Abstract

The identification of the Madurese local concept, Bhuppa’-Bhâbhu’-Ghuru-Rato, is a part of the conflict resolution instrument based on social construction theory. This concept serves as a strong foundation underlying the social relationships and moral structure of the Madurese community, which remains deeply rooted in various aspects of daily life. This research aims to analyze the significant role of the socio-cultural value system of the Madurese community in shaping the behavioral compliance of Madurese families. The research is qualitative in nature, relying on both primary and secondary data. Primary data is obtained from field studies, including direct observations and mapping of research aspects. The research findings indicate that there has been controversy in the interpretation of threats related to social inequality, economic family issues, and the pandemic already experienced. This interpretational controversy has been caused by differences in understanding, conflicting interests, and varying traditions or practices. Differences in understanding are evident from the varying levels of comprehension between groups in the community, which also highlights differences in literacy levels when interpreting these issues. The four important elements of Bhuppa’-Bhâbhu’-Ghuru-Rato play a vital role in controlling and providing guidance through families to enhance compliance. These elements are actualized in daily praxis as binding normative rules.

Abstract

This study examines a sakinah family empowerment by optimizing the role of Badan Penasihat Pembinaan dan Pelestarian Perkawinan (Body for Marital Advisory Guidance and Maintenance (BMAGM)) and parents from a mental revolution perspective. There are three research questions: What is the so-called BMAGM? What and how is the correlation between the national revolution movement and sakinah family empowerment in Indonesia? What strategies are carried out in doing mental revolution in a family in order to have a sakinah family? This qualitative research collected both primary and secondary data. Three essential findings in this study are as follows. First, BMAGM is a legal social-religious organization whose particular duty is to cope with problems in a family. Second, there are three programs in the National Mental Revolution Movement (NMRM) as stated in the Presidential Instruction No. 12 of 2016 i.e. Indonesia in Order Movement (IOM) in point H/8; United Indonesia Movement (UIM) point J/10; Clean Indonesia Movement (CIM) point A/1. Third, in the perspective of the National Mental Revolution Movement (NMRM), parents’ role is essential. Therefore, parents are a strategic issue and should be prioritized in building sakinah family in Indonesia.

Abstract

This research aims to understand the phenomenon of increasing childfree marriage as a contemporary social construction and analyze it from the perspective of maqashid al-sharia, especially related to the principle of progeny preservation in Islam. This study uses a descriptive qualitative approach with a field research method. Primary data was obtained through in-depth interviews with two married couples (four informants), each of whom committed to a child-free marriage. The data were analyzed thematically with an eminic and ethical approach, as well as interpretive-descriptive. Research has found that couples' decisions to marry without having children are based on a desire to achieve happiness and well-being throughout their life with their partner, as well as avoiding the creation of a toxic family. These internal factors are reinforced by external factors such as education, economy, and career. Research has also found that wives play a key role in these decisions regarding reproductive rights. From the perspective of Islamic law, although there is no explicit text prohibiting childfree marriage, maqashid al-sharia still emphasizes the importance of the sustainability of offspring. The childfree decision is a conscious choice of a married couple to pursue happiness and well-being without the presence of children, on the grounds of avoiding the potential for toxic families. In the Islamic view, childfree marriage falls within the territory of ijtihadiyyah which requires a legal approach based on maqashid al-sharia and 'illat analysis. Although this phenomenon is socially acceptable, normatively Islam still prioritizes the importance of offspring as part of the purpose of sharia.

Abstract

Madurese’s resistance to the development of tourism facilities is based on the socio-cultural conditions of the community, which is less open to modernization. This research describes the form of resistance and reflects on its relation to Madurese society’s social and historical conditions. This research uses qualitative data with interview methods, collecting news on the internet, and literature studies. Data collection in this research begins with reading news on the internet on Madurese's resistance related to modern facilities and modern tourism, then conducting interviews with informants to confirm data from the news. Data analysis was carried out through three stages, namely describing data, classifying, and interpreting data thematically to reveal the meaning of the resistance by the Madurese community against the development of tourism facilities. The findings of this study highlight at least three main things, namely the forced closure of non-Muslim entertainment venues due to dissatisfaction with the resulting value shifts. Second, the presence of powerful actors triggers resistance from the community. Third, Madurese people tend to make tourism based on Islamic Sharia as they believe in their daily lives.

