Abstract

Wanprestasi memiliki arti bahwa belum tercapainya suatu prestasi atau kewajiban di dalam perjanjian. Dimana salah satu pihak berprestasi buruk, karena tidak memenuhi atau lalai dalam melaksanakan kewajiban seperti yang ditentukan dalam perjanjian yang dibuat antara kreditur dengan debitur. Hal tersebut dapat terjadi baik karena disengaja maupun tidak disengaja. Jenis metode penelitian ini yaitu yuridis normatif, hal tersebut di karena penelitian mengkaji putusan pengadilan Negeri Jakarta Pusat Nomor 335/PDT.G/2008/PN.JKT.PST dalam perkara perdata dalam tingkat kasasi mengenai wanprestasi. Adapun yang dikaji penelitian ini yaitu putusan hakim dimana putusannya menerima dan mengabulkan gugatan dari penggugat yaitu: Perseroan Terbatas GMF dan menghukum tergugat yaitu: Perseroan Terbatas Metro Batavia untuk membayar hutang terhadap penggugat sejumlah USD 1.191.615,02 sesuai dengan invoice no.1 sampai no.29. Disamping itu tergugat juga dihukum agar mengganti kerugian yang diderita penggugat sebesar USD 200.000.000,00 serta dihukum untuk membayar biaya perkara yang timbul.Kata Kunci: Wanprestasi, Sita Jaminan, Putusan

Abstract

Abstract The purpose of this study was to determine the effect of the the quality of financial statements on the performance accountability of government agencies (a case study at the Language Center of North Sumatra Province). This type of research is causality. The data used are primary data and secondary data. Sampling is done by saturated sample or census. Data collection techniques using interview, questionnaire and documentation techniques. The analytical method used is simple linear regression. The result of this study indicate that the Quality ogf Financial Statements Agencies.

Abstract

The town of Mentok, located in West Bangka Regency, holds unique tourism potential distinct from other regions in the Bangka Belitung Islands Province. The combination of maritime tourism and the historical exile of Indonesia's first president is a key advantage for tourism in this district. Mentok is known for its distinctive seafood-based specialty, shrimp pempek, which sets it apart from other places. Belo Laut Village is the production center of this culinary specialty. Despite the uniqueness and strong association of shrimp pempek with Mentok, there has been no branding or effort to promote this local dish as a tourism asset for the town. The community service was conducted in Belo Laut Village, Mentok District, West Bangka Regency, focusing on the Kemplang Yuk Yen Poklahsar group using a Community-Based Approach and Educational Outreach methods. Shrimp pempek has become a distinctive culinary specialty strongly associated with the town of Mentok. This is similar to other regional dishes like gudeg in Yogyakarta, apple chips in Batu/Malang, and breadfruit chips in Belitung. However, the marketing orientation of shrimp pempek remains local. The product has significant potential for further development in terms of production, food safety, packaging, branding, and promotion to support Mentok's culinary tourism sector.

Abstract

Pinjaman online ilegal telah menjadi permasalahan serius di Indonesia, dengan dampak negatif yang signifikan terhadap masyarakat. Meskipun praktik ini ilegal, debitur tetap memiliki kewajiban hukum untuk membayar pinjaman sesuai perjanjian. Namun, asas iktikad baik menjadi faktor penting dalam memahami kewajiban moral debitur, karena menekankan pentingnya bertindak dengan integritas dan tanpa niat merugikan pihak lain dalam setiap tindakan hukum. Fenomena ini menciptakan korelasi yang menarik antara asas iktikad baik dan kewajiban debitur dalam mengembalikan prestasi pinjaman online ilegal. Pemerintah Indonesia telah mengambil langkah-langkah untuk mengatasi masalah ini, termasuk mengatur perusahaan fintech dan pinjaman online dengan lebih ketat.Kata Kunci:Pinjaman Online, Debitur, Iktikad Baik,Bonafides

Abstract

Research on speech acts has been extensively conducted by scholars; however, studies specifically focusing on prohibitive speech acts, especially regarding the forms and functions of local wisdom values within these acts, are still quite rare. This research is aimed at exploring the forms and functions of local wisdom values in the prohibitive speech acts of the Kerinci community. This research employed a descriptive qualitative method which involved ten informants from Pondok Tinggi Village and Sungai Penuh Village, Kerinci Regency, Jambi Province. The data were collected using observation, note-taking, and recording for two months. The data were analyzed qualitatively by using an interactive model. The results show that the forms of local wisdom values in the prohibitive speech acts of the Kerinci community were prohibitive speech acts with consequences and without consequences. These prohibitions encompass local wisdom values across moral, respectful behaviour, health, safety, social harmony, responsibility, ethics, and environmental stewardship. Moreover, the functions of local wisdom values in the prohibitive speech acts in the Kerinci community serve as a means of behaviour control and convey local wisdom values that support moral education and environmental preservation. Furthermore, the functions emphasize the importance of integrating local values into education to enhance community awareness of the environment and social relationships. Thus, integrating these local values into educational contexts could foster community awareness of environmental and social responsibilities, supporting cultural preservation and reinforcing the importance of these values for future generations.

