Abstract

Indonesia is a state of law, but many people do not comply with the law. In 2018–2020, the number of crimes in various regions of Indonesia continues to increase, and Boyolali Regency is no exception. This means that many people who act as perpetrators of criminal acts have to deal with the legal process. With so many people becoming defendants, the state has an obligation to ensure that the rights of the accused are fulfilled, one of which is the right to get free legal assistance through the presence of Posbakum both at detention centers and at the District Court. However, many defendants did not know or use their rights. This study used a qualitative, non-doctrinal approach by seeking informants to find out about the role of Posbakum and efforts to optimize Posbakum in the Boyolali detention center. From this research, it will be known that Posbakum has a role in fulfilling the rights of the accused during the process of dealing with the law and the efforts made by the Boyolali detention center in realizing the rights of the accused who are undergoing detention there.

Abstract

This socialization activity was carried out aiming to provide direction and provide examples, how to implement Pancasila values ​​that must be applied in everyday life. This is intended to be able to create the next generation of people who are of high quality and have high integrity. So that it can make a positive contribution to the country and bring Indonesia to become a developed country. The existence of Pancasila in the environment can shape the ethics of this nation is really very necessary. With this socialization, participants are expected to be able to listen and receive well the various available information. So that the participants can apply what they have learned and can become a good example among the community, especially for the next generation of young people who will continue the leadership relay in Indonesia.

Abstract

The abuse of minors is a serious crime that violates children's rights and has long-term impacts on the physical, emotional, and psychological well-being of victims. Legal protection for children who are victims of abuse requires an approach that focuses on protecting children and their recovery. This study aims to explore the practice of accompanying cases of sexual abuse of minors at the Klaten Police Department and to analyze the effectiveness of assistance in the criminal justice system. The research method used is an advocacy method with a focus on legal assistance. Assistance is carried out during the examination process, from consultation to assistance in making reports to the police. This research is expected to contribute to the development of policies and practices for better assistance in cases of sexual abuse of minors.

Abstract

National strategic projects that are being intensively carried out by the government do not escape the emergence of disputes or disputes. This study raises the case of compensation due to the construction of expressway infrastructure or the Solo-Yogyakarta toll road, precisely in the Klaten area, which is experiencing problems, one of which is the determination of the compensation value for the affected community. The matter was brought to trial at the Klaten District Court with a fast-paced trial process carried out by the Panel of Judges. This research was structured using the juridical-empirical method. This study will describe the settlement of compensation for land affected by the Solo-Yogyakarta toll road at the Klaten District Court and explore facts to find out the obstacles experienced from the perspective of the applicant in the settlement of compensation for land affected by the Solo-Yogyakarta toll road.

Abstract

The development of micro small businesses must be directly proportional to legal knowledge for the perpetrators, because with the development of micro small businesses, the possibility of intersecting with legal problems will be even greater. Of course, all micro small business actors hope that their business is fine, but problems such as civil, criminal, labor, tax will not rule out the possibility of being experienced in the future. Of course, with a good level of knowledge, problems such as disputes or disputes can be avoided in the future or at least if disputes occur micro small business actors know how to overcome them. Evidence of the large number of civil problems in court is an indication that intentionally or unintentionally many business actors do not carry out rights or obligations so that disputes between micro small business actors are born. Tips for overcoming legal problems for micro small businesses aims to foster legal awareness and settlement procedures in the event of disputes in the future, the author feels the need to provide legal counseling for micro small businesses in order to foster knowledge and understanding related to tips on overcoming legal problems for micro small businesses for the realization of more advanced Indonesian micro small businesses.

Abstract

The principle of "Equality before the law" states that every individual has equal rights before the law and equal treatment in the justice system. This principle emphasizes that all people must be treated fairly and equally in the eyes of the law without discrimination. This principle explains that everyone has equal access to the legal process and justice, without any bias or unfair treatment based on factors such as race, religion, gender or social status. This principle is an important foundation in ensuring justice, protection of human rights, and fair law enforcement for all citizens. The free legal aid program is one way to realize access to law and justice for the poor, which is provided by the state as mandated by the constitution. The provision of legal aid to citizens in Indonesia is an effort to fulfill and at the same time implement a rule of law that recognizes, protects and guarantees the human rights of citizens. Through the provision of free legal aid, it is hoped that people in need can gain access to free legal services that are fair and equitable, and receive appropriate legal protection.

