Abstract

The phenomenon of cohabitation or "kumpul kebo" has attracted public concern in Indonesia, a society that upholds moral values. Article 412 of Law Number 1 of 2023 concerning the Criminal Code (KUHP) criminalizes cohabitation, reflecting a shift from social norms to legal regulation. This study employs a normative juridical approach with document analysis to examine the legal substance of cohabitation and its usefulness in the Indonesian social context. The data sources include statutory regulations, court decisions, and relevant legal literature. The findings indicate that the criminalization of cohabitation provides a clear legal basis, safeguards public morality, and harmonizes legal enforcement nationwide. However, the absence of an explicit definition of "living together as husband and wife" creates interpretive ambiguity, which may pose challenges in legal implementation. Therefore, while this legal provision contributes to the enforcement of social and legal norms, its application must be carefully balanced with considerations of justice and human rights.

Abstract

General Background: Social media fraud is increasingly prevalent in the digital era, causing public concern and economic losses. Specific Background: Serdang Bedagai Regency in Indonesia is particularly vulnerable due to various local contributing factors. Knowledge Gap: In-depth studies analyzing the causes, criminal modus operandi, and local law enforcement responses to social media fraud from a criminological perspective remain limited. Aims: This study aims to examine the factors contributing to social media fraud in Serdang Bedagai, identify the perpetrators' methods, and evaluate the countermeasures taken by the Serdang Bedagai Police Resort. Results: The findings reveal that fraud is driven by economic hardship, a consumerist culture, limited digital literacy, a lack of public caution, and weak governmental oversight. The common fraud schemes include fake online loans, deceptive e-commerce transactions, and fictitious prize giveaways. The local police implement both penal approaches (criminal law enforcement) and non-penal strategies (preventive, cooperative, and educational efforts) to address the issue. Novelty: This study uniquely integrates a criminological framework with a normative juridical method, offering a localized analysis of digital fraud and its law enforcement responses. Implications: The results inform the development of community-based cybersecurity policies and enhance the effectiveness of digital crime prevention and prosecution in vulnerable regions. Abstract

Oil palm theft is one of the crimes that often occur in the jurisdiction of the Serdang Bedagai Police. This crime is influenced by various factors, such as the economic condition of the community, the weak plantation security system, and the existence of an organized network of theft syndicates. This study aims to analyze the factors that cause oil palm theft, the role of the police in overcoming it, and the obstacles faced in the law enforcement process. The research method used is qualitative descriptive, with a case study approach in the jurisdiction of the Serdang Bedagai Police. Data was obtained through interviews with police officers, the community, and plantation officials, as well as documentation and observations in the field. The results of the study show that the Serdang Bedagai Police have made various efforts in dealing with oil palm theft through preventive, repressive, and pre-emptive approaches. These efforts include routine patrols, cooperation with plantations, legal socialization to the community, and law enforcement against perpetrators. However, there are still obstacles such as limited human resources, low public participation in reporting crimes, and the complexity of the theft syndicate network. To overcome this obstacle, synergy between the police, the community, and plantation companies is needed in improving the security system and creating alternative economic solutions for the surrounding community. With a more comprehensive approach, it is hoped that the number of oil palm theft in this region can be significantly reduced.

Abstract

Traffic accidents are a serious problem that affects public safety and has a significant social and economic impact. This study aims to analyze the optimization of the performance of the Serdang Bedagai Police in overcoming traffic accidents in its jurisdiction. The research method used is qualitative with a descriptive approach. Data were obtained through interviews, observations, and documentation studies which were then analyzed in depth. The results of the study show that the main factors causing traffic accidents in Serdang Bedagai Regency are human factors, vehicle factors, and environmental factors. The Serdang Bedagai Police have made various efforts in dealing with traffic accidents, which include preventive, repressive, and rehabilitative approaches. Preventive efforts are carried out through socialization and driving safety education to the public. Repressive efforts are carried out through law enforcement such as electronic ticketing (ETLE) and vehicle raids, while rehabilitative efforts involve coordination with hospitals and psychological assistance for accident victims. Despite various efforts, this study found the main challenges faced, such as the lack of police personnel, low public awareness, and inadequate road infrastructure. Therefore, cooperation between the police, local governments, and the community is needed to improve traffic safety. With good synergy, it is hoped that the number of traffic accidents in Serdang Bedagai Regency can continue to decrease.

Abstract

The purpose of this research is solely to focus on discussing the form of legal regulation concerning offenders who possess Category I narcotics and the judges’ considerations in imposing criminal sanctions on such offenders, based on Decision Number: 463/Pid.Sus/2024/PN Mdn. The research method applied is normative legal research, which relies on secondary data. Data collection techniques include literature study from books, journal articles, and field studies by obtaining court decision data, followed by qualitative analysis. The findings indicate that the legal regulation of offenders who possess Category I narcotics is stipulated under Law Number 35 of 2009 concerning Narcotics, particularly in Articles 111 to 119, which cover narcotics abusers, distributors, and sellers who own narcotics. The judge’s consideration in imposing criminal sanctions was based on the facts established during the trial, where it was proven that the defendant was in possession of Category I narcotics in the form of methamphetamine, as evidenced by the Forensic Laboratory Examination Report Number: 334/NNF/2023 dated January 29, 2024, issued by the North Sumatra Regional Police. The Panel of Judges further provided specific considerations by sentencing the defendant to imprisonment for 7 (seven) years and 6 (six) months, taking into account both aggravating and mitigating circumstances relevant to the defendant. Abstract

Sexual violence against children is a very complex form of crime and has a long-term impact on the victim, both physically and psychologically. This study aims to analyze the comparison of legal regulations between sexual violence crimes and human trafficking crimes, evaluate the implementation of legal protection and criminal policies against sexual violence against children, and examine the countermeasures strategies carried out by the Pematangsiantar Resort Police. The method used is a normative juridical approach and a sociological juridical approach, by combining the study of laws and regulations and interviews with related parties. The results of the study show that although there are differences in characteristics between sexual violence and trafficking in persons, the two can be interrelated in the context of sexual exploitation of children. The Pematangsiantar Police have implemented criminal policies through preventive, repressive, and rehabilitative approaches. The strategies implemented include training investigators, provision of child-friendly spaces, and cross-sector collaboration with child protection institutions. Although there are still obstacles in terms of human resources and facilities, the efforts made show a strong commitment to providing legal protection for children as a vulnerable group. This research emphasizes the importance of criminal policies that are integrated with child protection approaches in order to provide comprehensive justice.

