Abstract

This study examines the legality of the IUP issuance process in Konawe Islands Regency, identifies potential administrative and legal violations, and provides recommendations to strengthen regulatory compliance. The research method used is normative juridical with a legal and case study approach. The results show that most IUPs in Konawe Islands Regency are issued without meeting administrative requirements, such as adequate environmental studies and consultations with affected communities. In addition, inconsistencies were found in the licensing process, such as procedural violations by the authorities that caused conflicts of interest and losses to the local community. This shows that there is a gap in the supervision and implementation of regulations.

Abstract

Language clauses in contracts are a crucial element that is often overlooked in Indonesian legal practice. With a statute and conceptual approach, this study analyzes the Supreme Court Circular Letter Number 3 of 2023, which provides guidelines regarding the use of language in contracts. The study results show that using clear and simple language in contracts can reduce the risk of disputes and increase trust between the parties involved. In addition, this study recommends the need for the consistent implementation of language standards to support legal integration and create a more stable business environment. Thus, this research contributes to developing contract law in Indonesia and provides insights for academics and legal practitioners.

Abstract

Control of the land plot must be proven through a valid certificate of ownership. In its development, it was found that there were duplicate certificates that overlapped each other. This study aims to provide an analysis related to the issuance of double certificates and the mechanism for their completion. This research is a normative juridical research with a legislative approach and a conceptual approach. The results of the study show that double certificates arise as a result of various factors, including administrative errors, lack of supervision, and the practice of abuse of authority in issuing certificates, thus creating legal uncertainty for land rights holders. The legal settlement requires a comprehensive approach, involving the improvement of the land administration system, and strict enforcement of any violations.

Abstract

Introduction: The Customary Dispute Resolution Mechanism (CDRM) of the Tolaki people in Southeast Sulawesi faces faces structural pressures arising from state legal expansion, jurisdictional overlap with formal courts, and the gradual reconfiguration of customary authority within Indonesia’s plural legal order. Historically, the Tolaki customary law system has played a central role in maintaining social harmony and resolving internal conflicts. However, the penetration of national law, globalization, and rapid socio-economic structural changes have placed Tolaki CDRM at a crossroads of adaptation.Purposes of the Research: This study aims to analyze the transformation patterns of Tolaki CDRM and to measure its resilience as an alternative dispute resolution mechanism amid the dominance of the national legal system.Methods of the Research: This qualitative research employs a socio-legal approach, combining normative analysis of Tolaki customary norms with empirical data from in-depth interviews with customary leaders (Pu'utobu, Mosoro), disputing parties, and judicial apparatus. Data was collected through document studies and field research in several Tolaki regions in Southeast Sulawesi.Results of the Research: (1) Tolaki CDRM has undergone significant institutional transformation through formalization under local regulations, (2) Procedural adaptations include standardized mediation and documentation systems such as structured mediation stages, written settlement documentation, and administrative reporting mechanisms; (3) CDRM demonstrates high resilience, sustained by the philosophical foundation of Kalo Sara and dual legitimacy—traditional community-based legitimacy and administrative state recognition. CDRM operates in active co-existence with the national legal system, often functioning as a pre-litigation mechanism. The restorative justice approach of CDRM, emphasizing social relationship recovery (Loleka), proves more effective than retributive formal justice in maintaining long-term kinship harmony.

Abstract

Public-private partnerships (PPPs) are an increasingly popular strategy in the provision of public services, such as clean water, infrastructure, and health. This article aims to analyze the factors that influence the success of such partnerships and their social and economic impacts on communities. This research method combines normative and empirical approaches to determine the cooperation agreement of the Regional Drinking Water Company (PDAM) in Kendari City. The results of the study show that in this context, political commitment, transparency, selection of the right partner, and continuous evaluation are considered key factors. In addition, the positive impacts of PPPs include increased access and quality of services, while the challenges faced such as inequality in access to services require special attention. Therefore, wise management is needed to ensure that this partnership provides fair benefits to all levels of society.

Abstract

Perkembangan teknologi digital telah mendorong perubahan signifikan dalam praktik pembuktian hukum perdata, khususnya terkait penggunaan tanda tangan digital dalam transaksi elektronik. Tanda tangan digital semakin banyak digunakan sebagai sarana autentikasi dan persetujuan dalam perjanjian elektronik, namun masih menimbulkan permasalahan hukum terkait kekuatan pembuktiannya dalam sengketa perdata. Penelitian ini bertujuan untuk mengkaji kekuatan pembuktian tanda tangan digital serta menganalisis pengaturan hukumnya dalam sistem hukum Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa tanda tangan digital memiliki kekuatan pembuktian yang sah dan mengikat sebagai alat bukti hukum sepanjang memenuhi unsur keotentikan sebagaimana diatur dalam Undang-Undang Informasi dan Transaksi Elektronik beserta peraturan pelaksananya. Meskipun demikian, dalam praktik peradilan perdata masih ditemukan kendala berupa keterbatasan pemahaman teknis aparat penegak hukum serta perbedaan penilaian hakim terhadap alat bukti elektronik. Oleh karena itu, diperlukan penguatan regulasi, peningkatan kapasitas sumber daya manusia di bidang hukum dan teknologi informasi, serta penyesuaian hukum acara perdata guna menjamin kepastian hukum dan perlindungan hukum para pihak dalam sengketa perdata di era digital.

