Abstract

This research aims to determine and analyze the handling of the COVID-19 pandemic in Lampung Province and West Java from the perspective of maqāshid sharīa. Given that the pandemic has a wide impact on society, its handling must be comprehensive. This research method uses a qualitative method with an ethnographic approach. The data was obtained from the Lampung and West Java Provincial Governments, namely from the Regional Secretary and members of the DPRD. The data analysis uses interactive analysis and concept analysis. This study found that to handle the COVID-19 pandemic, the Lampung and West Java Provincial Governments have made several policies, including regional and gubernatorial regulations. The policy is intended to limit the worship and economic activities of the community. From the perspective of maqāshid sharia, restrictions on worship and economic activities are part of protecting the human soul (hifdz al-nafs) as the highest protection or value before wealth (hifdz al-māl) and even religion (hifdz al-dīn). With this handling, the rate of the virus spread can be prevented so that more human lives can be saved

Abstract

Penelitian ini menyimpulkan bahwa hukum Islam di Mesir hokum keluarga yang berlaku saat ini tidak lagi hanya mengikuti hukum klasik para imam Mazhab seperti Hanafi dan Syafi’i, tetapi lebih komprehensif dengan mengadopsi mazhab-mazhab lainnya yang dianggap relevan selain mengambil bentuk hukum baru. Hukum keluarga di Mesir jika dibandingkan dengan hukum keluarga di Indonesia, ada sejumlah materi yang memiliki persamaan dan perbedaan. Usia perkawinan di Mesir adalah 18 tahun bagi laki-laki dan usia 16 tahun bagi perempuan. Sedangkan di Indonesia umur laki-laki dan perempuan yang sudah diperbolehkan menikah adalah 19 tahun.Batas usia minimum perkawinan antara dua Negara tersebut sebenarnya tidak terlalu jauh berbeda. Namun, Indonesia lebih progresif karena di antaranya mempertimbangkan faktor kesehatan dan psikologis.

Abstract

DPRD has a strategic position in the development of an area. Because, the people's representative institution has three inherent functions, namely the function of making local regulations (legislation), supervision (controlling) and budget function (bugeting). However, the reality of the implementation of the dprd function is still not optimal. This is due to the incomprehension of legislators in describing legislation, even more extreme, the existence of the function is not to assist local governments in carrying out government duties but rather as a tool for personal and party interests. This writing uses normative juridical research methods, where the author uses laws, journal articles, books and documents that support in discussing the issue of optimizing the tasks and functions of dprd members in realizing clean government. This study concluded, good governance can be done by optimizing and improving the quality of dprd members by improving the quality and understanding of DPRD members to their duties and functions. The fruit of quality improvement can be measured by how much the role of the DPRD in terms of partnership with executive institutions in making local regulations, drafting budgets, and in monitoring the course of government.

Abstract

The rules regarding a living in Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law imposes the obligation to earn a living only on the husband. These two regulations create problems in society. Many wives demand a living from their husbands. Not a few wives also have jobs and income, but they are spent on their own needs, including for consumptive things, channeling hobbies and others because they think that fulfilling a living is not part of their obligations. This condition is coupled with the interpretation of a number of verses of the Qur'an and the traditions of the Prophet which are still patriarchal. The marriage law and a number of verses of the Qur'an and the Prophet's hadith need to be reinterpreted. This is because the development of an increasingly advanced era makes the role of women not only as wives who only take care of the household, but also as one of the contributors to the economy. This research uses the library research method. This study concludes that the livelihoods in these two laws and regulations need to be updated to be relevant to current conditions. Supposedly, the wife also has the same obligation in matters of livelihood. The reinterpretation of livelihood using the interpretation of mubadalah is to produce the principle of mutuality. The wife can even be the main breadwinner under certain conditions. This interpretation has implications for the fulfillment of the family's economy during the pandemic and post-covid-19 pandemic. Because, in difficult economic conditions, the wife participates in helping the family economy on a macro basis or even as the main provider in the household who changes places with her husband.Keywords: Reinterpretation, Livelihoods, Marriage Law, Family Resistance, Covid-19

Abstract

Masjid merupakan sarana yang sangat penting dan strategis untuk membangun kuwalitas umat. Namun, seiring dengan berkembangnya zaman, masjid dituntut untuk memiliki peran lebih di tengah-tengah masyarakat. Jika melihat lebih luas, masjid memiliki peran besar baik dalam bidang ekonomi, politik, sosial, pendidikan, dan dakwah. Oleh karena itu, untuk mewujudkan kembali peran dan fungsi masjid ini, aktivitas-aktivitasnya harus dikelola dengan manajemen yang baik. Sebagai pusat gerakan dakwah, masjid dapat difungsikan sebagai pusat pembinaan akidah umat dan manajemen dakwah yang diterapkan sebagai alat untuk memperbaiki keadaan masyarakat sekitar dalam aspek akidah. Beberapa kasus dalam aspek akidah, pembinaan akidah sangat penting bagi masyarakat awam yang hidup di tengah-tengah maraknya kristenisasi. Metode yang digunakan pada penelitian ini adalah metode kualitatif dengan pendekatan studi kasus. Dalam penelitian ini terdapat dua fokus rumusan masalah, yaitu: 1) Manajemen dakwah masjid di daerah kristenisasi, 2) Upaya meningkatkan hasil dakwah yang telah dicapai. Penelitian ini sangat penting untuk dibahas terutama pada zaman yang sudah mulai merosot seperti saat ini. Kembali menjadikan masjid sebagai poros umat merupakan salah satu fungsi yang sudah mulai dilupakan karena melalui manajemen yang baik, semua akan terorganisir terkonsep, dan terstruktur dengan baik pula.

