Abstract

This research aims to analyse the validity relocation of land and buildings that cannot be used according to the aim of waqf stipulated in the Islamic Sharia and the Law on Waqf, as well as the relocation model of land and buildings that are impacted by the Sidoarjo mud blowout. This is juridical-normative research that uses statutory and conceptual approaches. The results show that there are dissents among Islamic law experts on the permissibility of waqf object relocation. Then, the Law on Waqf prohibits waqf diversion, except for public interests. Then, the Presidential Decree No. 14 of 2007 and its changes do not regulate waqf object replacement. Even so, in 2020 the government has relocated 8 out of 50 waqf objects outside of the Map of Impacted Area through build swap (ruilslag), whereas none of the waqf objects within the Map of Impacted Area that is the obligation of PT Lapindo Brantas company have been substituted. According to Article 15 clause (1) and (3) of the Presidential Decree No. 14 of 2007, the waqf land or buildings should be relocated using the sales transaction scheme. Its proceeds will then be used to buy substitute waqf objects elsewhere.

Abstract

This research aims to analyze the learning practices that have been carried out by Al-Qur'an Hadith teachers at Madrasah Aliyah in Demak Regency, Central Java Province who are members of the MGMP. This research is qualitative with a phenomenological approach. Data was collected using observation, documentation, and interviews. Next, the data was analyzed using several steps: collection, reduction, data presentation, and conclusion. The results of the research show that the majority of learning practices carried out by al-Qur'an hadith teachers at Madrasah Aliyah in Demak Regency are still classical, dominated by lectures, the media and learning methods used are less varied and adaptive, the learning is still focused on the teacher (not yet focused on students), have not made much use of technology or the internet and have not directed students' critical thinking skills. This research produces an analysis that to improve the quality of learning, the steps that must be taken are to increase innovation and knowledge through various online and offline training, take part in teacher professional education (PPG), and improve educational qualifications toward master's and doctoral levels so that the quality and competence of teachers increases as well as The learning is also more contextual and fun for students who are learning

Abstract

The tourism sector has become a development sector that has really developed in recent years. Tourism development has three dimensions of development, namely government, academics and entrepreneurs, but this model is modified into five dimensions, namely government as regulator, academics as conceptualizer, tourism business as investor, community working in the tourism sector as accelerator and media as catalyst. These five dimensions are called the pentahelix model. Through this model, it is hoped that the tourism sector can contribute to the community's economy through an empowerment process. So this research aims firstly, to explore tourism development using the pentahelix model, secondly, to design community empowerment using tourism development using the pentahelix model. This goal was achieved with a qualitative approach, a type of case study on Ijen Geopark Bondowoso tourism. This location is one of the biggest tourist attractions in Bondowoso. Data was collected by means of observation, interviews, documentation and FGD. Data were analyzed using descriptive and interpretive techniques and the validity of the data was tested using triangulation of sources and techniques. This research results, firstly, tourism developed using the pentahelix model is more successful than that developed using the triple helix model, because the dimensions used are more comprehensive, secondly, the community empowerment design through the pentahelix model is comprehensive and can absorb a high level of participation in tourism development. Thus, people's income has increased and unemployment has decreased in the Ijen Geopark tourist area because the community participates in tourism development. So, this pentahelix model can be used in designing sustainable community empowerment.

