Abstract

This research aims to investigate the roles that Land Deed Making Officials (PPAT) play in the purchase and sale of land, particularly in cases where the legal owner is not present. Normative Legal Research is the research method employed to analyse the case of Decision Number 3/Pdt.G/2023/PN. Tyres are used as case studies to show the legal implications of actions that violate the landowner's consent in a sale and purchase transaction. The results showed that Decision Number 3/Pdt.G/2023/PN. Ban, PPAT has a big responsibility in ensuring legal land sale and purchase transactions. The sale and purchase deed was executed without the landowner's consent, so because PPAT neglected to carefully fulfil its obligations, it is void. PPAT responsibilities include civil, criminal, and administrative aspects. PPAT can be punished if you make a false deed, and can be subject to administrative sanctions. This ruling confirms the importance of PPAT compliance with legal procedures to maintain legal certainty in property transactions. The legal consequences of this ruling emphasize the importance of valid consent in property transactions to prevent unlawful acts.AbstrakStudi ini bertujuan untuk mempelajari tanggung jawab Pejabat Pembuat Akta Tanah (PPAT) dalam proses transaksi jual beli tanah, terutama dalam kasus di mana transaksi terjadi tanpa persetujuan pemilik yang sah. Fokus penelitian ini adalah kasus putusan Nomor 3/Pdt.G/2023/PN.Ban. Metode penelitian hukum normatif digunakan. Ban yang digunakan sebagai studi kasus untuk menunjukkan implikasi hukum dari tindakan yang melanggar persetujuan pemilik tanah dalam transaksi jual beli. Hasil penelitian menunjukkan bahwa Putusan Nomor 3/Pdt.G/2023/PN.Ban, PPAT memiliki tanggung jawab besar dalam memastikan transaksi jual beli tanah legal. Tanggung jawab PPAT mencakup aspek perdata, pidana, dan administratif; namun, jika PPAT tidak melakukan tugasnya dengan benar, akta jual beli tersebut menjadi batal secara hukum karena tidak adanya persetujuan dari pemilik tanah. Jika PPAT membuat akta palsu, mereka juga dapat dikenai sanksi pidana dan administratif. Putusan ini menegaskan pentingnya kepatuhan PPAT terhadap prosedur hukum untuk menjaga kepastian hukum dalam transaksi properti. Akibat hukum dari putusan ini menekankan pentingnya persetujuan sah dalam transaksi properti untuk mencegah perbuatan melawan hukum.

Abstract

Tidak adanya bukti pencatatan pernikahan menimbulkan sejumlah dampak, tidak hanya kepada pasangan suami dan istri, tetapi berdampak kepada anak-anak hasil perkawinan tersebut. Sebagaimana kewajiban warga negara Indonesia yang baik setiap peristiwa penting di dalam kehidupannya wajib untuk dilaporkan dan dicatat kepada dinas penduduk dan pencatat sipil. Pernikahan yang tidak tercatat akan mempengaruhi kedudukan status hukum seseorang dan berdampak pula pada pembagian warisan ketika salah satu pihak meninggal dunia. Akta perkawinan memberikan perlindungan kepada ahli waris jika sewaktu waktu terjadi gugatan. Sehingga dalam penulisan ini bertujuan untuk mengetahui pentingnya peristiwa pernikahan untuk dicatat oleh negara dan mengetahui negara melindungi hak pembagian waris bagi anak luar kawin yang diakui sah oleh orangtuanya. Penelitian ini menggunakan metode yuridis normatif bersumber dari peraturan perundang-undangan, putusan pengadilan nomor 44/Pdt.G/2021/PN Jkt.Pst, buku, artikel dari website serta jurnal. Dalam penelitian ini menyimpulkan bahwa anak luar kawin yang diakui sah tetap mendapatkan bagian haknya sesuai hukum waris golongan I atau pertama yang berhak mewaris secara penuh sebelum turunnya waris kepada golongan II, dimana putusan Mahkamah Konstitusi (MK) Nomor 46/PUU-VIII/2010 telah mengubah ketentuan Pasal 43 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan terhadap status keperdataan anak luar kawin juga mempunyai hubungan perdata dengan ayahnya sepanjang dapat dibuktikan

