Abstract

Constitutional Court’s decision on the rights of children who were born out of wedlock causes various controversies. On the one hand, it is considered as a positive decision for children’s benefit and their future. On the other hand, it is considered also as a negative decision by legalizing unregistered marriage. Using a field research and qualitative approach, this research produces a conclusion that four of respondents from  different  background  of  organizations  agree  with  this  constitutional  court decision if the intended object is the children from Sirri (unregistered) marriage. Furthermore, one respondent agrees if this decision becomes a guideline and no longer a phenomenon. The most important message from informants is a recommendation that Constitutional Court not to issue another ambiguous fatwa and this institution is capable to make a humanist decision and remains in the corridors of the religious demands that have been rooted in the community. Keputusan  mahkamah  konstitusi  tentang  hak  anak  diluar  nikah  menimbulkan  berbagai macam kontroversi. disatu pihak keputusan tersebut dianggap positif untuk kemaslahatan anak  dan  masa  depan  mereka,  dan  di  lain  pihak  keputusan  tersebut  dianggap  negative karena melegalkan pernikahan dibawah tangan. Dalam penelitian yang menggunakan jenis penelitian field research dengan pendekatan kualitatif ini menghasilkan suatu kesimpulan bahwa empat responden dengan latar belakang organisasi yang berbeda menyatakan setuju dengan keputusan MK tersebut jika yang dimaksud adalah anak hasil pernikahan sirri. Dan satu responden menyatakan setuju jika keputusan tersebut menjadi sebuah pedoman bukan lagi fenomenal. Pesan terpenting dari para informan adalah himbauan agar MK tak  lagi  mengeluarkan  suatu  fatwa  yang  ambigu  dan  mampu  menciptakan  keputusan yang  humanis  dan  tetap  dalam  koridor  tuntutan  keagamaan  yang  telah  mengakar  di masyarakat.

Abstract

History of judiciary power in Indonesia judicial institutions is quite long and dilemmatic. The political situation in Indonesia has a major impact on the existence of judicial institutions. Independence of judiciary power is not met a demand for years. It is proved by the interventions of extra-judicial government institutions  to judicial institutions. The Supreme Court, as Indonesia's top court, at first has supervised General Courts, Religious Courts, State l Administration Court and the Military Courts only in judicial technical. Meanwhile, for non-judicial technical matters, those judicial institutions have been supervised by each government departments respectively. But with the enactment of Act No. 35 Year 1999 on Amendment of Act No. 14 Year 1970, which was enhanced by Act No. 4 Year 2004 on Judiciary Power, cultivation of non-judicial technical in those judicial institutions, including Religious Court have been held by the Supreme Court.Sejarah kekuasaan kehakiman lembaga-lembaga peradilan di Indonesia cukup panjang dan  dilematik. Situasi politik yang bergolak di Indonesia, berpengaruh besar terhadap eksistensi lembaga-lembaga peradilan. Independensi kekuasaan kehakiman tidak terpenuhi selama bertahun-tahun. Terbukti dengan banyaknya intervensi lembaga pemerintah ekstra-yudisial terhadap lembaga peradilan.Mahkamah Agung, sebagai puncak peradilan di Indonesia, pada mulanya  hanya membina Peradilan Umum, Peradilan Agama, Peradilan Tata Usaha Negara dan Peradilan Militer secara teknis yudisial saja. Untuk urusan teknis non-yudisial,pembinaan lembaga-lembaga peradilan tersebut dibawah naungan departemen pemerintahan masing-masing. Namun seiring diundangkannya Undang-Undang Nomor 35 Tahun 1999 tentang Perubahan Atas Undang-Undang Nomor 14 Tahun 1970, yang kemudian disempurnakan dengan Undang-Undang Nomor 4 Tahun 2004 tentang Kekuasaan Kehakiman, pembinaan teknis non-yudisial lembaga-lembaga peradilan, termasuk Pengadilan Agama dipegang oleh Mahkamah Agung.Keywords: Sistem Satu Atap, Mahkamah Agung, Pengadilan Agama.

