Abstract

Sengketa Ekonomi Syariah adalah perselisihan antara lain ; orang-perorangan, kelompok orang, atau bahkan badan usaha yang berbadan hukum maupun yang tidak berbadan hukum, yang menimbulkan akibat hukum antara satu dengan yang lainnya berkaitan dengan kegiatan usaha yang dilaksanakan menurut prinsip Syariah. Konsep sulh (perdamaian) sebagaimana mestinya tersebut dalam berbagai kitab fiqh merupakan doktrin utama hukum Islam dalam bidang muamalah untuk menyelesaikan suatu perkara, dan sudah merupakan condition sine quo non dalam kehidupan masyarakat manapun, karena pada hakikatnya perdamaian bukanlah suatu pranata positif belaka, melainkan berupa fitrah dari manusia. Segenap manusia menginginkan seluruh aspek kehidupannya nyaman, tidak ada yang mengganggu, tidak ingin dimusuhi,ingin damai dan tentram segala aspek didalam kehidupan. Dengan demikian institusi perdamaian adalah bagian dari kehidupan manusia. Undang-undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa mengatur tentang bagaimana proses penyelesaian sengketa di luar Pengadilan, yakni melalui konsultasi, mediasi, negosiasi, konsiliasi dan penilaian ahli yang menjadi pilihan pelaku usaha untuk menyelesaikan problem yang dihadapi dalam menjalankan bisnisnya.

Abstract

Observing the phenomenon of the rise of online buying and selling with cash on delivery (COD) payment systems that are not following consumer satisfaction, this research aims to discuss the view of Sharia economic law in the process of online buying and selling with the COD payment system. This type of research is literature research, using qualitative descriptive methods. Its approach is through normative and empirical legal approaches in the form of case studies. The results of this study concluded that based on the propositions of the Qur’an and hadith and the opinions of fiqh scholars, basically doing business is allowed as long as there is no element of gambling, fraud, riba, gharar, and dharar. In the case of online buying and selling with the COD payment system, if the goods sold are halal, it is clear that the quality and quantity of goods are between those offered by the seller and those received by the buyer; the payment is no element of fraud and addition, except for the postage agreed at the beginning, then according to Sharia economic law, the law can (mubah). However, conversely, if the practice of buying and selling online with COD payments, there are elements of gharar (unclear goods), riba (additional price without replacement), tadlis (fraud), and dharar (danger) that have an impact on harming sellers or buyers, then the law is haram.

Abstract

The East Java MUI Fatwa Number 4 of 2022 on Digital Transactions with the Paylater System emerged amid a national normative vacuum, as the National Sharia Council-Indonesian Ulama Council (DSN-MUI) has yet to issue a fatwa specifically regulating paylater mechanisms. This study aims to analyse: (1) the dynamics of contemporary fatwas in the digital age amid the absence of national Sharia regulation concerning paylater systems; (2) the forms of resistance articulated by the East Java MUI through Fatwa Number 4 of 2022; and (3) the dissemination of the fatwa and its reception among Muslim communities in East Java. This research employs a mixed methods approach integrating normative juridical and empirical perspectives. Primary data were collected through a survey involving 50 respondents across East Java, while secondary data consisted of the fatwa document, relevant DSN-MUI fatwas, academic literature, and media coverage related to digital financial transactions. The findings reveal three principal forms of resistance: resistance to usury (riba) manifested in interest-based charges, resistance to late payment penalties, and resistance to coercive debt collection practices, including intimidation and public shaming. However, this resistance does not amount to an absolute prohibition of paylater systems; rather, it represents a constructive normative critique that opens pathways for the development of Sharia-compliant paylater products. The study further demonstrates that fatwa dissemination remains ineffective, with only 28% of respondents aware of the fatwa’s existence. This research offers a dual contribution. Normatively, it formulates Sharia compliance criteria applicable to paylater mechanisms in the absence of a dedicated DSN-MUI fatwa. Empirically, it provides the first survey-based evidence regarding public awareness and reception of contemporary fatwas within the context of digital Islamic consumer finance governance.

