Abstract

Jurnal ini membahas penerapan pidana bersyarat bagi pelanggar kekarantinaan kesehatan selama pandemi Covid-19 dengan fokus pada kasus selebgram Rachel Vennya dan ketua FPI (Front Pembela Islam) Habib Rizieq Shihab, berdasarkan teori sistem hukum Lawrence M. Friedman. Pendahuluan menggambarkan permasalahan dalam penerapan sanksi pidana kekarantinaan di Indonesia, yang meskipun telah diatur oleh Undang-Undang Nomor 6 tahun 2018 tentang Kekarantinaan Kesehatan, praktik pelanggaran masih terjadi. Metode penelitian menggunakan pendekatan normatif dengan menganalisis putusan pengadilan yang relevan untuk menilai efektivitas hukum yang berlaku. Hasil dan diskusi menunjukan bahwa meskipun regulasi dan penegak hukum tersedia, penerapan hukuman dinilai tidak konsisten dan cenderung ringan, yang mengurangi efek jera bagi pelanggar. Aspek struktur hukum juga perlu ditingkatkan untuk menjamin bahwa tindakan hukum dilakukan tanpa pandang bulu, Kesimoulan menjelaskan pentingnya kesadaran hukum di kalangan masyarakat dan penegak hukum melalui edukasi dan penegakan hukum yang tegas, sehingga budaya hukum dapat tercipta lebih baik lagi kedepannya.Kata Kunci: Covid-19, Kekarantinaan kesehatan, Penegakan hukum, Lawrence M Friedman, Pidana bersyarat

Abstract

Penanganan kasus sengketa utang-piutang melalui jalur pidana sering menimbulkan permasalahan hukum akibat tumpang tindih antara ranah hukum pidana dan perdata. Penelitian ini berfokus pada perlindungan hukum terhadap debitur dalam sengketa utang-piutang yang sering diselesaikan dengan delik pidana penipuan. Dengan menggunakan metode penelitian hukum normatif, analisis di dasarkan pada literatur hukum, putusan pengadilan, serta asas legalitas yang diatur dalam KUHP dan Undang-Undang Kekuasaan Kehakuman. Hasil penelitian menunjukkan bahwa wanprestasi dalam perjanjian utang-piutang seharusnya berada di ranah perdata, kecuali jika terdapat unsur itikad buruk yang memenuhi delik penipuan. Kasus Fariyanti Ludji menggambarkan ketidakmampuan membayar utang diproses secara pidana, bertentangan dengan asas legalitas dan perlindungan hukum sesuai yang tertuang dalam Pasal 19 ayat (2) UU No. 39 Tahun 1999 tentang HAM. Penulis menemukan bahwa perlindungan hukum bagi debitur yang beritikad baik masih lemah. Kesimpulannya, diperlukan pembaharuan hukum untuk membedakan secara tegas antara wanprestasi dan penipuan, sehingga mencegah kriminalisasi debitur yang beritikad baik. Regulasi yang lebih komprehensif juga diperlukan untuk memperkuat perlindungan terhadap debitur Kata Kunci: Wanprestasi, Penipuan, perlindungamn Hukum, Pembaharuan Hukum.

Abstract

Kehadiran anak dalam keluarga membawa kebahagiaan dan tanggung jawab bagi orang tua untuk melindungi kekerasan, termasuk kekerasan seksual. Budi Satria divonis bebas menunjukan lemahnya pelaksanaan undang-undang perlindungan anak dan pentingnya penguatan penegakan hukum, terutama dalam kasus kekerasan seksual yang minim saksi dan alat bukti. Penelitian ini menggunakan metode hukum normatif dengan fokus pada asas legalitas berdasarkan perkara pada Putusan No. 36/PID.SUS/2023/PN/LBB. Kajiannya mencakup norma hukum sebagai acuan perilaku masyarakat. Perlindungan anak dari kekerasan seksual, khususnya oleh ayah kandung membutuhkan perhatian serius dari pemerintah, lembaga non-pemerintah, dan masyarakat. Undang-Undang Nomor 35 tahun 2014 tentang Perlindungan Anak mengatur perlindungan tambahan kepada pelaku. Karena alat bukti dinilai secara memadai, vonis bebas pelaku dianggap tidak sesuai. Perlindungan hukum untuk anak-anak yang menjadi korban kekerasan seksual oleh orang tua mereka perlu diperkuat karena celah hukum dan tantangan pembuktian sering menghambat keadilan. Perlunya revisi hukum, sosialisasi, dan kolaborasi antar lembaga untuk menciptakan lingkungan yang aman bagi anak.

