Abstract

Every nation attempts to provide welfare for its citizen such as better economic growth,social security and better life. All economic systems either Capitalism or Socialism has thesame objective to provide welfare for its nation. In Islam, welfare lies in complete justice,mercy, welfare, and wisdom; anything that departs from justice to injustice, from mercyto harshness, from welfare to misery and from wisdom to folly has nothing to do with theShari’ah. The Islamic concept and values on welfare of the society are related to Islamiceconomic history that can be found from Qur’an and Sunnah and Islamic literatures suchas history, fiqh, philosophy, kalam, and tasawwuf. it is assumed that there are some Muslimscholars whose works are related to role of state on welfare. Therefore, the study attempts toknow the role of state on social justice derived from Ibn Sina and give some critical study onhis thought. To achieve its objectives; this study employs qualitative research that refers tothe meanings, concepts, definitions, characteristics, metaphors, symbols and descriptions ofthe matter understudy. Moreover, it is used content and descriptive analysis to get findingof the study. The data collection is generated from Islamic sources. The finding of this studyis that Ibn Sina’s thought on state role to promote social justice containts of providing law,job opportunities and social security. These roles of state can contribute to harmony, peaceand welfare of the society.

Abstract

Waqf (endowment) is one of Islamic philanthropy that offers the basics of justice and benefit. It should be managed with innovative management such as cash and productive waqf that can contribute a positive impact on the socio-economic of society. In the context of waqf fundraising, cash waqf auction is one strategy to accumulate the funding. Cash waqf auctions can be used as a supporting instrument to support and to enhance the general public need and education. Besides, waqf is not limited to the utilization as zakat, therefore the community development programs such as streamlining Islamic school can be carried out through waqf auctions funds. This study is an attempt to clarify the implementation of waqf auction to finance the establishment of an Islamic institution. Then, it discuses the concept and practice of this waqf auction on the perspective of Islamic law and positive law. The methodology used is qualitative research that is using legal sociology and critical legal analysis, data collected through field research, a document study,  and in-depth interviews. The documents studied were journals, books, papers, and relevant documents for this study. The finding of research reveals that Trensains Islamic Institution is implementing a similar practice of waqf in general. The uniqueness is introducing to the community the development of the waqf system by opening a service office. In the practice of waqf, the Trensain Islamic Boarding School had previously purchased land using bank funds. While the repayment, Treansain auctioned waqf by publishing waqf certificates of 300 per meter and announced using several media. The system of waqf is carried out together. The practice of waqf in Islamic boarding schools is valid according to the provisions of Islamic law. However, based on positive law, they have not met all the requirements. The problem is that the Trensains Islamic Institution should immediately register the nadzir (manager) in the Minister of Religious Affairs and Indonesian Waqf Board.

Abstract

The purpose of this paper is to analyze the role of Islamic banks as providers ofIslamic wealth management product in relation with the enhancement of waqf funds.Theauthors use qualitative research that refers to the meanings, concepts, definitions,characteristics, metaphors, symbols and descriptions of the matter understudy by employscontent and descriptive analysis in order to get finding of the study. The data collectionis generated from Islamic sources: Qur’an, Sunnah and some Islamic literatures, andother sources such as books, journals, report documents, magazines and articles frominternet. These sources will be put in to coding and analyzed to answer the researchproblem of study. The role of Islamic wealth management is not only focusing on worldlyinvestment helping the clients’ need, but also hereafter investment. One of the instrumentsof wealth distribution that can be used for hereafter investment is waqf that helps theclients’ wealth to obtain blessing (barâkah) of Allah. By waqf, Islamic wealth managementinstrument can accomodate all models of waqf funds from cash waqf, insurance waqf,corporate waqf, etc. There are three options to of putting their wealth in waqf funds,they are: (i) family waqf, (ii) public waqf, and (iii) combination of waqf. All benefits ofthese waqf can contribute the the development of ummah. This paper is one of the veryfew conceptual studies concerning the practice of Islamic banking in implementing theproduct of wealth management for social purposes which is enhancement of waqf fundsfor the benefit of ummah.

Abstract

The purpose of this research is to analyze the influence of mudharaba contract, profitsharing rate and grant of mudharabah muthlaqah contract on customer’s interest to do savingand to ascertain how the mechanism of grant distribution on the mudharabah muthlaqahcontract in Muamalat Bank of Indonesia, branch of Sragen. The findings are that MudharabaContract, Profit Sharing Rate and Grant on the Mudharabah contract, had influenced thecustomer’s interest to do saving in Muamalat Bank. Resulted that F test had shown F point asmuch as 2,783 with significant point as much as 0,165 more than 0.05, while determinationcoefficient was shown by R2 as much as 0.093 or 9,3% had influenced on the customer’sinterest to do saving, while the 90,7% had influenced by other factor.

