Abstract

ABSTRACT Perkembangan teknologi informasi dan komunikasi menciptakan kehidupan masyarakat digital yang terus berkembang. Perkembangan teknologi selain memberikan manfaat juga memberikan dampak yaitu dengan munculnya kejahatan di ruang siber dengan jenis perundungan di ruang siber. Penelitian ini bertujuan untuk mengetahui bagaimana upaya yang dilakukan dalam menanggulangi perundungan di ruang siber  dengan kebijakan non penal agar dapat memberikan perlindungan terhadap pengguna internet. Metodologi yang digunakan adalah metode penelitian yuridis normatif dengan sumber data sekunder yang dianalisis secara deduktif. Hasil penelitian menujukkan  penanggulangan kejahatan perundungan di ruang siber dapat dilakukan dengan kebijakan non-penal menggunakan pendekatan moral (moral approach) yang dilakukan dengan menanamkan nilai kebaikan dari keluarga, sekolah dan masyarakat. Kebijakan non-penal dengan pendekatan teknologi (technology approach) dilakukan dengan menggunakan perangkat lunak seperti ReThink Stopcyberbullying. ABSTRACT The development of information and communication technology creates a digital society that continues to develop. Apart from providing benefits, technological developments also have an impact, namely the emergence of crime in cyber space with the type of bullying in cyber space. This research aims to find out how efforts have been made to overcome bullying in cyberspace with non-penal policies in order to provide protection for internet users. The methodology used is a normative juridical research method with secondary data sources which are analyzed deductively. The research results show that overcoming bullying crimes in cyber space can be carried out with non-penal policies using a moral approach which is carried out by instilling good values from family, school and society. Non-penal policies with a technological approach are carried out using software such as Re Think Stop cyber bullying.

Abstract

Narcotics abuse is a serious problem that affects the younger generation, including students in boarding religious schools. This activity aims to develop and implement an educational program to prevent narcotics abuse in Maahad Ahmadi Negeri Sembilan, Malaysia. The methods used include seminars, workshops, and dissemination of information through social media and attractive posters. This program is designed to increase students' awareness and knowledge about the dangers of narcotics and provide strategies for refusing offers of abuse. The results of this activity show an increase in students' understanding of narcotics issues and their ability to make better decisions. By involving all parties, including teachers, parents and the community, it is hoped that this activity can create a safer and more positive environment for students at Maahad Ahmadi

Abstract

This study raises the formulation of the problem, namely (1) How to regulate the authority of judges according to laws and regulations, (2) How are the factors that influence the crime of beatings that cause death by children, (3) What are the basic considerations of judges at the Simalungun District Court in decide on a criminal case in case no. 5/Pid-Child/2021/PN. Sim. The research method uses a normative juridical method by analyzing the laws and regulations and conceptually by analyzing descriptive data analysis. The results of this study indicate that the rule of law regarding the authority of judges according to the legislation, namely Law no. 48 of 2009 concerning judicial power and Joint Regulation of the Constitutional Court and the Judicial Commission of the Republic of Indonesia Number 047/KMA/SKB/IV/2009-02/SKB/P.KY/IV/2009 concerning guidelines for enforcing codes of ethics and guidelines for judge behavior, the factors that influence the crime of beatings that cause death by children, and the Basis for Consideration of the Judges of the Simalungun District Court in Deciding the Criminal Case of Beating Perpetrated by Children in the Decision on Criminal Case No. 5 Pid.Sus-Child/2021/PN. Sim.  The judge considering that the juvenile justice system must prioritize the Restorative Justice approach, and must strive for diversion with the aim of achieving peace between victims and children, resolving child cases outside the judicial process, preventing children from being deprived of independence, encouraging the community to participate and instilling a sense of responsibility to children. Suggestions from this thesis are the imposition of criminal sanctions for children, judges should consider prison sentences for children, this is to avoid children from negative influences in the prison environment.

Abstract

The purpose of this study was to determine the function of the criminal investigator, barriers to implementation and the relationship of law enforcement carried out by the Belawan Sector Police with Community Culture in overcoming the crime of extortion in the Belawan area. The type of research used is normative juridical (legal research) by examining various formal legal rules, which are then linked to the research objectives. Sources of data used are secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The results of the study found that the Medan Belawan Police in carrying out the law enforcement function of the Police and implementing the protection function had several strategies/criminal policies in overcoming the rampant criminal acts of extortion, both preventive and repressive efforts. The obstacles faced by law enforcement can be divided into internal and external barriers. Internal barriers and external barriers. The relationship between criminal law enforcement is not only pursuing the principle of formal law enforcement, but if there is room or opportunity to prevent criminal acts from happening, this is certainly better to implement. This means that the police protection function must be maximized through programs to prevent the occurrence of criminal acts in the community.

Abstract

The purpose of this study is to analyze the legal rules regarding theft in Indonesia, the implementation of the Plantation Law in handling the theft of oil palm plantations and the obstacles in the Langkat Police Legal Area. The research method used by the author is normative juridical by finding and collecting data through library research from reading sources in the form of legal books, legal expert opinions, laws and regulations, websites, and interview results. The results of the study show that the legal rules regarding palm oil theft in Indonesia are regulated in Article 107 Letter d of Law No.39 of 2014 concerning Plantations. In its application, any person who illegally harvests and/or collects plantation products shall be sentenced to a maximum imprisonment of 4 (four) years and a maximum fine of Rp. 4,000,000,000, - (four billion rupiah) and this is if the victim is a company that has a land area of more than 25 ha and already has a plantation permit from the government, but for cases where the victim is an individual, the article is not subject to the regulation of the Supreme Court, and countermeasures with preventive efforts where the handling focuses on prevention or control before the occurrence of the crime of theft. Repressive efforts are more in the nature of prosecution or eradication after the criminal act of theft of Oil Palm Fresh Fruit Bunches.

