Abstract

This paper tries to investigate the historical development of Islamic banking in the world. The formation of Islamic banking was inspired by the incompatibility between conventional banks and Islamic teachings based on the Qur'an and al-Hadith. Islamic economists are trying to replace and improve the traditional system of banking that has developed rapidly with the Islamic banking system. The establishment of Mit Ghamr marked the emergence of Islamic banking. Since then, many Islamic banks have been established and have proliferated. The primary purpose of this study is to analyze and determine the historical development of the Islamic banking system in various countries. Thus, this research can provide further information for Muslim economic actors as a guide in carrying out economic activities, especially those related to banking. This study using the historical analysis method and at the end of this paper, confirm that the Islamic banking system was preceded by applying a profit-sharing approach to avoid interest in banking. The development of Islamic banks cannot be separated from the efforts made by the Organization of the Islamic Conference (OIC), which since 1970 has issued many recommendations and encouraged its member countries to improve the people's economy in their respective countries. Then, Islamic banks developed in various countries, including Pakistan, Egypt, Iran, Cyprus, Kuwait, Bahrain, United Arab Emirates, Malaysia, Turkey, and Indonesia.

Abstract

Equity crowdfunding is a new innovation in finance, which is an external product of financial technology, by combining financial systems with information technology. Equity crowdfunding is a combination of investment business model with information technology, where meetings between investors and fund managers are conducted online through websites on this platform. Crowdfunding equity platform is now growing rapidly and is very popular among the community, due to some of the facilities offered by the platform organizers for service users. Therefore, further research needs to be done on this business practice, which covers all aspects of the mechanisms and systems on this platform. The purpose of this study is to determine the mechanisms and systems of all aspects of the investment cooperation agreement model applied on the equity crowdfunding platform. The intended aspects include the mechanism of agreement (contract), profit sharing system, user protection, stock trading mechanism, dispute resolution, risk management, and so on. Furthermore, it aims to determine its compliance with Islamic law and the positive laws that apply in Indonesia. Investment agreements on equity crowdfunding platform can be implemented in mudharabah agreement, meanwhile, the agreement between the crowdfunding service provider and the crowdfunding user can use the wakalah bil ujrah contract. The percentage to revenue ratio can use the profit and loss distribution system and the revenue distribution system according to the agreement. Equity crowdfunding platform should really pay attention to consumer protection in accordance with the provisions in accordance with POJK and hifdzul maal theory. In addition, it must carry out risk management to minimize the occurrence of losses for some parties, and create a dispute resolution mechanism in accordance with Islamic law and economic law.

Abstract

 Since the issuance of the 2003 MUI fatwa about the interest is forbidden, Islamic banks are growing rapidly but its slower than conventional banks market share. The villager has not been reached to socialize about the activities of Islamic banks. So as the villager who have low income levels,  related only to conventional financial institutions such as cooperatives, rural banks, banks and even moneylenders because the Islamic financial institutions are not reached by them. This study aims to analyze religious and economic preferences and behaviour of rural people towards Islamic banking. This study uses descriptive statistical analysis research with quantitative and qualitative approaches. The data used are primary and secondary data obtained from questionnaires distributed to 90 respondents and interviews from certain figures. The data analysis method used is frequencies.The results of the study show that religious and economic preferences are the most important factors that greatly influence to the behavior of rural people towards Islamic banking.This makes Islamic bank is urgent to accommodate that can not be done by conventional bank, especially in terms of the maslahah  afterlife in order to stay away from usury that is unlawful so it is in line with the Islamic principal مَا لَا يُدْرَكُ كُلُّهُ لَا يُتْرَكُ كَلُّهُ  and الْمَيْسُوْرُ لَايَسْقُطُ بِالْمَعْسُوْرِ.