Abstract

This experimental research was motivated by the low Arabic learning motivation in class VIII MTsN 9 Bantul which was caused by the use of monotonous learning methods. This study aims to find out students' Arabic learning motivation after the application of Grammatical Hunting language educational game method and to compare the Arabic learning motivation of the experimental class and the control class. This study used a quasi-experimental research type. The sample of this research was students of class VIII B and VIII C of MTsN 9 Bantul Yogyakarta consisting of 60 students. Data were collected through observation, interviews, questionnaires, and documentation. The results of this study indicated that: 1) The student's Arabic learning motivation increased after the application of Grammatical Hunting language educational game method based on the results of the paired sample t-test with a significance value of 0.000 < 0.05, Ha was accepted. 2) There was a significant difference in the learning motivation of the experimental class and the control class, based on the results of the independent sample t-test with a significance value of 2.042 ≥ 2.001, Ha was accepted. This method could increase students' motivation to learn Arabic. This study contributed to the use of varied learning methods, so that qawā'id learning would become an enjoyable learning.

Abstract

One of the problems in the implementation of the Constitution of the Republic of Indonesia No. 8 of 2016 Article 6 Paragraph 10 concerning equal rights to education for people with disabilities is the absence of Arabic language learning media that can be accessed by the visually impaired. Therefore, learning media that suits their needs is needed, using relevant materials and approaches, especially the CBI (Content-Based Instruction) approach. This study aims to develop and evaluate CBI-based Arabic language learning media for visually impaired students at MAN 2 Sleman Yogyakarta. Research and development (R&D) methods with a quantitative approach were used, involving expert evaluations and effectiveness tests on grade 10 students. Data is collected through tests, questionnaires, interviews, observations, and documentation. The media results developed are in the form of an Android-based application with audio features from native speakers, including three chapters of material and practice questions. The analysis of pre-test and post-test scores with paired sample T-test and N-Gain showed an improvement in students' Arabic language skills, with a significance value of 0.037 and an N-Gain score of 62.57%.

Abstract

The speed of information and communication technology development influences the transition of all human life in various ways, including in education. These various development media are incomplete if there are no things that make it easier for everyone to access learning. One media that can facilitate learning, especially learning Arabic, is E-learning based on the Learning Management System (LMS). This study adopts R&D research (research and development) with five stages: analysis, design, development, implementation and evaluation. The trial (implementation stage) was carried out on class XI students at the Muhammadiyah Boarding School Modern Islamic Boarding School in Yogyakarta, with a total of 42 students. The research results are in the form of learning media products of Learning Management System (LMS) based on the Book of Al-̒Arabiyah Li An-Nāsyi'īn for class XI students at the Muhammadiyah Boarding School Modern Islamic Boarding School, Yogyakarta, which can be accessed on the website https://mbs-yogya.ucm.ac.id/courses/11-tamrin-lughoh. The validation results from media experts obtained a feasibility of 92 in the very feasible category, while material experts were 86 in the very feasible category. As for the trials from the students, the results were 92.56 with a very decent category and 86 with a very decent category from the teachers.Keywords: Development, Learning Media, Learning Management System, Al-̒Arabiyah Li An-Nāsyi'īn̒

Abstract

Gender is the difference of men and women in the role, function, right, responsibility and behavior which is made by social and cultural value, and tradition. Gender bias is the circumstance that indicates male attitude more than female. This article is intended to determine gender bias in the book of Arabic class X that is written and based on a scientific approach as the curriculum characteristic in 2013. Student Books which are used as the principal teaching materials by their teacher, are very important in supporting the learning process.The findings of data analysis show that it has still been happening gender bias in the book in the form of pictures and texts.

