Abstract

Dalam beberapa tahun terakhir, penggunaan cryptocurrency sebagai alat transaksi dalam e-commerce semakin meningkat, namun ketidakpastian regulasi di Indonesia menciptakan dilema bagi pelaku bisnis dan konsumen. Meskipun diakui sebagai komoditas digital oleh Badan Pengawas Perdagangan Berjangka Komoditi (Bappebti), penggunaan cryptocurrency sebagai alat pembayaran resmi masih dilarang oleh Bank Indonesia. Penelitian ini bertujuan untuk mengkaji kepastian hukum penggunaan cryptocurrency dalam transaksi e-commerce di Indonesia dan membandingkannya dengan negara-negara seperti Jepang dan Uni Eropa yang telah memiliki kerangka hukum lebih matang. Dengan menggunakan metode normatif, penelitian ini menelaah peraturan yang berlaku serta dampaknya terhadap sektor e-commerce. Hasil penelitian menunjukkan bahwa ketidakjelasan regulasi menghambat inovasi dan adopsi cryptocurrency di Indonesia. Diperlukan kerangka hukum yang harmonis dan kolaboratif untuk menciptakan kepastian hukum dan melindungi konsumen. Regulasi yang lebih komprehensif diharapkan dapat mendorong perkembangan ekonomi digital dan meningkatkan daya saing Indonesia di pasar global.  Kata kunci: Kepastian Hukum, Cryptocurrency, E-commerce, Inovasi Digital, Regulasi Indonesia. Abstract In recent years, the use of cryptocurrencies as a means of transaction in e-commerce has been increasing, but regulatory uncertainty in Indonesia has created a dilemma for businesses and consumers. Although recognized as a digital commodity by the Commodity Futures Trading Supervisory Agency (Bappebti), the use of cryptocurrency as an official means of payment is still prohibited by Bank Indonesia. This study aims to examine the legal certainty of the use of cryptocurrencies in e-commerce transactions in Indonesia and compare it with countries such as Japan and the European Union which already have a more mature legal framework. Using a normative method, this study examines applicable regulations and their impact on the e-commerce sector. The results of the study show that regulatory uncertainty hinders cryptocurrency innovation and adoption in Indonesia. A harmonious and collaborative legal framework is needed to create legal certainty and protect consumers. More comprehensive regulations are expected to encourage the development of the digital economy and increase Indonesia's competitiveness in the global market. Abstract

The idea of revising the 1945 Constitution is likely to spark debate. Nevertheless, Article 37 of the 1945 Constitution has provided a mechanism for amendment, rather than replacement, of the constitution. The amendments to the 1945 Constitution are now mandatory, as previously decreed by the MPR leadership, which will be continued by the current leadership. This paper examines the role of public participation in the amendment of constitutions in Indonesia and Thailand. The study employs a normative legal research approach, utilizing statutes, conceptual frameworks, and comparative analyses. Data was collected from books, academic journals, relevant laws, and regulations. The results indicate that the forms of public participation in Indonesia and Thailand in the constitution-making and amendment processes are largely similar, including public hearings, working visits, socialization, seminars, workshops, and discussions. However, a notable difference exists in that Indonesia lacks explicit provisions for public participation in its constitutional amendment process, whereas Thailand has established clear regulations. It is recommended that Indonesia clearly regulate public participation as a procedure in its constitution-making and amendment processes.

Abstract

Banyaknya perusahaan penerbangan di Indonesia yang beroperasi, namun seringkali mengabaikan tanggung jawab mereka terhadap barang bawaan penumpang. Hal ini seringkali menimbulkan ketidaknyamanan dan kerugian bagi penumpang, ketidaknyamanan dan kerugian penumpang dalam transportasi umum merupakan isu kompleks yang memerlukan perhatian dari berbagai pihak untuk meningkatkan kualitas layanan dan keselamatan, salah satunya dalam transportasi umum udara sehingga perlu adanya perlindungan hukum dan tanggung jawab hukum maskapai penerbangan. Penelitian ini mengkaji tanggung jawab hukum maskapai penerbangan terhadap kehilangan dan kerusakan barang bagasi penumpang. Penelitian ini menggunakan jenis penelitian hukum normatif yang didukung oleh pendekatan perundang-undangan dan menggunakan bahan sekunder, primer, dan tersier yang berisi kaidah hukum yang relevan. Hasil penelitian ini menunjukkan bahwa kasus pertanggungjawaban maskapai terhadap hilang atau rusak barang penumpang bertentangan dengan Pasal 167 dan 168 dalam Undang-Undang Nomor 1 Tahun 2009 tentang penerbangan dan juga Pasal 5 dalam Undang-Undang Nomor 77 Tahun 2011 tentang tanggung jawab pengangkutan angkutan udara.