Abstract

The Constitution of the Republic of Indonesia Year 1945 mandates the government to strive for a national education system that emphasizes faith, piety and humanity based on the one and only god. Higher education carries the mandate of the 1945 Constitution, which is one of educating the nation's life, this mandate must be implemented by the government as a policy maker. Higher education is part of the national education system that has a strategic role in educating the nation's life and advancing science and technology by paying attention to pancasila. The tridharma of higher education carries 3 pillars, namely research, community service and learning. Universities and academicians have an important role in driving social change and progress in society. As agents of change, they have the potential to influence policy, champion social issues, and encourage innovation in various fields, including the economy. In recent years, the statistics on the growth and development of micro small businesses have achieved significant changes. Lecturers and students and other academicians are expected to synergize with each other to spread benefits in the community, the latest thoughts and the latest innovations for the sake of realizing a resilient and sustainable Indonesian economy.

Abstract

Program Kota Layak Anak di Kota Surakarta diimplementasikan melalui Kawasan Tanpa Rokok (KTR). Program tersebut diwujudkan supaya terciptanya pemenuhan hak anak di Surakarta secara maksimal. Pemenuhan hak anak di Indonesia diatur dalam Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak di mana anak memiliki hak-hak dasar yang harus terpenuhi sebagai layaknya manusia. Oleh karena itu dibentuknya KTR sebagai upaya pemenuhan hak anak khususnya di wilayah Surakarta menjadikan perlu adanya perhatian secara seksama oleh pemerintah ataupun masyarakat dewasa. Karena pada dasarnya anak-anak dianggap masih memiliki rasa daya ingin tahu yang tinggi sehingga sebagai masyarakat, orang tua ataupun wali dari anak harus memperhatikan kesejahteraan dari hak-hak anak itu sendiri.

Abstract

This article discusses the role of the Pacta Sunt Servanda principle in loan agreements, particularly in the context of a court decision related to the breach of contract by PT BPR Suryamas Surakarta. The principle asserts that an agreement is binding as law to the parties involved and is utilized by judges as a consideration in court. The article aims to analyze the correlation of this principle with the judge's considerations in the context of breach of contract and evaluate the judge's perspective from the standpoint of legal utility. The research employs a normative juridical method through a literature review, using secondary data such as legal regulations and relevant literature. The results indicate that the Pacta Sunt Servanda principle plays a crucial role as a basis for judicial consideration, evident in the court decision that punishes the defendants according to the agreed-upon contract. While legal certainty predominates, the happiness of the parties involved, and the public is also a consideration for the judge. This decision, though emphasizing legal certainty, essentially contributes to the happiness of all parties involved and the community. Artikel ini mendiskusikan peran Asas Pacta Sunt Servanda dalam perjanjian pinjam meminjam, terutama dalam konteks putusan hakim terkait wanprestasi PT BPR Suryamas Surakarta. Asas ini menegaskan bahwa perjanjian berlaku sebagai undang-undang bagi pihak yang membuatnya, dan digunakan oleh hakim sebagai pertimbangan dalam pengadilan. Artikel bertujuan menganalisis korelasi asas tersebut dengan pertimbangan hakim dalam konteks wanprestasi, serta mengevaluasi pertimbangan hakim dari perspektif kemanfaatan hukum. Metode yang digunakan adalah yuridis normatif melalui studi kepustakaan, dengan data sekunder berupa peraturan perundang-undangan dan literatur terkait. Hasilnya menunjukkan bahwa Asas Pacta Sunt Servanda memiliki peranan penting sebagai dasar pertimbangan hakim, tergambar dalam amar putusan yang menghukum tergugat sesuai perjanjian. Meskipun aspek kepastian hukum mendominasi, kebahagiaan pihak terlibat dan masyarakat secara umum juga menjadi pertimbangan hakim. Putusan ini, meskipun lebih menonjolkan kepastian hukum, pada intinya menciptakan kebahagiaan bagi semua pihak terlibat dan masyarakat.

Abstract

Restorative Justice is an alternative settlement of criminal cases involving the perpetrators, victims, family members and the victims as well as the authorities to settle disputes. Restorative justice began to develop in the 19th century and has been regulated in Indonesian legislation as in the Law No. In 2012, the Court of Appeal No. 15 of 2020, and the Police Regulations No. 8 in 2021. In its implementation it uses a criminal mediation mechanism involving law enforcement in the process of investigation, investigation and prosecution. There is no legal umbrella that specifically regulates Restorative Justice. In this study, the method of research used is the normative method of jurisprudence in which the study is carried out by the library. The aim of this research is to find out how the correspondence between the mechanisms and requirements in the settlement of criminal cases based on the rules in force in Indonesia on Restorative Justice. The method used is descriptive using secondary data is data obtained from library studies that are then analyzed with the rules, theories and opinions of relevant legal experts to obtain conclusions from the research. The results of this study of the setting on restorative justice still have differences between one and the other in the context of the type of behavior. In addition, restorative justice normatively has been in line with John Rawls’s concept of justice but in caseistic there are still some deviations from the rule.
