Abstract

Abstract This research aims to understand and know the legal protection procedures of Indonesian Migrant Workers and the obstacles that often occur in the Indonesian Migrant Workers Protection Agency Makassar Region, to answer the formulation of problems in this study, used a type of empirical research. This research aims to understand and know the legal protection procedures of Indonesian Migrant Workers and the obstacles that often occur in the Indonesian Migrant Workers Protection Agency Makassar Region, to answer the formulation of problems in this study, used a type of empirical research. Based on the results of research comparing Indonesian migrant workers that the legal protection procedures of Indonesian migrant workers conducted at the BP2MI office from before work, during work, and after work. Abstrak Penelitian ini bertujuan untuk memahami dan mengetahui prosedur pelindungan hukum Pekerja migran Indonesia dan hambatan-hambatan yang sering terjadi pada Badan Pelindungan Pekerja Migran Indonesia Wilayah Makassar, untuk menjawab rumusan masalah pada penelitian ini, digunakan jenis penelitian empiris.Berdasarkan hasil penelitian pelindngan Pekerja Migran Indonesia bahwa prosedur pelindungan hukum pekerja migran indonesia yang dilakukan pada kantor BP2MI dari sebelum kerja, saat kerja, dan setelah kerja. Hambatan-hambatan yang dihadapi Badan PerlindunganPekerja Migran Indonesia yaitu banyak pekerja illegal yang sulit terlacak oleh pemerintah, calo yang sulit untuk dihilangkan dan tidak seriusnya pemerintah dalam melindungi pekerja indonesia di luar negeri.

Abstract

Abstract Currently the world is shocked by an outbreak of a disease or virus that is verydangerous to humans and is a threat to global health. The name of the virus is Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-COV2) with the name Coronavirus Disease-2019 (COVID-19) or in Indonesia better known as Coronavirus. Coronavirus or corona virus was first discovered in China, to be precise in Hubei province, Wuhan city on December 8, 2019. Then on March 11, 2020 the World Health Organization (WHO) declared COVID-19 a global pandemic after the virus began to spread to 114 countries. .The spread of Covid- 19 initially only exacerbated human health problems, but over time it cannot be denied that Covid-19 has also begun to affect the economic problems of a country. One of them is in the business world, in times like today the continuity of contracts and agreements has experienced some bottlenecks due to the pandemic. The existence of this condition can be used by the debtor as an excuse for renouncing a contract agreement that has been agreed upon with the creditor on the grounds of force or force majeure. Financial institutions engaged in the business world affected by the covid-19 outbreak are ADIRA Finance and BFI Finance. Abstrak Saat ini dunia dihebohkan dengan salah satu wabah penyakit atau virus yang sangat berbahaya bagi manusia dan merupakan ancaman bagi kesehatan global. Nama virus tersebut adalah Severe Acute Respiratory Syndrome Coronavirus 2 (SARS-COV2) dengan nama penyakit Coronavirus Disease-2019 (COVID-19) atau di indonesia lebih dikenal dengan istilah Virus Corona. Coronavirus atau virus korona pertama kali ditemukan di negara China tepatnya di provinsi Hubei, kota Wuhan pada tanggal 8 Desember 2019. Kemudian pada tanggal 11 Maret 2020 World Health Organization (WHO) menetapkan COVID-19 sebagai pandemic global setelah virus tersebut mulai menyebar ke 114 negara. Penyebaran Covid- 19 awalanya hanya memperburuk masalah kesehatan manusia namun lama kelamaan tidak dapat dipungkiri bahwa covid-19 ini juga mulai mempengaruhi masalah perekonomian suatu negara. Salah satunya yaitu dalam dunia bisnis, pada masa seperti sekarang ini kelangsungan kontrak dan perjanjian mengalami beberapa kemacetan akibat pandemi. Adanya kondis ini dapat dijadikan pihak debitur sebagai alasan dalam melakukan pangingkaran suatu kontrak perjanjian yang telah disepekati bersama dengan pihak kreditur dengan alasan memaksa atau force majeure.Lembaga pembiayaan yang bergerak dalam dunia bisnis yang terkena dari adanya wabah covid-19 adalah ADIRA Finance dan BFI Finance.

Abstract

Medina 04020170120 : “This Reseacrh is aimed at students, especially law faculty students who want to carry out research related to Analysis of Unilateral Termination of Employment by Employers Based on Law Number 13 of 2003 concerning Employment (Case Study of Decision MANo.219 / Pdt.Sus-PHI / 2017 / Pn Mdn) This study seeks to reveal the consideration of the Panel of Judges in case study cases that occur in the field in accordance with the labor law and the government's efforts in overcoming the problem of unilateral termination of employment by employers. The results of this study indicate that in the decision of the Industrial Relations Court at the Medan District Court Special Class IA with Decision Number 219 / Pdt.Sus-PHI / 2017 / Pn Mdn who tried the case in the first level court that the Defendant, namely PT Suzuki Finance Indonesia acted arbitrarily - because in terminating the work relationship unilaterally and contrary to the juridical requirements, namely Law Number 13 of 2003 concerning Manpower. As well as the efforts of the government as a regulator to create laws and regulations governing the issue of termination of employment must be strengthened and form a forum known as the Manpower Office to propose mediation regarding the issue of termination of employment”.