Abstract

Globalization has created an interconnected and interdependent world, brought various conveniences while simultaneously raised new challenges in human rights issues. One prominent negative impact is the rise of Transnational Organized Crime (TOC), including human smuggling, which is increasingly facilitated by technological developments and market openness. This practice resembles a free market, where actors compete to attract customers without formal mechanisms for resolving disputes or enforcing contracts, giving rise to trust issues that are often addressed through reputational investment. This study aims to examine the gaps in Indonesia's national law in responding to this phenomenon and assess its relevance to international standards, particularly the Palermo Protocol. Using normative methods through literature review and a comparative approach, this study highlights the relationship between globalization, human smuggling, and the existing legal framework. The findings indicate that although the UN, through the UNODC and the Conference of Parties (COP), has initiated TOC prevention mechanisms, their implementation remains weak without strong normative ties. In conclusion, harmonization of Indonesian law with international standards is needed to strengthen human rights protection and the effectiveness of law enforcement against human smuggling.

Abstract

The development of information technology, especially in the realm of computers, has created a significant impact on security in cyberspace, including increasing cases of cyber crimes such as defamation. This article analyzes the laws related to defamation in social networks based on the ITE Law. This research uses normative and empirical juridical approaches to highlight weaknesses in policy implementation, such as ambiguous definitions and differences in interpretation between the ITE Law and the Criminal Code. In addition, the article proposes non-penal policy alternatives, such as religious and moral approaches, in addressing cybercrime. However, obstacles such as the lack of public understanding of the ITE Law and limited infrastructure and human resources in the police cyber unit were also identified. By understanding these challenges, it is hoped that law enforcement against cybercrime can be improved to create a safer and more ethical cyber environment.

Abstract

Abstrak Penelitian ini menganalisis penerapan sanksi pidana terhadap anak yang dengan sengaja membujuk atau melakukan persetubuhan, melalui studi kasus Putusan Pengadilan Negeri Medan No. 03/Pid.Sus-Anak/2023/Pn.Mdn. Permasalahan utama difokuskan pada bagaimana pertimbangan hakim dalam memutus perkara anak pelaku persetubuhan, serta peran prinsip keadilan restoratif. Studi menggunakan metode yuridis normatif dengan analisis kualitatif terhadap dokumen hukum, putusan pengadilan, dan bukti visum et repertum. Hasil penelitian menunjukkan hakim menyusun pertimbangan hukum secara sistematis, memadukan aturan normatif dan bukti empirik. Upaya diversifikasi berbasis keadilan restoratif telah dipertimbangkan namun gagal dilaksanakan akibat gagalnya rekonsiliasi. Akhirnya, sanksi pidana dijatuhkan dengan tetap memperhatikan faktor yang meringankan dan memberatkan, serta asas perlindungan anak. Temuan ini menegaskan pentingnya pertimbangan hukum tertulis dan pelibatan prinsip perlindungan anak, meski di sisi lain memperlihatkan keterbatasan implementasi keadilan restoratif dalam praktik. Kata Kunci: Sanksi Pidana, Anak, Persetubuhan, Keadilan Restoratif, Perlindungan Anak Abstract This research analyzes the application of criminal sanctions towards children who intentionally persuade or engage in sexual intercourse, using the Medan District Court Decision No. 03/Pid.Sus-Anak/2023/Pn.Mdn as a case study. The main issue centers on how judges formulate their legal considerations in such cases and the role of restorative justice principles. The study adopts a normative juridical method with qualitative analysis of legal documents, court verdicts, and medical evidence. The findings reveal that judges systematically construct legal arguments, combining normative statutes with empirical evidence. Restorative justice and diversionary efforts were formally considered but ultimately failed due to unsuccessful reconciliation attempts. Consequently, the court imposed criminal sanctions while considering both aggravating and mitigating factors as well as child protection principles. These results emphasize the necessity for written legal considerations and highlight the limited realization of restorative justice in judicial practice. Abstract

The debate on eradicating criminal acts of corruption for criminal law reform is legal and theoretical. This article discusses an important aspect of eradicating criminal acts of corruption in criminal law reform, namely how the position of the law applied in criminal law reform is seen in society from a legal theory perspective since the passing of the New Criminal Code in Indonesia. This problem was analyzed theoretically using normative legal research methods and the conclusion was obtained that the dynamics of eradicating corruption in Indonesia since the enactment of the New Criminal Code will experience a slowdown in the law enforcement process. This is because there are several articles that do not have firmness and legal certainty, such as article 603 of the new Criminal Code which reduces the sentence period for corruptors. The New Criminal Code has made corruption offenses the same as general offenses, so that they no longer have special characteristics or fall into the category of special crimes. Therefore, the Government should review the articles related to corruption offenses in the New Criminal Code so that the legal regulations do not experience a setback compared to the Corruption Eradication Law. Apart from that, there must be synchronization of regulations between the New Criminal Code and Law Number 30 of 2001 concerning the Eradication of Corruption Crimes.