Abstract

Salah satu upaya peningkatan keselamatan jalan ialah dengan mengurangi risiko terjadinya kecelakaan di simpang dengan cara mengoptimalkan kinerja simpang serta menurunkan jumlah konflik lalu lintas yang terjadi. Berdasarkan hal tersebut penulis melakukan penelitian upaya peningkatan keselamatan dengan cara penanganan konflik lalu lintas dan mengoptimalkan kinerja simpang. Penelitian ini bertujuan untuk memberikan penanganan simpang yang dapat diterapkan pada simpang empat Tugu Wisnu guna mewujudkan peningkatan keselamatan. Permasalahan pada simpang ini adalah terdapat ekor tundaan lalu lintas yang tertinggal pada bundaran sehingga menyebabkan konflik lalu lintas dengan arus lalu lintas pendekat simpang lainnya dengan fase APILL sama. Metode yang digunakan dalam analisis kinerja simpang menggunakan perhitungan MKJI dan disimulasikan menggunakan software Vissim 9 Full Version sedangkan metode untuk mengetahui konflik lalu lintas yang terjadi dengan menggunakan software SSAM. Kemudian memberikan usulan penanganan untuk diterapkan pada simpang empat Tugu Wisnu yaitu dengan perubahan pengaturan simpang 3 fase menjadi 4 fase dengan pergerakan lalu lintas mengelilingi bundaran serta 4 fase tanpa mengelilingi bundaran kemudian dari kedua usulan penanganan dipilih alternatif penanganan yang sesuai untuk menurunkan konflik lalu lintas dan mengoptimalkan kinerja simpang. Alternatif penanganan simpang yang dipilih berupa perubahan pengaturan simpang dengan 4 fase dengan pergerakan lalu lintas tanpa mengelilingi bundaran dapat menurunkan jumlah konflik lalu lintas sebesar 30% dan tingkat pelayanan simpang adalah D yang berarti terciptanya keselarasan antara keselamatan jalan dan kelancaran lalu lintas.

Abstract

Pengemudi memang masih menjadi faktor dominan penyebab kecelakaan lalu lintas. Merujuk data kecelakaan yang ada di jalan tol-jalan tol yang dikelola oleh Jasa Marga dan kelompok usahanya sampai Desember 2018, faktor penyebab kecelakaan paling banyak adalah faktor pengemudi sebanyak 85,13%. Kelelahan pada pengemudi juga dapat mengakibatkan menurunnya kesiagaan dan perhatian, penurunan dan hambatan persepsi serta waktu reaksi yang lambat, pengemudi akan mengantuk dan kemungkinan akan kehilangan kewaspadaan. Tujuan dari penelitian ini adalah untuk yaitu mengetahui sejauh mana karakteristik pengemudi dan pemanfaatan rest area mempengaruhi kelelahan pengemudi di jalan tol. Sehingga diketahui kebermanfaatan rest area dalam mengurangi tingkat kelelahan pengemudi di jalan tol. Penelitian ini menggunakan metode kuantitatif dengan pendekatan deskriptif yang menggunakan analisis regresi berganda dengan serangkaian uji instrumen. Dari hasil penelitian ini kelelahan yang dialami pengemudi terbagi menjadi 2 yaitu kelelahan fisik dan kelelahan kegiatan. Variabel usia pengemudi, pengemudi yang memilih beristirahat, pengemudi yang tidak memanfaatkan fasilitas istirahat di rest area, pengalaman mengemudi serta jangka waktu mengemudi dalam satu kali perjalanan memberikan kontribusi terhadap kelelahan pengemudi di jalan tol. Usia pengemudi berpengaruh terhadap semua jenis kelelahan yang dialami oleh pengemudi di jalan tol Pejagan-Solo.

Abstract

English for Specific Purposes (ESP) is garnering significant attention and anticipation for its contribution to the teaching and learning process at the Polytechnic of Road Transportation Safety in Indonesia. Consequently, this study offers valuable insights into the perceptions of cadets at a vocational college regarding the significance of the ESP course within the transportation engineering program. Specifically, this paper aims to explore the cadets' perspective on the role of ESP in their future careers. By conducting a qualitative descriptive study, four types of questionnaires were administered to a total of ninety second-year cadets who are pursuing a major in transport engineering. The findings reveal that the cadets/students recognize the importance of ESP as a crucial subject that supports their future employment prospects. Moreover, they acknowledge the appropriate allocation of time to ESP within their curriculum, recognizing its necessity for their academic success and eventual career advancement. Understanding the importance of ESP is crucial for cadets aspiring to work in the industry. Cadets must have a strong motivation to learn and familiarize themselves with core engineering concepts in order to establish themselves as competitive engineers on a global scale.

