Abstract

Capital punishment has long been used as a form of punishment for serious crimes, including corruption, with the aim of deterring and preventing offenses that harm the state and society. This study examines the impact of replacing the death penalty with life imprisonment in Indonesia’s new Criminal Code, particularly on efforts to eradicate corruption and its implications for law enforcement. The study employs a normative legal method, using legislative, conceptual, and comparative approaches to explore the historical application of the death penalty for corruption offenses, compare practices in countries such as China and Saudi Arabia that still enforce capital punishment, and analyze the policy shift in the Indonesian context. The findings indicate that replacing the death penalty may weaken its deterrent effect and increase the risk of corruption, especially if not supported by policies that strengthen law enforcement. Nevertheless, this change aligns with the principle of human rights protection, which is a key consideration in modern legal systems. This study recommends alternative measures such as asset forfeiture, the imposition of maximum fines, restrictions on political rights, and enhanced transparency and oversight to promote more effective and equitable anti-corruption policies.

Abstract

This study aims to analyze the factors hindering law enforcement in Indonesia through the perspective of Lawrence Friedman's legal system theory, which consists of legal structure, legal substance, and legal culture. The research employs a normative legal method with statutory and conceptual approaches. Data were analyzed from primary and secondary legal materials and correlated with relevant empirical practices. The findings reveal that the main obstacles to law enforcement lie in the lack of integrity and professionalism among law enforcement officials, inconsistencies in legal substance, and the generally low level of legal culture in society. Low legal awareness and a preference for informal dispute resolution further weaken the formal legal system. This study recommends structural reforms of law enforcement institutions and the enhancement of legal culture through legal education and consistent, fair law enforcement. Keywords: Legal Structure; Legal Substance; Legal Reform; Public Legal Awareness.

Abstract

In democratic governance, the Indonesian Constitutional Court and the United States Supreme Court serve as constitutional guardians, exercising judicial review within their respective legal traditions to uphold checks and balances and ensure the supremacy of the constitution. This study aims to compare the roles of the Indonesian Constitutional Court and the United States Supreme Court in implementing the principle of checks and balances through the judicial review mechanism. Using a normative juridical approach and comparative law methods, this study examines the institutional structure, scope of authority, and constitutional impact of the decisions of both institutions. The primary data sources include the constitutions of each country, specifically Article 24C of the 1945 Constitution and Article III of the United States Constitution, as well as Law Number 24 of 2003 concerning the Constitutional Court (in conjunction with Law Number 8 of 2011). The study shows that the United States Supreme Court has broader interpretive authority due to its common law tradition and the power of precedent, while the Indonesian Constitutional Court has limited authority within the context of a more normative civil law system. Differences in legal systems and institutional design affect the effectiveness of their oversight function.

Abstract

This study aims to analyze the effectiveness of applying the principle of meaningful participation in lawmaking in Indonesia, Switzerland, and Sweden The method used is normative juridical with a case study and comparative law approach. Data collection was conducted through a literature review of regulations, official documents, and related literature, which was then analyzed qualitatively using a descriptive-comparative framework. The novelty of this research lies in its functional comparative approach, which not only compares legal frameworks but also the practical implementation of the principle of participation in the legislative processes of each country. This study highlights the gap between formal regulations and substantive practices in Indonesia, and identifies best practices from Swiss referendum democracy and Swedish public consultation mechanisms. The results show that Indonesia still faces challenges in ensuring substantive public participation, which tends to be formal and limited without influencing the substance of regulations. In contrast, Switzerland implements direct democracy through referendums, and Sweden has developed transparent and structured public consultation mechanisms. However, the future prospects in Indonesia are quite positive, with increasing demands for transparency, technological advances, and the role of civil society opening up opportunities to develop more inclusive and effective public participation in law-making. In conclusion, although Indonesia is still limited in ensuring substantial public participation, the opportunities to improve participation mechanisms through transparency and technology are quite promising, leading to a more inclusive and influential system in law formation.