Abstract

Pada dasarnya notaris dituntut untuk membekali diri dengan memiliki kualitas standar pendidikan yang memuaskan, mempunyai kewenangan bertindak secara bebas dan mampu mengendalikan diri. Namun pada kenyataannya masih terdapat penyalahgunaan atas Akta Kuasa terhadap Persetujuan Kredit tambahan yang dibuat oleh Notaris dengan dibuatkannya akta kuasa tanpa sepengetahuan pihak ke tiga Dalam penelitian ini membahas bagaimana akibat hukum dan perlindungan hukum atas penyalahgunaan akta kuasa terhadap persetujuan kredit tambahan yang dibuat oleh notaris dengan dibuatkannya akta kuasa tanpa sepengetahuan pihak ke tiga. Teori hukum yang digunakan dalam penelitian ini adalah teori akibat hukum dari R. Soeroso sebagai teori pendukung dari teori utama yaitu teori Teori Perlindungan Hukum menurut Menurut Satjipto Rahardjo. Metode yang digunakan dalam penelitian ini adalah penelitian hukum yuridis normatif. Adapun pendekatan penelitian yang dipergunakan yaitu Pendekatan Perundang-undangan, Pendekatan Konseptual, Pendekatan Analis, Pendekatan Kasus dan teknik pengumpulan bahan hukum. Serta teknik analisa bahan hukum dilakukan Penafsiran Gramatikal, dan Penafsiran Sistematis. Akibat Hukum penyalahgunaan atas Akta Kuasa terhadap Persetujuan Kredit tambahan yang dibuat oleh Notaris dengan dibuatkannya akta kuasa tanpa sepengetahuan pihak ke tiga yaitu dapat dimintakan sanksi Administratif jabatan berupa peringatan tertulis kepada majelis pengawas notaris terhadap Notaris yang melanggar tersebut. Adapun tambahan perlindungan hukum menurut peneliti Terhadap Pemilik Sertipikat Atas Penyalahgunaan Akta Kuasa Persetujuan Kredit Yang Dibuat Oleh Notaris bahwa penggugat dapat meminta kepada Hakim dalam gugatannya yaitu tidak dijadikan tambahan yang berkedudukan sebagai subjek gugatan di kemudian hari jika pihak salah satu para tergugat dikemudian waktu melakukan upaya hukum kembali. Sebagai bentuk dari perlindungan hukum represif bagi pemilik sertifikat selaku pemberi kuasa.

Abstract

Pembahasan mengenai kepastian hukum pelaksanaan lelang  online melalui media internet. Jenis penelitian yang dipakai dalam penelitian ini adalah metode yuridis normatif. Pendekatan penelitian yang digunakan adalah, Pendekatan Perundang-undangan (Statute Approach), dan Pendekatan Kasus (Case Approach). kepastian hukum  pelaksanaan lelang online  melalui media  internet (online auction) oleh KPKNL merupakan transaksi  yang sah, dikuatkan dengan Undang-Undang Republik Indonesia Nomor 11 tahun 2008 tentang informasi dan transaksi elektronik dan dilakukan perubahan pada Undang-undang informasi dan transaksi elektronik Republik Indonesia Nomor 19 tahun 2016 yang  telah disahkan oleh pemerintah, serta adanya  perlindungan hukum  bagi pelaku atau pelaksana lelang sesuai dengan KUHPerdata. Implementasi pelaksanaan lelang online  melalui media  internet pada saat ini telah membantu masyarakat pelaku  lelang, sehingga dapat membantu mengurangi beberapa permasalahan  dalam   transaksi melalui media internet (online auction).

Abstract

This research aims to analyze the protection of human rights in criminal law in Indonesia, considering the importance of integrating human rights protection into a fair and effective criminal law system. This study uses a qualitative descriptive research method, utilizing primary data from case studies related to human rights violations and secondary data in the form of scientific literature, laws, and official documents from related institutions. Data were collected through documentation study techniques and media content analysis, which allowed for in-depth exploration of various cases and legal policies that had been implemented. Content analysis was used to identify key themes in legal documents and literature studies, while theoretical modeling helped formulate a theoretical model that links criminal law to human rights protection. The results of the study indicate that there is a discrepancy in several implementations of criminal law with human rights principles, especially in terms of protecting victims and fulfilling the rights of the accused. The conclusions obtained highlight the need for criminal law reform to ensure the fulfillment of basic rights for all individuals in accordance with international standards. This study provides recommendations for policymakers to integrate human rights protection more systematically into the criminal law system in Indonesia.

