Abstract

Penelitian ini dilakukan bertujuan untuk mengetahui perlindungan hukum terhadap anak pelaku turut serta dalam tindak pidana penganiayaan dan penentuan peran turut serta dalam tindak pidana penganiayaan oleh AG (studi kasus penganiayaan oleh anak pegawai Direktorat Jenderal Pajak). Penelitian ini mempunyai latar belakang perlindungan hukum terhadap anak berkonflik dengan hukum yang belum terimplementasi dengan baik. Penelitian ini dibuat menggunakan metode hukum yuridis normatif. Kebaharuan dalam penelitian ini menjelaskan mengenai perlindungan hukum terhadap anak sebagai pelaku turut serta tindak pidana penganiayaan. Temuan dalam penelitian ini adalah UU SPPA mengatur mengenai perlindungan hukum terhadap anak, yaitu pada Pasal 3, Pasal 79 ayat (2), dan Pasal 81 ayat (6) UU SPPA. Berdasarkan ketentuan tersebut, maka anak pelaku turut serta tindak pidana penganiayaan dalam menjalankan proses hukum dapat diperlakukan secara khusus pada hukum acara, menerima ancaman pidana yang berbeda apabila dibandingkan dengan orang dewasa, juga mendapatkan pemenuhan hak anak. Pada kasus penganiayaan oleh anak pegawai Direktorat Jenderal Pajak, peran AG sebagai anak pelaku turut serta tindak pidana penganiayaan telah tepat, tetapi putusan yang diputuskan oleh Hakim dirasa kurang tepat. Seharusnya AG dapat dikenakan asas lex specialis Pasal 76 C jo Pasal 80 ayat (2) UU Perlindungan Anak.

Abstract

Child grooming is a legal issue that has negative consequences for children, especially which in a victimized position. However, there are no regulations in Indonesia that specifically regulate these legal issues. Even while there are positive laws that can be used as a basis for criminalizing groomers, it turns out that law enforcement still faces a number of obstacles. In this case, a normative juridical methodology based on a statute approach, a case approach, a literature approach, a conceptual approach, and a comparison approach was used to conduct the research. Based on research studies, data collection is carried out. This research demonstrates that there are still obstacles to Indonesian child grooming legislation enforcement, which are quite often related to the evidence process. Alternative regulations against child grooming as stated regarding the positive laws above, such as ITE Law, Child Protection Law, and Pornography Law have gaps that have been found to lead to other issues, such as disparities in punishment. The TPKS Law and the Indonesian Criminal Code Bill could be other options that may one day be considered in cases involving child grooming. It ought to be striving for special regulations against child grooming. In such cases, it would appear that it would be preferable if they were made into technical regulations in the form of government regulations with proof and criminal sanctions that were more maximized. Abstract

Some Indonesians in refugee camps in Syria state they want to return to Indonesia. The plan to repatriate the Indonesian ex-ISIS then raises the pros and cons. Some consider that Indonesian citizen who have joined ISIS deserve to be given the opportunity to improve themselves and have a right to be returned to Indonesia if they really want to repent. Some are worried that the repatriation of Indonesian citizen who join ISIS would create new problems in Indonesia. The problem is that among them there are dozens of children, and they are not combatants who took up arms against Iraq and Syria. They just follow where their parents go. Using the normative juridical study method, this paper explains the potential impact that can arise on national security if the Indonesian government adopts a policy of repatriating Indonesian children who used to join ISIS. The results in this study then provide a prescription that should be carried out by the Indonesian government towards Indonesian children who used to join ISIS