Abstract

Ideally, the formulation of laws in Indonesia should align with the principles of a state based on law, emphasizing justice, legal certainty, and utility. However, in reality, the legislative process is often influenced by political interests, weak public participation, and the poor quality of academic manuscripts that fail to support legal effectiveness. This study aims to analyze the weaknesses in the legislative procedure in Indonesia and to offer a more effective conceptual reconstruction so that legislative products truly reflect the will of the people and fulfill the principles of a state governed by law. This article falls under library research with a qualitative approach. The methodology employed is normative legal research. The findings indicate that the effectiveness of law in the legislative process has not yet been optimal due to ongoing political dominance, low-quality public participation, and weak academic foundations. Therefore, the reconstruction of the law-making process should focus on improving the quality of academic manuscripts, strengthening mechanisms for public participation, and consistently applying the principles of transparency and accountability.

Abstract

Penerapan konsep Environmental, Social, and Governance (ESG) telah menjadi tren global yang semakin memengaruhi arah kebijakan dan praktik bisnis perusahaan, termasuk di Indonesia. ESG tidak hanya menjadi instrumen keberlanjutan, tetapi juga membawa konsekuensi hukum yang signifikan terhadap tanggung jawab perusahaan dalam menjalankan kegiatan usahanya. Penelitian ini bertujuan untuk menganalisis implikasi hukum penerapan ESG terhadap tanggung jawab perusahaan, khususnya dalam konteks kepatuhan terhadap regulasi lingkungan hidup, perlindungan hak-hak sosial, serta penerapan prinsip tata kelola perusahaan yang baik. Metode penelitian yang digunakan adalah yuridis normatif dengan menelaah peraturan perundang-undangan yang relevan, seperti Undang-Undang Perseroan Terbatas, Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup, serta ketentuan pasar modal, ditambah dengan kajian literatur dan doktrin hukum. Analisis dilakukan secara kualitatif dengan pendekatan konseptual dan perbandingan. Hasil penelitian menunjukkan bahwa penerapan ESG memiliki implikasi hukum yang luas terhadap perusahaan, mulai dari peningkatan kewajiban kepatuhan hukum, perluasan tanggung jawab sosial dan lingkungan, hingga kemungkinan timbulnya tanggung jawab hukum apabila perusahaan lalai memenuhi standar ESG. Selain itu, penerapan ESG juga mendorong transformasi tata kelola perusahaan menuju praktik bisnis yang lebih transparan, akuntabel, dan berkelanjutan. Kesimpulannya, ESG bukan sekadar instrumen sukarela, melainkan telah berkembang menjadi kerangka normatif yang memengaruhi rezim tanggung jawab perusahaan di Indonesia. Rekomendasi penelitian ini adalah perlunya penguatan regulasi ESG secara komprehensif dan harmonisasi standar nasional dengan praktik internasional untuk memastikan perlindungan hukum yang efektif bagi masyarakat dan lingkungan.

Abstract

Hukum adalah seperangkat aturan yang berisi tentang perintah, larangan dan arahan yang bertujuan untuk melindungi hak-hak yang terdapat pada manusia, atau yang lebih sering disebut dengan Hak Asasi Manusia (HAM). Di Indonesia, secara konstitusional mengenai HAM juga telah ditegaskan di dalam UUD 1945 terkhusus di dalam Bab XA UUD 1945. Pada dasarnya, salah satu hal yang penting yang akan diatur dan ditegaskan di dalam konstitusi di semua negara yang ada di dunia adalah mengenai perlindungan HAM terhadap warga negaranya. Sejarah dan gejolak HAM di Indonesia sudah sangat Panjang, terhitung sejak awal Indonesia merdeka hingga reformasi saat ini. Awal mula perhatian serius terhadap penegakan HAM di Indonesia adalah pasca jatuhnya Orde Baru, dimana tidak lama setelah jatuhnya rezim tersebut dibentuklah Undang-Undang Nomor 39 Tahun 1999 Tentang Hak Asasi Manusia. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini yakni mengenai Hak Asasi Manusia. Hasil dari penelitian ini akan mengkaji keberadaan hukum yang ada di tengah-tengah masyarakat dalam konteks Hak Asasi Manusia.

