Abstract

Pengabdian masyarakat ini dilakukan dengan memberikan edukasi mengenai kesehatan mental kepada warga binaan di Lembaga Pembinaan Khusus Anak (LPKA) Kelas II Karangasem. Manfaat yang dapat diberikan kepada warga binaan yakni agar meningkatkan pengetahuan warga binaan mengenai kesehatan mental dan agar kedepannya mereka mampu untuk menghadapi masalah-masalah dan tidak mengulangi perbuatan yang bertentangan dengan hukum.  Metode yang digunakan dalam pengabdian masyarakat ini adalah metode pendidikan terhadap masyarakat khususnya warga binaan. Metode pendidikan ini dilakukan dengan cara memberikan edukasi dan sosialisasi dengan tema “Socialization Of Crime And Mental Health For A Better Younger Generation”.

Abstract

Marriage in Balinese customary law is known as pawiwahan or wiwaha. Marriage in national law is regulated in Law Number 1 of 1974. The biggest problem in marriage is divorce which ends in conflict over property, both congenital and collective assets. Preventive action to prevent the above problems is by making a marriage agreement. This research focuses on normative legal research type that puts emphasis on the vagueness of norms in the marriage law regarding marriage agreements and explores more clearly the form and content of the marriage agreement in Balinese customary law. The result of this research is a form of marriage agreement, which is a written agreement made and legalized by a notary before the marriage is conducted. The contents of the marriage agreement include the classification of inherited and joint assets of the parties. In the making of this marriage agreement, good consequences are considered legally, psychologically, sociologically and culturally by the existence of this marriage agreement legal action. Perkawinan dalam hukum adat Bali dikenal dengan istilah pawiwahan atau wiwaha. Perkawinan dalam hukum nasioan diatur dalam Undang-Undang Nomor 1 Tahun 1974. Permasalahan terbersar dalam perkawinan yaitu perceraian yang berujung dengan konflik perebutan harta benda baik itu bawaan ataupun harta bersama. Tindakan preventif untuk mencegah terjadinya permasalahan diatas yaitu dengan dibuatnya perjanjian perkawinan. Penelitian ini akan berfokus pada jenis penelitian hukum normatif (normative legal research) yang menitik beratkan adanya kekaburan norma dalam undang-undang perkawinan mengenai perjanjian perkawinan serta mengulik lebih jelas bagaimana bentuk dan isi perjanjian perkawinan dalam hukum adat Bali. hasil dari riset ini yaitu bentuk perjanjian perkawinan yaitu perjanjian tertulis yang dibuat dan disahkan oleh notaris yang dibuat sebelum melangsungkan perkawinan. Isi dari perjanjian perkawinan antara lain pengkalsifikasian harta benda bawaan dan harta bersama para pihak. dalam pembuatannya perjanjian perkawinan ini tentunya ada akibat-akibat baik secara hukum, psikologis, sosiologis dan budaya dengan adanya perbuatan hukum perjanjian perkawinan ini

Abstract

Intensitas  tingginya  jumlah  angka  kecalakan   di  masyarakat  setiap  tahunnya  membuat  pemerintah  melakukan  upaya  pencegahan  dalam pengurangan  angka kecelakaan  yang  terjadi  dengan  adanya  kegiatan  sosislisasi  dilakukan  oleh  PT  Jasa  Raharja dalam  pelopor  keselamatan  berkendara  mangajar  generasi  muda  dalam  lebih  hati  - hati  dalam berkendara. Kemajuan  jaman  membuat tingginya  volume  kendaraan di  jalan  raya  yang  menimbulkan  kemacetan.  Serta  kesadaran  akan  pengguna  jalan  sangat  minim  banyaknya  pelanggaran  yang  terjadi  di  masyarakat pelanggaran  batas  usia minimal  berkendara  di  jalan.  Permaslahan  Bagaiamana  penerapan berlalu  lintas  di  jalan  raya  ? Bagaimana  hambatan  yang  di  jumpai  ?  Peningkatan  Keselamatan  berlalu  lintas  di  jalan  raya di sini a danya  harapan  generasi  muda  paham  akan  aturan  berkendara  UULLAJ  sehingga  bisa mengurangi  angka kematian  dan  kecelakaan.

