Abstract

Penelitian ini bertujuan untuk menganalisis secara kriminologis tindak pidana pencurian yang dilakukan oleh anak di Kota Makassar, dengan fokus pada dua aspek utama: upaya pencegahan dan faktor-faktor yang memengaruhi anak dalam melakukan tindak pidana tersebut. Tindak pidana pencurian yang melibatkan anak tidak hanya mencerminkan dinamika sosial dan ekonomi dalam masyarakat perkotaan, tetapi juga menunjukkan adanya celah dalam sistem perlindungan anak serta lemahnya pengawasan lingkungan. Secara kriminologis, anak sebagai pelaku tindak pidana umumnya berada dalam situasi yang kompleks, mulai dari pengaruh lingkungan keluarga, pergaulan, hingga ketimpangan sosial. Upaya pencegahan yang dilakukan oleh berbagai pihak di Makassar—termasuk pemerintah, aparat penegak hukum, lembaga pendidikan, dan masyarakat—masih bersifat parsial dan kurang terintegrasi. Oleh karena itu, diperlukan pendekatan preventif yang berorientasi pada keadilan restoratif, rehabilitasi sosial, serta penguatan nilai-nilai keluarga. Kajian ini merekomendasikan perumusan kebijakan yang responsif terhadap kebutuhan anak dan berbasis pada pendekatan multidisipliner agar dapat menanggulangi kejahatan anak secara lebih komprehensif. This study aims to provide a criminological analysis of theft crimes committed by minors in Makassar City, focusing on two main aspects: prevention efforts and the factors influencing children to engage in such criminal acts. Theft offences involving children reflect not only the socio-economic dynamics of urban life but also indicate gaps in child protection systems and weak environmental supervision. From a criminological perspective, children who commit crimes are often influenced by complex circumstances such as family environment, peer influence, and social inequality. Prevention efforts in Makassar—carried out by the government, law enforcement, educational institutions, and communities—remain partial and lack an integrated approach. Thus, a preventive strategy is needed that emphasises restorative justice, social rehabilitation, and the reinforcement of family values. This study recommends formulating responsive policies based on multidisciplinary approaches to comprehensively address juvenile delinquency and minimise recidivism among minors.

Abstract

This study aims to determine and analyze the level of legal awareness of the community in Manuju District, Gowa Regency in registering their land, to find out the factors that influence the community in Manuju District, Gowa Regency in registering their land. This research uses empirical method. The research location is in Manuju District, Gowa Regency. The results of this study indicate that the level of public legal awareness in the context of land registration in Manuju District, Gowa Regency can be said to be sufficient. Judged from several aspects, namely sufficient in legal knowledge, legal understanding, legal attitudes, and community behavior. The inhibiting factors for the community in Manuju District, Gowa Regency in registering their land are lack of understanding of the functions and uses of land certificates, thinking that the land registration process takes a long time, the costs incurred in the land management process and tax payments, the supporting factors for the community in registering their land are that it can create a sense of security, obtain legal protection, can be used as strong evidence in the eyes of the law, increase selling value, and improve the community's economy, and facilitate the transfer of rights. The government should more often conduct socialization about the importance of registering land, the community should ask the local government or use the services of land officials if they do not know the land registration process.

Abstract

The problem of village fund management in 2015 and until 2018, the budget of village funds from the central government to South Sulawesi has reached a total of Rp.5.7 trillion spread over 2,255 villages. With that much budget, it should be a trigger for the performance of village officials to increase development as mandated by Law Number 6 of 2014 concerning Villages (Village Law. But in its development, the abundant village funds were prone to be misused. Based on ICW monitoring since from 2015 to 2018, cases of corruption in village funds have increased from year to year and there have been at least 181 cases of corruption in village funds with 184 suspects of corruption and a loss of Rp. 40.6 billion. Increasing abuse of village funds has also occurred in South Sulawesi, namely 22 cases have been recorded with state losses of 3.4 billion, so it is deemed necessary to take efforts through preemptive and preventive patterns so that misuse of village funds is not repeated in various regions, particularly in Baji Mangngai Village, Mandai District, Maros Regency. we make a legal study, as it is believed that jurisprudence ha dir in an effort to provide legal problem solving.

