Abstract

This study aims to analyze freedom of association and assembly from a human rights perspective, and explore the challenges faced in its implementation in various countries. The scope of the study includes a review of various cases of violations of the right to freedom of association and assembly, both in countries with democratic and authoritarian systems. In addition, this study will also discuss the role of international organizations and civil society in promoting and protecting these rights. This study will not only discuss the theory and basic principles of freedom of association and assembly, but will also dig deeper into how these rights are implemented in practice, the challenges faced, and steps that can be taken to strengthen the protection of these freedoms throughout the world. This study is expected to make a significant contribution to understanding the complexity of freedom of association and assembly and its impact on human rights as a whole. This study uses a qualitative approach with a case study design. The qualitative approach was chosen because it allows researchers to dig deeper into freedom of association and assembly in the context of Human Rights (HAM).

Abstract

This research analyses the local authority in the formation of local regulations (Perda) based on the ideology of Pancasila. As a country with a decentralised system, Indonesia gives authority to local governments to form local regulations according to the needs of each region. However, in its implementation, this authority must remain in line with the principles contained in Pancasila as the basis of the state. This research uses normative legal research method with statute approach and conceptual approach. The data source used is secondary data consisting of laws and regulations, court decisions, and relevant legal literature. The results show that in the formation of local regulations, local governments must pay attention to the principles of the formation of good laws and regulations as stipulated in Law Number 12 of 2011 concerning the Formation of Laws and Regulations. In addition, there is a supervisory mechanism from the central government and the Supreme Court to ensure that the Perda formed does not conflict with higher regulations and the values of Pancasila. This research recommends strengthening the synergy between local and central government in drafting local regulations, as well as increasing public participation to ensure that any local regulations formed truly reflect the values of Pancasila and the interests of the community at large.

Abstract

Introduction: In the agenda of the supremacy of law in Indonesia, one of the tangible manifestations carried out is the establishment of the Constitutional Court in 2003. One of the powers of the Constitutional Court is judicial review which has a major role and influence in upholding human rights. The Purposes of the Research: The purpose of this study is to analyze especially from the philosophical perspective of the role of the Constitutional Court in upholding certainty regarding gender equality in Indonesia. The main research authority is judicial review.The Methods of the Research: The research method used in this study is a normative research method with a legal and philosophical approach. The method and approach will be used in examining the role of the Constitutional Court in upholding certainty regarding gender equality in Indonesia.Results of the Research: A series of Constitutional Court decisions, including Number 22-24/PUU-VI/2008, demonstrates Indonesia's commitment to gender equality. These rulings changed election systems, ensuring equal opportunities for all candidates. The Court nullified affirmative action provisions in Law No. 10 of 2008, shifting from a 30% female representation goal. Decision Number 20/PUU-XI/2013 strengthened gender equality in politics, while Decision Number 82/PUU-XII/2014 supported women's electability in leadership roles. Decision Number 22/PUU-XV/2017 addressed gender-based discrimination in the Marriage Law. These decisions show the Constitutional Court's role in promoting gender equality, yet ongoing efforts are needed for further progress.

Abstract

This study evaluates the application of Pancasila values and the enforcement of human rights in Indonesia's judicial system through a constitutional approach. Using normative legal research methods, the approach taken includes analysis of legislation, conceptual studies, as well as case studies of a number of relevant Constitutional Court decisions. The results show that the values of Pancasila, particularly the second and fifth precepts, play a fundamental role as the philosophical basis in the application and interpretation of human rights principles in Indonesia. The Constitutional Court has a strategic role in safeguarding the constitution while ensuring the enforcement of human rights through progressive legal interpretation. However, despite these positive steps, challenges such as inconsistencies in lower court decisions and mismatches between the rule of law and the needs of society remain. This research recommends strengthening Pancasila-based legal education, harmonizing legal policies, and increasing the capacity of judges in integrating human rights with social justice principles holistically. The findings confirm that the judicial system, with a strong constitutional approach, can be an effective tool in realizing social justice in accordance with the values of Pancasila and the constitution.

Abstract

Examining Body Finance is state agency that has authority inspection finance in Indonesian constitution , p the by constitutional set in _ Article 23E paragraph (1) of the 1945 Constitution. In operate function inspection state finances , the BPK in run it bound by principle assertion . However in level implementation , still there is action examinations carried out by the BPK in Thing this no notice principle assertion . Study this will study existence principle assertion in implementation authority inspection state finances by the BPK. Study this categorized as to in type study normative with based on problem or raised theme _ as topics study main inside _ study this . Approach used _ in study this is approach principle law with link a number of law existing positive _ During regarding with topics discussion main inside _ study this . Method analysis used _ is descriptive analytical with describe regulation current legislation _ apply as well as decisions later court _ linked with practice the law that occurs in the field ( facts ) law ). Abstract

Indonesia merupakan salah satu negara yang menjunjung tinggi hukum, hal ini dipertegas secara konstitusional di dalam Pasal 1 ayat (3) UUD 1945. Oleh karena itu, ada banyak aspek yang harus diatur di dalam hukum agar segala sesuatu tersebut dapat dilaksanakan dan dijalankan dalam bernegara di Indonesia. Sehingga, peraturan perundang-undangan selaku hukum positif yang memiliki peranan penting dalam penyelenggaraan ketatanegaraan Indonesia. Aspek penting yang harus dipahami dalam hal ini adalah pembentukan peraturan perundang-undangan. Pasca berlakunya Undang-Undang Nomor 13 Tahun 2022 Tentang Perubahan Kedua Atas Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan dikenal metode baru dalam pembentukan peraturan perundang-undangan di Indonesia. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini. Hasil dari kesimpulan penelitian ini mempertegas mengenai kedudukan politik hukum metode pembentukan peraturan perundang-undangan dengan menggunakan metode omnibus law di Indonesia setelah berlakunya Undang-Undang Nomor 13 Tahun 2022 Tentang Perubahan Kedua Atas Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan di Indonesia.

