Abstract

Praperadilan merupakan komponen dari sistem peradilan pidana di Indonesia yang bertujuan untuk mengatasi kejahatan yang bersifat penal dengan menggunakan hukum pidana baik dalam aspek substansial maupun formal sebagai alat utama. Praperadilan sebagai bagian dari penegakan hukum, sebagaimana dijelaskan oleh Barda Nawawi Arief, menyoroti permasalahan penegakan hukum, baik secara konseptual maupun dalam praktik, yang belakangan ini menjadi perhatian serius masyarakat. Praperadilan telah diatur di dalam Pasal 1 angka 10 Undang-Undang Nomor 8 Tahun 1981. Dalam Praperadilan tersebut, terdapat beberapa pihak yang turut hadir, salah satunya adalah Ahli yang mana Ahli dalam sebuah persidangan diwajibkan memiliki sifat yang netral tanpa adanya hubungan khusus yang akan memicu dugaan dengan kepentingan subjektif. Baru beberapa bulan ini, dunia hukum dihebohkan dengan Hakim Tunggal yang menolak OC Kaligis untuk menjadi Ahli Praperadilan Lukas Embe dengan dilatarbelakangi konflik kepentingan dalam perkara Praperadilan. Tujuan penelitian adalah menganalisis mengenai kewenangan Hakim Tunggal dalam menentukan Ahli di proses Persidangan. Rumusan masalah dalam penelitian ini adalah Bagaimana kewenangan Hakim Tunggal dalam menentukan Ahli dan bagaimana keterkaitan antara kualifikasi posisi Ahli dengan kasus Profesor OC Kaligis terhadap Lukas Embe. Metode penelitian adalah studi literatur yang melibatkan serangkaian tindakan terkait dengan pengumpulan data dari berbagai sumber tertulis, membaca, mencatat informasi, dan mengolah materi penelitian berdasarkan pada referensi yang dapat dipercaya sebagai landasan untuk penelitian ini. Adapun hasil dari penelitian ini adalah prinsip pemeriksaan dengan acara cepat yang mengharuskan pemeriksaan Praperadilan selesai dengan kurun waktu selambat-lambatnya adalah tujuh hari, maka Hakim Tunggal memiliki kewenangan dalam memilih juga menolak Ahli sesuai dengan sifat netral yang dimilikinya dalam Praperadilan demi mencapai tujuan penegakan hukum dan untuk menghindari konflik kepentingan secara subjektif selama Persidangan.

Abstract

Pentingnya penulisan ini yakni guna memahami pelaksanaan tradisi bakar batu di Papua dan menganalisisnya dari perspektif KUHP Baru. Hal ini dikarenakan tradisi tersebut merupakan media penyelesaian konflik yang menjadi penghubung antar pihak berselisih sebagaimana sesuai dengan konsep keadilan restoratif. Tradisi ini dapat memenuhi keadilan yang sesuai dengan naluri kebangsaan sebagaimana mandat dari ideologi negara sehingga dapat merepresentasikan upaya pembinaan hukum nasional dengan menerapkan hukum baru melalui Pasal 2 sebagai bagian dari pembaharuan KUHP. Berdasarkan pada pembaharuan KUHP, dimungkinkannya pemberlakuan the living law dengan batasan pemberlakuannya. Adapun tradisi bakar batu merupakan tradisi yang hidup di dalam masyarakat Papua sebagai tradisi yang digunakan sebagai penyelesaian konflik dalam perkara pidana maupun perkara adat. Adapun objek kajian pada penulisan hukum normatif ini adalah penemuan hukum in concreto dengan pendekatan statute dan conceptual. Pendekatan statute digunakan karena penulis mengkaji KUHP Baru tepatnya pada Pasal 2 mengenai the living law. Sedangkan pendekatan conceptual untuk memahami konsep tradisi bakar batu dan keterkaitannya dengan prinsip-prinsip atau norma yang berlaku di masyarakat. Data dikumpulkan dengan menggunakan metode studi pustaka dan dianalisis secara kualitatif. Adapun hasil penulisan ini menunjukkan bahwa pelaksanaan tradisi bakar batu adalah sanksi adat sebagai penyelesaian perkara yang dapat dijadikan sebagai bentuk pemidanaan terhadap perbuatan yang dinyatakan terlarang berdasarkan the living law yang diatur pada Pasal 2 dengan membayarkan denda. Selain itu, tradisi bakar batu sesuai dengan limitasi yang juga diatur pada Pasal 2 KUHP Baru yang pada intinya tidak bertentangan dengan prinsip atau norma yang berlaku di masyarakat.

