Abstract

The purpose of this research is to analyze the concept and method of ijtihad in Islam as an important source in the development of Islamic law. The method used in this research is a qualitative approach with a literature review of various classical and contemporary sources that discuss ijtihad, including books, scientific articles, and other scientific works. The results show that ijtihad is an intellectual effort made by a mujtahid to produce new laws based on the interpretation of the Qur'an and Hadith when no clear provisions are found in the two sources. The ijtihad method consists of various approaches, such as qiyas (analogy), istihsan (legal preference), and istislah (general maslahah). Ijtihad plays an important role in the adaptation of Islamic law to changing times, as well as providing space for legal novelty in dealing with contemporary issues. This study concludes that ijtihad is not only a legal method, but also a dynamic mechanism that allows the development of Islamic law in accordance with the needs of society.

Abstract

Ijtihad is a fundamental pillar in maintaining the continuity of Islamic law, ensuring its relevance amidst the challenges of changing times. Derived from the term jahada, meaning "to strive earnestly," ijtihad empowers scholars to establish rulings when the Qur'an and Hadith provide no direct guidance. This dynamic process allows Islamic law to adapt to contemporary issues such as technological advancements, Islamic finance, human rights, and various social challenges. This article aims to analyze the concept of ijtihad, classical methods such as qiyas (analogy), istihsan (juristic preference), and the practices of the scholars of Medina, as well as their application in modern contexts. Using a qualitative approach based on literature review, the study examines classical and contemporary sources. The findings reveal that ijtihad remains a critical tool for ensuring the flexibility of Islamic law, particularly through the application of maslahah mursalah (consideration of public welfare). By adopting a dynamic yet principled approach, ijtihad serves as a strategic mechanism to address the evolving needs of the Muslim community while upholding core Islamic values.

Abstract

This research is motivated by the fact that the Al-Quran and Hadith are the main sources in determining the law. In addition to these two religious texts, there are also Ijma' and Qiyas as methods in determining the law, both of which are the basis and method that has been agreed upon by the scholars. This discussion is interesting because this research will reveal how the steps of the Ijma' and Qiyas methods in determining a law and answering problems. This research is qualitative research with a normative approach and descriptive analysis, sourced from literature (library research). The primary source used is the book Ushl al-Fiqh al-Islam by Wahbah al-Zuhaili, and then the secondary sources used consist of books, journals, and other scientific works that are still related to the discussion. The technique in collecting data uses literature study techniques and is then analyzed properly. The results of this study show that as a source of Islamic law, Ijma' according to language is a deal, agreement, concurrence, or unanimity. According to the term, Ijma' is the agreement of the mujtahids from the people of the Prophet Muhammad at his time about the case of shar'i after the death of the Prophet Muhammad SAW. Meanwhile, Qiyas linguistically means measure, compare, or equate something with another. According to the term Qiyas, it is uniting something that is not mentioned in the nash with something mentioned by the nash due to the similarity of the illat between the two.

Abstract

This study examines the historical development of Fiqh and Usul Fiqh as essential branches of Islamic knowledge for establishing Islamic law. Understanding the history of these sciences is crucial to preventing misunderstandings in legal rulings and fostering tolerance in differing opinions. The research employs a qualitative method with a literature review approach, analyzing books, journals, and online sources related to the evolution of Fiqh and Usul Fiqh. The discussion reveals that the development of these sciences can be divided into three main phases. The formative phase (7th to 10th centuries CE) was marked by the application of laws based on the Qur’an, Sunnah, and systematically organized ijtihad by the Prophet, his companions, and the tabi’in. The stagnation phase (10th to 20th centuries CE) saw a decline due to the dominance of taqlid and sectarian fanaticism, although reformist scholars like Ibn Taymiyyah sought to revive the spirit of ijtihad. The developmental phase (post-establishment of national Islamic states) was characterized by the revival of Islamic law through purification movements, legal codifications such as the Majallah al-Ahkam al-‘Adillah, and the adaptation of Fiqh texts to modern contexts. This study concludes that the historical development of Fiqh and Usul Fiqh reflects the dynamic nature of Islamic law, which is adaptable to changing times through cycles of innovation, stagnation, and revival. Understanding this history is essential to maintaining the relevance of Islamic law in addressing modern challenges.

Abstract

Ta'arudh adillah or conflict between shar'i propositions is one of the fundamental problems in ushul fiqh that requires special attention. The resolution of ta'arudh adillah is crucial to ensure that arguments that appear to be contradictory can be compromised or chosen one of them appropriately, thus maintaining the continuity of understanding Islamic law. This research uses a qualitative approach by analyzing various classical literature by scholars in ushul fiqh. The descriptive-analytical method is applied to explain the concept of ta'arudh adillah, identify the causes of conflict, and evaluate the methods of resolution used by the scholars. The study shows that ta'arudh adillah can be caused by various factors, such as differences in text interpretation, the historical context of the argument, or the level of strength of the argument. The scholars used various methods of resolution, such as tarjih (choosing the stronger argument), nasakh (canceling the previous argument), and jama' (compromising arguments that appear to be contradictory). A deep understanding of the method of resolving ta'arudh adillah can help in applying Islamic law consistently and relevantly. This research makes a significant contribution to the understanding of this concept and its relevance in the modern context.

