Abstract

Kemajuan teknologi yang terjadi menghasilkan banyak penemuan baru, salah satunya emoji dalam komunikasi. Masyarakat mulai beralih dari komunikasi secara konvensional menuju komunikasi melalui sistem elektronik. Walaupun esensi dari komunikasi tidak berubah signifikan, nyatanya terjadi konflik terkait penggunaan emoji itu sendiri, dalam hal ini terkait emoji thumbs up. Oleh karena itu, diperlukan suatu penelitian komprehensif mengenai relevansi kedudukan emoji thumbs up di Indonesia. Penelitian ini menerapkan metode yuridis normatif yaitu meneliti sumber kepustakaan atau bahan sekunder. Penelitian ini membahas mengenai kedudukan emoji thumbs up itu sendiri serta sejauh mana praktik di Indonesia dapat mengakomodir penggunaan emoji thumbs up di Indonesia. Hasil penelitian menunjukkan bahwa Indonesia belum mengatur mengenai kedudukan emoji thumbs up. Namun, berdasarkan regulasi lainnya yang berkaitan dengan sistem elektronik, kedudukan emoji thumbs up sendiri belum dapat disamakan dengan bentuk-bentuk persetujuan elektronik lainnya.

Abstract

One of intellectual property that has legal protection in Indonesia is industrial design. In Indonesia, industrial design is closely related to the handicraft industry. In Indonesia there is already a registration of industrial designs that use handicraft designs such as traditional batik motif designs which are protected by copyright as an expression of traditional culture. This phenomenon is an overlapping and intersecting issue between the fields of copyright and industrial design. For this reason, legal studies are urgently needed to determine whether a traditional cultural expression can have industrial design novelty or not. This article uses a normative juridical approach, in the form of an analysis of legal principles of Indonesia’s law which is related to research problems. Based on the research results, traditional batik motifs fulfill the elements of an industrial design that can be registered and protected by the industrial design legal framework in Indonesia. The principle of novelty of industrial design can be implemented to filter the novelty of industrial design in selecting registration of traditional batik motifs as industrial designs. The legal protection of traditional batik motifs based on the Industrial Design Law has not been regulated comprehensively and clearly, the legal protection is only regulated as a disclosure of pre-existing industrial designs. A theoretical approach is needed in applying the articles regarding provisions for checking the novelty and registration of industrial designs related to communal intellectual property using the legal principles and theories that underlie the formation of the Industrial Design Law in Indonesia.

Abstract

Social media as a digital platform has a highly specialized design. Firstly, the content distribution is massive and instantaneous; and secondly, all the information and contents contained in the social media are relatively permanent, almost eternal, and are easily accessible even though it has been for decades. Furthermore, it is becoming easier to find sources of information with a search engine, such as Google, that can display up to millions of search results in a fraction of a second. The guarantee of the right to privacy is, then, related to a new right that was first recognized on the European continent, namely the right to be forgotten which is part of the Privacy Right. Indonesia is the first country in the South East Asia to recognize the right to be forgotten.Meanwhile, Indonesia has provided a clear legal infrastructure to accommodate the enforcement of the right to be forgotten, namely, through regulation in Article 26 paragraph (3) of Law Number 19 of 2016 on the Amendments to Law Number 11 of 2008 on Electronic Information and Transactions. Aspects with regards to this right are also regulated in Article 16 - Article 18 of Government Regulation Number 71 of 2019 on the Implementation of Electronic Systems and Transactions. This article focuses on examining how the application of the right to be forgotten in the context of using social media in Indonesia.

Abstract

One of the important approaches to be studied on the issue of overlapping copyright and industrial design rights in Indonesia today is the practice of dispute resolution in the judiciary and its impact on stakeholders. In this research, the method used is a statutory approach with analytical descriptive specifications. This research found that Indonesia does not yet have preventive legal arrangements and protection for disputes over copyright and industrial design rights. The results of this study indicate that the settlement of overlapping disputes between copyright and industrial design rights in Indonesia does not reflect the principle of fairness because there is no comprehensive rule of law that can bridge between the two legal regimes. Therefore, a form of harmonization and renewal of copyright law and industrial design rights is needed, to ensure justice and legal certainty for all parties to the practice of dispute resolution.