Abstract

Small Claim Court is one of the efforts of the Supreme Court of the Republic of Indonesia to reduce the accumulation of cases in court. This article seeks to describe the small claim court model as an alternative to the settlement of cases in the Religious Courts to realize the principle of quick, simple, and low-cost perspective of John Rawls's theory of justice. This article originates from doctrinal law research from the statutory approach, the comparative approach, the conceptual approach. The results of this study indicate that a small claim court can reduce the accumulation of cases in a religious court. The application must meet two criteria; namely, the disputed nominal does not exceed 200 million and does not require complicated verification. As regulated in the Republic of Indonesia Supreme Court Regulation No. 2 of 2015.Small Claim Court merupakan salah satu upaya Mahkamah Agung Republik Indonesia untuk mengurangi penumpukan perkara di pengadilan. Artikel ini berupaya mendeskripsikan model small claim court sebagai alternatif penyelesaian perkara di Pengadilan Agama untuk mewujudkan asas cepat sederhana dan biaya ringan perspektif teori keadilan John Rawls. Artikel ini berasal penelitian hukum doktrinasi dengan dari pendekatan perundang-undangan (statute approach), pendekatan perbandingan (comparative approach), pendekatan konseptual (conceptual approach). Hasil penelitian ini menunjukkan bahwa small claim court dapat mengurangi penumpukan perkara di pengadilan agama. Penerapannya harus memenuhi dua kriteria, yaitu nominal yang disengketakan tidak melebihi angka 200 juta dan tidak memerlukan pembuktian yang rumit. Sebagaimana diatur dalam Peraturan Mahkamah Agung Republik Indonesia Nomor 2 Tahun 2015.Kata Kunci: small claim court; pengadilan agama; keadilan.

Abstract

Abstract: Religious Court is a judicial environment under the Supreme Court as a perpetrator of judicial power independent of organizing religious court to enforce the law and justice. The implementation of a small claim court in religious courts following simple, quick, and low-cost principles. The Small Claims Court is a simple judicial mechanism outside of the regular judicial mechanisms to resolve disputes quickly and cost lightly. The purpose of this study was to determine the meaning of the principle of fast, simple, and low cost and the legal politics of applying a simple lawsuit in a religious court. This type of research is normative legal research with a statutory approach and a conceptual approach. The technique of analyzing legal materials uses prescriptive. The study results found that the principle of simple, fast, and low cost in religious courts must meet the expectations of justice seekers who always want a speedy, fair, and low-cost trial. Applying the principle of a simple, fast, and low-cost justice has an intrinsic value of justice, inseparable from the service function. The legal politics of implementing a small claims court in a religious court is a breakthrough step, the proceedings are also fast and inexpensive, decided by a single judge, and the trial mechanism is simple So that implementation of Small Claims Court will be able to help the dispute burden in religious courts.Keywords: legal policy; small claim court, religious court.Abstrak: Peradilan Agama adalah lingkungan peradilan di bawah Mahkamah Agung sebagai pelaku kekuasaan kehakiman yang mandiri menyelenggarakan peradilan agama untuk menegakkan hukum dan keadilan. Penyelenggaraan sidang gugatan kecil di pengadilan agama menganut asas sederhana, cepat, dan murah. Small Claims Court adalah mekanisme peradilan sederhana di luar mekanisme peradilan biasa untuk menyelesaikan sengketa dengan cepat dan biaya ringan. Tujuan penelitian ini adalah untuk mengetahui pengertian asas cepat, sederhana, dan biaya rendah serta politik hukum penerapan gugatan sederhana di pengadilan agama. Jenis penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik analisis bahan hukum menggunakan metode preskriptif. Hasil penelitian menemukan bahwa asas sederhana, cepat, dan biaya rendah dalam peradilan agama harus memenuhi harapan para pencari keadilan yang selalu menginginkan peradilan yang cepat, adil, dan berbiaya rendah. Penerapan asas peradilan sederhana, cepat, dan berbiaya rendah memiliki nilai keadilan yang hakiki, tidak terlepas dari fungsi pelayanan. Politik hukum pelaksanaan peradilan gugatan kecil di pengadilan agama merupakan langkah terobosan, proses beracara juga cepat dan murah, diputuskan oleh hakim tunggal, dan mekanisme persidangan sederhana Sehingga pelaksanaan peradilan gugatan kecil akan dapat membantu beban sengketa di pengadilan agama.Kata Kunci: kebijakan hukum; small claim courts; pengadilan agama.