Abstract

This study aims to examine the extent to which the competence and work discipline of police members in the Directorate of Vital Object Security of the South Sumatra Regional Police affect their performance in carrying out security duties in the Obvitnas/Obviter area. The research method used in this study is qualitative analysis. Respondents in this study were personnel of the Ditpamobvit of the South Sumatra Regional Police who carried out security duties in the Obvitnas area: Head of Bin Opsnal, Deputy Director of Pamobvit, and Director of Pam Obvit. The location of the study was at the Ditpamobvit of the South Sumatra Regional Police. The instruments used included interviews, observations, and documentation. The steps in this study included collecting data from interviews with personnel who carried out security and the leadership of Ditpamobvit and then describing and presenting the data that had been collected in written form. The results of this study indicate that competence and work discipline greatly influence the improvement of the performance of Ditpamobvit personnel of the South Sumatra Regional Police in carrying out duties in the Obvitnas and Obviter areas.

Abstract

Globalization that affects the national education system demands values to shape the character of the younger generation. This study uses a literature study method on five SINTA - indexed journals, it was found the character education in elementary schools is implemented through integrating values in learning, habituation in school culture, extracurricular activities, and Proyek Profil Pelajar Pancasila (P5). Although it shows progress, its implementation still faces challenges such as lack of consistency, minimal parental rolee, and limited teacher role models.This study offers an integrative models based on an adaptive and contextual national curriculum.

Abstract

Adolescents between the ages of 10 and 19 are faced with a triple nutritional burden with co-existence of undernutrition, overnutrition and micronutrient deficiencies. About a quarter of adolescents aged 13-18 years are stunted or short, 9 percent are underweight or have a low body mass index, while 16 percent are overweight and obese. In addition, about a quarter of adolescent girls experience anemia. The purpose of this study was to determine the relationship between body image and diet in middle adolescents at SMA Negeri 05 Bengkulu City in 2024.The research method used was descriptive quantitative research with a cross sectional approach. Sampling technique using simple random sampling technique with the number of samples in this study 77 people representing all students at SMA Negeri 05 Bengkulu City in 2024. The results showed that most of the respondents (59.7%) with negative body image, most of the respondents (50.6%) with poor diet. There is a relationship between body image and eating patterns in middle adolescents indicated by p=0.000. It is concluded that body image is determined by eating patterns in middle adolescents at SMA Negeri 05 Bengkulu City, so it is recommended for SMA Negeri 05 Bengkulu City the results of this study can be the basis for implementing guidance, coaching, and counseling activity programs on body image with eating patterns in middle adolescents.

Abstract

Aksesibilitas menjadi aspek penting dalam merancang fasilitas kesehatan untuk memastikan kemudahan, kenyamanan, dan keselamatan bagi semua pengguna, termasuk penyandang disabilitas. Gedung rawat inap RS Karima Utama menghadapi sejumlah masalah terkait aksesibilitas, seperti tangga darurat yang tidak sesuai standar, ukuran ramp yang tidak memadai, dan jarak antar pintu masuk yang kurang efektif. Penelitian ini bertujuan untuk mengidentifikasi dan mengoptimalkan desain aksesibilitas gedung tersebut berdasarkan prinsip Aksesibilitas dan Universal Design. Penelitian ini menggunakan metode Focus Group Discussion (FGD), diawali dengan kajian terhadap denah bangunan serta survei langsung ke lapangan. Berdasarkan data yang diperoleh, dibuat tiga alternatif desain baru yang kemudian dibahas melalui proses FGD. Dari hasil diskusi, alternatif kedua dipilih karena dinilai paling efektif dalam meningkatkan kemudahan akses. Penelitian menunjukkan bahwa gedung tersebut memerlukan perbaikan karena belum sepenuhnya memenuhi standar yang berlaku. Perbaikan yang direkomendasikan antara lain memperlebar tangga darurat dari 1 meter menjadi 1,2 meter agar sesuai standar, menambah pintu utama di sisi timur gedung untuk meningkatkan aksesibilitas dan kenyamanan, serta memperpanjang ramp dari 6 meter menjadi 8 meter dan memperlebar ramp dari 1,17 meter menjadi 1,2 meter, menyesuaikan dengan prinsip aksesibilitas dan Universal Design. Meskipun alternatif kedua memiliki kekurangan berupa hilangnya dua ruang rawat inap, hal ini tidak berdampak signifikan karena sejak awal jumlah ruang rawat inap sudah dirancang lebih dari kebutuhan minimum, sehingga pengurangan dua ruangan tidak akan mengganggu fungsi utama gedung.
