Abstract

Tujuan penelitian menganalisis hukum mengatur pencalonan perseorangan dalam pemilihan umum kepala daerah (Pemilukada); (2) mengetahui dan menganalisis implikasi hukum yang ditimbulkan dari pencalonan perseorangan. Metode penelitian dalam penelitian ini menggunakan tipe penelitian normatif. Hasil penelitian ini menunjukkan bahwa: (1) Pengaturan hukum pencalonan perseorangan dalam pemilihan umum kepala daerah (Pemilukada) telah diatur sesuai dengan peraturan perundang-undangan yang berlaku; (2) Adapun implikasi hukum yang ditimbulkan yang ditimbulkan dari pencalonan perseorangan adalah adanya implikasi hukum terhadap kultur hukum, implikasi hukum terhadap struktur hukum, dan implikasi hukum terhadap substansi hukum. The research objective is to analyze to analyze the law governing individual candidacy in regional head general elections (Pemilukada); (2) knowing and analyzing the legal implications arising from individual nominations. The research method in this study uses a normative research type. The results of this study indicate that: (1) The legal arrangements for individual nomination in regional head general elections (Pemilukada) have been regulated in accordance with the applicable laws and regulations; (2) The legal implications arising from individual nominations are legal implications for legal culture, legal implications for legal structure, and legal implications for legal substance.

Abstract

The negative view that the People's Representative Council of Indonesia (DPR) has long been in a constant effort to weaken the Corruption Eradication Comission (KPK), making the revision process of the KPK law until after it is legalized, receives pro and contra. A number of provisions in the new Law of KPK are considered to potentially weaken the independence of the institution, especially concerning the establishment of the so called Supervisory Council. The purpose of this research was to analyze an the position of the Supervisory Council and to explain its implications on the institutional aspects of the KPK.This normative legal research was conducted through a literature study using conceptual and statue approaches, which then analyzed qualitatively. The results show that the new Law of KPK makes the Supervisory Council as an internal supervision organ, but its position had not well formulated yet in the institutional structure. The existence of the Supervisory Council also have some impacts on the institutional aspects of KPK in terms of Institutional and functional independences.

Abstract

The high school / vocational school situation is following the modern school model in order to adapt its existence to technology era. Synchronization can make more excellence, including in the form of cross-border regional relationships and forming a competitive atmosphere between schools, and build new subsystems to improving the quality of schools, but in fact also poses an additional challenge in running the subsystems within the school, thus requiring a legal approach as a solution to potential conflicts. The method of implementation in this devotion uses a lecture socialization technique in order to create a legal awareness for students, teachers and parents in order to prevent legal problems. Socialization and application of legal symbols for transfer of knowledge to school elements isn’t biased after the dedication to the students has been completed. This dedication emphasizes four important points, including: (1) Religious Approach, (2) Student Moral & Ethics Development, (3) The Importance of Discipline, and (4) Embedding Legal Awareness, which is believed to help keep the school process to its goals any time. Finally, all these important points become the reference for the implementation of concrete activities in the environment of SMK Negeri 2 Makassar.Keywords: violence, vocational students, student trusteeABSTRAKSituasi sekolah setingkat SMU/Kejuruan telah mengikuti perkembangan model sekolah moderen dalam rangka menyesuaikan eksistensinya diera teknologi. Sinkronisasi diyakini dapat meningkatkan keunggulan, diantaranya dalam bentuk pergaulan lintas batas kewilayahan dan membentuk suasana kompetitif antar sekolah. Hal itu menumbuhkan berbagai subsistem baru dalam peningkatan mutu sekolah, namun sesungguhnya menimbulkan sebuah tambahan tantangan dalam menjalankan subsistem dalam sekolah tersebut, sehingga perlu pendekatan hukum sebagai solusi terhadap potensi konflik. Metode pelaksanaan dalam pengabdian ini menggunakan tehnik ceramah/sosialisasi agar terciptanya sebuah kesadaran hukum bagi siswa, guru dan wali siswa demi mencegah permasalahan hukum. Sosialisasi dan penerapan simbol hukum agar transfer ilmu pengetahuan kepada unsur dalam sekolah tidak bias setelah pengabdian pada siswa telah selesai. Pengabdian ini menekankan pada 4 poin penting, diantaranya: (1) Pendekatan Keagamaan, (2) Pengembangan Moral & Etika siswa, (3) Pentingnya Kedisiplinan, dan (4) Menanamkan Kesadaran Hukum, yang diyakini mampu membantu menjaga proses sekolah meraih tujuan-tujuannya setiap saat. Akhirnya, keseluruh poin penting ini menjadi acuan untuk dilaksanakannya berbagai kegiatan kongkrit dalam lingkugan sekolah SMK Negeri 2 Makassar.Kata kunci: kekerasan, siswa SMK, wali siswa