Abstract

This study examines the changes in the authority of the Professional Disciplinary Council (Majelis Disiplin Profesi, MDP) under Law Number 17 of 2023 concerning Health and their implications for legal certainty for medical and health professionals. Although these changes are intended to improve the professional disciplinary system, they have resulted in the centralization of authority under the Ministry of Health, including the appointment of members, institutional formation, and the process of judicial review of MDP decisions. Furthermore, MDP recommendations can now serve as a basis for criminal investigations against medical and health personnel, which contradicts the original function of the MDP as an institution for enforcing ethics and professional discipline based on due process of ethics. This research employs a normative juridical method with a descriptive-analytical and case study approach, supported by expert interviews in health law. Theoretical frameworks used include the Theory of Legal Certainty, the Theory of Human Rights, and the Theory of Legal Protection. Findings indicate that the centralization of authority under the Ministry of Health has created a power imbalance in professional oversight. This has negative implications for legal protection, increasing the risk of conflict of interest, abuse of authority, and weakening legal certainty for medical and health professionals. Therefore, it is necessary to revise Law No. 17 of 2023 and Government Regulation No. 28 of 2024 to restore the independence of the MDP and ensure a proportional redistribution of authority within the health professional oversight system.

Abstract

Child sexual exploitation is a severe violation of human rights that demands a firm and multidimensional legal response. This study aims to identify the underlying causes of child sexual exploitation and to analyze and compare law enforcement practices against such crimes within the legal systems of Indonesia and Malaysia. The research employs a normative juridical method with a comparative law approach. The findings reveal that the contributing factors in both countries include weak legal enforcement, socio-economic vulnerability, misuse of digital technology, and prevailing cultural norms. In terms of punishment, Indonesia has introduced chemical castration as an additional sanction under Government Regulation No. 70 of 2020, while Malaysia imposes imprisonment and caning based on the Penal Code and the Child Act 2001. Despite having comprehensive legal frameworks, Indonesia continues to face challenges in implementation, such as inadequate law enforcement sensitivity and insufficient psychosocial support for victims. The comparative analysis indicates that legal effectiveness relies not only on statutory provisions but also on institutional commitment to uphold justice and child protection.

Review of the trademark determination in court decision Number 75/Pdt.Sus-Hki/Merek/ 2022/Pn Niaga Jkt.Pst rejection of the application for the trademark GENHALILINTAR + Painting by Anofial Asmid because it was registered by PT SOKA CIPTA NIAGA on October 23 2017 with a Notification of Rejection Registration of the Mark "GENHALILINTAR + Painting" Agenda Number D002018027834 dated 31 December 2019 by the Directorate General of Intellectual Property and Decision of the Mark Appeal Commission / Defendant Number 375 / KBM / IPR / 2020 dated 8 September 2020. This turns out to be interesting because in Halilintar Anofial Asmid has registered the GENHALILINTAR + Painting brand in several classes, which of course contradicts the arguments in the Notice of Rejection and Decision of the Mark Appeal Commission. This paper uses normative legal research methods. With the conclusion Based on the legal annotation of the Decision that there are problems that occur in granting well-known trademark rights to certain people or civil legal entities, especially if the trademark holder is not the initial initiator of its popularity. In terms of administrative certainty of the GENHALILINTAR + Painting mark, state administrative legal action in trademark disputes can be filed against the decision to delete a registered mark at the initiative of the Minister. Abstract

Marital rape is a form of sexual violence that is often not explicitly recognized in legal systems, especially in countries with strong patriarchal cultures. This article provides a comparative analysis of the regulation and enforcement of marital rape as a criminal offense in Indonesia and Singapore. In Indonesia, the recognition of marital rape as a criminal offense has been strengthened through the new Criminal Code (Law No. 1 of 2023), the PKDRT Law, and the TPKS Law, although its implementation still faces challenges in the form of complaint offenses, social stigma, and a lack of understanding of gender issues among officials. Meanwhile, Singapore has removed legal immunity for husbands since the enactment of the Criminal Law Reform Act 2019, and provides civil protection through Personal Protection Orders (PPOs) and an integrated reporting system. This study uses a normative legal and comparative law approach to examine the differences in the legal systems, regulations, and cultures of the two countries. The results of the study show that Singapore is more progressive in handling cases of marital rape, both in terms of regulations and victim protection mechanisms. This article recommends that Indonesia strengthen inter-agency synergy, reform the reporting system, and improve public legal literacy as strategic steps in combating domestic sexual violence. With a comprehensive approach, it is hoped that the Indonesian legal system can be more responsive to the needs of victims and ensure gender sensitive justice.

