Abstract

Omnibus law is a law in which it discusses and contains more than one discussion theme or topic. The omnibus law became the attention of the Indonesian people after the enactment of Law no. 11 of 2020 concerning Job Creation. Even before the law was passed, it had been rejected by the community. This is because people think the law will harm the small people, one of which is PKWT employees and will actually benefit the elite. Then what is the actual status of the omnibus law in Indonesia, considering that the technique has not been regulated in Law no. 12 of 2011 concerning the Establishment of Legislation which was changed to Law no. 15 of 2019. And what is the status of PKWT after the omnibus law regarding the work copyright law. In this study, the author uses a normative juridical research method. The results obtained in this study can be concluded that the application of omnibus law in Indonesia may be applied, but it would be better if before the enactment of the omnibus law, the legal basis was first made, considering that our country is a state of law. The omnibus law is also not the only way out in solving regulatory problems in Indonesia. This is because Indonesia's problems are not only about overlapping regulations, but there are many things that are not sufficiently resolved through the omnibus law. Then regarding PKWT there are five important points that must be considered with the existence of the Job Creation Act, namely the employee's tenure, contract extension, probationary period, compensation money and the form of a written agreement.

Abstract

Abstract : The implementation of diversion aims to avoid criminalizing children in the settlement of cases at the Liwa Court. However, the fact is that the number of applications for diversion on the type of crime of theft by children in the last five years only amounted to 6 cases out of 69 cases. The author realizes that indeed not all cases can successfully carry out diversion because there are various obstacles to the facts on the ground, such as the lack of understanding of the community and the victim, as well as judges who handle children's cases. This study uses an empirical juridical research method, which is to approach the Liwa District Court directly in obtaining data on the settlement of diversion efforts in the case of children as perpetrators of the crime of theft at the Liwa District Court. Then the author also applies a descriptive analysis approach to manage qualitative data along with deductive methods in concluding problems. It is hoped that this research can provide a solution to the diversion problem that occurs, and increase the number of diversion processes in the future.

Abstract

Child abuse is a problem that requires special attention in determining the sanctions that will be borne by the child perpetrator considering that children are a gift from God Almighty whose dignity and honor must be maintained. The methods used in this study are Normative Juridical and Empirical Juridical. The sources of this study were the Head of Sub-unit 1 of the PPA Unit and Lecturers at the Criminal Law Section of the Faculty of Law, University of Lampung. The data obtained were analyzed qualitatively. The results of this study are: (1) The implementation of diversion at the Bandar Lampung Police is in accordance with the provisions contained in Article 7 paragraph (1) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System that at the level of investigation, prosecution, and examination of cases of children, diversion must be attempted, but it has not been running optimally.. (2) The inhibiting factors for the implementation of diversion as a resolution of criminal cases of child abuse at the Bandar Lampung Police are: lack of public trust in the diversion rules, lack of Bapas personnel, difficulty in bringing together the related parties, and several internal and external factors.

Abstract

Pelecehan seksual adalah tindakan yang tidak diinginkan dan merugikan korban secara fisik dan psikologis. Kasus pencabulan oleh seorang guru olahraga terhadap anak di bawah umur (Putusan PN No. 1339/Pid.Sus/2020/PN Tjk) mengungkapkan tantangan besar dalam penerapan hukum perlindungan anak di Indonesia. Meskipun terdakwa dijatuhi hukuman lima tahun penjara, keputusan ini tidak menerapkan pemberatan pidana, yang seharusnya diberlakukan sesuai dengan Undang-Undang Tindak Pidana Kekerasan Seksual (UU TPKS). Dalam UU TPKS, terdapat pemberatan hukuman yang bisa dikenakan kepada pelaku kekerasan seksual berulang, termasuk pelaku yang merupakan pendidik. Penelitian ini bertujuan untuk menganalisis penerapan pemberatan pidana bagi pelaku kekerasan seksual, khususnya dalam kasus yang melibatkan guru terhadap anak di bawah umur, serta menilai apakah keputusan yang dijatuhkan telah memenuhi asas keadilan. Hasil penelitian menunjukkan bahwa ketidakterapan pemberatan pidana dalam kasus ini mengurangi efek jera dan menciptakan ketidakadilan bagi korban, yang mengakibatkan trauma mendalam. Ketidakonsistenan dalam penerapan prinsip hukum ini menurunkan kepercayaan masyarakat terhadap sistem peradilan pidana, yang pada gilirannya menimbulkan urgensi untuk reformasi kebijakan hukum dan pelatihan lebih lanjut bagi hakim serta penegak hukum. Sexual harassment is an unwanted act that harms the victim both physically and psychologically. A case of molestation by a physical education teacher against a minor (Decision PN No. 1339/Pid.Sus/2020/PN Tjk) reveals significant challenges in the implementation of child protection laws in Indonesia. Although the defendant was sentenced to five years in prison, the decision did not apply sentencing enhancement, which should have been enforced in accordance with the Sexual Violence Crime Law (UU TPKS). Under the UU TPKS, there are enhancements to the penalties that can be imposed on repeat sexual violence offenders, including those who are educators. This research aims to analyze the application of sentencing enhancements for sexual violence offenders, particularly in cases involving teachers against minors, and to assess whether the imposed decisions have met the principles of justice. The results indicate that the non-application of sentencing enhancements in this case diminishes the deterrent effect and creates injustice for the victim, resulting in deep trauma. Inconsistency in the application of this legal principle erodes public trust in the criminal justice system, which in turn raises the urgency for legal policy reform and further training for judges and law enforcement officials.