Abstract

This research is aimed at finding the curriculum design of Islamic economic, especially on its epistemological basis, its method of integration and its method of teaching. The object of research is postgraduate program at universities that offer the degree of Islamic Economic. The universities that will be researched represent four outstanding countries that have serious concern on Islamic economic studies. Those universities are International Islamic University Islamabad Pakistan, Istanbul Sabahattin Zaim University, International Islamic University of Malaysia and four Universities of Indonesia i.e. Islamic State University Sunan Kalijaga Yogyakarta, Islamic State University Sunan Ampel, University of Airlangga, and STIE Tazkia. The data will be collected through documentary and interview method. To analyze the data the researchers employs descriptive, compare and contrast, and synthesis method. The curriculum design that includes the vision and mission where epistimological aspects are clearly stated, in most of Islamic economics departments. However, not all departments that state explicity their vision and mission and objective clearly have clear statement on the integration of conventional and Islamic economics. Islamic State University Sunan Kalijaga Yogyakarta, Islamic State University Sunan Ampel, University of Airlangga, STIE Tazkia, and Istanbul Sabbahatain Zaim do not state clearly the vision and mission in relation the program of integration and Islamization. So the epistimological aspect is not taken into serious consideration as the vision and mission of the program. The Universities that clearly state the integration and Islamization are Islamic Science University of Malaysia, International Islamic University of Islamabad, and International Islamic University of Malaysia.

Abstract

This article highlights the principles and implementation of Islamic banking marketing ethics. Ethics based on sharia principles are an essential differentiator from their competitors. It begins from the 4 P's marketing mix framework, namely product, price, promotion, and place. This article is qualitative descriptive research using literature review. This article employs secondary data from 11 articles. The data that has been collected then analyzed with descriptive information. Therefore, through 4 P's marketing mix lens, this article finds a lack of ethical marketing practices in Islamic Banking from the ethical ideals espoused in the literature. This study analyzes the ethical marketing practices of Islamic banks which can be used as an evaluation of policies in the Islamic financial industry.

Abstract

In the book "Theory and Practice of Islamic Economics: The Basics of Islamic Economics" Dr. Mohammad Abdul Mannan, explained that the Islamic social order is based on the Quran and the Sunnah of the Prophet Muhammad, which can be formed if each resident is able to maintain harmony among the families, families with the public, community and government, namely creation of an implementation of the rights and obligations can be met. Furthermore, he expressed the characteristics of an Islamic social order that is social equality, the right to exploit the wealth proportionately and private ownership recognized and protected in Islam, an Islamic mandate to engage in economic activities by setting a good rule to ensure the implementation of these activitiesin an honest and benefit, elimination of the capitalist system in all fields of economic activity,  modern planning concept that refers to the utilization of domestic resources to achieve certain goals which are subject to the orders of the holy book of Qur'an and Sunnah, the creation of social justice. Other than that he would affirm the concept of welfare state in Islam, by applying the values in the teachings of Islam as a moral and spiritual values,  economic values, and Islamic social and political values.  Next will be explained about the Islamic social order is clear, concise, and solid.Keywords: Islamic social order and its characteristics, the concept of welfare states with moral , spiritual, social, political, and economic.

Abstract

This article describes the structure of the waqf concept from a worldview theory perspective. Worldview is simply a fundamental belief system concerning God, reality, man and truth, ethics, etc.; which serves as a guide for human life. A person's worldview will determine his behavior and actions. The next question is what kind of belief concept makes someone willing to do waqf? This article is a literature review that employs qualitative data with a philosophical approach. The data analysis method employs content analysis of data sources from the library. The result shows that the worldview analysis on waqf is a concept that was emerging from the Islamic worldview whose emergence was supported by various other fundamental concepts such as God, Prophets, Revelation, and Sharia (religion). It proves that the structure of the waqf concept is not as simple as handing over the property to Allah for the benefit of others. The peculiarity of such waqf concept seems impossible to be affirmed by the secular Western worldview, which is unable to affirm the concept of revelation, the Prophet, and religion. It also proves that the philosophical foundation of a waqf concept built on an Islamic worldview is very consistent, solid, and even has a broad spectrum that spans the worldly and the hereafter visions simultaneously.

