Abstract

Abstract, This article presents the findings of a field study aimed at understanding the perspectives of palm oil farmers regarding the implementation of zakat mal. Data were collected through observations, interviews, and documentation, with a descriptive analysis employed to portray the realities of zakat practices among these farmers. The findings indicate that palm oil farmers have not fully grasped the concept of zakat mal. Many perceive zakat and charity as similar, leading to contributions that often do not align with the established nishab. Their donations are more influenced by personal willingness and ability. Additionally, the timing of zakat contributions to the mosque is irregular; they give when they have the means and intent. This lack of understanding is primarily attributed to the insufficient outreach from relevant institutions, including Baznas, local government, and community leaders. Furthermore, the community struggles to locate payment sites for zakat mal due to the absence of zakat administrators in Tanjung Jabung Timur Regency. Keywords: Mal Zakat, oil palm farmers, Tanjung Jabung Timur.

Abstract

Implementation of Elimination of Heavily Damaged Area Property at the DIY Education and Training Agency. This research aims to determine the implementation of the elimination of heavily damaged BMD at the DIY Education and Training Agency based on Ministry of Home Affairs Regulation No. 19 of 2016. The process for eliminating BMD is based on Permendagri No. 19 of 2016 changed the mechanism when compared to the previous regulation. Based on research results, it shows that the process of eliminating BMD is seriously damaged at the DIY Education and Training Agency, its implementation is still focused on the DIY Financial and Asset Management Agency (BPKAD) as the leading sector for BMD management. The main obstacles that become obstacles are the incomplete documentation and the physical obscurity of the goods proposed for disposal. This was caused by several things, namely the grant process in the past which was not accompanied by documentation, inadequate supervision of heavily damaged BMD, inadequate Human Resources (HR), and the absence of Standard Operating Procedures (SOP) regarding the removal of BMD.

Abstract

This research discusses the ideal arrangement of legal protection for informal sector workers in the perspective of the principles of legal certainty, justice, and expediency. This research method is normative juridical with a socio-normative approach. While data analysis is deductive. From the results of the research, it is found that labour arrangements as a form of legal protection for Informal Sector Workers need to apply the principle of proportionality, which is a principle that requires material balance and accuracy with an emphasis on the balance between the burden caused (the means used) and the interests supported (objectives), because informal sector workers carry out work relations on the basis of trust and individual business tendencies, the regulation of labour control needs to pay attention to the condition of the employer's ability to apply the work rules that have been determined, in addition to the need to reconstruct the notion of work relations and redefine work agreements in order to provide legal protection to informal sector workers. The current regulatory policy in the field of employment still exists and is structured based on the joints of colonial legal products that place workers as objects or objects that become one of the production factors in the business sector.

Abstract

Business licensing is a state administrative legal instrument used by the government to control business activities while ensuring legal certainty for business actors and the public. Since the enactment of Law Number 11 of 2020 concerning Job Creation, which was later re-established through Law Number 6 of 2023, the licensing system in Indonesia has undergone fundamental changes through the implementation of a risk-based business licensing approach and the digitalization of licensing through the Online Single Submission (OSS). These changes have also influenced the configuration of regional government authority, including the Indragiri Hilir Regency Government, in issuing business permits. This study aims to analyze the authority of the Indragiri Hilir Regency Government in issuing business permits after the enactment of the Job Creation Law, as well as to identify forms of coordination and obstacles to the implementation of this authority. The research method used is normative juridical with a statutory and conceptual approach. The research results show that the authority of the Regional Government has shifted from a conventional licensing model to an integrated licensing service model through the OSS, so that the Regional Government plays a greater role as a facilitator, service implementer, and supervisor of the fulfillment of licensing commitments according to norms, standards, procedures, and criteria (NSPK). However, in practice, obstacles remain, including limited system infrastructure, staff understanding, harmonization of regional regulations, and coordination between the central and regional governments. Therefore, strengthening regional institutional capacity, harmonizing regional regulations, and strengthening the integration of public service systems are necessary to ensure effective business licensing and ensure legal certainty in the regions.

Abstract

The concepts of Wadi’ah and Wakalah are generally referred to in hadith as the foundation for building economic transactions. However, when these concepts are applied in the modern context, many challenges arise, such as changes in social structure, technological advancements, globalization, and the complexity of economic transactions. This study aims to analyze the hadiths that form the basis of the concepts of Wadi’ah and Wakalah historically and to examine how these two concepts can be effectively applied in contemporary economics. Through a literature review method and a descriptive approach, this study uses data sources to analyze hadith related to Wadi’ah and Wakalah and their application in the context of contemporary Islamic economics. The research findings indicate that through historical criticism, it is understood that the application of these hadiths must be adapted to the continuously evolving social and economic context. Ai contextual approach allows for the flexibility in applying the concepts of Wadi’ah and Wakalah to address contemporary economic challenges, including those in the bankng sector, Islamic fintech, investments, and other service industries. The implications of these two concepts emphasize the importance of trust, responsibility, and transparency in creating ethical business practices that align with Sharia principles. By combining Islamic values with modern economic innovations, these concepts offer ethical and just solutions to meet the increasingly complex needs of modern society.
