Abstract

The purpose of this research is to understand the legal consequences of the dissolution of cooperatives that are declared bankrupt. In addition, this article discusses much more, related to the responsibilities of cooperative management for the dissolution of cooperatives, declared bankrupt. The method used in this study is a normative legal research method with a conceptual and legal approach with primary and secondary legal sources. The results of this study indicate that cooperatives have filed for bankruptcy because of their financial condition and their property is generally confiscated and cooperatives can be declared bankrupt and terminated by a decision by the government and a commercial judge. The legal consequences drawn by the Management of cooperatives for the liquidation of cooperatives that are declared bankrupt include: Bankruptcy is carried out at a meeting of cooperative members and lawsuits, Permission to complete the dissolution in other matters remains valid Dissolution of cooperatives by government decision, and there is no authority from the management to carry out dissolution . The management of the cooperative, in this case, is responsible individually or jointly for the losses of the cooperative where the cooperative management clearly fulfills the obligations of the cooperative management who acts intentionally or negligently

Abstract

This research is a conceptual study that aims to analyze the form of legal protection for workers who break their employment before the contract period ends by using the logic of deductive thinking with a statutory approach (statute approach). by relying on the concepts of its incarnation, views or doctrines that have existed with legal materials accessed through the internet after the enactment of Law No. 11 of 2020 concerning Job Creation. The results show that the government's constitutional obligation not only provides the widest possible employment for citizens, but also obliges to provide legal protection to every citizen to get fair treatment in the employment relationship.  In the context of the provision of the rights of workers who break the employment relationship before the contract period ends if the termination of employment at the will of the employer, then the employer is obliged to pay compensation to the worker in the form of wages whose amount is calculated from the termination of the employment relationship until the end of the contract period and vice versa if the termination of employment on the will of the worker then the worker  Must pay to the employer in the form of compensation in the amount of wages that will be received by workers from the will of termination of employment until the expiration of the contract period and the company is obliged to pay compensation to workers for the  termination of the employment since  a certain time employment agreement has been implemented by the worker.Keywords: Legal Protection; Contract Worker; Termination of Employment

Abstract

This study examines the effects of supplier collaboration, transportation efficiency, technology adoption, and market demand on the distribution efficiency and profitability of the pumpkin seed supply chain in Indonesia. Using a quantitative approach, data were collected from 150 respondents involved in the supply chain, including suppliers, distributors, and logistics providers. The data were analyzed using Structural Equation Modeling-Partial Least Squares (SEM-PLS 3). The findings reveal that supplier collaboration, transportation efficiency, and technology adoption significantly enhance distribution efficiency, which in turn positively impacts profitability. Market demand was also found to moderate the relationship between distribution efficiency and profitability, particularly during periods of high demand. These findings underscore the importance of fostering collaboration, optimizing transportation, and adopting technology to improve the supply chain’s operational performance and financial outcomes. The study provides valuable insights for practitioners and policymakers aiming to enhance the agricultural supply chain's competitiveness and sustainability in Indonesia.

Abstract

This study explores the legal harmonization of cross-border trade regulations and dispute settlement mechanisms within the BRICS bloc, comprising Brazil, Russia, India, China, and South Africa. With diverse legal traditions and economic priorities, BRICS nations face significant challenges in aligning their legal frameworks to foster seamless trade and effective dispute resolution. Using a normative juridical approach, this research examines regulatory disparities, existing dispute resolution mechanisms, and the potential for harmonization. The findings highlight key barriers, such as fragmented legal systems, inconsistent enforcement, and limited institutional capacity, while proposing actionable strategies, including standardized tariff systems, mutual recognition agreements, and the establishment of a centralized arbitration body. By addressing these issues, the study underscores the importance of legal alignment for enhancing economic integration and strengthening BRICS' position in global trade.

Abstract

This study explores the legal frameworks, enforcement challenges, and economic implications of Intellectual Property Rights (IPR) in BRICS countries—Brazil, Russia, India, China, and South Africa—using a normative juridical approach and qualitative analysis. The findings reveal significant disparities in the governance of IPR among these nations, with China and India leading in innovation and enforcement reforms, while Brazil, Russia, and South Africa face persistent challenges related to institutional capacity and judicial delays. Despite progress in aligning with international standards such as TRIPS, enforcement gaps and socio-economic priorities influence the effectiveness of IPR systems. The study also highlights the dual economic impact of IPR: fostering innovation and investment while raising concerns over access to essential goods. This research underscores the need for harmonized frameworks, enhanced enforcement mechanisms, and a balanced approach to innovation and equity in BRICS countries.

Abstract

Karena dirumuskan dengan metode omnibus law, UU Cipta Kerja dipercaya bisa menyembuhkan obesitas regulasi dan peraturan perundang-undangan. UU Cipta Kerja hadir sebagai simplifikasi regulasi agar terjadi pemangkasan birokrasi (baik untuk pelayanan investasi maupun UMKM) dan akselerasi pemulihan ekonomi nasional pada periode pandemi. Namun setelah putusan MK tentang UU tersebut dibacakan, UU Cipta Kerja dinilai bermasalah. Tujuan penelitian ini adalah menganalisis kedudukan dan kekuatan hukum UU Cipta Kerja setelah dikeluarkannya putusan MK di atas. Penelitian ini dilaksanakan dalam desain penelitian hukum normatif yang menggunakan data dari bahan hukum primer maupun sekunder. Berdasarkan hasil analisis komprehensif terhadap bahan-bahan tersebut, penelitian ini menyoroti beberapa temuan penting berikut: (a) UU Cipta Kerja masih berlaku, tetapi tidak bisa diterapkan, (b) ada semacam keharusan bagi pemerintah untuk menginstruksikan Menhukham membenahi UU Cipta Kerja agar pembentukannya sesuai dengan UU No. 12 tahun 2011, dan (c) Menhukham memiliki alternatif lain berupa penambahan metode omnibus pada UU No. 12 tahun 2011.

