Abstract

This article analyzes the programs of family planning village in the Ngingas Waru Village, known as the Kampung Logam (Blacksmith Village), Sidoarjo, East Java in the perspective of maqāṣid al-Syarī'ah (the theory of sharia objectives). In Islamic law, the family planning program is disputed, including the use of contraceptions. The author examines the implementation of the village planning program consisting of Tribina (BKB, BKR, BKL), UPPKS, and PIK-RM, in which they are then analyzed with the concept of maqāṣid al-syarī'ah. The results of the study concludes that the purpose of the formation of the family planning village programs in Ngingas is to improve a prosperous community, both in the fields of religion, health, education, descent, and economy. This concept is in accordance with the objectives of ḥif al-mujtama’ or ḥifẓ al-ummah in order to protect the rights of citizens related to maintaining the religion, the lives, the consciousness, the lineage, and the wealth.

Abstract

Jono Temayang Bojonegoro Village is known as a cultural tourism village. On January 20-February 19, 2016, 21 students of UIN Sunan Ampel Surabaya and a lecturer supervising the community in Jono Temayang Bojonegoro village in Real Work Participatory Action Research (KKN PAR). KKN PAR is implemented to optimize the empowerment of the community of cultural tourism village Jono Temayang Bojonegoro. Based on the results of mapping and transect, it is known that Jono village has tremendous potential to be developed from agriculture, animal husbandry, culture, religion and education. Among the problems faced by the Jono community are environmental, religious and educational issues. Based on the existing problems, then the action of the team accompanying the community is to establish a garbage bank, planting a toga plant, holding a "ngaji together", and private lessons. Desa Jono Temayang Bojonegoro dikenal sebagai desa wisata budaya.Pada 20 Januari-19 Februari 2016, 21 mahasiswa UIN Sunan Ampel Surabaya dan satu dosen pembimbing melakukan pengabdian masyarakat di desa Jono Temayang Bojonegoro dalam kegiatan Kuliah Kerja Nyata Participatory Action Research (KKN PAR). KKN PAR tersebut dilaksanakan untuk mengoptimalkan pemberdayaan masyarakat desa wisata budaya Jono Temayang Bojonegoro. Berdasarkan hasil mapping dan transect, diketahui bahwa desa Jono memiliki potensi yang luar biasa untuk dikembangkan, baik dari sector pertanian, peternakan, budaya, agama dan pendidikan. Diantara masalah yang dihadapi masyarakat Jono adalah masalah lingkungan, agama dan pendidikan. Berdasarkan masalah yang ada, maka maka action yang dilakukan tim pendamping bersama masyarakat adalah mendirikan bank sampah, menanam tanaman toga, mengadakan “ngaji bareng”, dan les privat.

Abstract

Pandemi COVID-19 masih terus menyebar di berbagai wilayah dan menimbulkan banyak korban setiap harinya serta berdampak besar bagi masyarakat menengah ke bawah. Pemerintah mengeluarkan kebijakan Desa Tanggap COVID-19 yang disebutkan dalam Surat Edaran Nomor 8 tahun 2020 sebagai salah satu upaya pencegahan dan penanganan COVID-19 di desa dengan membentuk Relawan Desa Lawan COVID-19 dan penggunaan dana desa untuk memperkuat ekonomi masyarakat. Penelitian ini bertujuan untuk mengkaji pelaksanaan kebijakan-kebijakan Desa Tanggap COVID-19 yang diterapkan di Desa Kepuhrejo Kecamatan Kudu Kabupaten Jombang yang mengacu pada Surat Edaran Menteri Desa Nomor 8 Tahun 2020 dan kebijakan lain yang diatur lebih lanjut oleh pemerintah daerah. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis empiris, dimana sumber utama yang diperoleh melalui penelitian lapangan dengan mengamati fenomena yang terjadi, dan melakukan wawancara, serta menggunakan pendekatan normatif. Kesimpulan yang didapatkan bahwa dalam hal penyediaan sarana dan prasarana untuk pemudik yang melakukan isolasi di gedung SD tidak sesuai dengan aturan yang berlaku dimana segala kebutuhan konsumsi yang dibutuhkan oleh pemudik tersebut tidak disediakan oleh pemerintah desa, kemudian penjaga pos pantau COVID-19 yang bertugas di beberapa titik desa tidak memperolah upah atas tenaga dan waktunya, dan keluarga miskin dan masyarakat marjinal yang memperoleh bantuan sosial yang berasal penggunaan dana APBDes.