Abstract

Penelitian ini bertujuan untuk mengkaji model edupreneurship yang diterapkan oleh Akadimiya Pro, sebuah lembaga nonformal berbasis digital yang menyediakan layanan akademik bagi mahasiswa. Fokus utama penelitian adalah menganalisis inovasi layanan, strategi operasional, serta kontribusi lembaga terhadap keberhasilan akademik mahasiswa. Penelitian ini menggunakan pendekatan kualitatif dengan jenis studi kasus. Teknik pengumpulan data dilakukan melalui wawancara mendalam, observasi, dan dokumentasi, yang kemudian dianalisis menggunakan teknik tematik untuk menggali pola layanan, strategi, serta dampaknya secara komprehensif. Hasil penelitian menunjukkan bahwa Akadimiya Pro berhasil mengembangkan model edupreneurship yang adaptif dan responsif terhadap kebutuhan mahasiswa, melalui layanan seperti bimbingan skripsi, olah data, paraphrase, serta publikasi jurnal. Strategi digital yang diterapkan mencakup pemanfaatan WhatsApp untuk komunikasi layanan, serta Instagram dan TikTok untuk promosi dan edukasi akademik berbasis konten pendek. Selain itu, pendekatan personal antara mentor dan peserta turut meningkatkan efektivitas layanan. Akadimiya Pro terbukti memberikan dampak positif terhadap pencapaian akademik mahasiswa, termasuk peningkatan kepercayaan diri, keterampilan akademik, dan efektivitas waktu studi; salah satunya ditunjukkan oleh estimasi 70% peserta yang berhasil menyelesaikan studi tepat waktu. Temuan ini mengindikasikan bahwa edupreneurship dalam bentuk layanan akademik informal berpotensi menjadi alternatif solusi atas keterbatasan pendampingan di lingkungan pendidikan formal.

Abstract

Background: First-semester students in the Arabic Language Education program often struggle with pronouncing complex Arabic phonemes in the al-Ashwat wa al-Lahjat course. Aims: This study aims to identify the phonemes that pose pronunciation difficulties, examine the effectiveness of song-based media in enhancing students' phonetic accuracy, and explore students' perceptions of using songs in learning. Methods: A qualitative case study approach was employed, involving 35 first-semester students from Class C of the Arabic Language Education Program at UIN Sunan Kalijaga Yogyakarta. Data were collected through participant observation and focus group discussions (FGDs). Results: The findings revealed that integrating song media, including hijaiyyah letter songs to identify problematic phonemes and Asmaul Husna songs to facilitate pronunciation practice, significantly enhances students' phonetic articulation. The most challenging phonemes identified were ع ('ain), ص (shad), ض (dhad), غ (ghin), ظ (dhadz), خ (kha), ث (tsa), ح (ha), ق (qaf), ش (shin), and ط (tha). Furthermore, song-based learning fosters an engaging and enjoyable learning environment, enhances motivation, and promotes collaborative learning. Implications:  These findings indicate that song media can be an effective pedagogical tool for enhancing Arabic phonetic instruction by improving students’ pronunciation accuracy, fostering engagement, and creating a more interactive and enjoyable learning environment.

Abstract

This study aims to describe the role of Al-Mumtaz Textbook in teaching Arabic to non-specialist (non-Arab) learners from philosophical, theoretical, and practical perspectives, and to analyze its contribution to the development of the four main language skills: listening, speaking, reading, and writing. The research employs a qualitative approach with a descriptive-analytical design. The primary data were obtained through documentation and content analysis of Al-Mumtaz Textbook, which is used in Arabic language instruction for non-native speakers. The population of this study includes the entire content of Al-Mumtaz Textbook, which comprises several volumes and is widely used in various educational institutions in Indonesia, particularly at the elementary and non-formal education levels. The sampling technique used was purposive sampling, focusing on the first and second volumes that beginners commonly use. The sample consists of sections of the book containing language skill exercises and their instructional presentation. Data was collected through documentation. Data analysis was conducted using a qualitative descriptive method, based on the Miles and Huberman model, which includes data reduction, data display, and conclusion drawing. The findings reveal that Al-Mumtaz Textbook significantly contributes to the gradual and contextual development of students' language skills. Its communicative approach and real-life-based exercises have also proven effective in increasing students’ confidence in using Arabic. Therefore, this book is considered a valuable primary reference for Arabic language instruction for non-specialist learners at various educational levels.