Abstract

The study aims to identify waqf issues in Lampung and South Sumatra Provinces and explore potential solutions to develop a national waqf ecosystem that is more responsive to the development of time. This research employed empirical juridical research. The primary data was gathered through observations, interviews, and documentation with waqif (donors), nadzir (the administrators of Waqf), public figures, academics, and BWI (Indonesian Waqf Institution) of Lampung and South Sumatra. The secondary data were gathered from books, laws and regulations, judicial decisions, scientific journals, and websites. This study discovered that the challenges of Waqf in Lampung and South Sumatra Provinces comprised aspects of management and supervision, a lack of socialization and literacy, waqf fraud, and insufficient nadzir (donors) resources for creating profitable Waqf and waqf digitization. The solution is to enhance the national waqf ecosystem by reforming waqf laws to strengthen waqif, nadzir, and BWI. With the renewal of waqf law, a positive ecosystem will emerge, reducing waqf disputes and improving people's well-being.

Abstract

This article discusses the age limit for marriage based on the maqasid al-sharia perspective in marriage law. This research is library research with the main data source being Law Number 16 of 2019. The data that has been collected is then analyzed using qualitative descriptive methods. The results of the study indicate that although there is no clear text that regulates the minimum age for marriage, the presence of a revision of Law Number 16 of 2019 concerning Marriage which regulates the minimum age for marriage is not contrary to the spirit of Islamic law, because the regulation is an effort from the government. to encourage the realization of the purpose of marriage, namely creating a serenity family, love, and affection. In addition, the regulation is also under the purpose of applying the law (maqasid as-sharia), namely hifz al-nasf (guarding the soul) and hifz al-nasl (guarding offspring).

Abstract

Dalam negara demokrasi, kedaulatan atau kekuasaan tertinggi dalam negara yang terletak di tangan rakyat. Pada hakekatnya pemilu merupakan pengakuan dan perwujudan hak-hak politik rakyat dan sekaligus merupakan pendelegasian hak hak tersebut oleh rakyat kepada wakil wakilnya untuk menjalankan pemerintahan. Kedaulatan rakyat merupakan hak konstitusional setiap warga negara baik yang berada didalam maupun diluar negeri. Pekerja migran adalah bagian dari warga negara yang wajib dijamin hak politiknya oleh pemerintah. Di Indonesia legal formal instrumen pengawal tejaminnya hak politik warga negara dalam pemilu diatur dalam UU Pemilu Nomor 7 Tahun 2017. Salah satu bagian substantif regulasi tersebut mengatur tentang pelaksanaan pemilu bagi warga negara Indonesia di Luar Negeri, termasuk pekerja migran sebagai  fokus kajian dalam penelitian ini. Penelitian ini bertujuan untuk menganalisis secara deskreptif  partsipasi pekerja migran dalam pemilu. Hasil penelitian menunjukkan bahwa partisipasi politik warga negara yang berdomisili diluar negeri termasuk pekerja migran dalam pemilu tahun 2019 masih cendrung rendah, namun ada peningkatan dibandingkan dengan hasil pemilu tahun 2014. Kemudahan dan kekhususan perlakuan terhadap mereka yang atur dalam regulasi pemilu belum berdampak signifikan untuk peningkatan partisipasi politik warga negara dan pekerja migran Indonesia dalam pemilu. Kendala yang menyulitkan Pekerja Migran Indonesia di luar negeri untuk berperan aktif dan berpartisipasi dalam pemilu adalah minimnya akses informasi mengenai proses pemilu, sulitnya mendaftar sebagai pemilih di luar negeri, dan keterbatasan waktu. Pemerintah sebagai keterwakilan negara perlu mengupayakan langkah strategis dalam mengantisipasi dan menanggulangi problema tersebut dengan cara memberikan akses yang lebih baik kepada Pekerja Migran Indonesia guna menjamin tersalurnya partisipasi politik mereka dalam pemilu secara maksimal

Abstract

Abstract:  The issue of legal protection for women and children remains a crucial concern in many Muslim countries, particularly regarding gender inequality, domestic violence, and limited access to justice. Although Islam upholds the principles of justice and respect for human dignity, its implementation is often influenced by patriarchal culture and legal systems that have yet to fully protect vulnerable groups. Based on this background, this study aims to analyze the forms and implementation of legal protection for women and children in Saudi Arabia, Egypt, and Indonesia through the mubadalah (reciprocity) perspective. This research is a qualitative library study using normative and comparative approaches, drawing on Islamic legal sources, national legislation, and relevant academic literature. The results indicate that Saudi Arabia remains oriented toward classical fiqh but is beginning to transform through legal reform; Egypt has progressively codified family law; while Indonesia integrates Islamic justice principles with national law through comprehensive regulations protecting women and children. From the mubadalah perspective, all three countries demonstrate efforts toward more equal and just legal relations, affirming that true legal protection must be grounded in reciprocity, humanity, and gender justice.   Keywords: Protection, Women and Children, Muslim Countries, Mubadalah