Abstract

Abstract: Muslim jurists agree that selling waqf property is forbidden A case happened when concrete pillars of a waqf mosque was sold in a mosque called Istiqlal in Daja village. The pillars were initially planned to be installed during rebuilding of the mosque. The research discovered that this pillar originated from charity. These pillars were re-sold to collect more fund from community to continue the rebuilding. Majority of sunni schools of law (Shafii, Maliki and Hanbali) view that such transaction is forbidden because there is no valid reason for selling the pillar. In addition, the seller is not the rightful person to do so. Meanwhile, Hanafi jurists allow such practice as long as all requirements are met, especially the availability of replacement property as well as fulfilment of all terms and conditions of selling. Abstract

Abstrak: Penelitian ini bertujuan untuk menganalisis peran arbitrase sebagai alternatif penyelesaian sengketa antara pelaku usaha swasta dan Badan Usaha Milik Desa (BUMDes) dalam kasus monopoli izin kapal angkutan di Desa Gersik Putih, Kabupaten Sumenep, serta mengidentifikasi faktor penghambat dan pendukung efektivitas arbitrase dalam penyelesaian sengketa tersebut. Penelitian ini menggunakan metode pendekatan kualitatif deskriptif dengan teknik pengumpulan data melalui wawancara, observasi, dan studi kepustakaan. Hasil penelitian menunjukkan bahwa praktik monopoli oleh BUMDes dalam pengelolaan kapal angkutan laut menimbulkan konflik kepentingan dengan pelaku usaha lokal dan berpotensi mengganggu stabilitas ekonomi desa. Meskipun arbitrase belum diterapkan secara formal, pendekatan serupa seperti mediasi dan musyawarah telah dilakukan untuk mencapai kesepakatan bersama. Faktor pendukung efektivitas arbitrase meliputi adanya klausul arbitrase yang jelas, pemahaman hukum para pihak, serta itikad baik dan dukungan pemerintah. Sementara itu, faktor penghambatnya antara lain kurangnya pemahaman masyarakat tentang prosedur arbitrase, lemahnya regulasi, dan belum adanya lembaga arbitrase lokal. Penelitian ini menyimpulkan bahwa arbitrase berpotensi menjadi mekanisme penyelesaian sengketa yang efektif, cepat, dan adil di tingkat desa apabila didukung oleh peningkatan pemahaman hukum, pembentukan lembaga arbitrase lokal, dan komitmen semua pihak dalam menegakkan prinsip good governance. Abstract: This study aims to analyze the role of arbitration as an alternative dispute resolution between private business actors and Village-Owned Enterprises (BUMDes) in the case of monopoly on shipping permits in Gersik Putih Village, Sumenep Regency, and to identify factors inhibiting and supporting the effectiveness of arbitration in resolving these disputes. This study uses a descriptive qualitative approach with data collection techniques through interviews, observations, and literature studies. The results show that monopolistic practices by BUMDes in managing shipping vessels create conflicts of interest with local business actors and have the potential to disrupt the village's economic stability. Although arbitration has not been formally implemented, similar approaches such as mediation and deliberation have been used to reach mutual agreements. Factors supporting the effectiveness of arbitration include the existence of a clear arbitration clause, the parties' understanding of the law, and good faith and government support. Meanwhile, inhibiting factors include a lack of public understanding of arbitration procedures, weak regulations, and the absence of a local arbitration institution. This study concludes that arbitration has the potential to be an effective, fast, and fair dispute resolution mechanism at the village level if supported by increased legal understanding, the establishment of local arbitration institutions, and the commitment of all parties to uphold the principles of good governance. Abstract

Corruption cases involving gold pawn (rahn) transactions within Islamic financial institutions highlight critical challenges related to sharia governance, fiduciary responsibility, and asset protection. Despite being founded on ethical and religious principles, sharia-compliant financial products remain vulnerable to financial crimes, particularly in high-value, asset-based transactions. This study examines asset confiscation mechanisms in a gold pawn corruption case in Pamekasan, Indonesia, analyzed through the perspectives of Islamic law and positive law. Employing a qualitative case study approach, this research utilizes statutory regulations, court-related legal documents, institutional reports, and secondary data from verified media and academic literature. The findings demonstrate that asset confiscation serves a dual function: as a legal instrument for state loss recovery under Indonesian anti-corruption law and as a normative mechanism aligned with Islamic legal principles such as amanah (trust), hifz al-mal (protection of property), justice, and public interest (maslahah). This study contributes to the literature by integrating Islamic jurisprudence with contemporary asset recovery discourse, emphasizing that asset confiscation is not merely a procedural legal act but a necessary governance mechanism to strengthen accountability and integrity within Islamic financial institutions. The research underscores the importance of harmonizing Islamic law and modern legal systems to restore public trust and enhance anti-corruption frameworks in sharia-compliant finance.