Abstract

Peer to peer lending menjadi solusi terbaik bagi para pengusaha UMKM, sehingga perkembangan start-up ini sangat cepat. Kemudahan dalam mekanisme yang ditawarkan menjadi faktor utama percepatan pertumbuhan start-up ini. Maka mulai berkembang beberapa platform peer to peer lending di Indonesia. Namun sistem yang digunakan masih berlandaskan pada sistem ekonomi konvensional, yang masih mengambil keuntungan dengan sitem bunga. Sementara bunga sangat dilarang dalam Islam, karena bunga dalam ekonomi Islam dianalogikan sebagai riba. Sedangkan dalam fiqh muamalah, transaksi yang halal adalah transaksi yang terlepas dari unsur-unsur maghrib (maisyir, gharar, dan riba). Supaya transaksi peer to peer lending terlepas dari unsur-unsur maghrib, maka peneliti akan membuat desain peer to peer lending yang sesuai dengan prinsip ekonomi Islam, dengan mengimplementasi akad murabahah pada transaksi peer to peer lending. Sehingga keuntungan yang diambil tidak menggunakan sistem riba. Penellitian ini menggunakan metode kualitatif-deskriptif-kepustakaan. Kesimpulan yang didapat adalah supaya transaksi peer to peer lending terhindar dari unsu-unsur maisyir, gharar, dan riba (maghrib), maka dapat diterapkan akad murabahah pada transaksi ini. Akad murabahah diterapakan pada ketiga pihak layanan peer to peer lending atau hanya pada kedua pihak saja, yaitu pihak pemberi pinjaman (lender) dan pihak penerima pinjaman (borrower). Penyelenggara layanan dan pihak memberi pinjaman berperan sebagai ba’i (penjual) dan penerima pinjaman berperan sebagai musytari (pembeli) selaku pihak yang mengajuakan pembiayaan untuk pembelian suatu barang yang dibutuhkan.

Abstract

Sharia economic dispute is a conflict of interest or loss for either party to the business or activities carried out by individuals, groups of people, or business entities that are legal or not legal entities to meet the needs of a commercial and non-commercial nature according to sharia principles. Furthermore, it can be resolved through litigation or judicial and non-litigation, or out-of-court lines. Resolution disputes through religious courts always takes a long time and complicated administration, but until now is it still in high demand by justice seekers. There is dispute resolution outside the judiciary, one of which is arbitration through National Sharia Arbitration Board (BASYARNAS) which can be the solution. This paper is a qualitative research study with a case was taken from Religious Court Class 1A Sleman and BASYARNAS Representative In Yogyakarta. The findings of this study provide the results dispute resolution in religious courts is more desirable because it has more executive powers than BASYARNAS, and also religious courts hold the absolute authority of sharia economic dispute resolution and religious courts spread throughout districts in Indonesia, so religious courts are very easy to find, in contrast to BASYARNAS whose existence is still in every capital of several provinces in Indonesia. Religious courts are superior because of the quality of judges, their presence in every district in Indonesia, and the culture of the people.

Abstract

Post pandemic of COVID-19 has opened some opportunities and challenges for everyone to be able to optimize digital activities. The digitalization concept that has been implemented by entrepreneurs who can stand despite the global pandemic outbreak can be an option even with the very potential for entrepreneurs to maximize profits. The practice of using QRIS in Indonesia is still only felt for large markets in urban areas, so it has not been maximally penetrated by markets in rural areas and border areas. As is the case with micro, small and medium enterprises (MSMEs) with home-based models that exist in rural areas and only have small capital. As for MSME actors in Prayungan Village, Sawoo District, Ponorogo Regency, the QRIS payment system has the potential to be implemented. This service activity is carried out by Darussalam Gontor University using training and mentoring methods regarding the benefits of the QRIS digital payment system for MSMEs. The purpose of this service is to provide education to MSME actors and be able to transform in the digital era. The results of this service were the realization of making QRIS for MSMEs and the survey results reached 80% who were very satisfied with the implementation of training and assistance for the QRIS payment system for MSMEs.