Abstract

This study aims to determine the legal regulation of criminal acts with violence in the Indonesian legal system, the obstacles and efforts of the Medan Labuhan Sector Police in eradicating the crime of theft with violence. The research method used is normative juridical with a qualitative approach. The results of the study found that the regulation of the crime of theft with violence is regulated in Article 365 of the Criminal Code, and the crime of theft with violence is included in the category of traditional crimes that are disturbing to the community. There are two obstacles, namely internal obstacles consisting of the lack of human resources (HR) budget for investigations and investigations, minimal Crime facilities or facilities, Members of the Criminal Investigation Unit of the Medan Labuhan Police who always exchange / move to other places (Mutations). External factors, namely the culture of low community legal compliance, weak synergistic institutional relations, wide and high population, urbanization, the influence of narcotics and gambling that occur in the Medan Labuhan sub-district. Non-penal efforts are carried out by taking pre-emptive and preventive actions, while the penal efforts carried out by the Medan Labuhan Police are to carry out investigations, examinations, detentions, and arrests as well as investigations by applying criminal law as the ultimum remedium for criminal law enforcement.

Abstract

Regarding the Role of the Medan City Non-Governmental Consumer Protection Agency in Providing Legal Protection to Consumers, namely analyzing forms of legal protection, the role of the Medan City LPKSM in providing legal protection to consumers and the mechanism for establishing LPKSM as a Consumer Protection Agency in Medan City. This research was conducted at the UPT office. Medan Consumer Protection, LPKN DPP office, YPPKN DPP office, North Sumatra LPK-RI DPD office. This research uses a type of legal research and a normative-juridical research method. Because this type of research is a normative-juridical research method, the data obtained comes from library research and field research. Forms of legal protection for consumers through 2 channels, namely through channels outside the court and through the courts. Prior to filing a lawsuit in court, LPKSM must have a legal standing and/or mechanism at the time of formation, namely making a notarial deed of establishment of a legal entity engaged in consumer protection, obtaining a permit from the Ministry of Law and Human Rights, and making TDLPK at the local related agency. The role of LPKSM is to provide information to consumers, assist consumers in fighting for their rights, protect consumer rights, receive consumer complaints, conduct advocacy, provide assistance, supervise and collaborate with relevant agencies regarding consumer protection.

Abstract

Incidents of violence among students, particularly those involving groups operating beyond the reach of law enforcement, continue to occur frequently. The police must implement proactive preventive measures to avoid such incidents, as these behaviors contradict the norms that students are expected to uphold. The importance of appropriate handling of students involved in crime and violence, particularly from a law enforcement perspective, is highly emphasized. This study addresses the following problems: what are the factors that cause group violence committed by students within the jurisdiction of the Pancur Batu Police Sector; how is the legal regulation regarding criminal acts of violence committed by minors; and what efforts are being undertaken by the police in addressing the issue. This research is an empirical legal study. The data analysis applied in this research follows a qualitative approach. The results conclude that the occurrence of student brawls is not only driven by personal desire but is also heavily influenced by peer pressure, which significantly affects one's social interactions and behavior. Legal provisions governing violent crimes committed by students can be found in the Indonesian Criminal Code, particularly Articles 170, 351, and 406, as well as in Law Number 35 of 2014 on Child Protection. The efforts made by the Pancur Batu Police in addressing group violence among students include both preventive and repressive approaches.

Abstract

The purpose of this study is to analyze the legal regulations in Indonesia regarding the use of foreign workers in connection with the criminal offense of human smuggling, as well as to examine the enforcement of the law against business actors who illegally employ foreign workers from the perspective of human smuggling. This research uses a normative legal approach by reviewing legislation, court decisions, and legal doctrines through statutory, case, and conceptual approaches, along with library research techniques and descriptive-analytical qualitative data analysis. The findings indicate that legal regulations in Indonesia concerning the use of foreign workers linked to human smuggling are covered by various laws such as the Manpower Act, the Immigration Act, and the Anti-Trafficking Law (UU TPPO), but remain partial and do not explicitly regulate smuggling in the context of corporations as perpetrators, which hinders legal enforcement. Law enforcement against such business crimes still faces multiple obstacles, such as weak legal frameworks, operational modes disguised as legal recruitment, limited understanding among law enforcement officials regarding transnational crimes, and the suboptimal implementation of corporate criminal liability, resulting in many cases ending only in administrative sanctions such as deportation, without significant deterrent effects

Abstract

This community service program aims to enhance the coastal community's economic capacity through the integration of mangrove reforestation and the development of educational tourism (edutourism) in Kampung Nipah, Serdang Bedagai Regency, North Sumatra. The community faced several problems, including limited knowledge about mangrove ecosystems, lack of conservation experience, and underdeveloped coastal tourism potential. The program adopted a participatory approach and hands-on training methods. Survey results showed a significant increase in participants’ understanding of mangroves, shifting from mostly low and moderate categories before the program to entirely moderate and high levels afterward. Furthermore, 100% of participants expressed satisfaction with the activities. The program also led to new economic initiatives such as the establishment of a local edutourism management group, tour guiding training, and the development of derivative mangrove products. In conclusion, the program effectively empowered the community both ecologically and economically, despite certain limitations related to time constraints and limited participant reach. Further assistance is recommended to ensure the sustainability of the program’s outcomes.