Abstract

Perkembangan Generative Artificial Intelligence (AI) menimbulkan tantangan baru dalam perlindungan hak cipta, khususnya terkait penggunaan karya berhak cipta sebagai data latih. Penelitian ini membandingkan pendekatan Amerika Serikat melalui doktrin fair use dengan pengaturan di Indonesia berdasarkan UU Hak Cipta dan Permenkumham Nomor 15 Tahun 2024. Di Amerika Serikat, legalitas pelatihan AI dinilai secara kontekstual melalui empat faktor fair use, yang memberi ruang inovasi namun tetap membatasi dampak terhadap pencipta dan pasar. Sebaliknya, Indonesia menerapkan pendekatan yang lebih protektif dengan mengkategorikan pelatihan AI sebagai penggunaan sekunder yang memerlukan izin dan pembayaran royalti melalui LMK. Meskipun berbeda pendekatan, kedua negara berupaya menyeimbangkan inovasi teknologi dan perlindungan hak cipta, dengan rekomendasi penguatan regulasi Indonesia melalui transparansi dataset, lisensi adaptif, dan harmonisasi standar internasional.

Abstract

Teknologi informasi dan telekomunikasi dapat dimanfaatkan pada berbagai bidang atara lain bidang pendidikan, bisnis, pemerintahan dan sosial. Perkembangan Ilmu Pengetahuan dan Teknologi (IPTEK) yang cukup pesat sekarang ini sudah menjadi realita sehari-hari bahkan merupakan tuntutan masyarakat yang tidak dapat ditawar lagi. Administrasi merupakan suatu fenomena sosial, yaitu perwujudan tertentu didalam masyarakat modern. Administrasi dalam arti sempit merupakan kegiatan ketatausahaan yang meliputi kegiatan catat- mencatat , surat menyurat , pembukuan dan pengarsipan surat sertahal-hal lainnya yang dimaksudkan untuk menyediakan informasi serta mempermudah dan memperoleh informasi kembali jika dibutuhkan. Di Indonesia, saat ini sudah mulai banyak lembaga-lembaga pemerintahan yang mulai memanfaatkan kemajuan teknologi informasi ini guna diaplikasikan sebagai media dalam memberikan kemudahan penyampaian informasi publik dan kemudahan pelayanan publik. Hal ini misalnya dalam penggunaan pendaftaran e-ktp yang dirasakan adanya kebutuhan akan penerapan teknologi informasi dan teknologi komunikasi tersebut dalam mencapai kualitas pelayanan untuk masyarakat, dan tercapainya transparansi, akuntabilitas, partisipasi, efisiensi.

Abstract

Abstract Digital copyright protection in Indonesia still faces major challenges amid the rapid development of increasingly popular Over-The-Top (OTT) services. OTT services facilitate the widespread distribution of creative works, but also increase the potential for digital copyright infringement, such as piracy and unauthorized copying. To overcome this problem, the use of adequate copyright protection technology is needed as an effort to optimize digital copyright protection on OTT services. This study aims to analyze the application of the Electronic Copyright Management System (ECMS) as an effective solution in protecting digital copyright on OTT services in Indonesia. Using normative and comparative legal research methods, this study analyzes the applicable regulations related to digital copyright in Indonesia and compares them with regulations in the United States. The results show that although Indonesia already has regulations on copyright, the existing regulations still do not adequately accommodate the protection of digital copyright and the implementation of security technology. Meanwhile, the United States, through the Digital Millennium Copyright Act (DMCA), has implemented ECMS as a digital copyright security technology. This study proposes the implementation of ECMS in Indonesia to optimize the protection of digital copyright, both preventively and repressively, and provides recommendations for more comprehensive regulatory updates.