Abstract

This study aims to describe the position of the Selection Team at the State Administrative Court, as well as analyze dispute resolution procedures within the scope of the General Election Commission administration. This study uses a normative juridical method. The collected legal material is analyzed using qualitative data analysis methods with a statute approach to describe the problem and answer study purposes. The results show that the position of the Selection Team is a witness in the process of dispute resolution at the State Administrative Court. Furthermore, the detrimental parties may submit an objection and appeal effort. In this case, administrative dispute resolution has been regulated in General Election Commission Regulation No. 3 of 2021. On the other hand, Judges will only adjudicate cases and resolve disputes at the State Administrative Court after the plaintiff has undergone administrative efforts. Therefore, it is recommended for the Judge to reject lawsuits from the plaintiffs if the lawsuit positions the Selection Team as the defendant. In addition, it is also recommended that the plaintiff know and understand dispute resolution procedures on the determination of members of the General Election Commission at the State Administrative Court. In contrast, if the plaintiff has undergone administrative effort while the General Election Commission rejects the effort. So to get legal certainty, the plaintiff must submit a lawsuit by positioning the Commissioner of the General Election Commission as the defendant at the State Administrative Court.

Abstract

Tujuan penelitian menganalisis pengawasan over loading kendaraan angkutan barang pada bptd wilayah xix sudah berjalan sesuai dengan prinsip keselamatan dan keamanan berlalu lintas dan angkutan jalan. Penelitian yang dilakukan adalah penelitian hukum empiris. Hasil penelitian ini menunjukkan bahwa (1) pengawasan over loading kendaraan angkutan barang dengan prinsip keselamatan dan keamanan berlalu lintas dan angkutan jalan pada BPTD wilayah XIX belum terlaksana dengan baik dikarenakan pelaksana lapangan seringkali mendapat tekanan dari pejabat yang berkepentingan serta masih banyaknya pelaku usaha transportasi, pelaku usaha logistik tidak menyadari dampak terhadap keselamatan dan keamanan dan hanya mengutamakan keuntungan. (2) pengawasan over loading kendaraan angkutan barang pada BPTD XIX berdasarkan hasil wawancara, analisis data hasil penelitian dan pengamatan langsung peneliti disimpulkan bahwa pelaksanaan pengawasan belum efektif dikarenakan berbagai faktor anatara lain; (1). Faktor kebijakan yang masih lemah (2). Kurangnya sumber daya manusia (3). Jam operasional tidak sesuai sop (4). Adanya pungutan liar petugas UPPKB (5). Budaya hukum pelaku usaha dan pengemudi. The aim of the research is to analyze the overloading supervision of goods transport vehicles at BPTD Region XIX that have been running according to the principles of safety and security of traffic and road transportation. The research conducted is empirical legal research. The results of this study indicate that (1) supervision of overloading of goods transport vehicles with the principles of safety and security in traffic and road transportation at BPTD region XIX has not been carried out properly because field implementers are often under pressure from interested officials. There are still many transportation business actors, Logistics businesses do not realize the impact on safety and security and only prioritize profits. (2) supervision of overloading of goods transport vehicles at BPTD XIX based on the results of interviews, research data analysis and direct observations of researchers concluded that the implementation of supervision has not been effective due to various factors, among others; (1). Policy factors that are still weak (2). Lack of human resources (3). Operational hours do not match soup (4). There are illegal levies by UPPKB officers (5). The legal culture of business actors and drivers.

