Abstract

This research investigates Indonesia’s legal framework for addressing human smuggling, focusing on the integration of penal policies targeting its root causes and evaluating the impact of international collaborations in law enforcement. Despite existing literature on human smuggling, critical gaps remain, particularly in understanding the role of criminal policy as part of social policy and the practical effects of international cooperation. The study aims to answer two primary questions: the role of criminal policy in addressing human smuggling crimes in Indonesia and the non-penal policies Indonesia has implemented to combat human smuggling. This research adopts a normative legal methodology, analyzing Indonesia’s Criminal Code, the Eradication of Trafficking in Persons Law, the Suppression of Migrant Smuggling Law, and relevant international frameworks like the Bali Process. The study reveals that an effective approach to combating human smuggling requires a balance of penal and non-penal measures, strong adherence to territorial sovereignty, and enhanced international cooperation. It finds that while penal policies act as deterrents, non-penal strategies, such as victim protection and public awareness campaigns, are equally crucial. Additionally, the study highlights the importance of regional and international collaborations in strengthening law enforcement, emphasizing the need for specialized legal framework to address human smuggling.

Abstract

The purpose of this study is to analyze the legal regulations in Indonesia regarding the use of foreign workers in connection with the criminal offense of human smuggling, as well as to examine the enforcement of the law against business actors who illegally employ foreign workers from the perspective of human smuggling. This research uses a normative legal approach by reviewing legislation, court decisions, and legal doctrines through statutory, case, and conceptual approaches, along with library research techniques and descriptive-analytical qualitative data analysis. The findings indicate that legal regulations in Indonesia concerning the use of foreign workers linked to human smuggling are covered by various laws such as the Manpower Act, the Immigration Act, and the Anti-Trafficking Law (UU TPPO), but remain partial and do not explicitly regulate smuggling in the context of corporations as perpetrators, which hinders legal enforcement. Law enforcement against such business crimes still faces multiple obstacles, such as weak legal frameworks, operational modes disguised as legal recruitment, limited understanding among law enforcement officials regarding transnational crimes, and the suboptimal implementation of corporate criminal liability, resulting in many cases ending only in administrative sanctions such as deportation, without significant deterrent effects

Abstract

This community service program aims to enhance the coastal community's economic capacity through the integration of mangrove reforestation and the development of educational tourism (edutourism) in Kampung Nipah, Serdang Bedagai Regency, North Sumatra. The community faced several problems, including limited knowledge about mangrove ecosystems, lack of conservation experience, and underdeveloped coastal tourism potential. The program adopted a participatory approach and hands-on training methods. Survey results showed a significant increase in participants’ understanding of mangroves, shifting from mostly low and moderate categories before the program to entirely moderate and high levels afterward. Furthermore, 100% of participants expressed satisfaction with the activities. The program also led to new economic initiatives such as the establishment of a local edutourism management group, tour guiding training, and the development of derivative mangrove products. In conclusion, the program effectively empowered the community both ecologically and economically, despite certain limitations related to time constraints and limited participant reach. Further assistance is recommended to ensure the sustainability of the program’s outcomes.

Abstract

Abstract

Air merupakan sumber daya vital yang berperan penting dalam kehidupan masyarakat dan dijamin pengelolaannya oleh negara. Namun, masih rendahnya pemahaman masyarakat terhadap hukum sumber daya air serta pentingnya konservasi lingkungan menjadi tantangan tersendiri. Kegiatan pengabdian kepada masyarakat ini dilaksanakan pada 04 Februari 2023 di Dusun Tanjung Bunga, Desa Garunggang, Kecamatan Kuala, Kabupaten Langkat dengan tujuan meningkatkan literasi hukum dan mendorong partisipasi masyarakat dalam konservasi sumber daya air. Metode yang digunakan adalah pendekatan edukatif-partisipatif melalui penyuluhan hukum dan penanaman 1.000 pohon. Evaluasi dilakukan terhadap 300 responden menggunakan pre-test dan post-test. Hasil menunjukkan peningkatan rata-rata skor dari 61,4 menjadi 81,7 atau naik sebesar 20,3 poin (33,05%). Kategori pemahaman rendah menurun dari 44% menjadi 8%, sementara kategori baik dan sangat baik meningkat menjadi 72%. Selain peningkatan pengetahuan, kegiatan ini juga menghasilkan aksi nyata konservasi melalui penanaman pohon sebagai bentuk implementasi preventif penegakan hukum lingkungan. Kegiatan ini membuktikan bahwa edukasi hukum yang dipadukan dengan aksi konservasi mampu menumbuhkan kesadaran kolektif dan komitmen masyarakat dalam menjaga keberlanjutan sumber daya air.

