Abstract

Law Number 6 of 2014 outlines the authority, responsibilities, and processes related to the election and dismissal of village heads. This study examines the mechanisms applied by Indonesian law to resolve disputes related to village head elections. The relevant decision is 73/G/2023/PTUN.MDN. This study uses normative legal research, which involves the analysis of laws and regulations as legal documents. Research findings indicate a discussion regarding the selection of village heads in Huta Julu, a community in Mandailing Natal Regency. Village leaders are appointed directly, bypassing the resolution of existing issues, while disputes regarding fair vote distribution by the election committee are handled unfairly. This study explains the strategies used by judges in resolving disputes that occurred during the village head election in Huta Julu.

Abstract

The objectives in this study are (1) To find out whether Per capita Income, Health Sector Expenditures and Education Sector Expenditures Persistently Influential on Human Development Index in Regency / City of South Kalimantan Province for the period 2010-2018; (2) To find out whether Per capita Income, Health Sector Expenditure and Education Sector Expenditure Simultaneously Influence Human Development Index in Regency / City of South Kalimantan Province for the period 2010-2018; (3) To find out what variables are dominantly affecting the District / City Human Development Index of South Kalimantan Province 2010-2018. This research is expected to be able to provide understanding to local governments, private parties and community institutions with an interest in economic development in the regencies / cities of South Kalimantan Province. The results of this study indicate that per capita income has a significant effect and positive direction on the index of human development, regional spending on the health sector has a significant effect and a positive direction on the index of human development and regional expenditure on the education sector has a significant effect and positive direction on the index of human development.

Abstract

Coffee beans are the seeds of the coffee plant and are the main source for coffee drinks. In Indonesia, there are two main varieties of coffee beans developed, namely Robusta Coffee (Coffee Robusta) and Arabica Coffee (Coffee Arabica). Coffee is one of Indonesia's main export commodities, occupying the third position in the world after Brazil and Vietnam. This research aims to determine the criteria in determining the selection of quality coffee beans through the Weighted Aggregated Sum Product Assessment (WASPAS) and Additive Ratio Asessment (ARAS) methods. This is done to simplify the process of selecting quality coffee beans. This research uses 5 criteria, namely: Price, Color, Aroma , Taste , and Impurity Content . The results of the study show that the ratings resulting from the application of the two methods have similarities. The best alternative identified after the application of both methods is the C7 alternative. Using the WASPAS method, the C7 alternative obtained a reference value of 0.5255. Meanwhile with the ARAS method, the C7 alternative gets the highest reference value, which is 0.9908.

Abstract

Social media today functions not only as a communication tool but also as a platform for entertainment, education, and information dissemination. However, problems arise when false information (hoaxes) is spread—particularly when the perpetrators are minors. This study aims to analyse the differences in handling hoax dissemination by minors from the perspectives of criminal law and Islamic criminal law. Employing a normative juridical method with a comparative approach, the research draws on library-based data and case analysis. Four real-life cases of hoax dissemination via TikTok were examined, with identification of underage perpetrators based on user account content and behaviour. The findings reveal that, under national criminal law, the legal process prioritizes diversion as an initial step. If diversion fails, the case proceeds to court, where formal sanctions may be applied. In contrast, Islamic criminal law emphasizes returning the child to their parents, imposing ta’dībī (educational discipline) on the child, and ḍamān (compensatory liability) on the parents if the hoax involves defamation (qadhf). Key differences between the two systems include legal foundations, criminal responsibility, types of hoaxes, sanctions, and age thresholds. Nevertheless, both systems share a core principle: prioritizing rehabilitation and education over punitive measures. This study offers a novel comparative perspective and underscores the need for child-cantered legal frameworks in addressing the spread of hoaxes on social media.

Abstract

Penggunaan pestisida kimia yang berlebihan dalam praktik pertanian telah menimbulkan dampak negatif terhadap kesehatan manusia dan lingkungan. Pestisida nabati menjadi alternatif ramah lingkungan dalam pengendalian hama tanaman. Penelitian ini bertujuan untuk mengetahui efektivitas penyuluhan dalam meningkatkan pengetahuan petani tentang penggunaan pestisida nabati di Desa Rawang Lama, Kabupaten Asahan. Metode penelitian yang digunakan adalah pre-eksperimen dengan desain one-group pretest-posttest. Sebanyak 30 petani menjadi responden, yang dipilih secara purposive. Instrumen yang digunakan berupa kuesioner pilihan ganda yang diberikan sebelum dan sesudah penyuluhan. Hasil menunjukkan peningkatan rata-rata nilai pretest dari 53,0 menjadi 81,3 pada posttest. Hasil uji Paired Sample t-Test menunjukkan nilai signifikan (p-value) sebesar 0,000 (< 0,05), yang mengindikasikan adanya peningkatan pengetahuan yang signifikan setelah intervensi. Penyuluhan terbukti efektif dalam meningkatkan pemahaman petani mengenai pengertian, jenis, dan manfaat pestisida nabati seperti serai dan daun sirsak dalam pengendalian hama. Temuan ini menegaskan bahwa edukasi berperan penting dalam mendorong petani mengadopsi praktik pertanian yang lebih berkelanjutan dan ramah lingkungan. Abstract

This study investigates the growing phenomenon of ticket hoarding (Iḥtikār) and counterfeiting in Indonesian football matches, which causes significant harm to both consumers and event organizers. The purpose of this research is to analyse these practices from the perspectives of Islamic criminal law and Indonesian positive law, and to evaluate the legal sanctions applicable to such offenses. Employing a juridical-empirical method with a qualitative approach, data were collected through interviews, observation, and documentation, focusing on cases at Baharoeddin Siregar Stadium, Lubuk Pakam, North Sumatra. The findings reveal that ticket hoarding and forgery constitute jarīmah taʿzīr and iḥtikār in Islamic criminal law, due to elements of fraud, injustice, and public harm. Under Indonesian law, these acts violate provisions on trade monopolies and meet the criteria for fraud and forgery as defined in the Criminal Code (KUHP) and Law No. 7 of 2014. This research offers an original contribution by contextualizing Islamic criminal law in economic crime, highlighting the need for policy reform and stronger enforcement to combat illegal ticketing practices.