Abstract

This study aims to examine and analyze the norm conflict regarding the definition of small fishermen in legislation at the same hierarchical level. This study uses normative legal research with the statute, conceptual, and comparative approaches. The collected legal material is then qualitatively analyzed to describe the problem and answer study purposes. The results show that there is a conflict of norms between Law Number 45 of 2009 with Law Number 7 of 2016 in defining small fishermen. Law Number 45 of 2009 refers to fishermen with a maximum vessel size of 5 GT, while Law Number 7 of 2016 refers to fishermen who use their own or others’ vessels with a maximum size of 10 GT. On the other hand, GT is a unit of measure agreed upon as the provisions of the Convention on the International Tonnage Measurement of 1969 in determining the vessel category. To eliminate norm conflict concerning the definition of small fishermen, the Government enacted the GR in Lieu of Law Number 2 of 2022. Fatally, GR in Lieu of Law Number 2 of 2022 raises ambiguity which shows the definition of small fishermen is increasingly unclear. Therefore, it is recommended that the House of Representatives initiate amendments to Law Number 7 of 2016 and GR in Lieu of Law Number 2 of 2022. These amendments must accommodate a more specific indicator regarding vessel size, aligned with the provisions in Law Number 45 of 2009. These steps are expected to create greater legal clarity and certainty for small fishermen and provide improved guidance for all stakeholders in the maritime and fisheries sector.

Abstract

Currently the world is shocked by an outbreak of a disease or virus that is very dangerous to humans and is a threat to global health. The name of the virus is Severe Acute Respiratory Syndrome Coronavirus 2 know as SARS-COV2 with the name Coronavirus Disease-2019 or COVID-19 or in Indonesia better known as Coronavirus. Coronavirus or corona virus was first discovered in China, to be precise in Hubei province, Wuhan city on December 8, 2019. Then on March 11, 2020 the World Health Organization declared COVID-19 a global pandemic after the virus began to spread to 114 countries. The spread of Covid-19 initially only exacerbated human health problems, but over time it cannot be denied that Covid-19 has also begun to affect the economic problems of a country. One of them is in the business world, in times like today the continuity of contracts and agreements has experienced some bottlenecks due to the pandemic. The existence of this condition can be used by the debtor as an excuse for renouncing a contract agreement that has been agreed upon with the creditor on the grounds of force or force majeure. Financial institutions engaged in the business world affected by the covid-19 outbreak are ADIRA Finance and BFI Finance.

Abstract

Tujuan penelitian menganalisis bencana alam dikategorikan sebagai keadaan darurat yang menjadi unsur hukum tata negara darurat dan menganalisis wewenag dan tanggung jawab pemerintah dalam menanggulangi bencana. Penelitian ini dilaksanakan menggunakan yuridis normatif. Hasil penelitian ini menunjukkan bahwa (1) bencana alam diakategorikan dalam Hukum Tata Negara darurat karena termasuk salah satu hal yang tidak dapat diatasi oleh alat-alat perlengkapan negara sebagaimana biasaanya. Peristiwa bencana alam berpotensi besar mehilangkan dan memusnahkan atau paling minimal membuat tidak berfungsi untuk sementara salah satu unsur-unsur suatu Negara, yakni wilayah (laut, udara, dan darat), penduduk, dan kegiatan pemerintah; (2) Tujuan tanggung jawab pemerintah terhadap penanggulangan bencana alam menurut Undang-Undang Nomor 24 Tahun 2007 meliputi penjaminan pemenuhan hak masyarakat dan pengungsi yang terkena bencana, perlindungan masyarakat dari dampak bencana, pengurangan resiko bencana dan pemaduan pengurangan resiko bencana dengan program pembangunan, serta pengalokasian dana penanggulangan bencana alam melalui tahap pelaksanaan penanggulangan bencana alam yang berupa tahap prabencana, tanggap darurat, dan pascabencana. The research objective is to analyze the natural disasters categorized as emergencies which are an element of emergency constitutional law and to analyze the authority and responsibility of the government in dealing with disasters. This research was conducted using normative juridical. The results of this study indicate that (1) natural disasters are categorized in the Emergency Constitutional Law because they are one of the things that cannot be handled by state apparatus as usual. Natural disasters have the potential to eliminate and destroy or at least make temporarily incapacitate one of the elements of a country, namely territory (sea, air and land), population and government activities; (2) The objectives of the government's responsibility for natural disaster management according to Law Number 24 of 2007 include guaranteeing the fulfilment of the rights of communities and refugees affected by disasters, protecting people from the effects of disasters, reducing disaster risk and integrating disaster risk reduction with development programs, as well as allocating natural disaster management funds through the stages of implementing natural disaster management in the form of pre-disaster, emergency response, and post-disaster stages.