Abstract

Sexual violence is an act that is degrading, humiliating, harassing, and/or attacking a person’s body or reproductive function, typically caused by an imbalance of power relations or gender discrimination, which results in psychological and physical suffering. Sexual violence against children is a social problem that requires special attention because this crime involves children in its commission. The Institute for Criminal Justice Reform (ICJR) also emphasizes that intercourse with a child constitutes a criminal offense, even if it is framed as consensual, in order to protect the child’s rights and future. Based on this issue, the author aims to examine efforts to combat sexual violence against children under the guise of sexual consent to find the most effective strategies to reduce this increasingly widespread crime. The research method used is a normative and empirical juridical approach. The data used includes both primary and secondary data. Data collection procedures involve literature study and field research. The data analysis was conducted using qualitative analysis. The results of the study show that efforts to combat sexual crimes include both penal and non-penal measures. Penal efforts involve the government enacting more specific regulations on sexual crimes involving adults and children under the pretense of sexual consent, as well as taking repressive measures as a last resort. Non-penal efforts conducted by relevant institutions include public outreach and education that provides information about such criminal behaviors. The suggestions in this study are: (1) To prevent sexual crimes committed under the guise of sexual consent, it is necessary to involve the community and a supportive environment that is aware of unlawful acts occurring around them, and to collectively protect family and community members from engaging in harmful behavior. (2) The government is expected to establish more specific policies regarding sexual crimes involving adults and children under the pretext of sexual consent.

Abstract

Law enforcement cannot be separated from the use of various sciences, one of which is forensic medicine. Its use is by implementing forensic autopsies for the purposes of investigating victims in unnatural and suspicious deaths that are suspected of being related to criminal acts such as in cases of alleged criminal acts of abuse that cause death. This study uses an empirical legal approach by reviewing applicable legal regulations and their application in practice. Data were obtained through interviews with investigators, forensic doctors, and the victim's family, as well as literature studies that include laws and previous research. The results of the study indicate that forensic autopsies have an important role in investigating cases of abuse that cause death, as occurred in the case of the death of a foster child at LPKA Bandar Lampung. The autopsy results revealed signs of previously undetected physical violence, allowing law enforcement officers to name suspects and continue the investigation process. However, the implementation of autopsies in the Indonesian legal system still faces various obstacles, including resistance from the victim's family who refuse autopsies due to cultural and religious factors, limited forensic experts and autopsy facilities in several areas, and intervention from certain parties who try to hinder the investigation. Therefore, this study recommends a stricter policy in requiring autopsies for suspicious deaths, increasing the number of forensic personnel, and transparency in the legal process to ensure justice for victims and families. Thus, autopsies can function optimally as scientific evidence in revealing criminal acts and strengthening law enforcement in Indonesia.