Abstract

Indonesian children in Malaysia who come from migrant families often face limited access to education, including in dealing with learning difficulties such as dyslexia. This community service activity aims to assist children with dyslexia through the application of the team teaching method in an informal learning environment. The implementation method is carried out in a collaborative participatory manner by involving teachers and volunteers as the main facilitators in the learning process. The program is implemented in three stages: team teaching method training, classroom learning assistance, and evaluation of child development. The results of the activity show that this approach is able to create a more interactive and focused learning atmosphere, improve basic reading skills, and build children's self-confidence. Teachers also feel the benefits of dividing roles in managing the class and adjusting learning strategies more effectively. Parental involvement is limited, but does not hinder the course of the activity. This community service suggests the team teaching method as an effective learning strategy for migrant children with special learning needs, especially dyslexia, in the context of informal education.Anak-anak Indonesia di Malaysia yang berasal dari keluarga migran sering menghadapi keterbatasan akses pendidikan, termasuk dalam menangani kesulitan belajar seperti disleksia. Kegiatan pengabdian ini bertujuan untuk mendampingi anak-anak dengan disleksia melalui penerapan metode team teaching di lingkungan belajar informal. Metode pelaksanaan dilakukan secara partisipatif kolaboratif dengan melibatkan guru dan relawan sebagai fasilitator utama dalam proses pembelajaran. Program dilaksanakan dalam tiga tahap: pelatihan metode team teaching, pendampingan belajar di kelas, serta evaluasi perkembangan anak. Hasil kegiatan menunjukkan bahwa pendekatan ini mampu menciptakan suasana belajar yang lebih interaktif dan terfokus, meningkatkan kemampuan membaca dasar, serta membangun kepercayaan diri anak. Guru juga merasakan manfaat dari pembagian peran dalam mengelola kelas dan menyesuaikan strategi belajar secara lebih efektif. Keterlibatan orang tua bersifat terbatas, namun tidak menghambat jalannya kegiatan. Pengabdian ini menyarankan metode team teaching sebagai strategi pembelajaran yang efektif untuk anak-anak migran dengan kebutuhan belajar khusus, khususnya disleksia, dalam konteks pendidikan informal.

Abstract

Local traditions surrounding the Hajj and Umrah pilgrimages among Madurese communities have received limited scholarly attention, particularly within comparative transnational contexts. While existing studies documented the cultural significance of pilgrimage in Madura, less is known about how these traditions are reconfigured when Madurese communities migrate and inhabit different socio-political environments. This study examined how Hajj and Umrah practices are organized, experienced, and transformed among Madurese communities in Indonesia and among Madurese migrants in Malaysia. Employing a qualitative descriptive approach, data were collected through in-depth interviews, participant observation, and documentation involving community members, religious leaders, and academics. The findings revealed a clear contrast between the two contexts: in Madura, pilgrimage traditions remained highly visible and communally celebrated, reinforcing social cohesion and moral recognition, while in Malaysia these practices tended to be simplified and selectively expressed as adaptive responses to minority positioning, sociopolitical regulation, and norms of public visibility. The study demonstrated that Hajj and Umrah function not only as acts of worship but also as culturally embedded performances through which identity, belonging, and social legitimacy are negotiated within transnational social fields. By foregrounding the interplay between ritual, culture, and mobility, this research contributes to broader discussions on lived Islam, migration, and the dynamic transformation of religious practices across national boundaries.

Abstract

Corruption cases involving gold pawn (rahn) transactions within Islamic financial institutions highlight critical challenges related to sharia governance, fiduciary responsibility, and asset protection. Despite being founded on ethical and religious principles, sharia-compliant financial products remain vulnerable to financial crimes, particularly in high-value, asset-based transactions. This study examines asset confiscation mechanisms in a gold pawn corruption case in Pamekasan, Indonesia, analyzed through the perspectives of Islamic law and positive law. Employing a qualitative case study approach, this research utilizes statutory regulations, court-related legal documents, institutional reports, and secondary data from verified media and academic literature. The findings demonstrate that asset confiscation serves a dual function: as a legal instrument for state loss recovery under Indonesian anti-corruption law and as a normative mechanism aligned with Islamic legal principles such as amanah (trust), hifz al-mal (protection of property), justice, and public interest (maslahah). This study contributes to the literature by integrating Islamic jurisprudence with contemporary asset recovery discourse, emphasizing that asset confiscation is not merely a procedural legal act but a necessary governance mechanism to strengthen accountability and integrity within Islamic financial institutions. The research underscores the importance of harmonizing Islamic law and modern legal systems to restore public trust and enhance anti-corruption frameworks in sharia-compliant finance.

Abstract

Penelitian ini bertujuan membahas model penyelesaiansengketa akibat kelalain penjaga toko kelontong Madura dalam perspektif amanah muamalah. Metode yang digunakanyaitu pendekatan kualitatif, dengan teknik pengumpulan data melalui wawancara dan observasi. Hasil temuan menunjukkanbahwa kerugian yang terjadi disebabkan oleh pemberiankasbon tanpa pencatatan dan penggelapan dana yang melanggar prinsip amanah. penyelesaian sengketa dilakukanmelalui musyawrah kekeluargaan yang hasil keputusanditetapkan penggantian kerugian ditanggung penjaga tokoserta diperkuat melalu pembuatan surat pernyataanbermaterai. Hasil penelitian menemukan bahwa prinsipamanah dan musyawarah menjadi dasar efektif dalammenyelesaikan sengketa pada usaha ritel tradisional berbasiskepercayaan.