Abstract

The development of information and technology, has a positive impact on human life, but on the other, it will have a negative impact. The misuse of social media, especially in the school, is an important thing to pay attention to. This paper aims to provide understanding and legal assistance in order to avoid misuse of social media. The first step taken was to provide socialization and enlightenment to the students and the school, especially SMAN 2 Kota Serang about the dangers of misuse of social media. Understanding and enlightening students about the dangers of misuse of social media is an effort to prevent the occurrence of misuse of social media, especially in the school. The results and impact of the implementation of program can be seen in the understanding of students and schools regarding the dangers of misuse of social media. Keywords: legal protection, UU ITE, studentAbstrak:Perkembangan informasi dan teknologi disatu sisi memberikan dampak positif bagi kehidupan manusia, namun disisi lain akan memberikan dampak negatif. Tulisan ini bertujuan untuk memberikan pemahaman dan pendampingan hukum guna menghindari penyalahgunaan media sosial. Abstract

Indonesia Corruption Watch (ICW) mengumumkan laporan terbaru penindakan kasus tindak pidana korupsi di Indonesia yang mengalami peningkatan signifikan dari tahun 2017 sampai 2021 yang mencapai lebih dari 200 (dua ratus) kasus korupsi. Melihat peningkatan yang signifikan perlu upaya pemberantasan korupsi yang serius, tidak hanya dengan penindakan investigasi dan perbaikan perundangan-undangan melainkan juga melalui pendekatan restorative dengan anjuran tangan pelaku yang bekerjasama sebagai kolaborator hukum. Problematika lainnya dalam penindakan perkara korupsi ialah belum adanya pedoman pemidanaan bagi Justice Collaborator sehingga membuka kemungkinan adanya Disparitas Pemidanaan, misalnya dalam perkara pemberian izin budidaya lobster dan izin ekspor BBL terdakwa dijatuhi pidana uang pengganti atas keuntungan yang diterima, sementara dalam kasus penyuapan pegawai pajak atas penerimaan restitusi PT WAE, terdakwa tidak dijatuhi pidana uang pengganti meskipun terdakwa juga menerima keuntungan. penelitian ini menggunakan metode penelitian yuridis normatif yaitu metode penelitian dengan melakukan analisa data pustaka menggunakan bahan hukum primair maupun sekunder. Adapun pendekatan masalah yang digunakan dalam penelitian ini ialah dengan pendekatan perundangan- undangan, pendekatan kasus dan pendekatan konseptual. Hasil penelitian ini menunjukan bahwa faktor penyebab disparitas pidana terhadap Justice Collaborator salah satunya ialah belum adanya pedoman pemidanaan yang mengatur secara keseluruhan mengenai dasar pemidanaan dan perlindungan bagi Justice Collaborator. Untuk itu perlu adanya perumusan pedoman pemidanaan untuk memperkecil kemungkinan disparitas pemidanaan sehingga pemenuhan reward atau penghargaan bagi Justice Collaborator dapat dipenuhi tanpa menimbulkan korban ketidakadilan.Kata kunci: Disparitas; Justice Collaborator; Korupsi

Abstract

This study examines the legal conflict between constitutional guarantees of freedom of expression, press, and academia with the need to protect the judicial process from obstruction of justice. In the digital age, media narratives and public opinion exert increasing pressure on law enforcement. This study answers two questions: (1) How has the regulation of obstruction of justice developed in Indonesian criminal law? and (2) How are news reports, opinions, and academic activities categorized as forms of obstruction of justice in the investigation process? Using a normative legal method, the study analyzes regulations, legal principles, and case studies. The results show the evolution of regulations from physical offenses in the old Criminal Code (Article 221) to non-physical offenses in the Corruption Eradication Law (Article 21), to systematic codification in the National Criminal Code. The key finding is that the fundamental demarcation lies in proving malicious intent (mens rea) and malicious conspiracy. The Tian Bahtiar case set a precedent that transactional media activities (“obstruction-for-hire”) lose the protection of the Press Law. It is concluded that regulatory ambiguity, especially the phrase “indirectly,” has the potential to create legal uncertainty and a chilling effect that threatens the social control function of the press and academics.