Abstract

This study aims to examine the issue of Mediation as an Alternative Dispute Resolution (ADR) in Cases of Lost/Damaged Packages in Shopee Express Pamekasan Hub. Consumer disputes in expedition services are a crucial issue, given that business actors are fully responsible for losses suffered by consumers. This study applies a normative legal method that focuses on the analysis of legal norms, principles, doctrines, and applicable laws and regulations. This study uses a descriptive qualitative approach with a case study method. As a solution, this dispute is resolved through mediation. The mediation process usually occurs if internal resolution through the return feature or direct contact with customer service fails or is rejected by one of the parties. This process involves a third-party mediator who is tasked with bridging communication between consumers and Shopee Express representatives to reach a peaceful and fair mutual agreement.

Abstract

The Free Nutritious Meals Program (MBG) is a strategic government policy to improve the nutritional quality of students. One important component in its implementation is the procurement of food trays as a means of food distribution. However, the procurement of imported food trays from non-Muslim countries raises potential disputes related to product halal certification, business ethics, and compliance with public procurement regulations. This study aims to identify potential disputes in the procurement of imported food trays for the MBG program and examine the relevance of sharia arbitration as a dispute resolution mechanism. This study uses a normative qualitative method with a conceptual and legislative approach, through document analysis, DSN-MUI fatwas, and academic literature related to sharia economics and public procurement. The results of the study indicate that disputes may arise due to non-compliance with halal standards, non-transparent procurement practices, and the weak integration of sharia arbitration in contracts. Sharia arbitration, through institutions such as BASYARNAS, has great potential to resolve disputes fairly, quickly, and in a manner that is oriented towards the public interest.

Abstract

This study examines Islamic Philanthropic practices (Zakat, Infaq, and Sadaqah) within a transnational context that has received limited scholarly attention, particularly among migrant workers. Legal issues arise from regulatory misalignment between Indonesia and Malaysia in Zakat governance, which affects the practice of religious obligations. The objective of this study is to introduce the concept of social delegitimation in relation to transnational religious obligations and to understand the process through which Madurese migrants in Malaysia fulfil Zakat, Infaq, and Sadaqah (ZIS). This research adopts an empirical study using anthropological and comparative approaches and applies Kenneth L. Pike's emic and etic perspectives. The findings indicate that the fulfilment of ZIS takes place through continuous negotiation within conditions of transnational uncertainty. Regulatory misalignment contributes to the social delegitimation of formal zakat institution in Malaysia, leading migrants to prefer channeling their ZIS through networks of kiai (religious scholars) and community groups in their hometowns, which are perceived to guarantee emotional proximity, blessing (barakah), and spiritual accountability. Accordingly, this study demonstrates that religious authority and the legitimacy of Islamic philanthropy in diaspora contexts are shaped more by social relations and transnational resilience strategies than by mere state legal frameworks.Penelitian ini mengkaji praktik filantropi Islam (zakat, infaq, dan sadaqah) dalam konteks transnasional yang jarang dieksplorasi, khususnya di kalangan pekerja migran. Terdapat isu hukum mengenai ketidakselarasan regulasi zakat antara Indonesia dan Malaysia yang memengaruhi praktik kewajiban agama. Tujuan studi ini adalah memperkenalkan konsep delegitimasi sosial terhadap kewajiban agama transnasional dan memahami proses pemenuhan zakat, infaq, dan sadaqah (ZIS) migran Madura di Malaysia. Metode yang digunakan adalah penelitian empiris dengan pendekatan antropologi dan komparatif, serta menerapkan perspektif emik dan etik Kenneth L. Pike. Hasil penelitian menunjukkan bahwa pemenuhan ZIS berlangsung melalui negosiasi berkelanjutan dalam situasi ketidakpastian transnasional. Ketidakselarasan regulasi mendorong delegitimasi sosial terhadap institusi zakat formal di Malaysia, menyebabkan migran lebih memilih menyalurkan ZIS melalui jaringan kiai dan komunitas di kampung halaman karena dinilai menjamin kedekatan emosional, keberkahan, dan akuntabilitas spiritual. Dengan demikian, kontribusi artikel ini memperlihatkan bahwa otoritas keagamaan dan legitimasi filantropi Islam di diaspora lebih ditentukan oleh relasi sosial dan strategi ketahanan transnasional daripada sekadar kerangka hukum negara.