Abstract

The recent appraisal of Islamic Banking and Finance (IBF) development has focused on the interest based banking system. Banks role and function have been retained to create sharia compliant instruments to replace conventional banks interest based instruments. Another issue is the objective of Islamic banking to contribute to social obligation despite profit maximization. In this context, IBF institutions have been involved in debt financing oriented transactions such as murabahah instead of musyarakah and mudharabah, as they are more profitable. This research attempts to clarify Islamic banking's objective derived from Muslim scholars views and how it complies with sharia. Thus, it is necessary to rethink the paradigm of IBF that is in line with pure Islamic economics, whereas conventional banking has been shifting toward social banking. The methodology used is qualitative-descriptive-literature. The result is, several applied integrated models in IBFs, such as Social Islamic Bank Limited (SIBL), have offered Mudaraba Waqf Cash Deposit Account (MWCDA). Then sadaqa house is provided by Bank Islam Malaysia Berhad (BIMB), an integrated institution model in which Islamic banking can cooperate with other Islamic social finance such as waqf institutions in Indonesia. Finally, the research finding argues that Islamic banking's paradigm is to promote the ummah's maslahat by integrating commercial and social aspects into its operational and objective.Penilaian perkembangan Islamic Banking and Finance (IBF) baru-baru ini berfokus pada sistem perbankan berbasis bunga. Peran dan fungsi bank tetap dipertahankan untuk menciptakan instrumen yang sesuai dengan syariah untuk menggantikan instrumen berbasis bunga bank konvensional. Isu lain adalah tujuan perbankan syariah untuk berkontribusi pada kewajiban sosial selain juga keuntungan maksimal. Dalam konteks ini, lembaga IBF telah terlibat dalam transaksi yang berorientasi pembiayaan hutang seperti murabahah daripada musyarakah dan mudharabah, karena lebih menguntungkan. Penelitian ini mencoba mengklarifikasi tujuan perbankan syariah yang berasal dari pandangan cendekiawan Muslim dan bagaimana kepatuhannya terhadap syariah. Dengan demikian, perlu dipikirkan kembali paradigma IBF yang sejalan dengan ekonomi Islam murni, padahal perbankan konvensional sudah bergeser ke arah social banking. Metodologi yang digunakan adalah kualitatif-deskriptif-literatur. Hasilnya, beberapa model terintegrasi yang diterapkan di IBF, seperti Social Islamic Bank Limited (SIBL), telah menawarkan Mudharabah Waqf Cash Deposit Account (MWCDA). Kemudian, rumah sedekah disediakan oleh Bank Islam Malaysia Berhad (BIMB), sebuah model lembaga terpadu dimana perbankan syariah dapat bekerja sama dengan keuangan sosial Islam lainnya seperti lembaga wakaf di Indonesia. Akhirnya, temuan penelitian ini berpendapat bahwa paradigma perbankan syariah adalah mempromosikan kemaslahatan umat dengan mengintegrasikan aspek komersial dan sosial ke dalam operasional dan tujuannya.

Abstract

Information technology that has developed so rapidly in recent years has directed the focus of large banks to digital services, including mobile banking. The internet's rapid growth is changing how companies connect with their customers, and the banking business is no exception. Of course, the concept of blessing must be prioritized by every Muslim, especially in banking institutions. This research aims to analyse the BSI Mobile application's existing mobile banking service system. In 2021, Bank Syariah Indonesia (BSI) started to merge 3 (three) Islamic commercial banks in Indonesia, at the same time, to support the development of information technology (especially in banking), BSI has also created a BSI Mobile application to facilitate transactions. This research is qualitative research with a grounded research approach and uses a qualitative descriptive analysis method. However, even though the service system in the BSI Mobile application has met customer needs and is under the basic principles of sharia, many customers or the Muslim community who have not used it do not even know the system and application. Ultimately, it will impact applications that cannot be utilized optimally. Based on the results of research that the researcher have done, the BSI mobile banking service system should emphasize the publication and socialization of BSI Mobile products with various methods, including approaches that use sharia principles because legal regulations will be applied due to threats and legal causes that occur.Teknologi informasi yang berkembang begitu pesat dalam beberapa tahun terakhir telah mengarahkan fokus bank-bank besar ke layanan digital, termasuk mobile banking. Pesatnya pertumbuhan internet mengubah cara perusahaan terhubung dengan pelanggan mereka, dan bisnis perbankan tidak terkecuali. Tentunya konsep berkah harus diprioritaskan oleh setiap Muslim khususnya di lembaga perbankan. Penelitian ini bertujuan untuk menganalisis sistem layanan mobile banking yang ada pada aplikasi BSI Mobile. Pada tahun 2021, Bank Syariah Indonesia (BSI) sudah mulai menggabungkan 3 (tiga) bank umum syariah di Indonesia, sekaligus untuk mendukung perkembangan teknologi informasi khususnya di bidang perbankan, BSI juga telah membuat aplikasi BSI Mobile untuk mempermudah transaksi. Penelitian ini merupakan penelitian kualitatif dengan pendekatan grounded research, dan juga menggunakan metode analisis deskriptif kualitatif. Namun, meskipun sistem layanan pada aplikasi BSI Mobile telah memenuhi kebutuhan nasabah dan sesuai dengan prinsip dasar syariah, namun banyak dari nasabah atau masyarakat Muslim yang belum menggunakannya bahkan belum mengetahui sistem dan aplikasi tersebut. Pada akhirnya akan berdampak pada penggunaan aplikasi yang tidak dapat dimanfaatkan secara maksimal. Berdasarkan hasil penelitian yang telah peneliti lakukan, sistem layanan BSI mobile banking dapat meningkatkan publikasi dan sosialisasi produk BSI Mobile dengan berbagai metode termasuk pendekatan yang menggunakan dalil prinsil syariah, karena secara hukum peraturan akan diterapkan karena adanya ancaman dan sebab hukum yang terjadi.
