Abstract

ABSTRAKPemerintah saat ini aktif mendorong konversi kendaraan listrik seiring dengan komitmen Indonesia dalam Perjanjian Paris dan Tujuan Pembangunan Berkelanjutan (SDGs) PBB. Langkah nyatanya adalah dengan diterbitkannya Peraturan Presiden Nomor 55 Tahun 2019 tentang Percepatan Program Kendaraan Bermotor Listrik Berbasis Baterai. Untuk mendukung hal itu, pemerintah telah mengalokasikan anggaran subsidi sebesar Rp1,4 triliun guna memberikan potongan biaya konversi sepeda motor sebesar Rp7 juta per-unit. Namun, percepatan program ini akan sulit tercapai bila hanya mengandalkan anggaran yang bersumberkan dari negara. Oleh karena itu, diperlukan pengembangan skema pembiayaan alternatif. Penelitian ini menawarkan green bond (obligasi hijau) sebagai salah satu solusinya, dengan fokus menganalisis aspek yuridis dan arah kebijakannya untuk pembiayaan konversi kendaraan listrik. Metode yang digunakan adalah penelitian hukum dengan pendekatan perundang-undangan, konseptual, perbandingan, dan analisis ekonomi hukum (economic analysis of law). Hasil penelitian menunjukkan bahwa green bond layak dijadikan skema pembiayaan karena sesuai dengan POJK No. 18 Tahun 2023. Aturan ini menyatakan bahwa dana green bond dapat dialokasikan untuk kegiatan usaha berwawasan lingkungan, termasuk transportasi ramah lingkungan seperti kendaraan listrik. Kedepan, diperlukan peran serta pemerintah, OJK, dan sektor terkait melalui pemberian insentif untuk mengoptimalkan potensi instrumen keuangan ini.Kata kunci: green bond; konversi; kendaraan listrik. ABSTRACTThe government is currently implementing measures to encourage the conversion of electric vehicles, in accordance with Indonesia's commitment to the Paris Agreement and the UN Sustainable Development Goals (SDGs). The pivotal step in this process is the issuance of Presidential Regulation Number 55 of 2019, which pertains to the Acceleration of the Battery-Based Electric Motor Vehicle Program. In order to provide support for this initiative, the government has allocated a subsidy budget of Rp 1.4 trillion to provide a discounted motorcycle conversion fee of Rp 7 million per unit. Nevertheless, the acceleration of this programme may encounter challenges if it is contingent on state budgetary resources alone. Consequently, there is an imperative to devise alternative financing schemes. This research posits green bonds as a potential solution, with a particular emphasis on the analysis of legal aspects and policy directions for financing the conversion of electric vehicles. The methodology employed in this study is legal research, encompassing statute, conceptual, comparative, and economic analysis of law approaches. The findings indicate that green bonds are a viable financing scheme, as they are in alignment with POJK No. 18 of 2023. The regulation stipulates that financial resources allocated to green bond funds may be utilised for environmentally sound business activities, including the promotion of environmentally friendly transportation methods, such as electric vehicles. In order to optimise the potential of this financial instrument, it is essential that the government, OJK, and related sectors participate in future initiatives by providing incentives.Keywords: conversion; electric vehicle; green bond.

Abstract

Narkoba merupakan salah satu permasalahan serius yang mengancam generasi muda, khususnya Gen Z yang rentan terhadap pengaruh lingkungan dan tekanan teman sebaya. Sosialisasi gerakan anti narkoba menjadi langkah strategis untuk meningkatkan kesadaran dan pengetahuan siswa mengenai bahaya narkoba serta membangun sikap preventif sejak dini. Kegiatan pengabdian kepada masyarakat yang dilakukan oleh dosen dan mahasiswa Universitas Wijaya Putra ini dilaksanakan di SMA Ta’miriyah Surabaya dan SMK Penerbangan Dharma Wirawan 05 Sidoarjo dengan tujuan meningkatkan pemahaman siswa tentang pentingnya peran serta dalam gerakan anti narkoba. Melalui penyuluhan, diskusi interaktif, dan distribusi materi edukatif, diharapkan siswa mampu memahami konsekuensi penggunaan narkoba serta mengembangkan sikap penolakan terhadap narkoba. Hasil kegiatan menunjukkan adanya peningkatan pengetahuan dan kesadaran siswa tentang bahaya narkoba serta pentingnya sosialisasi gerakan anti narkoba sebagai upaya pencegahan sejak dini. Kegiatan ini diharapkan dapat menjadi langkah awal dalam menciptakan lingkungan sekolah yang bebas dari narkoba dan membentuk generasi yang sehat, cerdas, dan berdaya saing.

