Abstract

Belawan waters are waters that directly lead to the waters of the Malacca Strait and are a human trafficking route that is frequently traversed by perpetrators. The existence of cases of human trafficking that occur in the Malacca Strait area will certainly have an impact on the security of the strait. There are three main principles of national security that could be threatened by cross-border cases, namely sovereignty, territorial integrity, political, social, economic and cultural sustainability. This research aims to examine the factors causing human trafficking through Belawan waters from a criminological perspective; to determine the forms of supervision and law enforcement in Indonesian waters in eradicating criminal acts of human trafficking and to examine obstacles to law enforcement of criminal acts of human trafficking through Indonesian waterways. This research method uses normative legal research. The data used is secondary data with primary, secondary and tertiary legal materials as research data sources. The data obtained comes from statutory regulations and developing legal theories related to human trafficking. Data analysis was carried out using qualitative analysis. The results of this research are the first that factors causing human trafficking through Belawan waters include internal factors consisting of economic influence (poverty), negligence of victims, authoritarian societal cultural factors, lack of expertise or skills of victims, low education, lack of job opportunities, lack of access to information and occupational risks. Meanwhile, external factors can be influenced by weak immigration control in a country, lack of coordination between immigration and the police and the Indonesian Navy in the Belawan waters. Second, that the form of supervision and law enforcement in Indonesian territorial waters is to eradicate criminal acts of human trafficking by carrying out penal efforts through law enforcement in accordance with Law Number 21 of 2007 and non-penal efforts by prioritizing preventive efforts. Third, that Obstacles law enforcement of criminal acts of trafficking in persons through Indonesian waterways, including weak supervision by the police and immigration which does not provide information on trafficking in persons; Community indifference in preventing human trafficking cases; The case handling process can take a relatively long time; Development of the Modus Operandi for the Crime of Human Trafficking; There is a condition that the victim does not know that he is being exploited or is a victim of human trafficking; Minimal budget for law enforcement officers.

Abstract

Street crime is a form of crime that often occurs in public spaces and disturbs the community, such as theft, mugging and violence on the street. This research aims to analyze the law enforcement efforts carried out by the South Tapanuli Police (Polres) in dealing with street crime and identify factors that become obstacles in the law enforcement process. The research method used is an empirical juridical approach, with data collection techniques through interviews, observation and documentation studies. The results of the research show that the South Tapanuli Police have taken various preventive and repressive steps, such as routine patrols, outreach to the community, and taking action against criminals. However, there are still several obstacles such as limited personnel, lack of community participation, and lack of operational support facilities. Therefore, synergy is needed between the police, local government and the community to create conducive security conditions. It is hoped that this research can provide input in formulating more effective policies in eradicating street crime in the area.

Abstract

This study analyzes the implementation of the Electronic Traffic Law Enforcement (ETLE) system through traffic CCTV surveillance as an effort to enforce traffic violations in Medan City. The objectives of this research are to examine the legal basis of the ETLE system, analyze its implementation by the Traffic Directorate of the North Sumatra Regional Police, and identify obstacles encountered in its application. This research employs a normative juridical method with a descriptive-analytical approach, utilizing primary legal materials in the form of statutory regulations and secondary legal materials from legal literature and scholarly works. The results indicate that the legal foundation of the ETLE system is established under Law Number 22 of 2009, Government Regulation Number 80 of 2012, and Police Regulation Number 8 of 2023, which collectively provide legal certainty for electronic-based traffic law enforcement. The implementation of ETLE in Medan City has been conducted through public socialization and CCTV-based monitoring to enhance efficiency and objectivity in traffic law enforcement. However, several obstacles remain, including technical limitations of CCTV facilities, weather conditions, low public awareness, inaccurate vehicle data, and the use of fake license plates. These challenges affect the effectiveness of ETLE implementation and require improved infrastructure and inter-agency coordination.

Abstract

Air merupakan sumber daya vital yang berperan penting dalam kehidupan masyarakat dan dijamin pengelolaannya oleh negara. Namun, masih rendahnya pemahaman masyarakat terhadap hukum sumber daya air serta pentingnya konservasi lingkungan menjadi tantangan tersendiri. Kegiatan pengabdian kepada masyarakat ini dilaksanakan pada 04 Februari 2023 di Dusun Tanjung Bunga, Desa Garunggang, Kecamatan Kuala, Kabupaten Langkat dengan tujuan meningkatkan literasi hukum dan mendorong partisipasi masyarakat dalam konservasi sumber daya air. Metode yang digunakan adalah pendekatan edukatif-partisipatif melalui penyuluhan hukum dan penanaman 1.000 pohon. Evaluasi dilakukan terhadap 300 responden menggunakan pre-test dan post-test. Hasil menunjukkan peningkatan rata-rata skor dari 61,4 menjadi 81,7 atau naik sebesar 20,3 poin (33,05%). Kategori pemahaman rendah menurun dari 44% menjadi 8%, sementara kategori baik dan sangat baik meningkat menjadi 72%. Selain peningkatan pengetahuan, kegiatan ini juga menghasilkan aksi nyata konservasi melalui penanaman pohon sebagai bentuk implementasi preventif penegakan hukum lingkungan. Kegiatan ini membuktikan bahwa edukasi hukum yang dipadukan dengan aksi konservasi mampu menumbuhkan kesadaran kolektif dan komitmen masyarakat dalam menjaga keberlanjutan sumber daya air.

