised. The case raised is the novelty of the results of this research analysis. The results of this study indicate that the legal consequences of a minor's land certificate used as debt collateral by his biological mother without going through the determination of the guardian and the power of attorney to make the minor's land rights from the court are null and void (nietig van rechtswege). The law (Article 393 of the Civil Code) has provided preventive legal protection against minors whose land titles are used as debt collateral by their biological mothers if this is done without the appointment of a guardian and power of attorney from the court. The minor's biological mother in her position as guardian is only authorized to make the certificate of land title on the basis of absolute necessity or clearly beneficial to the minor after hearing or legally summoning the child's immediate family or blood relatives and the supervisory guardian.

Abstract

Pajak merupakan sumber utama pendapatan negara, dengan kontribusi terbesar dalam APBN. Untuk meningkatkan kesadaran dan kepatuhan wajib pajak, Direktorat Jenderal Pajak (DJP) membentuk Relawan Pajak untuk Negeri (Renjani) bekerja sama dengan Tax Center di berbagai perguruan tinggi. Relawan pajak bertugas memberikan asistensi pelaporan SPT tahunan serta edukasi perpajakan kepada masyarakat. Pengabdian ini bertujuan untuk melakukan asistensi pelayanan wajib pajak orang pribadi (WPOP) dalam pelaporan SPT tahunan melalui e-filing, dengan melibatkan relawan pajak di KPP Pratama Jember. Asistensi pelayanan yang dilakukan oleh relawan pajak tersebut nantinya akan dikaji dari perspektif Etika Bisnis Islam., yaitu prinsip tauhid, keadilan, tanggung jawab, kejujuran, dan kebermanfaatan. Metode yang di gunakan dalam pengabdian ini yaitu menggunakan metode Service Learning (CS). Metode Service Learning merupakan sebuah pendekatan edukasi yang tidak hanya berfokus pada aspek akademik, tetapi juga melibatkan peran aktif dalam kegiatan pelayanan kepada masyarakat. Pengabdian dilaksanakan dengan teknik penyuluhan dan pendampingan, tahapan pengabdian ini meliputi: tahap pendampingan/bimbingan teknis, tahap pelaksanaan asistensi, dan tekahir tahap evaluasi. Hasil pengabdian menunjukkan bahwa relawan pajak telah menerapkan prinsip etika bisnis Islam dalam kegitatan pelayanannya. Pengabdian ini diharapkan dapat berkontribusi pada peningkatan kualitas layanan dan edukasi perpajakan guna meningkatkan kesadaran dan kepatuahn wajib pajak kedepannya.

Abstract

In practice, inclusive schools face many obstacles, using a curriculum that has not been fully implemented properly. Teachers do not understand using methods and learning media for children with special needs. Be in a good instrument. Unique infrastructure that has not been adequate in supporting child development is an obstacle to implementing inclusive education successfully. This study aims to analyze the Inclusive Education program's context, inputs, processes, and products. This research is a program evaluation research using the CIPP model. The methodology used is a survey and descriptive method. The research informants were the principal, vice-principal for curriculum and student affairs, teachers, special assistant teachers data collection techniques through observation, questionnaires, and interviews. The technique used to analyze power is descriptive qualitative analysis. Based on the data, the problem with inclusive education programs experienced by schools is the presence of non-permanent accompanying teachers who only receive one time per week, thus hampering the development of students with special needs. In addition, the facilities and infrastructure that support the learning process are still incomplete. The uniqueness of the inclusive education curriculum needs to be reviewed to improve children's learning abilities with special needs.

Abstract

This study aims to analyze halal values ​​in the value chain of the UD Poultry Slaughterhouse industry. Independent Mrs. Warni. The methods used in this research include direct observation, interviews, and document analysis related to the production process. The results showed that UD. Mandiri Bu Warni has carried out the process well, starting from the supply of chicken, halal slaughter, to delivery to consumers. However, UD. Mandiri has not fully maintained the purity of chicken meat, because it is only cleaned with water to make it look clean. In addition, UD. Mandiri Bu Warni also has not used packaging that has a halal label, even though it already has a halal certificate which is currently still in the process of being extended. Therefore, this research contributes to the development of the Poultry Slaughterhouse industry by applying the value chain and halal principles