Abstract

Abstract: This strategy to overcome child marriage in Malang Regency is important because the number of child marriages is increasing. This research was conducted in a sociological juridical manner located at the Office of Women's Empowerment and Child Protection (DP3A) Malang Regency and at the Malang Regency Religious Office. Data were collected by interview method and analyzed by content analysis. From the research conducted, it can be concluded that the Constitutional Court's Decision No. 22/PUU-XV/2017 which was followed up by Law no. 16 of 2019 concerning Amendments to Law No. 1 of 1974 concerning Marriage, which raised the marriage age limit for women from 16 years to 19 years, especially in Malang Regency, has not succeeded in solving the problem and has caused its own probematics, namely the number of applications for marriage dispensation to the Malang Regency Religious Court is increasing. The strategy taken in tackling child marriage from the perspective of the masahah theory is by socializing marriage maturity through madrasas, conducting marriage guidance in each District KUA, Establishing a Counseling Information Center (PIK) as an effort to reproductive health, Providing kid genre props, Formation of human beings genre and genre ambassadors, and dissemination of reproductive health education. Another strategy is to empower the role of the family through parental supervision, as well as improve the quality of formal education for students.Keywords: child marriage; maslahah; health education.   Abstrak: Strategi penanggulangan perkawinan anak di Kabupaten Malang ini penting dilakukan karena perkawinan anak semakin bertambahnya jumlahnya. Penelitian ini dilakukan secara yuridis sosiologis yang berlokasi di Kantor Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DP3A) Kabupaten Malang dan di Kantor Agama Kabupaten Malang. Pengambilan data dilakukan dengan metode wawancara dan menganalisisnya dengan content Analisys. Dari penelitian yang dilakukan di dapat bahwa Putusan MK No. 22/PUU-XV/2017 yang ditindak lanjutin dengan UU No. 16 Tahun 2019 tentang Perubahan UU No. 1 Tahun 1974 tentang Perkawinan, yang menaikkan batas usia perkawinan bagi perempuan yang semula 16 tahun menjadi 19 tahun khususnya di Kabupaten Malang belum berhasil menyelesaikan masalah dan menimbulkan probematika tersendiri, yaitu jumlah permohonan dispensasi nikah ke Pengadilan Agama Kabupaten Malang semakin bertambah banyak. Strategi yang dilakukan dalam menanggulangi perkawinan anak perspektif teori masahah adalah dengan dengan melakukan sosialisasi pendewasaan perkawinan lewat madrasah, melakukan bimbingan perkawinan di masing-masing KUA Kecamatan, Pembentukan Pusat Informasi Konseling (PIK) sebagai upaya kesehatan reproduksi, Pemberian alat peraga genre kid, Pembentukan insan genre dan duta genre, dan sosialisasi penyuluhan kesehatan reproduksi. Strategi lainnya yang dilakukan adalah dengan pemberdayaan peran keluarga melalui pengawasan orang tua, serta peningkatan kualitas pendidikan formal bagi peserta didik.Kata Kunci: perkawinan anak; maslahah; pendidikan kesehatan.

Abstract

Protection for children separated from their parents, particularly due to parental incarceration, is a pressing issue in Indonesia that demands serious attention. The absence of parental support and guidance places these children in vulnerable situations, negatively impacting their physical, emotional, and social well-being. This study examines the importance of legal and social protection for these children and explores the role of the state and government in providing adequate protection and welfare guarantees. Previous research reveals gaps in integrating Islamic legal principles with child protection policies that are contextual and relevant to contemporary social challenges. This article presents a review of key Islamic legal concepts related to child protection, such as maslahah mursalah, and integrates them with international human rights standards, such as the Convention on the Rights of the Child (CRC). Employing an empirical approach, the study investigates the implementation and practical outcomes of child protection laws. Primary data were gathered through interviews and observations involving key stakeholders, complemented by secondary data from books, journal articles, and legislative documents, including the Child Protection Act. The findings reveal that children separated from incarcerated parents often face neglect, discrimination, and social vulnerability. A case study of the Women’s Prison Class II A in Malang City highlights inadequate child protection measures due to insufficient government funding, which hampers the effective delivery of developmental and protective services for these children. To address these challenges, stronger regulatory frameworks and increased budgetary support are essential. Enhancing the role of the state in implementing robust policies will not only ensure the welfare of affected children but also set a standard for societal participation in fostering healthy, discrimination-free environments. Such measures are critical for safeguarding the rights and development of these vulnerable children.