Abstract

Tujuan penelitian menganalisis urgensi penggunaan metode Omnibus Law kedalam sistem penataan peraturan perundang-undangan Indoensia dan bagaimana penerapan Omnibus Law dalam sistem perundang-undangan di Indonesia. Penelitian ini menggunakan metode pendekatan historis, yuridis komparatif dan sosiologis serta pendekatan kualitatif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa Urgensi penggunaan metode Omnibus Law dalam sistem pembentukan peraturan perundang-undangan adalah sebagai bentuk salah satu strategi dalam penyederhanaan, harmonisasi dan sinkronisasi peraturan perundang-undangan terhadap pembentukan regulasi yang tidak terkendali dan semrawut selama ini di Indonesia. Pemerintah bersama dengan Dewan Perwakilan Rakyat mengesahkan Undang-Undang No 11 Tahun 2020 Tentang Cipta Kerja yang menggunakan metode Omnibus Law sebagai terobosan baru dalam membentuk Undang-Undang. The research objective is to analyze the urgency of using the Omnibus Law method in the Indonesian statutory regulatory system and how the Omnibus Law is implemented in the Indonesian statutory system. This research uses a historical approach, comparative juridical, sociological, and qualitative approaches. Based on the results of the research and discussion, it can be concluded that the urgency of using the Omnibus Law method in the system for forming laws and regulations is a form of strategy in simplification, harmonization and synchronization of laws and regulations towards the formation of uncontrolled and chaotic rules so far in Indonesia. The government and the House of Representatives passed Law No. 11 of 2020 concerning Job Creation which uses the Omnibus Law method as a new breakthrough in forming a Law.

Tujuan penelitian menganalisis perbedaan perbandingan Pemungutan Suara Ulang dalam Pasal 372 yang mengatur tentang Pemungutan Suara Ulang dalam Pemilihan Umum dengan Pasal 112 yang mengatur tentang Pemungutan Suara Ulang dalam Pemilihan Kepala Daerah. Penelitian ini menggunakan pendekatan normatif. Hasil penelitian menujukan bahwa Pada Pemilu Tahun 2019 Pemungutan Suara Ulang di Provinsi Sulawesi Selatan sebanyak 91 TPS yang tersebar di 9 (Sembilan) Kabupaten/Kota se-Sulawesi Selatan sedangkan pada Pemilihan 2020 terjadi PSU di 1 (Satu) TPS di Kabupaten Pangkajene Kepulauan Provinsi Sulawesi Selatan dan 2 (dua) TPS pada Pemilihan Tahun 2018. Dalam hal ini terdapat beberapa perbedaan yang mencolok pada Pasal 372 dan Pasal 112 terkait syarat dilaksanakannya PSU. The research objective is to analyze the difference in the comparison of re-voting in Article 372 which regulates re-voting in General Elections with Article 112 which regulates re-voting in Regional Head Elections. This study uses a normative approach. The results of the study indicate that in the 2019 General Election there were 91 TPS in South Sulawesi Province which were spread over 9 (Nine) Regencies/Cities throughout South Sulawesi, while in the 2020 Election there were PSUs in 1 (One) TPS in Pangkajene Regency, Sulawesi Province. South and 2 (two) TPS in the 2018 Election. In this case there are some striking differences in Article 372 and Article 112 regarding the conditions for the implementation of the PSU.