Abstract

The last 20 years have seen a growing interest in Islamic Family Law among scholars with a significant number of studies being published in international settings. The current paper evaluates the trend in the research activities in relation to Islamic Family Law across the world between the year 2000 and the year 2024. This study used data out of the Scopus journal. A systematic bibliometric analysis shows that the number of articles has grown since 2015 because of the increased interest in women's issues worldwide, the necessity to introduce changes in Muslim states, and the connection between the Islamic family law and other legal systems. Malaysia, Indonesia, Pakistan and Egypt are also considered to be some of the pioneer countries which study Islamic Family Law and the western countries that have a problem of Muslim minority also have made remarkable contributions in the study of Islamic Family Law. This paper is a critique and synthesis of the literature on issues like polygamy, divorce, and child marriage through sentiment analysis and elicits the potential opinions at both ends of the spectrum. The results indicate that research on Islamic Family Law has expanded across multiple dimensions. However, the NVivo thematic coding reveals recurring concerns regarding compatibility between Islamic family law and international human rights norms, particularly in discussions on gender equality and child marriage. This paper intends to scope the existing field in hopes of covering contemporary discourses by focusing on the Islamic Family Law research field and detailing the evolution of the field and mapping its prominent scholars.

Abstract

Sharia economic law in Indonesia has been revitalised through legal unification and codification to improve national economic development. In this context, the Sharia economy has become a guideline in every transaction. Therefore, people must understand the Islamic economic concept to create maslahah (goodness) in every aspect of life. Sharia economic law is not a new system, as it has been implemented since the era of the Prophet. However, there is a need for adjustment in the implementation of the Sharia economic law from time to time to enable it responding the current development. This study employs qualitative inquiry, using library research to analyse Sharia economic law's history and legal development. Legal documents used include state laws and regulations, the regulations of the Bank of Indonesia, the fatwa of DSN-MUI, and others. This paper argues that the revitalisation of the Sharia economic law in Indonesia is in line with the efforts made by the predominantly Muslim population to conserve and develop the system. This includes non-legalised and legalised implementation of the Sharia economic system, such as Sharia banking. Furthermore, the system does not contradict the value of Pancasila and the 1945 Constitution’s pillars of the Unitary State of the Republic of Indonesia. Sharia economic law, prioritising moral and religious principles, has proven to create maslahah and become a solution to the economic crisis. This was shown by the survival of Sharia banks during the 1998 economic crisis, maintaining the Sharia-standardised contract to create justice in society.

Abstract

This study aims to analyze the social construction of dowry (tuor) in the Mandailing-Angkola traditional marriage in Padang Lawas Regency, North Sumatra Province, as well as examine its practice from the perspective of Maqāṣid al-Sharī'ah Jasser Auda. This study uses a qualitative method with a normative-sociological approach, combining the study of Islamic law with the observation of customary practices believed by the community, primary data was obtained through in-depth interviews with traditional leaders, religious leaders, and the Padang Lawas community, while secondary data came from relevant literature and documents. The results of the study show that the practice of dowry in the Mandailing-Angkola custom in Padang Lawas Regency, North Sumatra, still maintains traditional values, but there is a shift in meaning due to contemporary social and economic pressures. Maqāṣid al-Sharī'ah Jasser Auda's perspective emphasizes the importance of simplicity, justice, and moral responsibility, thus encouraging the reinterpretation of dowry practices to be in harmony with the principles of Islamic law without eliminating cultural values. From a theoretical perspective, the practice of dowry can be analyzed through six characteristics of the system according to Auda: cognition (cognitive nature of system), which emphasizes socially accepted understanding and meaning; wholeness, where dowry is an integral part of the institution of marriage; openness, which allows adaptation to social and economic changes; interrelated hierarchy, emphasizing the relationship between dowry and family structures and customs; multidimensionality, including social, moral, and religious aspects; and purposefulness, which is the orientation of dowry practices on the achievement of benefits (maslahah) and the prevention of harm (mafsadah). With this framework, dowry is not only understood as a formal obligation or material symbol, but also as a social, moral, and religious instrument that affirms family harmony, marital legitimacy, and social responsibility in the Padang Lawas society, so that it remains relevant, adaptive, and just.
