Abstract

This research aims to (1) determine the implementation of Article 54 of Law Number 35 of 2009 concerning Narcotics Regarding the Implementation of Rehabilitation for Narcotics Abusers in Buleleng Regency, and (2) determine the obstacles faced by the Buleleng BNNK in implementing rehabilitation for Narcotics abusers in Buleleng National Narcotics Agency. The type of research used is empirical legal research, with a descriptive nature. The research location was carried out at the National Narcotics Agency, Buleleng Regency. The data collection techniques used were observation, interviews and document study. The sampling technique used is the Non Probability Sampling technique. Qualitative data processing and analysis techniques. The results of the research show that (1) the implementation of Article 54 of Law Number 35 of 2009 concerning Narcotics regarding the implementation of rehabilitation for Narcotics abusers at the Buleleng BNNK has not been fully implemented at the Buleleng BNNK, (2) The obstacles faced by the Buleleng BNNK in carrying out rehabilitation are Lack of public knowledge about the existence of the Narcotics Law regarding rehabilitation, narcotics abusers are not yet fully aware, the public's unwillingness to report families who are indicated to be using narcotics and a lack of health workers at the Buleleng BNNK Pratama Clinic.

Abstract

Agency (BNN) in empowering the community as a non-penal policy in the preventive effort against drug abuse in Buleleng District, and (2) analyze the inhibiting factors or obstacles faced by the Buleleng District BNN in optimizing community empowerment as a non-penal policy in the preventive effort against drug abuse in Buleleng District. The research used empirical legal research, with a descriptive research nature conducted at the Buleleng District BNN. Data collection techniques used were document study, observation, and interviews. Non-Probability Sampling technique was used for sample selection, and Purposive Sampling technique was used for subject determination. Data processing and analysis were conducted qualitatively. The results of the research indicate that; (1) Community Empowerment Programs carried out by the Buleleng District BNN are in accordance with the provisions of the laws and regulations. Buleleng District BNN's efforts in empowering the community as a non-penal policy in the preventive effort against drug abuse include the P2M Program through Socialization, Formation of Narcotics Activists or Volunteers, Rehabilitation Programs through the Formation of IBM Teams and Shining Villages, and Cross-Sectoral Cooperation. (2) There are obstacles in the implementation of community empowerment programs as non-penal policies in the preventive effort against drug abuse in Buleleng District, namely internal obstacles such as budget constraints, personnel/members, and transportation facilities, and external obstacles such as relatively low public awareness in the preventive effort against drug abuse.

Abstract

This research aims (1) to find out and analyze the basic considerations for Law Number 5 of 2014 which does not allow ASN to take part in political activities. (2) to find out and analyze the legal consequences of ASN involved in practical political activities. The type of research used by researchers is normative legal research, namely through a statutory regulation approach and a comparative approach. The sources of legal material used are the 1945 Constitution, Law Number 5 of 2014, Law Number 7 of 2017, Law Number 2 of 2011. The results of the research show that (1) Legally normative, Corps Spirit Development and the Civil Servant Code of Ethics which explicitly states that ASN/PNS are obliged to avoid conflicts of personal, group or class interests. Therefore, ASN is prohibited from carrying out actions that lead to partiality with one of the candidates or actions that indicate being involved in practical politics/affiliating with a political party. And explicitly states that ASN must be neutral. (2) In connection with sanctions for State Civil Apparatus who are not neutral, the Minister for Administrative Reform issued a Circular Letter from the Minister for Administrative Reform Number: SE/18.1/M.PAN/5/2004. This circular regulates the criteria for imposing sanctions on state civil servants who are not neutral. The criteria for these sanctions are severe disciplinary punishment, demotion to one level of rank, severe disciplinary punishment in the form of dismissal, severe disciplinary punishment in the form of dishonorable dismissal as a Civil Servant.

Abstract

Inheritance aims to transfer rights and responsibilities for something material or non-material from one party to another party called the heir. This research aims to (1) determine the position of women in terms of inheritance from the perspective of Balinese Customary Law. (2) To determine the legal consequences of handing over inheritance rights to married women from the perspective of Customary Law in Bali. The type of research used is normative legal research, namely research based on statutory regulations. In this research, a statutory approach is used by examining statutory regulations related to research. The technique for collecting legal materials in this research is using document study techniques, namely by studying data collected from archival research or literature studies such as books, papers, articles, journals, newspapers or the works of legal experts. With this research, it was found that (1) Balinese society is patriarchal, so women are not prioritized in becoming heirs (2) with the Decree of the Main Council of Pakraman Village, Bali Province No: 01/Kep/Psm-3/Mdp Bali/X/2010 Regarding the inheritance of Balinese Hindu women, which has legal force, married women are given inheritance rights to their parents' property.

Abstract

This research aims to analyze and examine the implementation of the obligation to use Indonesian language labels on goods traded domestically as regulated in Article 8 paragraph (1) letter j UUPK Jo Article 20 paragraph (1) PP Number 29 of 2021 concerning the Implementation of the Trade Sector Jo Article 97 paragraph (3) of Law Number 18 of 2012 concerning Food and the legal consequences for business actors who do not include Indonesian language labels on goods traded domestically in Singaraja City. The type of research used is descriptive empirical juridical research. The sample used was purposive sampling. Data collection techniques include document study, observation and interviews. Data processing and analysis was carried out qualitatively. Based on the research conducted, it is known that the implementation of the obligation to use Indonesian language labels on goods traded in Singaraja City has not been implemented well by food product business actors. The legal consequences for business actors who violate are subject to sanctions as stated in Article 62 paragraph (1) UUPK in conjunction with Article 26 paragraph (1) PP Number 29 of 2021 concerning the Implementation of the Trade Sector.