Abstract

Health services at the first level are carried out by puskesmas in accordance with the regulation of the health social security administering body number 1 of 2014 concerning health insurance administrators. This study is to determine the responsibilities and inhibiting factors in the provision of health services, especially participants in social security administering bodies at the Watampone Health Center. This study uses an empirical method. The results of this study indicate that the responsibility of the Puskesmas Watampone in providing health services is legally responsible for all losses caused by negligence by medical and non-medical personnel at the Watampone Health Center. As for the inhibiting factors in the provision of health services at the Watampone Health Center in the form of facilities and infrastructure, inadequate human resources and financial management and utilization of funds from the social security administering bodies, they are not optimal.

Abstract

This study aims to determine the implementation of investigations to uncover cases the crime of premeditated murder in the city of Makassar and knowing the reconstruction process of premeditated murder in the city of Makassar. The research method used in the writing of this thesis is an empirical method, with secondary and primary data coverage, this research was conducted at the Makassar Polrestabes. The results of this study indicate that the implementation of the investigation and the reconstruction process is very helpful in uncovering the crime case premeditated murder in the city of Makassar. The obstacle experienced by Makassar police investigators is the process of reconstructing a case of premeditated murder which resulted in the death of UMI (Muslim Indonesia University) student, namely Andi Predy Akrimas alias Andi lolo, the reconstruction process was not carried out at the crime scene (TKP) due to security factors, many community so that the reconstruction process was not carried out at the scene of the case. Research recommendations. All forms of constraints experienced by investigators, the authors expect the public to know the importance of carrying out the investigation and reconstruction process so that the community does not take actions that interfere with the investigation and reconstruction process.

Abstract

Abstract: This study aims to identify and analyze the factors causing the crime of livestock theft in Jeneponto district and to identify and analyze efforts to overcome the crime of livestock theft in Jeneponto district. This study uses empirical juridical research methods taken from data using primary data by conducting interviews and secondary data by managing data from primary legal materials, secondary law, and tertiary law. Based on the results of the study, it is known that the factors that influence the occurrence of the crime of animal theft include economic factors, environmental factors, educational factors, and educational factors. As for the efforts in overcoming the problem of the crime of animal theft, namely: Preventive efforts (Prevention Efforts), Repressive efforts (Enforcement Efforts), and curative efforts. It is necessary to reform the criminal law which is essentially part of the effort to protect the community, especially the crime prevention effort and the consistency of each party in carrying out the non-penal effort to make it more effective. Abstrak:Penelitian ini bertujuan untuk mengetahui dan menganalisis faktor penyebab terjadinya tindak pidana pencurian ternak di kabupaten Jeneponto dan mengetahui dan menganalisis upaya penanggulangan tindak pidana pencurian ternak di kabupaten Jeneponto. Penelitian ini menggunakan metode penelitian bersifat yuridis empiris diambil dari data menggunakan data primer dengan melakukan wawancara dan data sekunder dengan mengelolah data dari bahan hukum primer, hukum sekunder, dan hukum tersier. Berdasarkan hasil penelitian diketahui faktor-faktor yang mempengaruhi terjadinya tindak pidana pencurian hewan antara lain faktor ekonomi, faktor lingkungan, faktor pendidikan, dan faktor pendidikan. Adapun upaya-upaya dalam menanggulangi masalah tindak pidana pencurian hewan yaitu: upaya Preventif (Upaya Pencegahan), upaya Represif (Upaya Penindakan), dan upaya kuratif. Perlu dibuat pembaruan hukum pidana yang pada hakikatnya merupakan bagian dari upaya perlindungan masyarakat khususnya upaya penanggulangan kejahatan dan adanya konsistensi dari setiap pihak dalam melaksanakan upaya non penal tersebut agar lebih efektif.