Abstract

This article discusses the division of roles between husband and wife during a pandemic in the Mubadalah perspective. Due to the coronavirus, there are changes in social life, including family life, which impacts the division of roles between husband and wife in domestic life. The Mubadalah is a concept that discusses gender equality by emphasizing the principle of mutual benefit from two people who are related. Women and men have the same rights and opportunities to take part in the public and domestic sphere and take advantage of all life aspects. This research aimed to determine and analyze the division of roles between husband and wife during the pandemic from the Mubadalah perspective. This research was qualitative field research. The data was collected through interviews and documentation, then analyzed with deductive reasoning. This research concluded the roles of husband and wife in the family during this pandemic were according to the agreement between husband and wife in the economy, educate children, fand house chores. That was based on the conditions and situations faced by the couple. The husbands’ role was still dominant in economic fulfillment. However, it did not prevent the wives from helping and supporting the family economy. Conversely, educating children and house chores was still dominated by the wives, although it did not prevent the husbands from taking part in informing the children and house chores. It shows that the concept of Mubadalah has not been applied to the division of roles between husband and wife in the family during the pandemic because both husband and wife should have equal rights and opportunities in carrying out activities in the domestic and public sphere.

Abstract

Abstract: This article discusses Islamic family law from the perspective gender studies. The study of Islamic family law is a compulsory study for all students in the Faculty of Islamic Law and Legal Studies. The study, though, only referred to classical Islamic jurisprudence as reflected in Islamic law school (Maddhab). In addition, it uses the positive law of marriage in Indonesia, namely Law No. 1/1974 on Marriage and Presidential Degree No. 1/1990 on Kompilasi Hukum Islam. With the development of renewal in Islamic family law in contemporary state, Islamic family law should be studied through various approaches, including gender analysis. This is important because many modern muslim scholars formulate the renewal of Islamic family law to achieving gender equality in marriage. They do so by reinterpreting Quranic texts and prophet traditions. If the study of Islamic family law is conducted from, among other things, gender analysis, students will be able to think critically and flexible in discussing contemporary issues of Islamic family law. Abstrak: Tulisan ini mengkaji studi hukum perkawinan Islam dengan pendekatan gender. Hukum perkawinan Islam sebagai mata kuliah wajib yang diajarkan di Fakultas Syariah, masih cenderung merujuk kepada pendapat mazdhab klasik, UU Perkawinan Nomor 1 Tahun 1974, dan Kompilasi Hukum Islam. Dengan perkembangan zaman dan adanya pembaruan pemikiran hukum Islam, perlu dikaji lebih mendalam materi Hukum Perkawinan Islam dengan berbagai pendekatan, salah satunya dengan pendekatan gender. Hal tersebut penting dilakukan, karena telah banyak pemikir modern muslim yang merumuskan adanya pembaruan dalam Hukum Perkawinan Islam demi tercapainya kesetaraan gender dalam perkawinan yang sesuai dengan perkembangan zaman, diantaranya dengan reinterpretasi teks al-Qur’an dan Hadis Hukum Perkawinan. Diharapkan dengan pembelajaran Hukum Perkawinan Islam dengan pendekatan gender, mahasiswa dapat berfikir kritis dan tidak kaku dalam berijtihad tentang masalah Kontemporer  Hukum Perkawinan Islam.Kata Kunci:Abstract: This article discusses Islamic family law from the perspective gender studies. Abstract