Abstract

Di dalam setiap masyarakat terdapat suatu kekuatan sosial (social forces) yang dapat berfungsi sebagai alat untuk mencapai suatu tujuan. Kekuatan sosial adalah faktor yang sangat mempengaruhi penegakan hukum. Hal ini karena hukum yang akan diberlakukan pasti akan menghadapi kekuatan-kekuatan sosial yang ada di tengah-tengah masyarakat. Setidaknya, terdapat beberapa faktor-faktor berpengaruh dalam kekuatan sosial. Pembahasan ini menjadi salah satu isu krusial yang dikaji di dalam sosiologi hukum. Pada dasarnya, gejala sosial memiliki kaitan yang erat dengan pembahasan di dalam penelitian ini. Mengenai fungsi hukum di dalam masyarakat juga menjadi isu penting yang akan dibahas. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini yakni mengenai Hak Asasi Manusia. Hasil dari penelitian ini akan memperlihatkan faktor-faktor kekuatan sosial yang mempengaruhi hukum yaitu kekuatan uang, kekuatan politik, kekuatan massa dan teknologi baru. Kemudian, penelitian ini menyimpulkan bahwa terdapat manfaat sosiologi hukum dalam memahami seberapa jauh fungsi penegakan hukum di tengah-tengah masyarakat

Abstract

Indonesia merupakan negara hukum, sebagai negara yang sangat menjunjung tinggi hukum terdapat beberapa penegak hukum yang memiliki peranan penting di dalamnya. Kepolisian adalah salah satu law enforcement yang memiliki peranan penting dalam penegakan hukum di Indonesia. Secara konstitusional, di dalam Pasal 30 ayat (4) UUD 1945 ditegaskan bahwa Kepolisian Negara Republik Indonesia sebagai alat negara yang menjaga keamanan dan ketertiban masyarakat memiliki tugas penting dalam melindungi, menganyomi, melayani masyarakat serta menegakkan hukum. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini. Di dalam penelitian ini akan dibahas mengenai sejarah singkat kelahiran kepolisian di Indonesia dan peranan Kepolisian sebagai penegak hukum dalam mewujudkan keamanan dan ketertiban negara. Hasil dari penelitian ini memperlihatkan telah bayak dinamika dalam perkembangan institusi kepolisian di Indonesia serta peranan penting kepolisian dalam mewujudkan keamanan dan ketertiban negara Indonesia.

Abstract

Hukum merupakan suatu hal yang abstrak, karena tidak dapat dilihat dan disentuh, namun dapat dirasakan keberadaannya. Hal ini karena hukum bukan suatu benda, melainkan tindakan (setelah dimplementasikan). Untuk mengkaji hal tersebut, maka kita harus memperhatikan eksistensi hukum melalui efektivitas hukum yang ada di tengah-tengah masyarakat. Membahas mengenai efektivitas hukum di tengah-tengah masyarakat berarti membahas mengenai daya kerja atau pengimplementasian suatu hukum dalam mengatur dan/atau memaksa masyarakat untuk patuh dan taat terhadap hukum. Maka, sudah pasti terdapat faktor-faktor yang mempengaruhi tingkat efektivitas hukum tersebut. Kemudian, juga terdapat faktor-faktor yang mempengaruhi hukum tersebut benar-benar berfungsi di dalam masyaralat. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini. Hasil dari penelitian ini memperlihatkan ada beberapa faktor yang mempengaruhi efektivitas penegakan hukum di masyarakat yaitu kaidah hukum (peraturan), penengak hukum, sarana atau fasilitas dan kesadaran masyarakat itu sendiri

Abstract

This study examines the overburdening of the Constitutional Court (MK) due to the high volume of regional head election (pilkada) disputes, which has led to case backlogs, reduced legal efficiency, and increased state expenditures. Although institutions like Bawaslu and PTUN also have authority to resolve these disputes, many cases are submitted directly to MK, bypassing other mechanisms. Using a normative juridical method that includes legal analysis, historical context, comparative law, and case studies, the research evaluates previous dispute resolution practices and proposes a digitalization-based reform. Key challenges identified include procedural inefficiencies, high costs, and a lack of institutional coordination. The current system is viewed as suboptimal, with many disputes producing outcomes that fail to satisfy parties involved. To address these issues, the study proposes a digital platform aimed at streamlining the resolution process through integrated case registration, document submission, and inter-agency coordination. This system would reduce MK’s caseload, cut operational costs, and enhance transparency and accountability via real-time monitoring. By reinforcing the roles of Bawaslu and PTUN, the platform could help redistribute dispute resolution authority more effectively. The study concludes that digital transformation offers a viable solution to improve the efficiency, fairness, and cost-effectiveness of pilkada dispute resolution in Indonesia.