Abstract

This article responds to the birth of legislation that has a correlation with marriage law as a form of uniformity and legal certainty, although there are still differences of opinion and debate among Indonesian Muslim communities regarding the position of witnesses in marriage. the discussion of witnesses to marriage is interesting to discuss, how are witnesses to marriage in the views of fiqh four madzhab and how the position of witnesses to marriage in Indonesian legislation. Using the literature review method (literature study) primary and secondary data sources from books, journals, other regulations. The results showed that first, a marriage witness according to the fiqh of four madzhab is a person who knows correctly and with certainty, his testimony can be accounted for in the future if needed by one of the spouses about the occurrence of a marriage event. The position of marriage witnesses in the legislation as a pillar of marriage, this is adopted from the opinion of the Shafi'i madzhab. Two witnesses are the minimum requirement in marriage. The purpose of requiring witnesses is to prevent negative issues from the community regarding extramarital relationships. Then the existence of marriage witnesses as a confirmation of the rights that arise after the marriage contract such as mushaharah relations, nafakah rights and inheritance rights. Abstract

Sebagai generasi muda harus memiliki bekal kreativitas, inovatif, kecerdasan dan ketrampilan yang dapat bermanfaat bagi lingkungan disekitar mereka. Sebagai generasi muda yang berkarakter maka harus mampu memiliki mental yang kokoh dalam menghadapi berbagai problematika yang terjadi di masyarakat. Karakter saja tidak cukup bagi generasi muda, tetapi harus bisa berfikir kreatif dan inovatif melalui program kewirausahaan. Karena saat ini lapangan di dunia kerja sudah mulai penuh maka generasi muda tidak harus mencari kerja tetapi harusnya merekalah yang membuka lapangan pekerjaan. Jadi pembinaan generasi muda untuk program kewirausahaan juga perlu dan penting untuk diberikan kepada generasi muda. Abstract

This study aims to analyze the legal system adopted in Indonesia. Mix Law System is one of the applicable legal systems, in addition to the enactment of the national legal system applies also Islamic law. The existence of Islamic Law is manifested in the constitution of the State of Indonesia which is commonly known as the 1945 Constitution of the Republic of Indonesia. Where the 1945 Constitution is a basic law that regulates the life of the nation and state in order to realize a just government and a prosperous people. This research uses an empirical sociological approach method that is descriptive analysis with the use of qualitative data as the type of research and library research as one of the data collection techniques. This research concludes that, first: The principles of Islamic Law that are used as the ideal foundation of fiqh are the principle of tauhidullah, the principle of insaniyah, the principle of tasamuh, the principle of ta'awun, the principle of silaturahim bain annas, the principle of justice, and the principle of benefit. As for knowing the theories of Islamic law enforcement in the apostolic period of Muhammad SAW are the theory of confession, the theory of accession, the theory of proof, the theory of verdicts, the theory of oaths, the theory of forgiveness. Second: Dispute resolution based on classical Islamic law namely, Al Sulh (Peace), Tahkim (Arbitration), Wilayat al Qadha (Judicial power). Third: The principles of judicial administration according to fiqh qadha and Indonesian law there is a strong correlation between the state and Islam, including Islamic law which has become a living law in the life of the nation and state. Fourth: The principles in the constitution also have relevance to the principles in Islamic Law which are regulated in the Quran and the Al-Hadith including the principles of justice, equality, and welfare. Based on this, Indonesia, which is based on Pancasila and the 1945 Constitution, can be reviewed from the perspective of Islamic law as an effort to realize the laws regulated in the Quran and Al-Hadith.

Abstract

Penelitian ini bertujuan untuk mengkaji sejarah perkembangan golongan yang ingkar sunnah sampai dengan ajaran-ajaran yang dikembangkan dan didakwahkan kepada masyarakat serta konsikuensi penganut paham ingkar sunnah terkhususnya bagi muslim itu sendiri. Penelitian ini menggunakan pendekatan kualitatif deskriptif, dengan penelaahan dokumen. Penelitian ini menyimpulkan, bahwa ingkar sunnah merupakan bentuk kegagalan dalam memahami sunnah dan pemahaman ini juga sudah ada pada masa kenabian. Sehingga beberapa ulama menerangkan bahwa konsikuensi terhadap penganut paham ini dikategorikan kafir.

Abstract

This study analyzes the contribution of Abu al-A'la al-Maududi's thought related to Islamic morality in the Islamic economic system. The background of this study departs from the failure of the conventional economic system that is materialistic and independent of moral values, so that the concept of Islamic economics that integrates ethics and spirituality is needed. With the method of literature study and the approach of Maqāṣid al-Syarī'ah, this study examines al-Maududi's works and compares them with relevant literature. The results of the study show that morality in al-Maududi's thought is not just an additional norm, but the main foundation of Islamic economics that emphasizes justice, balance, and social responsibility. These findings confirm the fundamental differences between Islamic and conventional economics, while providing practical implications that the implementation of modern Islamic economics must prioritize the integration of moral values in economic policies and practices.