Abstract

Perkembangan perbankan digital memberikan kemudahan dalam transaksi keuangan, namun juga meningkatkan risiko kejahatan siber, khususnya phishing melalui scam link. Rendahnya literasi hukum dan literasi digital masyarakat menyebabkan meningkatnya kerentanan terhadap kejahatan tersebut, yang tidak hanya menimbulkan kerugian finansial tetapi juga dampak psikologis seperti kecemasan dan trauma. Kegiatan Pengabdian kepada Masyarakat ini bertujuan meningkatkan pemahaman masyarakat mengenai perlindungan hukum preventif dan represif serta penanggulangan dampak psikologis akibat kejahatan phishing. Metode yang digunakan adalah pendekatan edukatif dan partisipatif melalui ceramah interaktif, diskusi, serta evaluasi pre-test dan post-test terhadap 35 peserta. Hasil evaluasi menunjukkan peningkatan rata-rata pemahaman peserta dari 56,4 pada pre-test menjadi 84,7 pada post-test, atau meningkat sebesar 28,3 poin. Peningkatan terjadi pada seluruh indikator, termasuk kemampuan mengidentifikasi scam link, kesadaran menjaga kerahasiaan data pribadi, serta pemahaman langkah hukum apabila menjadi korban. Temuan ini menunjukkan bahwa penyuluhan berbasis multidisipliner hukum dan psikologi efektif dalam meningkatkan literasi hukum dan ketahanan psikologis masyarakat terhadap kejahatan phishing di era perbankan digital.

Abstract

This study examines the adequacy of legal regulations governing credit card misuse (carding) in cyberspace in Indonesia and their implications for legal certainty and law enforcement effectiveness. Using a normative juridical method, it analyzes key statutes, including Law No. 1 of 2024 (EIT Law amendment), Law No. 27 of 2022 on Personal Data Protection, and Law No. 1 of 2023 on the Criminal Code, supported by conceptual and doctrinal approaches. The findings show that, although these regulations provide a general framework for addressing cybercrime, they remain fragmented and do not explicitly regulate carding as a distinct offense. This gap weakens legal certainty and limits effective enforcement. Two main issues are identified: the absence of specific criminal norms on carding and the lack of harmonization across criminal, cyber, and data protection laws. Current legal policy is also predominantly repressive, with limited preventive and victim-oriented measures.

Abstract

Background: Traffic violations are a problem that continues to occur and has an impact on public safety. Specific Background: In Serdang Bedagai Regency, traffic law enforcement efforts still face various challenges, despite having a strong legal basis. Knowledge Gap: However, studies that specifically review the process of equitable law enforcement and the obstacles faced by officials in this area are still limited. Aim: This study aims to analyze the rule of law, the implementation of the enforcement process, and the obstacles faced by traffic law enforcement in Serdang Bedagai Regency. Results: The results show that law enforcement refers to Law No. 22 of 2009 concerning Road Traffic and Transportation, with legal settlement through the Sei Rampah District Court Decision which sentenced violators to two years imprisonment. However, weak enforcement of violations such as not wearing helmets or seat belts is a major obstacle. Novelty: This study provides an empirical picture of the relationship between legal provisions, judicial processes, and the reality of traffic law implementation in the region. Implications: The findings provide a basis for policy makers and police officers to strengthen consistent and equitable traffic law enforcement at the local level. Abstract

This study aims to analyze the influence of Green Brand Image and Legal Compliance in Business on Consumer Loyalty in MSMEs Grama Sphere Medan. In an era of increasing consumer awareness of sustainability issues and the importance of legal compliance, these two factors are considered to play an important role in shaping consumer trust and loyalty. This study uses a quantitative approach with an associative method, involving 80 respondents who have made at least two purchases at Grama Sphere. The data collection technique was carried out through a questionnaire with a Likert scale, and data analysis was carried out using multiple linear regression in SPSS 27. The results of the study indicate that both partially and simultaneously, Green Brand Image and Legal Compliance have a positive and significant effect on Consumer Loyalty. The coefficient of determination (R²) value of 60.8% indicates that the independent variables are able to explain variations in consumer loyalty substantially. The implications of these findings suggest that MSMEs need to strengthen their environmentally friendly brand image and maintain legal compliance as a strategy in building long-term loyalty. This study contributes to the local literature on sustainable marketing and ethical and legal-based business practices.

Abstract

Sexual violence against children is a very complex form of crime and has a long-term impact on the victim, both physically and psychologically. This study aims to analyze the comparison of legal regulations between sexual violence crimes and human trafficking crimes, evaluate the implementation of legal protection and criminal policies against sexual violence against children, and examine the countermeasures strategies carried out by the Pematangsiantar Resort Police. The method used is a normative juridical approach and a sociological juridical approach, by combining the study of laws and regulations and interviews with related parties. The results of the study show that although there are differences in characteristics between sexual violence and trafficking in persons, the two can be interrelated in the context of sexual exploitation of children. The Pematangsiantar Police have implemented criminal policies through preventive, repressive, and rehabilitative approaches. The strategies implemented include training investigators, provision of child-friendly spaces, and cross-sector collaboration with child protection institutions. Although there are still obstacles in terms of human resources and facilities, the efforts made show a strong commitment to providing legal protection for children as a vulnerable group. This research emphasizes the importance of criminal policies that are integrated with child protection approaches in order to provide comprehensive justice.