Abstract

Electronic detection devices are an additional penalty stipulated in Government Regulation Number 70 of 2020. However, since being enacted until now there has been no judge's decision deciding the additional penalty for installing this electronic detection device because there are many instruments in the regulation itself. This study aims to find out the problems and solutions related to the application of the installation of electronic detection devices to perpetrators of sexual violence against children. This research leads to normative juridical law research, with data collection carried out by means of document studies. The results of the research found that there were several problems in the rules regarding the application of installing electronic detection devices so that later by doing comparisons a solution was found for some of the problems stipulated in PP 70/2020.

Abstract

This study is related to a case of assault in which the parents of the victim are prominent figures in GP Ansor. The research examines the form of complicity in the criminal act of assault committed by the underage individual, the minor AG. This research is based on the fact that legal protection relating to children in conflict with the law (ABH) has not been implemented properly. The novelty in this research is the explanation of the legal protection provided to all children who provide assistance in cases of abuse. In order to guarantee all children's rights, including children in conflict with the law, to live, grow, develop and participate optimally in accordance with human dignity, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System was created. Normative juridical is used in this research through a statutory approach, using secondary data sources supported by primary and secondary legal materials. The results of the research show that according to the results of Court Decision Number 4/Pid.Sus-Anak/2023/PN.JKT.SEL which has permanent legal force, AG's child's role as a child who assists in criminal acts of abuse is appropriate, however the decision given judged by the judge to be inappropriate. Reviewing various aspects along with existing laws and regulations, it would be more appropriate to impose a second subsidiary sentence, namely Article 353 Paragraph (2) of the Criminal Code (KUHP) juncto Article 56 2nd of the Criminal Code, which reduces the sentence for AG Children, is the best choice.

Abstract

The topic of bullying is never discussed from time to time, the phenomenon of bullying is like an epidemic or a rapidly spreading disease that causes many victims. The phenomenon of bullying is increasingly growing because currently it is a modern era that cannot be separated from technological developments which have positive and negative impacts. Television or social media shows are easier for school-age children to imitate, especially behavior that is considered not good. For example, a fight scene that ends in bullying. Bullying occurs at every school level, from elementary school, middle school, high school to university, both public schools and religious schools and Islamic boarding schools. Bullying is carried out by students, teachers, parents and also school principals with the majority of victims being students. In order to protect and prevent bullying, the government has issued many laws such as the Child Protection Law, the Children's Criminal Justice System Law, the Minister of Education, Culture, Research and Technology Regulations, the Minister of State for Women's Empowerment and Child Protection Regulations, Guidebooks and Programs Anti-bullying from each school and various forms of efforts to anticipate and prevent bullying in schools. In fact, the various regulations issued by the Government have not been able to overcome bullying behavior, which will even increase by 30% in 2023 compared to 2022. This research will complement other research that has been carried out previously, using a different perspective, namely with the concept of sustainability. activities through the PDCA (Plan, Do, Check, Action) system, which requires stakeholders (Government, Teachers, Parents, Students, Law Enforcement and all parties involved) to carry out systematic and holistic prevention efforts, which in every The steps taken must always be reviewed to find out whether the work plan made has succeeded in preventing or not being effective.

Abstract

Domestic Violence is any act committed against a person, resulting in the onset of physical, sexual, psychological, and/or domestic abuse. As we understand it, domestic violence crimes are common in the personal sphere and often lead to the absence of witnesses other than victims who make it difficult to prove. This research aims to determine the regulations related to the settlement of domestic violence and to find out the application of the system of proving domestic violence crimes. This research was conducted by normative juridical research methods. The legal source used is a secondary legal source. The approach used is the statute approach and case approach related to the problem. The results of this study explain that the regulation stipulated in the domestic violence crime stipulated in The Law of the Republic of Indonesia No. 24 of 2004, in establishing a person to be a defendant in a domestic violence crime with the testimony of one witness and supported by one other valid evidence, is proven by the Verdict No. 131/Pid.Sus/2017/PN Pre.