Abstract

Perkembangan perbankan digital memberikan kemudahan dalam transaksi keuangan, namun juga meningkatkan risiko kejahatan siber, khususnya phishing melalui scam link. Rendahnya literasi hukum dan literasi digital masyarakat menyebabkan meningkatnya kerentanan terhadap kejahatan tersebut, yang tidak hanya menimbulkan kerugian finansial tetapi juga dampak psikologis seperti kecemasan dan trauma. Kegiatan Pengabdian kepada Masyarakat ini bertujuan meningkatkan pemahaman masyarakat mengenai perlindungan hukum preventif dan represif serta penanggulangan dampak psikologis akibat kejahatan phishing. Metode yang digunakan adalah pendekatan edukatif dan partisipatif melalui ceramah interaktif, diskusi, serta evaluasi pre-test dan post-test terhadap 35 peserta. Hasil evaluasi menunjukkan peningkatan rata-rata pemahaman peserta dari 56,4 pada pre-test menjadi 84,7 pada post-test, atau meningkat sebesar 28,3 poin. Peningkatan terjadi pada seluruh indikator, termasuk kemampuan mengidentifikasi scam link, kesadaran menjaga kerahasiaan data pribadi, serta pemahaman langkah hukum apabila menjadi korban. Temuan ini menunjukkan bahwa penyuluhan berbasis multidisipliner hukum dan psikologi efektif dalam meningkatkan literasi hukum dan ketahanan psikologis masyarakat terhadap kejahatan phishing di era perbankan digital.

Abstract

This study discusses the policy of overcrowding as an effort to prevent violence in the Class I Detention Center (Rutan) Medan. The issues studied include: how the overcrowding policy is implemented in preventing violence between inmates; what are the supporting and inhibiting factors in the implementation of the policy; and how effective are the policies of regulatory arrangement, institutional strengthening, and provision of infrastructure in reducing the number of violence in detention. This study uses an empirical legal research with a qualitative approach, which positions law as a social phenomenon (law in action) and not only as a written norm. The nature of this research is descriptive analytical, namely describing objective conditions in the field while analyzing the relationship between the overcrowding policy and the social dynamics that occur in detention. Data were obtained through interviews, observations, and documentation studies. The results of the study indicate that the implementation of the overcrowding policy has been carried out through the redistribution of inmates, optimization of guidance, and coordination between agencies, but still faces obstacles such as budget limitations, minimal facilities and infrastructure, and bureaucratic institutional structures. Supporting factors such as officer commitment and internal innovation in detention also help reduce the potential for violence. Overall, regulatory reform, institutional strengthening, and infrastructure provision contribute to reducing the risk of violence, although their effectiveness remains suboptimal and requires continuous improvement.

Abstract

This study analyzes human trafficking (TPPO) in Asahan Regency during the period 2018–2023, focusing on modus operandi, criminal policies, and enforcement obstacles. The study employs a normative legal research method, using library research and analysis of legislation, official police documents, annual reports, and scholarly literature related to TPPO. The results indicate that TPPO modus operandi has evolved from traditional methods to modern forms that utilize technology, social media, and cross-regional networks. Perpetrators carry out various actions, including recruiting migrant workers without authorization, document forgery, domestic exploitation, and child exploitation in the plantation sector. These crimes emphasize economic and sexual exploitation of vulnerable groups, particularly women and children, and exploit victims’ lack of knowledge regarding legal procedures and legal migration. TPPO handling in Asahan Regency is conducted through a combination of penal and non-penal strategies. The penal approach emphasizes firm law enforcement oriented toward victims, through enhanced investigator capacity, establishment of special units, actions against organized networks, and optimization of asset seizure. The non-penal approach focuses on prevention through public education, awareness campaigns on illegal recruitment methods, strengthening community networks, monitoring high-risk areas, and providing integrated services for victims. However, law enforcement faces various structural, procedural, social, and institutional obstacles, including limited resources, low public legal awareness, victim trauma, and the complexity of transnational and covert modus operandi. To enhance the effectiveness of TPPO enforcement, a comprehensive strategy is required, including strengthening law enforcement capacity, providing adequate victim protection systems, implementing preventive policies based on education and community empowerment, fostering multi-stakeholder collaboration, and conducting continuous monitoring and evaluation of emerging forms of TPPO.

Abstract

This study examines the adequacy of legal regulations governing credit card misuse (carding) in cyberspace in Indonesia and their implications for legal certainty and law enforcement effectiveness. Using a normative juridical method, it analyzes key statutes, including Law No. 1 of 2024 (EIT Law amendment), Law No. 27 of 2022 on Personal Data Protection, and Law No. 1 of 2023 on the Criminal Code, supported by conceptual and doctrinal approaches. The findings show that, although these regulations provide a general framework for addressing cybercrime, they remain fragmented and do not explicitly regulate carding as a distinct offense. This gap weakens legal certainty and limits effective enforcement. Two main issues are identified: the absence of specific criminal norms on carding and the lack of harmonization across criminal, cyber, and data protection laws. Current legal policy is also predominantly repressive, with limited preventive and victim-oriented measures.