Abstract

Information technology that has developed so rapidly in recent years has directed the focus of large banks to digital services, including mobile banking. The internet's rapid growth is changing how companies connect with their customers, and the banking business is no exception. Of course, the concept of blessing must be prioritized by every Muslim, especially in banking institutions. This research aims to analyse the BSI Mobile application's existing mobile banking service system. In 2021, Bank Syariah Indonesia (BSI) started to merge 3 (three) Islamic commercial banks in Indonesia, at the same time, to support the development of information technology (especially in banking), BSI has also created a BSI Mobile application to facilitate transactions. This research is qualitative research with a grounded research approach and uses a qualitative descriptive analysis method. However, even though the service system in the BSI Mobile application has met customer needs and is under the basic principles of sharia, many customers or the Muslim community who have not used it do not even know the system and application. Ultimately, it will impact applications that cannot be utilized optimally. Based on the results of research that the researcher have done, the BSI mobile banking service system should emphasize the publication and socialization of BSI Mobile products with various methods, including approaches that use sharia principles because legal regulations will be applied due to threats and legal causes that occur.Teknologi informasi yang berkembang begitu pesat dalam beberapa tahun terakhir telah mengarahkan fokus bank-bank besar ke layanan digital, termasuk mobile banking. Pesatnya pertumbuhan internet mengubah cara perusahaan terhubung dengan pelanggan mereka, dan bisnis perbankan tidak terkecuali. Tentunya konsep berkah harus diprioritaskan oleh setiap Muslim khususnya di lembaga perbankan. Penelitian ini bertujuan untuk menganalisis sistem layanan mobile banking yang ada pada aplikasi BSI Mobile. Pada tahun 2021, Bank Syariah Indonesia (BSI) sudah mulai menggabungkan 3 (tiga) bank umum syariah di Indonesia, sekaligus untuk mendukung perkembangan teknologi informasi khususnya di bidang perbankan, BSI juga telah membuat aplikasi BSI Mobile untuk mempermudah transaksi. Penelitian ini merupakan penelitian kualitatif dengan pendekatan grounded research, dan juga menggunakan metode analisis deskriptif kualitatif. Namun, meskipun sistem layanan pada aplikasi BSI Mobile telah memenuhi kebutuhan nasabah dan sesuai dengan prinsip dasar syariah, namun banyak dari nasabah atau masyarakat Muslim yang belum menggunakannya bahkan belum mengetahui sistem dan aplikasi tersebut. Pada akhirnya akan berdampak pada penggunaan aplikasi yang tidak dapat dimanfaatkan secara maksimal. Berdasarkan hasil penelitian yang telah peneliti lakukan, sistem layanan BSI mobile banking dapat meningkatkan publikasi dan sosialisasi produk BSI Mobile dengan berbagai metode termasuk pendekatan yang menggunakan dalil prinsil syariah, karena secara hukum peraturan akan diterapkan karena adanya ancaman dan sebab hukum yang terjadi.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh persepsi dan religiusitas terhadap kebiasaan bersedekah mahasiswi UNIDA Gontor, Kampus Mantingan, Indonesia. Penelitian ini merupakan penelitian kuantitatif dengan pendekatan Structural Equation Modeling (SEM) dengan menggunakan software SmartPLS (v.3.2.9). Hasil yang didapat adalah: (1) Persepsi berpengaruh secara positif dan signifikan terhadap kebiasaan bersedekah, berdasarkan hasil nilai variabel eksogen (persepsi) pada path coefficients adalah 0.323 dan hasil uji t-statistic nilai hubungan persepsi dengan kebiasaan bersedekah sebesar 4.146; (2) Religiusitas berpengaruh secara positif dan signifikan terhadap kebiasaan bersedekah, berdasarkan hasil nilai variabel eksogen (religiusitas) pada path coefficients adalah 0.447 dan hasil uji t-statistic nilai hubungan religiusitas dengan kebiasaan bersedekah sebesar 6.332.

Abstract

Baitul Qur'an Social Fund Institution is one of the social fund institutions in Ponorogo which is located in Gontor, Mlarak, Ponorogo. This institution was established in 2015 and under the management of the Baitul Qur'an Islamic Boarding School Sholeh Children's. the unique features of this institution is that in raising funds uses the ZISCO system strategy, ZISWAF pickup which was adopted from the YDSF Al-Fatah Surabaya system. This system is carried out by visiting several donors in order to pick up the donations that will be distributed. This has improved the good relationship between muzakki and institutions, thus strengthening the friendship and sense of kinship between the two parties. The funds that have been collected will be distributed to ashnaf who really need the funds through several programs at the Baitul Qur'an Social Fund Institution.

Abstract

Sebagaimana diamanatkan oleh Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) untuk menjamin warga negaranya untuk mengekspresikan ritual keagamaan mereka, pemerintah menciptakan sistem jaminan halal. Sebelum tahun 2014, peraturan yang berlaku adalah KMA RI no. 519 tahun 2001 yang kemudian direvisi dengan UU 33/2014. Perubahan regulasi ini berdampak pada LPPOM MUI sebagai lembaga yang selama ini menjadi instrumen utama dalam penegakan sistem jaminan halal di Indonesia. Penelitian ini berusaha menganalisis kewenangan apa saja yang berubah setelah berlakunya undang-undang baru tersebut dengan menitikberatkan pada aspek legalitas, kewenangan dan keuangan. Dengan menggunakan studi kepustakaan yang dilanjutkan dengan analisis deskriptif, penelitian ini menemukan bahwa ketiga aspek tersebut telah mengalami perubahan. Legalitas LPPOM MUI semakin kuat, kewenangannya berkurang tetapi tidak setingkat LPH lainnya, dan alur dan kewenangan penetapan fee terpusat pada BPJPH dengan beberapa komponen biaya yang masih ditentukan berdasarkan kebijakan LPH terkait.