Abstract

Abstract: This study aims to understand and analyze the function of the government in carrying out the functioning of public services during the pandemic while still paying attention to PP. No. 88 of 2019 concerning occupational health. The research method used in writing this thesis is an empirical legal research method. Empirical legal research is a type of legal research that analyzes and examines the workings of law in society. The government's function is to carry out public service functions during the pandemic by issuing Work From Home system rules and the government also imposes restrictions on management at public service offices and in protecting government employees also applies a scheduling system for employees who come to work at the office. The recommendation from this research is that the government must continue to monitor and protect employees in public services to the maximum extent so that employees feel safe and continue to carry out their functions optimally. Abstrak: Penelitian ini bertujuan Untuk memahami dan menganalisis fungsi pemerintah dalam melaksanakan jalannya fungsi pelayanan publik dimasa pandemi dengan tetap memperhatikan PP.No.88 Tahun 2019 tentang kesehatan kerja. Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum empiris. Penelitian hukum empiris, merupakan salah satu jenis penelitian hukum yang menganalisis dan mengkaji bekerjanya hukum di dalam masyarakat. Hasil penelitian ini adalah Fungsi pemerintah dalam melaksanakan jalannya fungsi pelayanan publik dimasa pandemi dengan mengeluarkan aturan sistem Work From Home dan pemerintah juga melakukan pembatasan pengurusan di kantor pelayanan publik serta dalam melindungi pegawai pemerintah juga memberlakukan sistem penjadwalan pegawai yang masuk kerja dikantor. Rekomendasi dari penelitian ini adalah Pemerintah harus terus melakukan pengawasan serta perlindungan secara maksimal terhadap pegawai di pelayanan publik agar pegawai merasa aman dan tetap menjalankan fungsinya secara maksimal juga.

Abstract

Urban regions face numerous challenges in implementing regional autonomy. The smart city concept has been implemented by cities in various countries to tackle these issues. This article aims to comprehend and assess the political laws selected by the Indonesian government to address the challenges of implementing regional autonomy in urban areas using smart city concepts and indicators. The research method employed was normative research through a statutory regulations approach, in addition to a conceptual approach. The research material was secondary data comprising primary legal materials as well as secondary legal materials amassed via online and offline research at the library. The data was then analyzed in a descriptive manner. The analysis results demonstrate that numerous Indonesian cities have introduced smart city indicators. However, these indicators lack a legal foundation referencing smart city standards. The absence of specific regulations for smart cities in Indonesia has resulted in unstructured and immeasurable implementation. In Indonesia, the closest legal regulations or policies to the concept of a smart city are those outlined in Government Regulation Number 38 of 2017 concerning Innovation. Going forward, it is necessary to establish legal guidelines that contain specific standards for smart cities, from inception to implementation, in order to enhance regional autonomy in urban areas.

Abstract

The Constitutional Court's decision regarding the age limit for nominations for President and Vice President has caused problems in society, one of which is related to the issue of the existence of a Family Court. This issue arises because juridically there is a logical inconsistency in the Constitutional Court's decision regarding the age limit for nominations for President and Vice President and related to the nomination of the President's children to contest the Presidential and Vice Presidential elections in the 2024 election. This research aims to analyze aspects of the age threshold for Presidential candidacy and The Vice President reviewed the theory of dignified justice along with an analysis of the Family Court issue as a result of the Constitutional Court's decision. This research is normative legal research which also orientates socio-legal aspects to assess the impact of a Constitutional Court Decision. The approach used is a conceptual and statutory approach. The research results confirm that the enigma of the age threshold for presidential candidacy in the perspective of the theory of dignified justice occurs because the Constitutional Court has gone beyond the open legal policy conception where the age threshold for presidential and vice presidential candidacy is actually the domain of the legislative institution as in the open legal policy conception. Judging from the theory of dignified justice, the enigma of the age threshold for presidential candidacy also occurs because the Constitutional Court failed to construct the dimensions of social justice as envisioned in the formulation of Pancasila. MK Decision on the Age of the President and Vice President as part of a legal product certainly has social, political and legal impacts on society. Issues related to the Family Court should be addressed wisely by the Constitutional Court because these issues exist as a form of public concern for the dignity of the Constitutional Court as an institution that protects the constitution.

Abstract

This study aims to determine and analyze the level of legal awareness of the community in Manuju District, Gowa Regency in registering their land, to find out the factors that influence the community in Manuju District, Gowa Regency in registering their land. This research uses empirical method. The research location is in Manuju District, Gowa Regency. The results of this study indicate that the level of public legal awareness in the context of land registration in Manuju District, Gowa Regency can be said to be sufficient. Judged from several aspects, namely sufficient in legal knowledge, legal understanding, legal attitudes, and community behavior. The inhibiting factors for the community in Manuju District, Gowa Regency in registering their land are lack of understanding of the functions and uses of land certificates, thinking that the land registration process takes a long time, the costs incurred in the land management process and tax payments, the supporting factors for the community in registering their land are that it can create a sense of security, obtain legal protection, can be used as strong evidence in the eyes of the law, increase selling value, and improve the community's economy, and facilitate the transfer of rights. The government should more often conduct socialization about the importance of registering land, the community should ask the local government or use the services of land officials if they do not know the land registration process.