Abstract

Penelitian ini bertujuan untuk mengetahui serta memahami urgensi pengaturan AI dalam UU Hak Cipta di Indonesia serta potensi AI sebagai subjek hukum dalam sistem hukum di Indonesia, Penelitian ini menggunakan metode penelitian normative serta menggunakan pendekatan perundang-undangan atau statue approach serta pendekatan perbandingan atau comparative approach. Adapun rumusan masalah dalam penelitian ini adalah Apa urgensi pengaturan artificial intelligence dalam rezim hukum hak cipta di Indonesia? Dan Bagaimanakah potensi artificial intelligence sebagai subjek hukum dalam sistem hukum di Indonesia ? Dalam penelitian ini menemukan bahwa dalam UUHC Indonesia tidak mengenal AI sebagai subjek hukum, sehingga AI berdasarkan pada UUHC Indonesia tidak dapat digolongkan sebagai pencipta serta potensi AI untuk diakui sebagai entitas baru berkaitan dengan subjek hukum selain manusia dan badan hukum yang sebelumnya telah diakui sebagai subjek hukum di Indonesia sangat terbuka, mengingat AI dapat dipersamakan dengan badan hukum sesuai dengan teori-teori badan hukum serta adanya konsep Work Made For Hire yang terdapat dalam UUHC Amerika Serikat yang dapat diadopsi oleh Indonesia untuk mengakomodir AI sebagai suatu entitas baru berkaitan dengan subjek hukum yang diakui di Indonesia.  Kata Kunci: Kecerdasan Buatan, Hak Cipta, Subjek Hukum This study aims to determine and understand the urgency of AI regulation in the Copyright Law in Indonesia as well as the potential of AI as a legal subject in the legal system in Indonesia, This study uses normative research methods and uses a statutory approach or statue approach and a comparative approach. Abstract

This study explores the impact of educational visits to Jungle Pod Chocolate and Secret Garden Village on participants' understanding and appreciation of the chocolate industry and sustainability practices. Through a qualitative approach involving participatory observation and in-depth interviews, this research reveals a significant increase in participants' knowledge about the chocolate-making process, from cocoa beans to the final product, and their awareness of sustainability. The visit outcomes indicate a positive change in participants' perception of chocolate, encouraging them to support more responsible and sustainable practices. Thus, this study highlights the importance of direct educational initiatives in raising awareness and inspiring a change in attitude towards more ethical and sustainable chocolate consumption, while recognizing the contribution of various parties that made this educational experience valuable. This research provides important insights for chocolate producers, educators, and other stakeholders about the effectiveness of educational visits as a tool to promote sustainability and ethics in the chocolate industry.

Abstract

Legal obligation is an action that must be done by someone. Every action taken is a form of a sense of responsibility for the problems that are happening, be it legally or morally. Therefore, obligations will always be attached to human life in carrying out social activities. Rules regarding the obligation for fiduciary recipients to carry out fiduciary write-offs (roya) if the agreed debt has been paid off, but it is also necessary to know about the legal consequences if the obligation to write-off (roya) fiduciary guarantees is not carried out, it can result in losses for the fiduciary giver. In this case the problem arises "What are the legal consequences for not carrying out the elimination of (roya) fiduciary guarantees after the credit is paid off. The research method used is a juridical-normative type of research that places law as a system of norms in studying and analyzing the legal consequences of not eliminating (roya) fiduciary guarantees. The type of approach used is the statutory regulation approach and the legal concept analysis approach. The results of the discussion review related to the legal consequences of not carrying out the elimination (roya) of fiduciary guarantees found no strict rules regarding this matter, both in Law no. 42 of 1999, PP no. 21 of 2015, Permenkumham No. 9 of 2013, and Permenkumham No. 10 of 2013, because the things that are regulated are still limited to the obligation to remove (roya) fiduciary guarantees, so there is no threat of punishment or legal sanctions for violators. Meanwhile, legal remedies that can be taken by fiduciary providers who suffer losses due to the actions of fiduciary recipients who are negligent in carrying out the fiduciary guarantee elimination (roya) are by filing a lawsuit against the law (PMH).