Abstract

This article examines the legal synchronization of social bond issuance as an alternative financing instrument for the fulfillment of affordable housing needs in Indonesia. The central issue of this study is the lack of alignment between social bond regulations and affordable housing provisions, which hinders the achievement of sustainable urban development. The objective of this research is to formulate a juridical basis capable of harmonizing social bond requirements with affordable housing targets. This study employs normative legal research through statutory and conceptual approaches. The results indicate that the provisions of POJK 18/2023 on social bonds are not yet aligned with affordable housing regulations contained in Government Regulation 12/2021, Government Regulation 21/2024, and Regulation of the Minister of Public Works and Housing 7/2022, creating obstacles to effective implementation. A horizontal synchronization model is required to harmonize these regulatory frameworks, particularly to support economic equalization under the Asta Cita Program designated as a National Priority in the National Medium-Term Development Plan 2025–2029. The study concludes that regulatory synchronization is essential to ensure the effectiveness of social bonds as a financing instrument for affordable housing in Indonesia.

Abstract

Corporate Social Responsibility (CSR) or Social and Environmental Responsibility (TJSL) constitutes a legal obligation imposed on companies as part of their responsibility toward society and the environment. Normatively, CSR regulation in Indonesia is directed toward limited liability companies, particularly those operating in sectors related to natural resource utilization. However, recent developments have raised legal questions about the implementation of CSR-like programs by Bank Indonesia, an independent state institution. This study employs normative legal research using statute, conceptual, and case approaches. The findings demonstrate that CSR or TJSL obligations are explicitly regulated under Law No. 40 of 2007 concerning Limited Liability Companies, Government Regulation No. 47 of 2012, and the Minister of State-Owned Enterprises Regulation No. PER-05/MBU/04/2021. Conversely, Bank Indonesia is governed by Law No. 23 of 1999 as amended by Law No. 6 of 2009 and is not a corporate entity subject to CSR obligations. From an administrative law perspective, the absence of explicit attribution of authority indicates that the implementation of CSR by Bank Indonesia exceeds its statutory mandate. This study highlights the normative boundaries of administrative discretion and contributes to legal discourse by examining CSR practices within non-corporate state institutions.

Abstract

The integration of international legal principles and standards into Indonesian regulations has expanded significantly, particularly within the field of contemporary law. A notable area of development is the regulation of green bonds as a sustainable financing instrument in Indonesia, which is guided by principles formulated by the International Capital Market Association (ICMA) and standards established by the ASEAN Capital Market Forum (ACMF). This study examines how legal frameworks and the legal justification for adopting international standards are applied to green bond regulation in Indonesia and the Philippines. The research adopts a normative legal approach, employing statutory, conceptual, and comparative methods. Its objective is to identify the applicable regulations and to analyze the rationale underlying the incorporation of international principles and standards in green bond governance in both countries. The findings reveal that green bond regulation in Indonesia under POJK 18/2023 and in the Philippines under SEC Memorandum Circular No. 12, Series of 2018, represents a harmonization of ICMA’s Social Bond Principles with the ASEAN Social Bonds Standards. From an international law perspective, the use of ACMF standards is grounded in the Vienna Convention on the Law of Treaties 1986, reflecting a theoretical inclination toward universalist protectionism.