Abstract

Dengan mempertimbangkan faktor antisipasi pasar, penelitian ini melihat pengaruh perubahan peringkat obligasi terhadap return saham. Konsentrasi kepemilikan saham dan rata-rata kumulatif pengembalian abnormal berfungsi sebagai indikator antisipasi pasar dan return saham. 40 sampel yang diperoleh lalu diuji menggunakan analisis one-sample t-test. Contoh kriteria terdiri dari korporasi yang tercatat sebagai penerbit saham dan obligasi, telah dinilai oleh PT Pemeringkat Efek Indonesia (PT PEFINDO), dan telah mengalami perubahan peringkat antara tahun 2014 dan 2018. Temuan ini menunjukkan bahwa perubahan peringkat obligasi, termasuk peningkatan dan penurunan peringkat, secara substansial dipengaruhi oleh return saham. Hasilnya juga menunjukkan bahwa pasar telah mengantisipasi informasi yang berasal dari perubahan peringkat obligasi.

Abstract

This study examine the transformation of the concept of justice in Islamic criminal law as a contribution to the reform of national criminal law. The assess the extent to which the principles of justice in Islamic criminal law, such as proportional justice, victim protection, and the principle of public benefit (maslahah), have been incorporated into the new national criminal law system, particularly within the 2023 Indonesian Penal Code (KUHP). This research employs a doctrinal method through literature analysis, drawing on national legislation, jurisprudence, and both classical and contemporary Islamic legal thought. The findings reveal that although several Islamic legal principles are beginning to be accommodated, such as the application of restorative justice, a more humane sentencing approach, and the acknowledgment of local values, this integration remains partial and does not yet fully reflect the comprehensive framework of Islamic justice. Therefore, transforming the national criminal law system through the values of Islamic legal principles is a strategic step toward building a justice system that is more responsive, substantively fair, and aligned with the Indonesian national identity.

Abstract

Perceptions about halal certification vary widely, many consumers still do not understand the importance of this certification, even though this certification is part of their rights as consumers. Without a strong understanding of the importance of halal certification, Muslim consumers may face the risk of consuming non-halal products that can interfere with their beliefs. The research method used is Normative legal research, research by approaching laws and regulations and legal literature and journals. The results of the study show that halal certification has a crucial role in providing legal certainty for Muslim consumers in Indonesia, the majority of whom are Muslim. Law No. 33 of 2014 concerning Halal Product Assurance makes this certification mandatory, so it is expected to protect consumer rights in accessing products that comply with sharia principles. Legal certainty for Muslim consumers is very important in the context of consumer protection, especially in the digital era and e-commerce. Research shows that adequate regulation and protection can help Muslim consumers obtain products and services that comply with Islamic principles. Optimizing halal certification is one of the key aspects that supports legal certainty for Muslim consumers. Thus, the urgency of halal certification in this context lies not only in legal and social support, but also in collective efforts to educate the public about the importance of halal products, operationalization in business practices, and assurance that the products they consume maintain sharia values. The role of the government in supporting Micro, Small, and Medium Enterprises (MSMEs) and other business actors to access halal certification is very strategic, considering the importance of this certification to increase the competitiveness of MSME products in domestic and international markets.

Abstract

When conducting a field survey in Terai Bangun Village, Mining District, Regency. Kampar, the results of the interview explained that the amount of waste produced in one week reached 7.2 tons, in one year the waste reached 345.4 tons. The waste generated is 47% organic waste, 45% inorganic waste and 8% hazardous and toxic waste (B3). The purpose of this research is to develop an incinerator, with a household-scale capacity. The efficiency of the combustion rate is expected to be around 500 oC-1000 oC in the combustion chamber. Methods This research performs the work stage in carrying out the design, the design stage aims to obtain designs, patterns, and anarduino uno circuits. In this stage using software, Solidwork 2016, Arduino Uno, and Porteus. design results which include stress, displacement and strain parameters Produce technical drawings that are in accordance with the framework stated in a safe loading condition for the waste burning process.

Abstract

This research aims to analyze the role of female students in waste management based on Talcott Parson's imperatives. This research is empirical juridical research with a juridical approach through legal studies related to the research topic and an empirical approach through sociological facts in the field. This research provides a more comprehensive picture regarding the role of female students in waste management and effective and efficient regulatory strategies in waste management. The results of this research are that the role of female students is carried out by taking concrete actions in minimizing waste, sorting waste, utilizing waste, and understanding materials in waste management in formal institutions and Islamic boarding school environments. Waste management is carried out in line with Talcott Parson’s imperative called AGIL (adaptation, goal attainment, integration and latency) with the existence of waste management activities that are intracurricular, co-curricular and extra-curricular in formal institutions and at the Islamic boarding school level.