Abstract

Chemical castration punishment is regulated in Law No. 17 of 2016 about Child Protection, which provides additional sanctions for perpetrators of child sexual crimes. In South Korea, it is regulated in the South Korean Bill on Prevention and Handling Perpetrator Violence Sexual to However, the implementation of this law has encountered various obstacles, including unclear implementation procedures and rejection from several medical circles. Even though there are aiming to protect children from sexual violence, criticism has emerged regarding potential human rights violations. tendency to repeat crimes. With a more structured system, South Korea has succeeded in reducing the recidivism rate through a rehabilitation approach and long-term supervision. This study uses a normative legal approach using a legislative approach, a conceptual approach and a comparative legal approach. The results of the study show that although both countries have the same goal of protecting children from sexual violence, there are significant differences in the implementation and effectiveness of chemical castration sanctions in Indonesia which carries out execution aimed at the profession doctor while South Korea was handed over to court as execution castration chemical. This study aims to provide insight into the comparison of legal policies in the two countries and their implications for the protection of child sexual violence victims. Meanwhile, South Korea became the first country in Asia to implement chemical castration in 2011. This policy was implemented based on the results of a medical diagnosis indicating that the perpetrator had.

Abstract

Purpose: To provide new information and knowledge to readers about the impact of losses from phising through social media Methodology/approach: The research methodology used in the writing of this article is the normative legal research method, which is conducted by studying, observing, and examining several theoretical aspects related to legal principles, concepts, views, legal doctrines, legal regulations, and legal systems pertinent to the research problem. Results/findings: Phishing is a technique where scammers try to make their victims provide personal information, such as passwords, credit card numbers, or other financial information, by impersonating a trusted entity through fake emails or fake websites. The main goal of phishing is to steal the target's identity or gain illegal access to someone's account. With the information possessed by the phishing perpetrator, they can carry out various types of fraud, such as identity theft, money laundering, or attacks on computers and network systems. Phishing can have very serious impacts on victims, such as financial loss, identity theft, loss of personal data, stress, trauma, damage to reputation, and operational disruption. Limitations: This paper raises the formulation of the problem, namely how the impact of losses from phising through social media. Contribution: The writing of this article is intended for law faculty students, particularly in the study of health law, and as a guide for law enforcement practitioners in understanding about the impact of losses from phising through social media.

Abstract

Fenomena tindak pidana seksual oleh anak dengan hewan (zoofilia) menjadi persoalan serius yang tidak hanya melanggar hukum dan norma kesusilaan, tetapi juga menimbulkan trauma mendalam bagi korban dan pelaku. Penelitian ini bertujuan untuk menganalisis bentuk penerapan rehabilitasi dan pengawasan terhadap anak pelaku dalam kasus di Polres Tasikmalaya. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan kualitatif, melalui wawancara dengan penyidik Polres Tasikmalaya, studi kepustakaan, dokumentasi, dan observasi. Hasil penelitian menunjukkan bahwa upaya rehabilitasi diawali dengan pengembalian anak ke orang tua sebagai langkah awal pemulihan emosional dan psikologis anak. Selanjutnya, pengawasan dilakukan secara terpadu oleh keluarga dan instansi terkait seperti Bapas dan UPTPPA, yang bertujuan untuk mendukung proses pembimbingan dan pemulihan perilaku anak. Selain itu, pendekatan berbasis komunitas yang melibatkan sekolah, tokoh agama, dan lembaga perlindungan anak menjadi bagian penting untuk memperkuat nilai moral dan sosial anak. Upaya ini didasari oleh teori kontrol sosial dan teori diferensiasi asosiasi, dengan menekankan pentingnya lingkungan suportif bagi anak. Penelitian ini memberikan kontribusi penting dalam pengembangan pendekatan rehabilitatif dan perlindungan anak pelaku tindak pidana seksual menyimpang, serta mendukung prinsip keadilan restoratif sebagaimana diatur dalam UU SPPA

Abstract

This study critically examines the phenomenon of children as perpetrators of victim blaming in cases of sexual violence. This dimension has received only a small portion of attention in legal and child protection policy studies. Using an empirical legal approach that combines normative analysis, case studies, and conceptual analysis, this study evaluates the effectiveness of the law enforcement system against children involved in blaming victims of sexual violence. The findings show that although there is a fairly progressive legal framework through Law Number 11 of 2012 concerning the Criminal Justice System for Children, its implementation has not substantively addressed the symbolic aspects of violence. First, legal narratives tend to place children as perpetrators in general, without considering the socio-cultural context behind victim blaming. Second, the penal system remains textual and lacks a rehabilitative approach consistent with restorative justice principles. Third, diversion mechanisms have not been optimized to address child perpetrators in cases of victim blaming as non-physical violence. Fourth, the weak literacy of law enforcement officials regarding the psychosocial and symbolic dimensions of violence results in responses that are procedural and non-transformative. This study suggests reinforcing legal interventions based on moral education, social recovery, and cross-sectoral involvement to prevent the replication of symbolic violence by children in their social spaces.