Abstract

This research aims to determine and analyze the effectiveness of using Etle in reducing traffic violations, particularly in the Makassar Police jurisdiction. This research uses an empirical juridical type of research. The sources of data for this research are results from interviews, observations, books, documents, regulations, and other written materials closely related to the object to be discussed. The results obtained from this research indicate that the Polda Makassar institution, particularly the traffic unit in collaboration with the city government, has fulfilled its role as a complaint center, legal assistance service specifically for traffic, policy studies, traffic legislation, and accident handling. The obstacles faced since the implementation of electronic traffic tickets include: issues related to facilities and infrastructure, the quality and quantity of human resources, and network limitations. The factors influencing the implementation of electronic traffic tickets at the Satlantas Polda Makassar are the readiness of technological infrastructure, public awareness, the availability of human resources, and the commitment of leaders and personnel. The recommendation of this research is that the government and related agencies should synergize more in providing assistance and legal aid, conduct comprehensive legal socialization/education efforts to the public, work firmly with the community in the development and handling of electronic traffic tickets, and remind and raise awareness again about the importance of adhering to legal regulations while driving. Abstrak: Penelitian ini bertujuan untuk mengetahui dan menganalisis Efektivitas Penggunaan Etle mengenai bagaimana dalam mengurangi pelanggaran lalu lintas khususnya di Wilayah Polda Makassar. Penelitian ini menggunakan tipe penelitianyuridis empiris. Adapun sumber data penelitian ini adalah hasil dari wawancara, observasi, buku, dokumen, peraturan perundang- undangan, dan bahan-bahan tertulis lainnya yang berkaitan erat dengan objek yang akan dibahas.Hasil yang diperoleh dari penelitian ini menunjukkan bahwa lembaga Polda Mkassar khususnya satuan lalu lintas yang bekerja sama dengan pemerintah kota telah menjalankan perannya sebagai tempat pengaduhan, pelayanan bantuan hukum khususnya lalu lintas, kajian kebijakan, perundang-undangan tentang lalu lintas, dan penanganan kecelakaan. Kendala-kendala yang dihadapi semenjak berlakunya elektronik tilang antara lain: kendala dalam hal sarana dan prasarana, kualitas dan kuantitas sumber daya manusia, dan keterbatasan jaringan. Faktor-faktor yang mempengaruhi pelakasanaan elektronik tilang di Satlantas Polda Makassar adalah faktor kesiapan infrastruktur teknologi, faktor kesadaran masyarakat, faktor kesediaan sumber daya manusia dan faktor komitmen pemimpin dan personil. Rekomendasi penelitian ini adalah diharapkan hendaknya pemerintah dan pihak-pihak instansi yang terkait lebih bersinergi dalam pendampingan dan pemberian bantuan hukum, upaya sosialisasi/ penyuluhan hukum secara menyeluruh kepada masyarakat, bekerja sama secara tegas dengan masyarakat dalam pembinaan dan penanggulangan elektronik tilang yang terjadi pada lalu lintas, serta menghimbau dan menyadarkan kembali arti pentingnya mematuhi aturan-aturan hukum dalam berkendara.

Abstract

This study aims to analyze the legal consequences of the issuance of Covernote by Notary / PPAT on the parties to a banking credit agreement, identify potential legal problems due to delays or discrepancies in the documents promised in Covernote, and provide an understanding of the role and limitations of Covernote in banking practice as a supporting document for credit guarantees. The method used in this research is empirical juridical with a qualitative descriptive approach, where data is obtained through interviews with Notary / PPAT, banks, and debtors related to the issuance of Covernote, as well as through document studies and relevant laws and regulations. The results show that Covernote does not have binding legal force as a credit guarantee, but is often a reference in the process of disbursing funds by banks. The legal consequences can be in the form of default risk for the debtor if the documents promised in the Covernote cannot be fulfilled, as well as the potential legal responsibility for Notary / PPAT if there is negligence in its issuance. The implications of this research emphasize the need for caution in the issuance of Covernote so as not to cause legal problems for the parties. In addition, banks as creditors need to understand the limitations of Covernote in guaranteeing legal certainty over mortgage rights. The recommendations of this research emphasize the need for clearer regulations related to the issuance of Covernote by Notary/PPAT in order to provide legal protection for all parties involved in banking credit agreements.

Abstract

This study examines judges’ legal reasoning in determining the success or failure of diversion in juvenile cases within Indonesia’s Juvenile Criminal Justice System. Using a normative juridical approach with a doctrinal character, the research analyzes statutory provisions under Law Number 11 of 2012 and selected district court decisions that reflect diverse diversion outcomes. The findings reveal that although diversion is an imperative legal mandate, its implementation varies significantly in judicial practice. Diversion may succeed substantively when judges actively facilitate restorative dialogue and involve probation officers effectively, but it may fail when reduced to procedural formality or financial compensation negotiations. The study also identifies instances where diversion is entirely omitted despite meeting normative requirements, reflecting a persistent retributive bias in juvenile adjudication. These inconsistencies demonstrate that diversion outcomes are strongly influenced by judicial discretion, victim willingness, socio-economic factors, and the availability of non-material restoration mechanisms. The study concludes that diversion must be reinforced as a substantive right of the child rather than a mere administrative obligation. Strengthening judicial guidelines, enhancing probation services, and promoting restorative justice-oriented judicial training are essential to ensure consistent, child-centered, and restorative diversion practices

