Abstract

This study aims to understand the form and effectiveness of legal protection for consumers of crypto assets before and after the enactment of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (PPSK Law) and Financial Services Authority Regulations (POJK) Number 27 of 2024 and POJK Number 3 of 2024. The method used is normative legal research with a legislative approach and qualitative descriptive analysis techniques. This approach was chosen to explore the substance of legal norms and assess the practical implications of regulatory changes on the rights of consumers who use crypto assets. The novelty of this research lies in its critical analysis of the changes in the supervisory regime from the perspective of legal protection for digital asset consumers, which has not been comprehensively discussed before. This research is relevant amid the dynamic development of the rapidly evolving and complex digital financial sector, particularly following the enactment of the PPSK Law and the OJK's derivative regulations. The results of the study indicate that prior to the implementation of the latest regulations, legal protection for consumers of crypto assets was minimal and sectoral in nature, with a focus on commodity aspects by BAPPEBTI. This resulted in weak protection against risks such as value fluctuations, fraud, and threats to digital transaction security. However, after being transferred to the OJK, the protection approach became more integrated through the regulation of business licenses, clearing systems, digital asset storage governance, and more adequate dispute resolution mechanisms. In conclusion, the transfer of regulatory authority to the OJK significantly strengthens legal protection for cryptocurrency consumers in Indonesia. The new regulations enhance legal certainty and increase user confidence, while also fostering the development of a more transparent, accountable, and consumer-oriented digital asset ecosystem.

Abstract

The Principle of Recognizing Service Users (Prinsip Mengenali Pengguna Jasa, PMPJ), as outlined in Article 3 of Government Regulation No. 61 of 2021 concerning Amendments to Government Regulation No. 43 of 2015 on Whistleblowers in the Prevention and Eradication of Money Laundering Crimes, underscores the role of advocates as mandatory whistleblowers. This creates legal challenges regarding its implementation, resulting in a dialectical tension with the central argument that while PMPJ obligations are firmly grounded in normative legal frameworks, advocates—who are explicitly required to uphold these provisions—find no compelling legal basis for such duties in Law No. 18 of 2003 on Advocates (the Advocate Law). The principle of Lex Superior Derogat Legi Inferior further complicates this issue, as it suggests that the Advocate Law, being of a higher legal order, supersedes the obligations imposed by PMPJ. The primary objective of this study is to critically analyze the implementation of PMPJ, specifically focusing on the supporting and inhibiting factors in the context of preventing and combating money laundering crimes. The findings highlight that the failure to optimally implement PMPJ within the advocate profession is largely due to the unresolved legal dialectic surrounding the obligations of advocates. This issue has not been addressed in prior studies, representing a novel contribution of this research. Consequently, this study proposes the need for a reformulation of the Advocate Law, emphasizing the explicit inclusion of advocates' obligations regarding the implementation of PMPJ principles.

Abstract

The legal empowerment of Micro, Small, and Medium Enterprises (MSMEs) involves strategic policies aimed at enhancing the resilience and competitiveness of the MSME sector within a national legal framework. This encompasses aspects such as licensing, regulatory compliance, capacity building, market access, technological integration, financing mechanisms, and institutional collaboration among the government, private sector, and civil society. In the era of digital transformation, many Indonesian MSME owners face significant challenges due to limited capacity to adapt to rapid technological advancements, hindering their legal and commercial development. This research adopts a normative juridical method with a comparative legal approach, utilizing literature-based analysis to examine regulatory frameworks and institutional practices. As a contribution to strengthening the legal empowerment framework for MSMEs in Indonesia, this article offers a novel perspective by proposing a hybrid legal empowerment model that integrates Indonesia’s normative and principle-based legal tradition with a pragmatic, centralized governance approach as exemplified by China. It argues that legal empowerment for Indonesian MSMEs in the digital era cannot rely solely on deregulation or administrative simplification. Rather, a more comprehensive strategy is required—one that includes state-led legal facilitation, community-based digital legal literacy initiatives, and institutional redesign that systematically embeds MSMEs into the broader legal development agenda. This integrated model is proposed as a forward-looking framework to bridge Indonesia’s legal empowerment gap and to promote inclusive and sustainable growth of MSMEs within the digital economy.