Abstract

Introduction: Mining service contracts executed by State-Owned Enterprises (SOEs) in the form of persero play a strategic role in Indonesia’s natural resource governance. Although formally framed as commercial contracts, these agreements involve public assets, state authority, and environmental responsibilities, creating legal complexities that challenge traditional private contract doctrines.Purposes of the Research:  This article aims to examine the legal character of mining service contracts entered by Indonesian SOEs persero and to determine whether such contracts can be classified as purely private commercial agreements or should be understood as contracts with inherent public dimensions.Methods of the Research: This study employs normative legal research using statutory, and conceptual approaches. Legal materials are examined through document analysis of legislation, doctrinal writings, and relevant legal principles governing contracts, state owned enterprises persero, and mineral and coal mining activities.Results / Main Findings / Novelty/Originality of the Research: The study finds that mining service contracts by SOEs cannot be categorized as ordinary private contracts. Instead, they constitute public–commercial contracts characterized by limited contractual freedom, heightened public accountability, and embedded state obligations. This conceptualization offers a refined legal framework for understanding SOE contracts in strategic sectors.

Abstract

Penelitian ini bertujuan untuk menganalisis batas pertanggungjawaban notaris dalam sengketa  akta autentik pada perkara perdata  serta mengkaji batasan normatif tanggung jawab notaris berdasarkan peraturan perundang-undangan dan doktrin hukum perdata. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum primer berupa Undang-Undang Jabatan Notaris, Kitab Undang-Undang Hukum Perdata, serta putusan pengadilan terkait sengketa akta autentik, sedangkan bahan hukum sekunder diperoleh dari literatur dan jurnal ilmiah yang relevan. Hasil penelitian menunjukkan bahwa pertanggungjawaban notaris dalam sengketa perdata bersifat terbatas pada aspek formal pembuatan akta, yaitu kebenaran formil atas identitas para pihak, waktu, dan prosedur pembuatan akta, bukan pada kebenaran materiil isi pernyataan para pihak. Notaris dapat dimintai pertanggungjawaban apabila terbukti melakukan pelanggaran terhadap kewajiban jabatan, asas kehati-hatian, atau terdapat unsur kesalahan dan kelalaian yang menimbulkan kerugian. Dengan demikian, batas pertanggungjawaban notaris berfungsi sebagai perlindungan hukum sekaligus sebagai instrumen penegakan profesionalitas jabatan notaris dalam praktik perdata.

Abstract

Introduction: The rapid expansion of digital technology has transformed marketing practices and created a contractual ecosystem involving influencers as key promotional actors. This shift has generated distinctive legal issues concerning contract formation, consumer protection, and electronic information governance.Purposes of the Research: Examining the civil liability of influencers in endorsement contracts and analyzing the legal position of influencers in Indonesia's digital contractual ecosystem.Methods of the Research: This study employs a normative legal research method using statute, conceptual, and analytical approaches by examining provisions within the Civil Code, the Electronic Information and Transactions Law, and the Consumer Protection Law.Results Main Findings of the Research: The findings demonstrate that influencer liability in endorsement agreements is multilayered, covering both contractual (wanprestasi) and tort-based (onrechtmatige daad) responsibilities. The study also reveals the emergence of a digital-era duty of care requiring influencers to verify product legality and ensure truthful promotional content. This contributes to a modern reconstruction of contract doctrine in Indonesia’s digital economy.

Abstract

This community service program aims to enhance the legal drafting capacity of the community and village government of Lalowosula Village, East Kolaka Regency, focusing on the development of responsive and participatory local regulations. The low level of legal literacy, limited participation, and lack of access to regulatory information constitute the main challenges in village governance. The method applied in this program consists of five stages: preparation, socialization, legal counseling, technical training, and mentoring. The activity involved village officials, BPD members, and community legal awareness groups. The results show a significant increase in participants’ understanding of legal drafting techniques and community participation in formulating public policies. The program also successfully developed an interactive website that provides legal drafting guidelines and online administrative services for villagers living outside the region. The community expressed positive responses toward the training and indicated readiness to participate in future policymaking processes. This service program has contributed to strengthening legal awareness, improving policy quality, and promoting participatory village governance practices. This program offers a replicable model for integrating digital tools into village-level legal drafting and participatory governance in Indonesia. Abstrak Program pengabdian ini bertujuan meningkatkan kapasitas masyarakat dan pemerintah Desa Lalowosula, Kabupaten Kolaka Timur, dalam penyusunan produk hukum desa yang responsif dan partisipatif. Rendahnya literasi hukum, minimnya partisipasi masyarakat, serta terbatasnya akses informasi regulasi merupakan tantangan utama dalam tata kelola desa. Metode pengabdian dilakukan melalui lima tahapan: persiapan, sosialisasi, penyuluhan hukum, pelatihan teknis, dan pendampingan. Kegiatan melibatkan aparat desa, anggota BPD, serta kelompok keluarga sadar hukum. Hasil kegiatan menunjukkan peningkatan signifikan terhadap pemahaman peserta mengenai teknik penyusunan peraturan desa serta meningkatnya partisipasi warga dalam merumuskan kebijakan publik. Program ini juga berhasil mengembangkan website interaktif yang menyediakan panduan penyusunan peraturan desa serta layanan administrasi online bagi warga yang tinggal di luar daerah. Masyarakat memberikan respon positif dan menunjukkan kesiapan untuk terlibat dalam proses legislasi desa. Program ini berkontribusi pada penguatan kesadaran hukum, peningkatan kualitas kebijakan desa, dan pengembangan praktik tata kelola desa yang partisipatif. Program ini menawarkan model yang dapat direplikasi untuk mengintegrasikan perangkat digital ke dalam penyusunan hukum tingkat desa dan tata kelola partisipatif di Indonesia.