Abstract

The purpose of this study is to determine and analyze the implementation of the provisions of Article 9 Paragraph 1 Letter a of Law No. 8 of 1999 concerning Consumer Protection and to determine the legal consequences for business actors who offer goods incorrectly as if the goods have a discount. The type of research used is empirical legal research with a descriptive research nature. The location of this research was conducted in Singaraja City. The data collection technique used was by means of document study, observation and interview. The sampling technique used was the Non Probability Sampling technique and the determination of the subjects used the Purposive Sampling technique. The data processing and analysis techniques were qualitative. The results of the study indicate that the provisions of Article 9 Paragraph 1 Letter a of the Consumer Protection Law have not been implemented properly. This is reflected in the fact that there are still business actors who offer goods incorrectly as if the goods have a discount. The legal consequences for business actors who offer goods as if there is a discount, namely based on Article 62 Paragraph 1 of the Consumer Protection Law, can be subject to criminal sanctions in the form of imprisonment for a maximum of 5 (five) years and/or a maximum fine of IDR 2,000,000,000.00 (two billion rupiah). If the offer of goods that appear to include a discount is made in electronic media, then based on Article 45a Paragraph 1 of the UUITE, the business actor can be sentenced to a maximum of 6 (six) years and/or a maximum fine of IDR 1,000,000,000.00 (one billion rupiah).

Abstract

Population growth increases every year in Buleleng Regency and is accompanied by an increase in cases of sexual violence. Based on Law Number 2 of 2002 concerning the National Police of the Republic of Indonesia, it is stated that the police's duty is to handle casespedophiliawhich is related to preventive and repressive efforts that are not yet optimal. From the problem above, there are 2 problem formulations, including: What is the role of the police in handling sexual violence against minors?(pedophilia)and What obstacles do the police face in dealing with sexual violence against minors?(pedophilia). This research uses an empirical method with qualitative research characteristics. Data collection techniques used include observation, interviews, documentation. The sampling technique used is the techniquenonprobability sampling with shapepurposive sampling. This research found that the role of the police was to investigate, investigate and arrest the perpetrators. In this case, the obstacles faced by the police come from within and outside the institution.

Abstract

This research aims to analyze victimology regarding the rights of victims of Online Gender- Based Violence (OGBV) through the distribution of pornographic content based on Decision Number 616/Pid.Sus/2023/PN JKT.SEL, focusing on (1) legal analysis of OGBV through the distribution of pornographic content on social media in Decision Number 616/Pid.Sus/2023/PN JKT.SEL, and (2) legal protection for victims of OGBV through the distribution of pornographic content on social media in Decision Number 616/Pid.Sus/2023/PN JKT.SEL. The main focus of this study is the distribution of pornographic content on social media without consent, involving digital sexual exploitation for economic gain. Using a normative juridical method with statutory, case, and conceptual approaches, this research examines the implementation of legal protection for OGBV victims. The findings indicate that although there is a legal framework governing victim protection, its implementation remains suboptimal, particularly in terms of comprehensive victim recovery. Data from SAFEnet Indonesia recorded a significant increase in OGBV cases in the first quarter of 2024, rising fourfold from 118 to 480 cases. This study emphasizes the importance of adopting a victim-centered justice approach within the criminal justice system and the need to strengthen the role of the Witness and Victim Protection Agency (LPSK) in ensuring victims' access to sustainable recovery services.

Abstract

This research aims (1) to find out the implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency as a form of legal protection for victims of sexual violence; (2) to find out the obstacles faced in the implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency; (3) and to find out efforts at universities in Buleleng Regency to overcome challenges and obstacles in the implementation of Permendikbud Ristek No. 30 of 2021. The results showed that (1) The implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency reflects a systematic effort to protect victims of sexual violence, despite the challenges of socialization, patriarchal culture, and lack of facilities, and requires the synergy of all parties so that the policy runs effectively and fairly; (2) Implementation of Permendikbud Ristek No. 30 of 2021 in universities in Buleleng Regency. 30 of 2021 in universities in Buleleng Regency faces obstacles in the form of a lack of understanding of gender, weak reporting mechanisms, lack of victim assistance, and the potential for abuse of academic power, so that legal protection for victims of sexual violence has not been optimal and transparent; (3) Universities in Buleleng Regency are trying to overcome obstacles to the implementation of Permendikbud Ristek No. 30/2021 through periodic counseling, the formation of the PPKS Task Force, and psychological assistance for victims, in order to create an academic environment that is safe, responsive, and in favor of the protection and recovery of victims of sexual violence.

Abstract

The purpose of this study was to describe the formation of student discipline characters through the application of school discipline and Civics learning at SMA Negeri 1 Waingapu. This research is a descriptive qualitative research. This research was conducted at SMA Negeri 1 Waingapu. Data collection is done through interviews, observation, and documentation. The research data were analyzed by data collection, data reduction, data presentation, and conclusions. The results of this study are the formation of students' disciplined character through discipline starting from a). rules in school are made and formulated by students themselves, namely through the Student Council, the goal is to create disciplinary behavior in students without feeling burdened because disciplinary rules are the ideas of the students so that it arises awareness in students to obey the rules. b) the implementation of discipline in schools is carried out by all existing components, especially teachers and student councilors who routinely conduct raids on school attributes and other items that are prohibited at school. The formation of student discipline character through PPKn subjects, namely the teacher always emphasizes discipline in students, it starts from the teacher giving an example of discipline, creating a conducive learning atmosphere, and the teaching learning process is always orderly.