Abstract

The circulation of illegal cosmetics containing hazardous substances represents a serious issue that not only threatens public health but also reflects the inadequacy of criminal liability enforcement against business actors. This study aims to analyze the regulatory framework governing criminal liability for illegal cosmetic business actors and to examine the elements of criminal responsibility in judicial practice. This research employs a normative juridical method with statutory, conceptual, and case approaches. The novelty of this study lies in integrating classical criminal liability concepts with strict liability principles within the modern consumer protection framework. The findings reveal that although the criminal regulatory framework is comprehensive and layered, its implementation still faces challenges, particularly in proving fault elements and ensuring effective law enforcement. Judicial practices also demonstrate a tendency to apply the lex specialis principle and implicitly recognize strict liability to enhance consumer protection. This study concludes that strengthening a consumer-oriented criminal liability paradigm and improving institutional coordination are essential to suppress the proliferation of hazardous illegal cosmetics.

Abstract

Pengesahan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP Nasional) yang diproyeksikan berlaku efektif pada 2 Januari 2026, menandai sebuah milestone monumental sekaligus kontroversial dalam sejarah hukum pidana Indonesia. Legislasi ini mengklaim membawa misi agung dekolonisasi, demokratisasi, konsolidasi, dan harmonisasi hukum pidana nasional, mengakhiri dominasi Wetboek van Strafrecht warisan kolonial Belanda yang telah bercokol hampir satu abad. Namun, di balik narasi pembaharuan tersebut, pengesahan ini memantik diskursus konstitusional yang tajam karena sejumlah pasal dinilai secara substansial bertentangan dengan prinsip negara hukum demokratis dan menghidupkan kembali ketentuan otoritarian yang sebelumnya telah dibatalkan oleh Mahkamah Konstitusi (MK) melalui mekanisme judicial review. Penelitian ini menyajikan analisis mendalam dan ekstensif mengenai peran Mahkamah Konstitusi dalam mengawal konstitusionalitas KUHP baru, dengan fokus spesifik pada putusan-putusan terkait pengajuan uji materiil di masa transisi serta proyeksi prospek pengujian di masa mendatang. Menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach), dan pendekatan konseptual (conceptual approach), studi ini membedah bahan hukum primer berupa UUD NRI 1945, naskah komprehensif KUHP Baru, putusan-putusan MK yang relevan (seperti Putusan Nomor 013-022/PUU-IV/2006 dan Putusan Nomor 1/PUU-XXI/2023), serta literatur sekunder yang otoritatif. Hasil penelitian menunjukkan bahwa MK cenderung mengambil posisi judicial restraint dengan menolak permohonan judicial review pada masa vacatio legis dengan alasan prematuritas, sebuah sikap yang menyisakan ruang ketidakpastian hukum dan potensi pelanggaran hak konstitusional (constitutional injury) yang tertunda. Temuan juga mengungkapkan adanya fenomena inkonsistensi radikal antara ratio decidendi putusan MK terdahulu dengan substansi KUHP baru, khususnya terkait revitalisasi pasal penghinaan Presiden (lèse-majesté) dan penghinaan lembaga negara, yang mengindikasikan defisit moralitas konstitusi (constitutional morality) dari pembentuk undang-undang. Penelitian ini merekomendasikan perlunya reorientasi paradigma pengujian undang-undang dari yang bersifat murni represif menjadi akomodatif terhadap preventive review dalam situasi luar biasa, serta pengawalan ketat masyarakat sipil pasca-berlakunya KUHP pada 2026.

Abstract

Indigenous culture plays a vital role in shaping normative frameworks that support modern governance. This study examines the Minangkabau indigenous community’s tradition of consensus-based deliberation (musyawarah) as a democratic pillar that contributes to the achievement of the Sustainable Development Goals (SDGs), particularly SDG 16.7 on inclusive and participatory decision-making. Using a normative legal research method with a qualitative approach, the study explores how Minangkabau customary law integrates communal values into decision-making processes that promote social justice and poverty alleviation. In Minangkabau society, deliberation is not merely procedural but reflects a collective ethic where truth is determined through group consensus rather than individual assertion. This principle fosters inclusive governance, equitable outcomes and social cohesion. The study further analyzes the alignment between this indigenous practice and the Islamic principle of syuraa (consultation), which serves as a moral foundation for participatory democracy in Islamic jurisprudence. The results show that deliberative consensus functions as an effective participatory democracy mechanism based on local wisdom in realizing social justice and poverty alleviation. These findings confirm the relevance of integrating customary values and the principle of syūrā in strengthening equitable social governance and supporting the sustainable achievement of the SDGs.
