Abstract

Bahwa perlindungan hukum terhadap merek sangat penting terlebih lagi untuk merek yang telah memiliki reputasi baik dan / atau merek terkenal, karena pemilik merek tersebut telah mengeluarkan investasi yang sangat besar untuk menjadikan merek tersebut dikenal oleh masyarakat dan konsumen. Perlindungan hukum untuk mencegah agar merek yang telah memiliki reputasi baik dan telah dikenal masyakarat agar tidak ditiru oleh pihak lain yang berusaha untuk mendompleng keterkenalan merek tersebut untuk kepentingan usahanya. Peniruan terhadap merek terkenal dianggap sebagai bentuk itikad tidak baik karena usaha untuk meniru dan mendompleng keterkenalan merek tersebut sebagai salah satu unsur adanya itikad tidak baik. Dalam undang-undang ataupun peraturan terkait yang mengatur mengenai hukum Merek di Indonesia hanya memberikan atauran ataupun batasan-batasan untuk mengkualifikasikan suatu merek terkenal. Dalam berbagai sengketa merek di Pengadilan juga penggugat meminta petitum untuk dinyatakan sebagai merek terkenal. Dalam penulisan tesis ini penulis akan membahas mengenai perlindungan merek yang memiliki reputasi baik, dimana klasifikasi dalam hal menentukan merek yang memiliki reputasi baik belum diatur dalam peraturan perundang-undangan. Analisis sengketa kasus merek “ACC memberi kemudahan” melawan merek “KlikACC”, yang menyatakan merek “ACC memberi kemudahan” adalah merek yang memiliki reputasi baik, namun diawal putusan menyatakan tidak ada persamaan pada pokoknya kemudian dalam putusan Peninjauan Kembali di Mahkamah Agung menyatakan adanya unsur itikad tidak baik dan kedua merek tersebut memiliki persamaan pada pokoknya.

Abstract

This study set out to address the question, "How is the future legal construction of the pattern of implementing inclusive, specialized, and equal Education for Persons with Disabilities in Indonesia?" The normative issue of how disabled people in Indonesia are often managed inspired this study. The Law on the Education System and the Law on Disabilities both include ambiguous principles on inclusive and special (segregated) education. The Statute Approach method was used to conduct this normative assessment of the law. The study's findings suggest that moving forward, Indonesia will revise legal norms in both laws and the integration of special schools and regular schools by establishing special units in regular schools to accommodate students with disabilities, all with the goal of achieving full inclusive education for people with disabilities. This may be done in increments, on a continuous basis, and using metrics based on the state of Indonesia's infrastructure right now

Abstract

The rapid growth of marketplaces as part of electronic commerce in Indonesia has facilitated transactions while simultaneously increasing the circulation of illegal re-branding products that harm consumers. The unclear legal position and civil liability of marketplace operators raise issues of legal certainty, particularly when counterfeit or re-branding products are sold by third-party sellers through digital platforms. This study addresses two main issues: the legal regulation of marketplace operators’ civil liability for the circulation of re-branding products in Indonesia and the implementation of such liability in relation to consumer losses. This research employs a normative legal method using statutory and case approaches, with specific reference to Decision Number 537/Pid.B/2022/PN Jkt.Brt. The findings indicate that the regulation of marketplace civil liability remains fragmented and fails to explicitly define the obligations of marketplace operators in preventing and controlling the distribution of illegal re-branding products. In practice, the implementation of civil liability primarily targets sellers as direct perpetrators, while the role and negligence of marketplace operators in supervision and control are rarely addressed, resulting in ineffective consumer compensation mechanisms.

Abstract

The development of financial technology has encouraged the increasing use of online loan services, especially among Generation Z. The ease of access and the fast disbursement process of funds make online loans an alternative to fulfilling financial needs, but on the other hand it causes various problems, such as the rampant illegal online loans, unreasonable interest, unethical billing, and misuse of consumer personal data. This research aims to analyze the role and implications of the supervision of the Financial Services Authority (OJK) towards the protection of Generation Z consumers as online loan users. The research method used is normative legal research with a normative legal approach through literature studies on relevant laws and regulations and literature. The research results show that OJK has the authority to attribute it based on Law Number 21 of 2011 to regulate, supervise, and protect consumers in the financial services sector, including fintech lending services. Although the supervision of OJK has given a positive impact in the form of increased compliance with legal online loan providers, consumer protection has not been fully optimal due to limited authority against illegal online loans, low financial literacy of the community, and surveillance challenges in the digital era.