Abstract

The aim of this study is to find out and analyze the role of controllers in protecting the interests of publicly-listed company investors by ensuring the implementation of good corporate governance principles. The delay of the implementation of the Annual General Meeting of Shareholders and the publication of annual financial statements are two examples of non-fulfillment of the principles of good corporate governance namely transparency and accountability, which resulting temporary suspending trading of its shares by Indonesia Stock Exchange. When the role of the controller as shareholder who has the ability to control the company is ineffective because the shareholding of the company is less than 50%, the undertake of investors protection become an issue. This research was conducted based on a juridical-normative approach with analytical descriptive specifications based on secondary data. The results of this study revealed that the controller has several mechanisms to control the company to reduce losses for shareholders. However, the determination of a controller with less than 50% shareholding of the company’s shares results in the controlling role towards the company become ineffective and potentially detrimental to the interests of investors. The difference between this research and the previous lies in the object of this study which discusses the role of controllers in ensuring the fulfillment of the principles of good corporate governance so that they can provide protection to investors.

Abstract

The protection of consumers’ personal data in digital MSME (Micro, Small, and Medium Enterprises) businesses poses a significant challenge in the era of digital transformation, particularly amid the rising cases of data breaches in Indonesia. Although Law No. 27 of 2022 on Personal Data Protection (PDP Law) has come into effect, its implementation still faces numerous obstacles, especially for MSMEs that are limited in terms of resources and technological understanding. By comparison, China, through its Personal Information Protection Law (PIPL), enforces strict supervision combined with AI-driven compliance technologies. This study aims to analyze the effectiveness of personal data protection frameworks in Indonesia and China and to propose a hybrid model that integrates government regulations with technological solutions. The research employs a normative juridical method using statutory, conceptual, and comparative law approaches, relying on secondary data such as regulations, academic journals, and policy documents. The findings indicate that adopting a hybrid model for the protection of consumers’ personal data in digital MSME businesses could serve as an effective solution. This model merges a compliance-based approach, as adopted under Indonesia’s PDP Law, with the strict oversight mechanisms implemented under China’s PIPL. By adapting mechanisms such as mandatory registration, periodic audits, and technology-based compliance incentives, Indonesia could enhance transparency, accountability, and data security within its digital MSME ecosystem.

Abstract

The trustee is the party responsible for assisting the implementation of bond issuance and transactions in the capital market. In the implementation of bond issuance, the role of the trustee is crucial in creating legal protection for bondholders. The purpose of this study is to clearly understand the duties and responsibilities of the trustee towards bondholders as well as the legal protection rights possessed by bondholders if the trustee commits acts of negligence under capital market law. The results showed that the trustee must make compensation as a form of legal protection to bondholders in accordance with the regulations contained in the laws and regulations in the field of capital market and bondholders who feel aggrieved can ask the trustee for compensation by means of consensus deliberation or dispute resolution at an alternative dispute resolution institution established by the Service Authority Finance (OJK). Bondholders can also prove to court because the losses suffered are the result of the negligence of the trustee who represents them in a bond issuance process.

Abstract

Putusan Mahkamah Konstitusi Nomor 23/PUU-XIX/2021 hadir dengan memberikan konsekuensi yuridis untuk mengubah acara hukum pada perkara yang diawali dengan pengajuan permohonan penundaan kewajiban pembayaran utang dan ditolaknya tawaran perdamaian dari debitur. Tujuan penelitian ini adalah untuk meninjau putusan a quo berdasarkan asas keadilan dan diwujudkan dengan gagalnya kewajiban pembayaran utang yang berdimensi cepat. Metode penelitian yang digunakan adalah yuridis normatif pada penelitian hukum kepustakaan atau penelitan hukum doktrinal sebagai penelitian hukum dengan cara mengkaji bahan Pustaka atau data-data sekunder. Hasil penelitian menunjukkan bahwa berdasarkan asas keadilan, debitur dan masing-masing kreditor dapat mempertahankan hak-haknya dalam rangka penyelesaian utang piutang dengan membukanya upaya hukum kasasi.