Abstract

This study analyzes customary law sanctions in traditional marriages, often contrary to human rights principles, especially for women. This study aims to evaluate the impact of customary law sanctions on women’s rights and provide recommendations for improvement. The method used is a qualitative approach with case studies, which involves interviews with traditional leaders and women involved in customary marriages. The results of the study show that customary law sanctions tend to burden women, creating gender injustice and human rights violations.  Keywords: Customary Law; Human Rights; Woman; Penalty; Gender Equality

Abstract

Introduction: This article explores the limitations of guardians' legal authority in managing children's assets, emphasizing the importance of protecting minors from potential abuses by guardians.Purposes of the Research: The purpose of this study is to analyze the legal framework governing guardianship in Indonesia, focusing on the responsibilities and limitations imposed on guardians in asset managementMethods of the Research: This research employs a normative legal approach, analyzing statutes and legal principles, particularly from the Civil Code, to understand the scope of guardianship and its implications for children's welfare.Results Main Findings of the Research: The findings reveal critical gaps in the guardianship system, highlighting the need for enhanced oversight and accountability measures. This research contributes to existing knowledge by proposing legal reforms that ensure guardians act in the best interests of children, thereby advancing protective legal frameworks.

Abstract

Introduction: The rapid growth of the e-commerce industry has brought significant economic benefits. Still, it also raises challenges regarding dispute resolution that is efficient, fair and meets the needs of all parties.Purposes of the Research: This study aims to examine and analyze the use of Dispute Resolution in E-commerce (Electronic Commerce) through the Online Dispute Resolution (ODR) mechanism as a solution to provide easier and faster access to justice in the context of online business transactions.Methods of the Research This study uses doctrinal legal research with a statute and conceptual approach. It uses primary legal materials that are authoritative and binding, such as laws and regulations, and secondary legal materials. This study uses legal interpretation techniques as analysis techniques.Results of the Research: The results of this study are expected to provide deeper insight into the potential of ODR in handling e-commerce disputes and its impact on access to justice for all parties involved. This research can also provide recommendations to the government, the e-commerce industry, and other relevant institutions to consider and develop a better framework for integrating ODR in e-commerce dispute resolution to ensure fairness and satisfaction of online businesses.

Abstract

Customary land is an essential aspect of the Tolaki tribal community, which is jointly owned by them and holds great significance. However, disputes over customary land often arise, leading to compliance with customary law and its consequences. This research seeks to explore the views and regulations of Tolaki customary law regarding land disputes and conflicts. The doctrinal legal research approach has been used in this research to understand how land disputes are handled under Tolaki customary law. The results indicate that land disputes are considered a form of social conflict that arises due to violations of customary civil law. The resolution process involves a series of customs, and a solution is reached through positive laws. The Tolaki customary law has laid down several principles that guide the resolution process of land disputes. According to their customs, the disputing parties must first attempt to resolve the matter through negotiations. If negotiations fail, the parties must seek the help of their respective customary leaders, who will then guide them through the dispute resolution process. If the dispute remains unresolved, then the parties may seek the intervention of positive law. In conclusion, the Tolaki customary law views land disputes as a social conflict that can be resolved through a series of customs and positive laws. It is imperative to preserve these customs and laws to maintain the sanctity of customary land and ensure that disputes are resolved fairly.     Tanah adat merupakan aspek penting bagi masyarakat suku Tolaki, yang dimiliki bersama dan memiliki arti penting. Namun, sengketa atas tanah adat sering kali muncul, yang mengarah pada kepatuhan terhadap hukum adat dan konsekuensinya. Penelitian ini bertujuan untuk mengeksplorasi pandangan dan pengaturan hukum adat Tolaki mengenai sengketa dan konflik tanah. Pendekatan penelitian hukum doktrinal telah digunakan dalam penelitian ini untuk memahami bagaimana sengketa tanah ditangani di bawah hukum adat Tolaki. Hasil penelitian menunjukkan bahwa sengketa tanah dianggap sebagai bentuk konflik sosial yang muncul akibat pelanggaran hukum perdata adat. Proses penyelesaiannya melibatkan serangkaian adat istiadat, dan penyelesaiannya dilakukan melalui hukum positif. Hukum adat Tolaki telah menetapkan beberapa prinsip yang memandu proses penyelesaian sengketa tanah. Menurut adat istiadat mereka, pihak-pihak yang bersengketa harus terlebih dahulu berusaha menyelesaikan masalah melalui negosiasi. Jika negosiasi gagal, para pihak harus mencari bantuan dari pemimpin adat masing-masing, yang kemudian akan memandu mereka melalui proses penyelesaian sengketa. Jika sengketa tetap tidak terselesaikan, maka para pihak dapat meminta intervensi hukum positif. Kesimpulannya, hukum adat Tolaki memandang sengketa tanah sebagai konflik sosial yang dapat diselesaikan melalui serangkaian hukum adat dan hukum positif. Sangat penting untuk melestarikan adat dan hukum ini untuk menjaga kesucian tanah adat dan memastikan bahwa perselisihan diselesaikan secara adil.