Abstract

A notary, as a public official, holds legal responsibility for any document or item entrusted to them in the scope of their professional duties. This paper examines the legal liability of Notary Albert Riwukore regarding the loss of nine land ownership certificates (SHM) that were initially deposited during the credit collateral process between Rachmat (debtor) and BPR Christa Jaya Perdana (creditor). Although the SHMs were retrieved by Rachmat—its legal owner—for photocopying purposes, the retrieval lacked written consent and official documentation from the notary's office. This raised legal concerns under both civil law (tort and breach of contract) and criminal law (alleged embezzlement). The analysis reveals that the notary’s responsibility must be distinguished between administrative negligence and criminal intent. No evidence supports the presence of dolus (malicious intent), although culpa (negligence) may still be applicable. Moreover, Rachmat's voluntary action as the rightful owner to retrieve the certificates eliminates a key element of embezzlement. This study underlines the importance of meticulous documentation systems and precautionary procedures in the notarial profession to avoid potential criminalization of their official duties.

Abstract

This study examines the legal aspects of mystery box sales transactions in e-commerce, which raise legal challenges, particularly regarding the validity of contract objects and consumer protection. The object of mystery boxes is often unknown to consumers, potentially leading to breach of contract. Under civil law, this may violate Articles 1320 and 1238 of the Civil Code. According to Law No. 8 of 1999 on Consumer Protection, the lack of clarity in mystery box contents may violate the consumer's right to accurate information and cause harm. This study emphasizes the importance of regulation and consumer education to ensure fair and lawful transactions.

Abstract

The making of authentic deeds by a notary is part of the legal service that has the highest evidentiary value in the Indonesian civil law system. One of the formal requirements of an authentic deed according to Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (UUJN) is the presence of two witnesses who know and directly witness the process of signing the deed. In notarial practice, notary staff are often appointed as witnesses for reasons of administrative convenience, trust, and availability of time. This study aims to examine the legal position and role of notary staff as witnesses in authentic deeds and the form of legal protection available if the deed is legally disputed. The research method used is normative legal with a statutory and conceptual approach, supported by literature studies and analysis of related court decisions. The results of the study indicate that notary staff are legally valid as witnesses as long as they meet the requirements as competent witnesses according to law. However, if a dispute arises over the deed, the staff can be asked for information as a witness in court and has the potential to face legal pressure. Therefore, legal protection for notary staff includes the principle of good faith, legal protection for witnesses, the right to legal assistance, and the ethical responsibility of notaries as employers. In conclusion, there needs to be more explicit regulations regarding the role of staff in deeds and clear protection mechanisms to maintain professionalism, integrity, and legal certainty in notarial practice.

Abstract

The procurement of products and services is an important component of economic activities, both in the public and private sectors. Nevertheless, in practice, legal complications often arise, which can hinder the progress of the project and result in financial losses for all parties. Administrative errors, violations of the law, and differences in contract interpretation that result in disputes are some of them. The purpose of this study is to investigate the legal protections afforded to aggrieved parties in procurement agreements. The expected result is a reduced risk of disputes and increased transparency and effectiveness in the procurement process through an understanding of the legal aspects that govern procurement. Legal protection in disputes over the procurement of goods and services was analyzed using a qualitative method with an analytical descriptive approach in this study. Data was collected from primary legal sources, including statutes, regulations, and court rulings, as well as secondary sources, including academic journals, books, and research reports. The findings of the study show that the procurement of goods and services still faces a range of challenges, including regulatory uncertainty and less transparent practices, which hinder legal protection. Therefore, the mechanism for procurement of goods and services needs to         be improved to increase effectiveness and fairness in resolving disputes.

Abstract

More and more people are taking advantage of the convenience offered by online shopping thanks to advances in information technology. Nevertheless, there are a number of legal issues lurking behind the convenience offered, including unclear rights and responsibilities of the parties, conflict resolution, and consumer protection from unsuitable or harmful products. The purpose of this study is to examine the strengths and weaknesses of the Indonesian legal system, evaluate the effectiveness of existing regulations, and determine the extent to which the parties to online sales and purchase agreements are legally protected. This study uses a qualitative normative juridical methodology, with information gathered from a review of laws, scientific articles, and other relevant legal documents. The results of the study show that the low level of public legal literacy and the absence of an efficient online dispute resolution process are 2 (two) areas where the laws governing consumer protection still have room for improvement. To build a secure and sustainable digital commerce ecosystem, existing legal protections for online transactions need to be optimized and legal education for consumers and business actors needs to be improved.