Abstract

Penelitian ini dilakukan untuk mengkaji realita kegiatan masyarakat Tengger Bromo dalam upaya mempertahankan dan melestarikan tradisi budaya yang dapat menjadi salah satu keragaman dan kekayaan khasanah wisata budaya di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah metode deskriptif kualitatif dari Miles dan Huberman yaitu laporan utama reduksi data, penyajian data dan penarikan kesimpulan yang diadakan serentak bersamaan dengan proses pengumpulan data, dalam bentuk siklus selama proses penelitian. Penelitian ini juga berhasil mengidentifikasi aktivitas masyarakat sebagai tradisi budaya yaitu berkaitan dengan siklus kehidupan seperti upacara kehamilan (sesayut), upacara kelahiran (brokohan), upacara perkawinan (praswalagara), dan upacara kematian (entas-entas); kehidupan masyarakat seperti pujan kasanga (pujan mubeng), mayu desa (unan-unan); siklus pertanian (liliwet); gejala alam; dan ritual-ritual tradisi lainnya seperti hari raya kasada dan hari raya karo. Bersama-sama dengan pihak terkait sepertipemerhati pariwisata, pelaku wisata, dinas kebudayaan dan pariwisata, Taman Nasional Bromo Tengger Semeru (TNBTS), serta pihak lain yang terkait, masyarakat Tengger berhasilmempertahankan dan melestarikan tradisi mereka menjadi salah satu kekayaan khasanah wisata budaya dan keberagaman wisata di Indonesia khususnya wisata budaya yang dapat dijual kepada wisatawan sebagai daya tarik wisata budaya.

Abstract

Penanganan pemesanan dan pembatalan kamar melalui telepon merupakan salah satu fungsi penting dalam operasional hotel yang berperan langsung terhadap pencapaian target penjualan kamar. Penelitian ini bertujuan untuk menganalisis penanganan pemesanan dan pembatalan kamar melalui telepon serta pengaruhnya terhadap penjualan kamar di Hotel Grand Tjokro Yogyakarta. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus. Data diperoleh melalui wawancara mendalam dengan staf reservasi, observasi langsung pada proses pemesanan dan pembatalan, serta telaah dokumen terkait. Hasilnya menunjukkan bahwa penanganan pemesanan dan pembatalan kamar melalui telepon memerlukan keterampilan komunikasi yang efektif dan ketepatan informasi agar tidak menimbulkan kesalahpahaman dengan tamu. Faktor seperti kecepatan respons, kejelasan konfirmasi, dan fleksibilitas kebijakan pembatalan berpengaruh terhadap optimalisasi penjualan kamar. Penelitian ini menegaskan pentingnya peran staf reservasi dalam menjaga stabilitas penjualan kamar melalui pelayanan reservasi telepon yang profesional dan responsif. Hasil dari penelitian ini diharapkan dapat menjadi acuan bagi pihak manajemen hotel dalam merumuskan strategi peningkatan kualitas layanan reservasi melalui telepon, meminimalkan dampak negatif pembatalan kamar, serta mengoptimalkan tingkat okupansi melalui prosedur kerja yang lebih efisien dan responsif.

Abstract

Permintaan akan transportasi premium, didorong oleh meningkatnya daya beli dan preferensi akan kemewahan, perusahaan transportasi semakin menawarkan layanan kelas atas. Mereka bersedia membayar harga premium untuk menikmati fasilitas mewah dan, tentu saja, prestise. Penelitian ini berfokus pada bus pariwisata mewah Omah Sultan Juragan 99 Trans Malang, Jawa Timur dan mengeksplorasi motivasi dan pengalaman pengguna. Penelitian ini dilakukan selama 6 bulan, dengan menggunakan metode kualitatif, termasuk observasi, wawancara dengan manajer dan staf, serta mengumpulkan 46 formulir umpan balik dari 56 pengguna potensial. Studi ini mengkaji aspek-aspek kunci seperti motivasi, kualitas layanan, fasilitas, citra merek, dan pengalaman. Hasil menunjukkan bahwa pengguna termotivasi dengan rasa penasaran, prestise/ gengsi, kenyamanan dan keamanan, ingin perjalanan mewah ala sultan, dan perjalanan wisata privat dengan layanan berkualitas tinggi dan fasilitas yang lengkap dan canggih untuk mendapatkan pengalaman yang unik, berbeda, dan berkesan. Dengan 25 pengguna setia yang menyewa lebih dari satu kali memungkinkan mereka untuk terus menggunakan bus pariwisata mewah ini untuk tujuan perjalanan lainnya dan mendapatkan pengalaman yang berbeda di setiap perjalanannya.