Abstract

This study aims to analyze freedom of association and assembly from a human rights perspective, and explore the challenges faced in its implementation in various countries. The scope of the study includes a review of various cases of violations of the right to freedom of association and assembly, both in countries with democratic and authoritarian systems. In addition, this study will also discuss the role of international organizations and civil society in promoting and protecting these rights. This study will not only discuss the theory and basic principles of freedom of association and assembly, but will also dig deeper into how these rights are implemented in practice, the challenges faced, and steps that can be taken to strengthen the protection of these freedoms throughout the world. This study is expected to make a significant contribution to understanding the complexity of freedom of association and assembly and its impact on human rights as a whole. This study uses a qualitative approach with a case study design. The qualitative approach was chosen because it allows researchers to dig deeper into freedom of association and assembly in the context of Human Rights (HAM).

Abstract

Perbedaan perlakuan di depan hukum masih terjadi, misalnya pada dua kasus pembelaan diri yang dialami oleh MIB dan ZA. Satu kasus dihentikan oleh kepolisian, sedangkan pada kasus lainnya tidak dijadikan sebagai pertimbangan hukum. Pada Putusan Nomor 1/Pid.Sus-Anak/2020/PN.Kpn, persoalan tindakan pembelaan diri dalam perspektif persamaan di hadapan hukum, serta proses penyelesaiannya melalui keadilan restoratif menjadi bermasalah. Metode penelitian yang digunakan merupakan jenis penelitian normatif dengan pendekatan perundang-undang dan kasus. Hasil analisis menunjukkan bahwa perbedaan proses hukum dalam kasus pembelaan diri yang dialami oleh MIB dan ZA tidak mencerminkan adanya persamaan di hadapan hukum. Intervensi terhadap salah satu kasus, yakni kasus MIB dan adanya klasifikasi tertentu yang ditetapkan dalam Surat Edaran Kapolri Nomor SE/8/VII/2018 dan Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 menyebabkan upaya keadilan restoratif tidak dapat dijalankan pada proses penyidikan dan penuntutan di kasus ZA. Hal ini juga ditambah dengan penafsiran hakim yang keliru terhadap unsur pembelaan diri ZA, yang tidak mempertimbangkan ancaman pelecehan dan pemerkosaan terhadap kekasih ZA. Upaya mengakomodir keadilan restoratif melalui Putusan Nomor 1/Pid.SusAnak/2020/PN.Kpn merupakan upaya terakhir yang dapat dilakukan oleh pengadilan dalam proses peradilan. Tindakan pembelaan diri yang dilakukan oleh seseorang seharusnya dapat menerapkan konsepsi keadilan restoratif. Namun, hal tersebut masih belum dapat diterapkan sepenuhnya dan secara komprehensif.

Abstract

Indonesia continues to experience persistent territorial disparities as a result of the long-standing application of symmetric decentralization, under which uniform administrative standards are imposed on regions with fundamentally different structural capacities. This approach has contributed to chronic governance underperformance and spatial injustice. The resulting mismatch between regional heterogeneity and policy uniformity underscores the need for a conceptual reorientation grounded in normative theories of justice and constitutional principles. This article aims to develop a coherent framework for asymmetric regional development capable of addressing structural inequalities while remaining consistent with the constitutional architecture of the Unitary State. Using a normative legal research approach that combines statutory analysis with case studies of Aceh, Papua, and Yogyakarta, this study investigates how asymmetric arrangements can be operationalized as both legally legitimate and philosophically justified governance models.The article presents four key contributions: first, it reconceptualizes asymmetric regional development as an ethical and constitutional imperative, grounded in Rawlsian distributive justice, Sen’s capability approach, and contemporary spatial justice theory; second, it highlights the policy pitfalls of symmetric decentralization through a critical assessment of historical and empirical evidence, including failures in regions such as Malaka; third, it introduces the Regional Inclusion Feasibility Index (IKPD) as a juridical and technocratic innovation, providing objective, multidimensional criteria for regional expansion; and fourth, it situates Indonesia’s asymmetric model within global comparative practices, demonstrating its alignment with principles of proportional autonomy and contextual justice. Collectively, these contributions position asymmetric regional development as a viable pathway toward equitable and sustainable territorial governance in Indonesia.