Abstract

Military criminal offenses represent violations of hierarchical discipline, a foundational principle of the military system. This research examines the legal analysis of insubordination committed by military personnel from the perspective of Islamic criminal law. The primary objective of this study is to evaluate how the legal system—both positive law and Islamic criminal law—assesses the crime of insubordination within the military context. This study employs a qualitative normative juridical methodology, using a statute and conceptual approach to examine relevant legal provisions, including military criminal codes and Islamic jurisprudential sources. The findings reveal that insubordination is classified under Article 106 of the Indonesian Military Criminal Code (KUHPM) as a serious offense involving disobedience or resistance toward a superior officer. From the perspective of Islamic criminal law, such conduct is closely associated with jarīmat al-baghyu (rebellion) and is punishable under the category of ta‘zīr, which allows for discretionary sanctions such as imprisonment, dismissal, or other corrective measures. This study offers original insight by bridging the gap between formal military legal systems and Islamic legal thought, emphasizing the role of moral and ethical values in reinforcing military discipline. The implications suggest the potential for integrating ta‘zīr-based principles into Indonesia’s military justice system to enhance internal discipline through a framework grounded in justice, piety, and legal authority.

Abstract

This study explores the issue of criminal responsibility for mercenaries, individuals who participate in armed conflicts for material gain, either through direct recruitment or as part of organized groups. The primary purpose of the research is to analyses how criminal liability for mercenary actions is conceptualized in both Islamic Criminal Law and International Criminal Law, given the complex legal challenges posed by their involvement in cross-border conflicts. The methodology employed is normative juridical with a comparative approach, analyzing relevant legal sources including the 1949 Geneva Convention Additional Protocols and primary Islamic legal texts. The study systematically compares how each legal system treats the criminal accountability of mercenaries based on their roles during conflict. The results reveal that under Islamic Criminal Law, mercenaries who engage in rebellion (bughāt) may be subject to capital punishment, as referenced in Qur’an Surah Al-Hujurat verse 9. In contrast, International Criminal Law treats mercenaries as individuals subject to the national laws of the country where the offense occurs (locus delicti), with limited recognition of mercenaries as combatants. The originality of this study lies in its comparative framing, bridging two distinct legal traditions that are rarely analyzed together in the context of modern warfare. The implications underscore the need for a more coherent and adaptive policy framework to address the transnational nature of mercenary activity and ensure equitable legal accountability across jurisdictions.

Abstract

Keterbukaan informasi publik menjadi salah satu pilar penting dalam mewujudkan pemerintahan yang transparan dan akuntabel. Namun, sering kali muncul permasalahan ketika badan publik menolak memberikan informasi yang dianggap penting oleh masyarakat. Konflik ini biasanya timbul akibat perbedaan penafsiran mengenai informasi mana yang seharusnya terbuka dan mana yang harus dikecualikan. Penelitian ini bertujuan untuk menganalisis putusan PTUN Surabaya No. 32/G/KI/2021 terhadap sengketa keterbukaan informasi publik ditinjau dari perspektif Fiqh Siyasah Qadhaiyyah. Penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan pendekatan yang diterapkan adalah pendekatan legislasi (Statute Approach) dan pendekatan yuridis kasus (Case Approach). Hasil penelitian ini menunjukkan bahwa putusan PTUN Surabaya No. 32/G/KI/2021 menimbulkan berbagai isu terkait keadilan, maslahah, dan hak publik atas keterbukaan informasi. Keputusan yang menolak akses terhadap informasi publik tanpa alasan yang kuat berpotensi bertentangan dengan prinsip keadilan substantif dan transparansi yang diakui dalam hukum Islam. Dalam konteks hukum Islam, hakim harus mempertimbangkan kepentingan publik secara luas dan memastikan bahwa setiap pembatasan akses informasi dilakukan dengan dasar yang sah serta sesuai dengan prinsip keadilan. Abstract

Illegal gold mining (pertambangan emas tanpa izin, PETI) in Jambur Tarutung, Kotanopan, presents complex legal, socio-economic, and environmental challenges. This study examines the enforcement of criminal law against illegal gold mining in the region and explores how Islamic criminal law can provide a complementary framework for addressing such issues. Using an empirical juridical approach, this research integrates normative analysis of relevant legal provisions - particularly Law No. 3 of 2020 on Mineral and Coal Mining - with field data gathered through in-depth interviews, observations, and document analysis involving law enforcement officials, community leaders, religious scholars, and affected residents. Findings reveal that law enforcement remains largely ineffective due to weak supervision, limited institutional capacity, socio-political interference, and the dependence of local communities on illegal mining as an economic livelihood. From an Islamic criminal law perspective, these activities constitute jarimah ta?z?r involving fasad (corruption and destruction), warranting discretionary sanctions by the ulil amri that combine punitive and restorative measures. This study argues for an integrative enforcement model that merges positive law with maq??id al-shar??ah, emphasizing ecological restoration, community empowerment, and moral-spiritual reform. Such an approach promotes sustainable resource governance while fostering social justice and collective environmental responsibility.