Abstract

The civil rights of children outside of marriage have an impact on the child, because they do not receive legal protection, such as the care and welfare of the child, including the child's right to inherit. The position of an illegitimate child will be a burden for the mother and the mother's family, and the child's legal status is also not covered by the law, such as determining the child's legitimacy, such as the status of the child's birth certificate. Therefore, the author wrote this to identify the legal status of illegitimate children. This writing is prescriptive normative legal research, to answer legal issues raised with arguments, theories or new concepts as prescriptions in solving the problems faced. "Children born out of wedlock only have a civil relationship with their mother and her mother's family." Article 280 KHUPer "With the recognition of a child out of wedlock, a civil relationship is created between the child and his father or mother." Article 100 KHI "Children born out of wedlock only have a family relationship with their mother and their mother's family." Article 49 paragraph (2) Law number 24 of 2013, amendment to Law Number 23 of 2006 concerning Population Administration "Recognition of children only applies to children whose parents have entered into a valid marriage according to religious law, but not yet legal according to State law." Based on the writing, the recognition of an illegitimate child (biological product) as a recognized child means that it will give rise to alimony rights, birthright rights and inheritance rights for the child from his biological father. Abstract

The objective of this research is to conduct a juridical examination of the protection of inheritance rights for nonmarital children from their biological father mother under Indonesian law. Nonmarital children have historically faced legal challenges concerning The acknowledgment of the civil status bond between the child and the biological father, which directly impacts their succession rights. This study analyzes provisions of positive law in Indonesia, particularly those regulated under Law No. 1 of 1974 on Marriage, the Compilation of Islamic Law (KHI), the Civil Code and Constitutional Court Decision No. 46/PUU-VIII/2010, which opens avenues for acknowledging the biological relationship between a nonmarital child and their father through evidentiary means such as DNA testing. Additionally, this study discusses the role of gifts (hibah) and obligatory bequests (wasiat wajibah) as alternative legal instruments to safeguard the inheritance status of children resulting from valid marital relationships, particularly within the context of positive law. The findings of this analysis indicate that, although the KHI imposes limitations on sharia lineage, the Constitutional Court decision provides legal certainty and constitutional protection for children born outside official marital bonds to claim Rights to inheritance derived from their natural parents. However, the implementation of this protection continues to encounter technical and cultural obstacles, necessitating further regulatory adjustments and public socialization. This research recommends regulatory adaptations and enhanced access to biological evidence to strengthen the safeguards for the inheritance rights of nonmarital children in Indonesia.

Abstract

Marriage in the Christian tradition has undergone a historical development, from a simple community practice in the ancient Roman world, where a personal declaration of commitment between the prospective bride and groom was considered valid, to becoming a sacred and legal institution elevated as a sacrament of the church. The 11th-century Reformation of the Catholic Church and the 16th-century Council of Trent strengthened the sacramental status of marriage, requiring its publication and solemnization before the church community to avoid disputes and ensure legal and theological validity. In Indonesia, the practice of church marriage was influenced by the colonial legal system, which required civil registration in addition to a church blessing. Today, a church blessing is considered to fulfill the spiritual aspect, while registration at the Civil Registry Office is an absolute prerequisite for legal recognition and protection of the constitutional rights of Christian families. This research uses a normative juridical method with a study of regulations, doctrines, and implementation practices. The research results show that there is a dualism of recognition—a valid church marriage may not be legally recognized by the state without civil registration, which has an impact on the legal status, inheritance, and administration of children. Analysis of church legal theory, formal state legality, constitutional rights, and legal certainty emphasizes the importance of harmonization between positive law and the sacred values of the church so that the rights of Christian families are comprehensively protected. The research recommendations emphasize the need for public education, church advocacy, and inclusive state services so that church marriages receive full spiritual and legal recognition in Indonesia.

Abstract

This study examines the influence of waqf and grants on the inheritance distribution system in Islamic law, from the perspective of Indonesian positive law and contemporary Islamic jurisprudence. In Islamic teachings, the distribution of inheritance (al-mirats) is regulated in detail through the provisions of the Qur'an and Hadith, and has received in-depth explanations in classical literature and jurisprudence. The phenomenon of grants and waqf, both before and after the death of the testator, creates its own dynamics due to the intersection of provisions of Indonesian positive law, such as the Compilation of Islamic Law (KHI), and classical and contemporary Islamic jurisprudence. Normatively, waqf and grants have different legal consequences that directly impact the rights of heirs, distributive justice, and potential disputes. This study uses a normative legal approach, examining relevant laws, doctrines, fatwas, and court decisions, to highlight the need for regulatory synergy to ensure justice, legal certainty, and social harmony in the distribution of inheritance in Indonesian Muslim society.
