Abstract

Bribery is a form of abuse of power that not only undermines justice but also erodes the integrity of the legal system. This study aims to evaluate the level of public understanding of bribery practices, analyze its regulation in national criminal law and Islamic criminal law, and examine the role of law enforcement in prevention efforts. The research method used is empirical legal research, combining normative analysis of legislation with field data obtained through observation and interviews. The results show that the public's low understanding of the prohibition of bribery and the weakening of the moral integrity of officials and public servants are the main factors driving bribery practices. In positive criminal law, provisions regarding bribery are regulated in Law Number 31 of 1999 concerning Eradication of Corruption Crimes, while in Islamic criminal law, bribery is considered a jarimah ta'zir because it damages the public interest (maslahah 'ammah). Sanctions against perpetrators are determined based on the judge's discretion, taking into account the degree of guilt and its impact on society. This study emphasizes the need for a more comprehensive preventive and repressive approach in both legal systems to strengthen the effectiveness of combating bribery and foster a culture of integrity in law.

Abstract

Background: Environmental degradation resulting from corporate and individual actions remains a persistent legal challenge in Indonesia. Despite the existence of regulatory frameworks such as Law No. 32/2009 on Environmental Protection and Management (as amended), enforcement remains weak—particularly in corporate-related crimes, as exemplified by the H₂S gas leak incident in Mandailing Natal.. Purpose: This study investigates criminal liability for environmental crimes from the perspectives of Indonesian positive law and Islamic criminal law.. Methods: Using a normative legal research method supported by comparative and case approaches, the study examines legal texts, jurisprudence, and relevant Islamic legal doctrines within the framework of maqāṣid al-sharī‘ah. Results: Findings suggest that while Indonesian law provides sufficient formal basis for corporate prosecution, its implementation lacks consistency. In contrast, Islamic criminal law, through ta‘zīr principles, offers a moral-ethical framework emphasizing justice, deterrence, and ecological responsibility. Implication: The study highlights the urgency of integrating ethical-legal principles from Islamic jurisprudence into the existing legal system to ensure more equitable environmental justice. Originality: This paper’s novelty lies in its contextual application of maqāṣid-based reasoning to corporate environmental crimes

Abstract

Efektivitas perlindungan anak dalam kerangka hukum pidana Malaysia melalui Child Act 2001, dikaitkan dengan prinsip-prinsip universal Konvensi Hak Anak (CRC) dan pendekatan etis dalam hukum pidana Islam melalui maqasid al-shariah. Malaysia, sebagai negara yang telah meratifikasi CRC, memiliki tanggung jawab hukum dan moral untuk memastikan perlindungan anak dari segala bentuk kekerasan, eksploitasi, dan perlakuan tidak manusiawi. Child Act 2001 telah menunjukkan kemajuan normatif dengan mengadopsi prinsip best interests of the child, namun dalam pelaksanaannya, terutama pada aspek penjatuhan sanksi pidana, masih terdapat kesenjangan yang berdampak pada efektivitas perlindungan anak.Dari perspektif hukum pidana Islam, fiqh jinayah menawarkan paradigma perlindungan yang lebih humanis melalui prinsip hifz al-nafs (perlindungan jiwa) dan hifz al-nasl (perlindungan keturunan), yang menempatkan anak sebagai amanah dan entitas sosial yang harus dijaga keberlangsungan fisik maupun moralnya. Mekanisme ta’zir dalam hukum Islam memberikan fleksibilitas bagi hakim untuk menjatuhkan sanksi yang kontekstual dan berkeadilan, menyesuaikan dengan derajat pelanggaran serta kondisi sosial anak sebagai korban.Penelitian ini mengusulkan perlunya harmonisasi antara regulasi nasional dan nilai-nilai maqasid untuk menciptakan sistem hukum pidana yang tidak hanya retributif, tetapi juga restoratif dan preventif. Dengan integrasi prinsip CRC dan maqasid al-shariah, perlindungan anak dapat dirancang lebih adaptif, responsif, dan menjunjung tinggi martabat anak sebagai individu yang berhak atas keamanan dan keadilan hukum.

Abstract

This study aims to analyze the inhibition of honorable dismissal of civil servants who apply for early retirement by examining legal regulations and cases related to the inhibition of honorable dismissal of civil servants. The method used in this study is the normative legal method, while the approaches employed are the legislative approach, the conceptual approach, and the case approach. This study found that this obstruction of dismissal was carried out through the issuance of the Minister of Education, Culture, Research, and Technology's Decision No. 50804/M/11/2023, dated September 12, 2023, regarding the Revocation of the Decision on Honorable Dismissal at the Request of a Civil Servant in the Ministry of Education, Culture, Research, and Technology named Suroyo. The result of this study is the decision of the Jakarta Administrative Court No. 540/G/2023/PTUN.JKT, which states that the defendant, both procedurally and substantively, in issuing the subject of the dispute, has violated applicable regulations and has also violated the General Principles of Good Governance, particularly the principle of legal certainty, which has caused legal uncertainty regarding the plaintiff's status. Therefore, the plaintiff's lawsuit must be granted in full, and the disputed object is declared null and void. The defendant is required to revoke the Minister of Education, Culture, Research, and Technology's Decision No. 50804/M/11/2023, dated September 12, 2023, regarding the revocation of the decision to dismiss a civil servant in the Ministry of Education, Culture, Research, and Technology named Suroyo upon his own request.