Abstract

The purpose of this study to examine the legal certainty related to the ownership of land rights by foreign nationals (WNA) through name loan agreements or nominees in Indonesia. The methodology used is normative legal research with a legislative and conceptual approach, as well as analysis of primary and secondary legal materials. The results of the study show that the practice of nominee agreements is often considered illegal and has the potential to cause legal disputes, because it is contrary to Law No. 5 of 1960 concerning Agrarian Principles which only allows Indonesian citizens to have property rights to land. In addition, this agreement can result in losses for all parties involved, including foreign citizens (WNA) who lose their rights and Indonesian citizens (WNI) who lend their names. This research provides an understanding of the need for clearer regulations to protect the interests of all parties and prevent the abuse of the law in land tenure by foreign nationals (WNA) in Indonesia.

The prevalence of hoaxes in Indonesia is not a new phenomenon. Over the past three years, there has been a consistent increase in the dissemination of hoaxes across various platforms in the country. Furthermore, with the onset of the pandemic, the spread of hoaxes related to Covid-19 has become particularly rampant. In 2021 itself, the Ministry of Communications and Informatics identified and debunked a total of 723 hoaxes pertaining to Covid-19. This research paper aims to examine the current state of hoax dissemination in Indonesia and identify the key factors contributing to their spread. The study adopts a normative legal research approach, drawing on data derived from books, journals, relevant laws, and regulations. The findings reveal that social media platforms play a significant role in the proliferation of hoaxes throughout Indonesia. The presence of numerous anonymous or fake accounts facilitates the easy dissemination of hoaxes via social media. Moreover, the lack of due diligence in verifying and fact-checking information creates a loophole that allows hoaxes to circulate within the community. In order to address this issue effectively, it is crucial to implement measures that target the root causes of hoax dissemination. This includes the development of stricter regulations and enforcement mechanisms to combat the creation and spread of hoaxes, particularly on social media platforms. By comprehensively understanding the dynamics and factors influencing the spread of hoaxes in Indonesia, policymakers, law enforcement agencies, and the general public can work together to combat this pressing issue.

Abstract

The purpose of this study is to analyze and explain the legal protection available to buyers of uncertified land in situations where the seller dies before the certification process is completed, especially against heirs' claims in civil law and to identify and explain the legal consequences arising from an uncertified land sale and purchase agreement on the legal protection of buyers from heirs' claims. The method used is the normative legal method with a statutory approach and a conceptual approach. The results of the study are that 1. Legal protection for buyers of uncertified land, in the context of civil law, can refer to several articles of the Civil Code. Articles 832 and 833 of the Civil Code emphasize that heirs inherit the rights and obligations of the testator, including obligations from agreements that have not been fulfilled. If the heirs are negligent in fulfilling these obligations, for example the certification process, the buyer can file a lawsuit for breach of contract based on Article 1243 of the Civil Code to claim compensation. 2. The legal consequences of an uncertified land sale and purchase agreement on the legal protection of buyers from heirs' claims are very vulnerable and high risk. An uncertified land sale and purchase agreement, especially if it is only a private agreement, does not provide a guarantee of legal ownership to the buyer. This opens up a gap for heirs to claim inheritance rights to the land, and the buyer has the potential to lose his rights to the land he has purchased. ABSTRAK Tujuan Penelitian ini untuk menganalisis dan menjelaskan perlindungan hukum yang tersedia bagi pembeli tanah yang belum bersertifikat dalam situasi di mana penjual meninggal dunia sebelum proses sertifikasi selesai, khususnya terhadap tuntutan ahli waris dalam hukum perdata dan untuk mengidentifikasi dan menjelaskan akibat hukum yang timbul dari perjanjian jual beli tanah yang belum bersertifikat terhadap perlindungan hukum pembeli dari tuntutan ahli waris. Metode yang digunakan adalah metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian bahwa 1. Perlindungan hukum pembeli tanah yang belum bersertifikat, dalam konteks hukum perdata, dapat merujuk pada beberapa pasal KUHPerdata. Pasal 832 dan 833 KUHPerdata menegaskan bahwa ahli waris mewarisi hak dan kewajiban pewaris, termasuk kewajiban dari perjanjian yang belum terpenuhi. Jika ahli waris lalai dalam memenuhi kewajiban tersebut, misalnya proses sertifikasi, pembeli dapat mengajukan gugatan wanprestasi berdasarkan Pasal 1243 KUHPerdata untuk menuntut ganti rugi. 2. Akibat hukum perjanjian jual beli tanah yang belum bersertifikat terhadap perlindungan hukum pembeli dari tuntutan ahli waris adalah sangat rentan dan berisiko tinggi. Perjanjian jual beli tanah yang belum bersertifikat, terutama jika hanya berupa perjanjian di bawah tangan, tidak memberikan jaminan kepemilikan yang sah kepada pembeli. Hal ini membuka celah bagi ahli waris untuk menuntut hak waris atas tanah tersebut, dan pembeli berpotensi besar kehilangan haknya atas tanah yang telah dibelinya.  Kata Kunci: Perlindungan Hukum, Perjanjian, Jual-Beli Tanah