Abstract

This paper provides a normative juridical analysis of Indonesia's carbon trading regulations, with a focus on environmental justice and fairness. It examines the legal framework established by Presidential Regulation No. 98 of 2021, which governs carbon pricing mechanisms, including carbon taxes and carbon credit trading. The analysis highlights key gaps in the regulation, particularly in terms of equitable benefit distribution and inclusion of vulnerable communities in decision-making processes. While Indonesia's carbon trading system aligns with global trends and its international obligations, significant improvements are needed to ensure that marginalized groups are not further disadvantaged. Recommendations include the redistribution of carbon trading revenues, enhanced public participation, stronger enforcement mechanisms, and alignment with international best practices.

Abstract

Salah satu sasaran Pengabdian kepada Masyarakt ini adalah meningkatkan efektivitas UMKM Desa Pengalangan yang terletak pada Kabupaten Gresik memiliki beragam UMKM yang berperan dalam mendukung perekonomian lokal dan kesejahteraan masyarakat. Pengembangan produksi, pengemasan, dan pemasaran merupakan suatu hal yang dapat ditawarkan untuk mengembangkan suatu usaha termasuk UMKM. Dari hasil observasi di lapangan, terdapat beberapa UMKM di Desa Pengalangan yang belum mendapatkan pengetahuan tentang pentinganya pengembangan dari proses produksi, pengemasan, dan pemasaran. Latar belakang masalah: 1)UMKM menghadapi kesulitan untuk mencari pasar yang stabil dan pelanggan yang memadai, pembinaan untuk membantu UMKM memasarkan produk dan layanan; 2)UMKM seringkali menghadapi kekurangan keterampilan manajemen dan teknis, program pelatihan, dan pendidikan dalam menjalankan bisnis; 3)UMKM yang tidak memiliki akses atau keterampilan dalam mengadopsi teknologi terkini dapat tertinggal dalam persaingan program digitalisasi; 4)UMKM perlu mendapatkan perlindungan hukum terhadap hak kekayaan intelektual, merek dagang, dan sertifikat halal. Tujuan program ini: 1)Supaya UMKM dapat meningkatkan daya saingnya, memperluas pasar, dan memberikan kontribusi yang lebih besar bagi perekonomian; 2)Supaya UMKM dapat meningkatkan kualitas manajemennya, memperkuat keterampilan teknisnya, dan pada akhirnya meningkatkan daya saingnya; 3)Supaya UMKM dalam mengadopsi teknologi dan meningkatkan daya saing mereka; 4)Supaya UMKM dapat tumbuh dan berkembang secara berkelanjutan, meningkatkan daya saing, dan memberikan kontribusi yang lebih besar bagi perekonomian nasional. Metode pelaksanaan 1)Pendekatan melalui Bapak Lurah dan pengurus desa setempat dalam pelaksanaan PkM; 2)Melakukan koordinasi pada pemilik UMKM; 3)Melakukan pelatihan pada pengembangan produksi, pengemasan, dan pemasaran pada pemilik UMKM; dan 4)Melakukan evaluasi secara berkala pada program pelatihan dan pendampingan terhadap UMKM. Hasil kegiatan 1)UMKM mengikuti kegiatan pelatihan dan pendampingan secara optimal, memproduksi produk yang higienis, pengemasan produk yang tampilannya menarik, bertahan lama, dan pengambilan foto produk yang menarik; 2)UMKM melakukan pencatatan keuangan secara berkala menggunakan aplikasi keuangan digital; 3)UMKKM melakukan penjualan melalui media digital eCommerce, facebook, Instagram, Grab, dan WhatssApp Business.

Abstract

Era society 5.0 mengubah berbagai paradigma di tengah masyarakat. Tak terkecuali pada bidang profesi advokat. Artikel ini akan membahas hal yang harus dipersiapkan profesi advokat sebagai bagian dari profesi hukum di era Society 5.0. Artikel ini merupakan penelitian normatif berjenis eksploratif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa bila advokat memahami dan menjalankan secara optimal nilai esensial sebagai officium nobile, dapat dikatakan sejalan dengan konsep Society 5.0 yang berorientasi untuk membangun masyarakat dan semangat menyelesaikan permasalahan sosial serta menciptakan keberlanjutan. Salah satunya dengan mengembangkan desain Expert System untuk Praktek Hukum. Pengembangan desain expert system diharapkan mampu menjembatani knowledge gap antara senior lawyer dengan associate. Disamping itu juga untuk memberikan akses layanan pada masyarakat pengguna jasa lawyer melalui hak akses yang diberikan. expert system dalam fungsinya untuk melakukan penelusuran bahan hukum yang akan digunakan untuk melakukan applied legal research, merupakan kulminasi pengalaman dari senior lawyer yang dipadukan dengan bahan-bahan hukum untuk mempersingkat waktu yg dibutuhkan associate dan masyarakat pengguna jasa dalam memahami dan memberikan solusi pada beberapa kasus-kasus hukum tertentu. Pengembangan expert system juga dapat mendukung kerjasama secara kolaboratif beberapa advokat dari berbagai kantor hukum. Wacana pengembangan expert system untuk kepentingan praktek hukum diharapkan akan dapat menciptakan nilai-nilai baru dalam mewujudkan access to justice for all, sebagai goals ke 16 dari Sustainable Development Goals (SDGs).