Abstract

Criminal penalties can be imposed for infractions, including those committed by minors. However, the purpose of sanctions extends beyond punishment; they also aim to promote restoration. Given that children involved in homicide cannot be held to the same legal standards as adults, the law prioritizes their psychological development and growth. This article seeks to clarify the nature of criminal accountability for juvenile offenders and to explore the law enforcement process in cases of murder involving young individuals. This research utilizes a literature review methodology, drawing data from relevant publications, journals, and books. The findings suggest that adolescent homicide offenses can be effectively addressed through a restorative justice framework that prioritizes rehabilitation over retribution. A key component of restorative justice is the Family Group Conference, which involves the families of both the perpetrator and the victim in the juvenile's accountability process.

Abstract

This study examines the comparative juvenile justice systems for child offenders of murder between Indonesia and Malaysia. The background of the research stems from the rising cases of children in conflict with the law due to serious crimes such as murder. Both countries adopt different legal approaches: Indonesia applies restorative justice through Law No. 11 of 2012 on the Juvenile Criminal Justice System, while Malaysia relies on the Child Act 2001 influenced by the Doli Incapax doctrine. This research uses a normative juridical method with a comparative approach to analyze the similarities and differences in both legal systems. The findings indicate that Indonesia emphasizes child rehabilitation through diversion mechanisms, whereas Malaysia adopts a more formal approach emphasizing court decisions. The study recommends policy improvements in both countries to enhance the protection of child offenders' rights.

Abstract

The helplessness of children in protecting themselves provides opportunities for adults to exploit them. As in Decision Number 148/Pid.Sus/2024/PN Mdn, where the development of digitalization and social media trends, namely TikTok, was misused as a means of exploiting children in foster care. The perpetrators take advantage of children's vulnerability by having the child appear in TikTok live streaming to attract audience sympathy in order to get gifts that can be converted into money. This study aims to analyze the guarantee of legal protection for orphanage children as victims of exploitation and examine the criminal liability of the manager of the orphanage foundation in cases of child exploitation through TikTok live streaming. The normative juridical method with a statutory approach and a case approach is used in this research. The results show that orphanage children who are victims of exploitation are entitled to legal protection guarantees in the form of special protection, social rehabilitation, legal assistance, and supervision by empowerment institutions such as KPAI. The actions of the orphanage manager are proven to meet the requirements of criminal liability because they intentionally exploit for material gain, have the ability to be responsible, and without any excuse that can eliminate criminal responsibility.

Abstract

An examination of electronic evidence within the context of Indonesian criminal law focuses on the evolving role of electronic evidence in criminal proceedings, highlighting the challenges arising from the absence of clear regulation in the Indonesian Criminal Procedure Code (KUHAP) and the necessity of balancing this with privacy rights under the Personal Data Protection Law (UU PDP). Electronic evidence, such as digital data and electronic documents, is increasingly recognized under the applicable laws in Indonesia, yet its practical application remains complex within the criminal justice system.  This research employs a normative legal methodology, analyzing relevant legal provisions and their interplay, particularly concerning the validity of electronic evidence and data privacy. Both statutory and conceptual approaches are utilized, reviewing primary legal materials such as KUHAP, UU PDP, and related regulations. The study also examines key legal principles, including compliance, transparency, and proportionality, in the context of handling electronic evidence.  Secondary data is gathered through a comprehensive literature review, including legal texts, academic books, and journals. The findings indicate significant gaps in the current legal framework, particularly regarding the procedural norms for evidence collection and the tension between privacy rights and criminal justice needs. The research concludes with recommendations for legal reforms aimed at integrating electronic evidence more effectively into KUHAP, ensuring greater consistency, safeguarding privacy, and promoting procedural fairness in criminal proceedings.