The KB village has several programs, namely Family Planning (KB), Tribina which includes Family Development Coaching, Adolescent Family Development, Elderly Family Development (BKB, BKR, and BKL), Efforts to Increase Prosperous Family Income (UPPKS), and Information and Counseling Center Youth (PIK_RM). Based on the analysis of Islamic law, the Family Planning Village program in general is in accordance with the principles of Islamic law, but there are a number of programs whose laws are disputed by Jurisprudence. The Tribina program is in accordance with Islamic law, because the obligation of parents to care for and educate their children from toddlers to adolescents is good, and caring for elderly parents is an obligation of children to their parents. Regarding the family planning program, the majority of scholars allow for the use of contraceptives not to be permanent, not harmful and carried out by experts, while the permanent contraception, such as vasectomy and tubectomy, the majority of scholars forbid them. In connection with the UUPKS, the legal UUPKS may even be recommended because part of mutual assistance. But what needs to be considered is that the business must be in accordance with the concept of Islamic business, including not containing elements of gharar (uncertainty) and usury. The PIK_RM is in accordance with Islamic law, because fostering teenagers with proper and good guidance is highly recommended in Islamic law, so that they can become a superior generation and not fall into bad things.

Abstract

This article discusses about the forced marriage in Sidosermo Dalam Surabaya to be analyzed by Islamic law. This research is field research and is qualitative in nature. Data were collected through interviews and documentation, then analyzed deductively. The forced marriage still occurs in Sidosermo Dalam Surabaya. Marriage was motivated by several reasons: the factor of parents' concern for their child, the factor of family relations, the existence of myths, the existence of Syafii's understanding of fiqh that allows the forced marriage, and economic factors. The forced marriage can occur in girls and boys even though they are adults. In Islamic law, all schools of thought think that the permissible marriage permit is for girls who are not yet mature, while for those who are adults or who are widows there is a dispute between the imam of the mazhab. In the KHI, the forced marriage should not occur because the marriage can be carried out with the consent of the two prospective brides.

Abstract

This article traces the thoughts of Muhammad Shahrur on the issue of women from the perspective of fiqh or Islamic jurisprudence. He stated that one aspect causing discrimantion toward Muslim women is the interpretation of medieval fuqaha (Muslim jurists) on certain Qur’anic verses which remain upheld by many Muslims up until today. This phenomenon, however, is contradictory to a widely held Islamic legal maxim stating that every social change necessitates the change in legal aspects. For the context of women issues, Islamic teachings should be reinterpreted for the purpose of relevance and modern demand. Using Western hermeneutic methodology, Muhammad Shahrur interprets Qur’anic verses, especially those related to women issues, such as the issue of inheritance, bequest, leadership, polygamy and dressing. In addition, he also proposes reform for laws affable to women. Although his thoughts are contradictory in many respects from the preposition of traditional Islamic jurisprudence, he has indeed opened a new perspective in the discourse of Islamic thoughts.

Abstract

في هذا المقال تبحث الكاتبة الوزارة في تاريخ السياسة الشرعية منذ عهد النبي محمد صلى الله عليه وسلم إلى عصرنا الآن. إن كلمة الوزارة كلمة عربية أصيلة من وزن "وزر" ولكن الإدارة الوزارية مأخوذة من عادة الفرس بمعنى الحاكم. كلمة الوزارة في القرآن مستعملة في حكاية هارون عن كونه مساعدا للنبي موسى عليه السلام في الدعوة. إن الوزارة لم تكن معروفة في الحكومة الإسلامية إلا منذ العصر العباسي، ولكنها نشأت منذ عهد النبي محمد صلى الله عليه وسلم. في عهد الرسول كان أبو بكر مساعد الرسول فهو وزيره وفي عهد الخلفاء الراشدين كان بعض الصحابة يساعدون الخليفة فهم وزراؤه كعمر بن الخطاب هو وزير الخليفة أبي بكر الصديق، وفي عهد الخلافة الأمية كانت الوزارة مستعملة لمساعد الخليفة ولكن لم تكن منظمة، فالوزارة تكون منظمة في الخلافة الإسلامية منذ العصر العباسي إلى عصرنا الآن وتطورت الوزارة بتطور شكل الدولة. إن الوزارة أمر مهم في الحكومة، إذ أن الوزير هو مساعد هام للرئيس أو الخليفة، استولى الرئيس الوزير ليساعده في حل مشاكل الدولة والحكومة والرعية، بهذه المساعدة تخفف ثقل عبء الرئيس في أمر الدولة.