Abstract

This study aims to determine the productivity, income, farm feasibility, and break-even point of scallion (Allium fistulosum L.) farming in the California Cialam Jaya Agrotourism Area, Tanea Village, Konda District, South Konawe Regency. The research method used was a survey method with a quantitative descriptive approach. The data used included primary and secondary data, collected through interviews and observations with farm managers. Data analysis used included analysis of productivity, income, farm feasibility using the R/C Ratio approach, as well as Break Even Point (BEP) analysis in terms of production, revenue, and selling price. The results of the study showed that the productivity of spring onion farming was 8,400 kg/ha, with an income of Rp22,224,167 per planting season and an R/C Ratio of 2.12, indicating that spring onion farming is financially viable. The break-even point for production was 471 kg/ha, the BEP for revenue was Rp2,807,000, and the BEP for selling price was Rp4,708.53, all indicating that actual production exceeded the break-even point, thus making this farming profitable. Based on these results, spring onion farming in the study area was declared feasible and has the potential for further development

Abstract

This study aims to examine the role of entrepreneurial literacy in community empowerment to enhance local economic potential in Denai Sarang Burung Village. The methods used include digitalization training, strengthening market access, and collaboration with international partners. The results show that improving entrepreneurial literacy significantly increases the capacity and competitiveness of women MSME actors. The establishment of institutions such as the Merah Putih Cooperative strengthens coordination and collective marketing, supporting business sustainability. The challenges of women's dual roles as housewives and entrepreneurs have begun to be identified and are the focus of sustainable solutions. This study provides an important foundation for the development of an inclusive and sustainable community-based local economy.

Abstract

Penelitian ini bertujuan menganalisis implementasi Peraturan Daerah Nomor 6 Tahun 2015 tentang Pengelolaan Persampahan di Tempat Pembuangan Akhir (TPA) Terjun Medan Marelan serta menganalisisnya dalam perspektif siyasah dusturiyah. Kota Medan menghasilkan sekitar 1.700 ton sampah per hari, namun pengelolaannya belum optimal karena keterbatasan sarana dan prasarana, minimnya alokasi anggaran, dan lemahnya pengawasan. Penelitian ini menggunakan pendekatan yuridis empiris dengan metode statute approach dan case approach, didukung oleh data primer melalui observasi, serta data sekunder berupa literatur dan dokumen hukum terkait. Hasil penelitian menunjukkan bahwa pelaksanaan perda belum sepenuhnya sesuai, khususnya dalam pemilahan sampah dan pengelolaan kapasitas TPA yang telah melebihi daya tampung. Dalam perspektif siyasah dusturiyah, pemerintah daerah telah menjalankan perannya sebagai wali al-amr, namun diperlukan penguatan aspek musyawarah, penyediaan sarana prasarana memadai, dan pengawasan yang lebih tegas demi terwujudnya kemaslahatan masyarakat dan kelestarian lingkungan.

Abstract

Patient satisfaction is a key indicator in assessing the quality of hospital services, particularly in outpatient services, which are the starting point for patient interaction with healthcare institutions. Dr. R. Hardjanto Balikpapan Level II Hospital experienced a decline in patient satisfaction by 8.4% and the number of polyclinic visits by 2.54%. This study aims to determine the effect of organizational management, accessibility, and nurse professionalism on outpatient satisfaction. The research method used is quantitative with a survey approach. Data collection was carried out by distributing questionnaires to outpatients, then analyzed using multiple linear regression. The results of the study indicate that partially and simultaneously, organizational management, accessibility, and nurse professionalism have a significant effect on patient satisfaction. Structured organizational management, easy access to services, and professional behavior of nurses have been proven to be able to increase positive patient perceptions of service quality. These findings confirm that these three factors are important components in forming a satisfying service experience in hospitals.

Abstract

This community engagement program aims to enhance the village’s economic self-reliance and social resilience through a participatory and collaborative approach involving women-led micro, small, and medium enterprises (MSMEs), youth, children, and the village government as key partners. The implementation stages began with village potential mapping through focus group discussions, followed by business legalization assistance including the issuance of Business Identification Numbers (NIB) and halal product certification along with training in business management, product innovation, and digital marketing. The results demonstrate a significant increase in local capacity and competitiveness: several women-owned MSMEs successfully obtained NIB and halal certificates, the process of establishing a culinary and souvenir center (Pujasera) as a hub for local product promotion was successfully initiated, and a digital marketing network was developed to expand market access, while a more child-friendly and gender-equitable village environment was fostered. These achievements confirm that a participatory and collaborative model can effectively create an inclusive, competitive, and sustainable village ecosystem, while also making a tangible contribution to the advancement of knowledge.