Abstract

This study aims to examine the historical and cultural aspects of Sad Kerthi as a legal terminology that is part of the traditional knowledge of indigenous people in Bali, one of Indonesia’s culturally richest provinces. The recognition and respect for indigenous communities have been a significant topic outlined in Article 18B paragraph (2) of the 1945 Constitution. This Article underpins legislations and regulations aimed to empower indigenous communities to exercise self-governance in their social context within the framework of the contemporary globalised society. By using socio-legal research methods with a statute approach and legal facts, this research finds that the lack of a legal definition of Indigenous people adversely impacts the self-determination of Indigenous people in Indonesia. At the same time, the common problems faced are not unequivocal, by considering Bali, Sad Kerthi as local wisdom is incorporated in Bali Province Act 15/2023. This legislation is further broken down into local regulations that allow Balinese communities to preserve their social structures and self-determination in everyday activities. Based on legal evidence collected from three different types of customary villages in Bali, which are Baliaga, Apanage, and Anyar, the indigenous communities in each of these traditional villages are autonomous and enjoy specific privileges maintained since their ancestors.

Abstract

The administration of regional property via usage programs constitutes a source of regional financial Revenue. The administration of regional property is governed by Government Regulation Number 1 of 2014 about the Management of State/Regional Property, subsequently supplemented by Regulation of the Minister of Home Affairs Number 19 of 2016 on the Management of Regional Property. Nonetheless, the regulation of the regional property (Barang Milik Daerah/BMD) sector encounters numerous challenges, particularly regarding the coordination required between the Minister of Home Affairs and the Minister of Finance in developing general and technical policies on regional property, which remains suboptimal. Consequently, the Minister of Home Affairs Regulation Number 19/2016 remains inadequate as a regional reference for formulating Regional Regulations/Regulations of Regional Heads, leading many to directly consult the Minister of Finance, which governs State Property. According to the description above, the subsequent challenges are articulated: Issues in regulating the regional property sector at both central and regional levels. Format for the Reorganization of the Central Regulation of the Regional Public Property Sector. Normative (legal) research methodologies, including statutory, conceptual, and case approaches, are employed to analyze the problem formulation. Findings from this research: Regulatory issues arise from a lack of alignment among ministries in coordinating efforts. The Minister of Home Affairs reports to the Coordinating Minister for Political, Legal, and Security Affairs, whereas the Coordinating Minister for the Economy oversees the Minister of Finance. The organization of rules involves distinguishing between Government rules for state property and regional property, necessitating cross-sectoral harmonization throughout their formulation. This must be accomplished due to the control of regional property under many laws, necessitating harmonization in formulating technical regulations at the governmental level, along with heightened care. Recent legislation must be modified to align overarching policies and their technical execution.

Abstract

The aim of this study is a fundamental part of Indonesia's state structure, as it has existed since Indonesia's independence and has been recognized within the legal framework. This recognition is enshrined in Article 18B of the 1945 Constitution and reinforced by Law No. 6 of 2014 on Villages. In Bali, customary law communities, known as krama desa, have special rights, including autonomous governance over local affairs. This study focuses on the autonomy of customary villages in Bali, particularly in resolving customary disputes. The study method used is normative legal research with a legislative approach, analyzing the legal provisions governing customary villages and their dispute resolution mechanisms. The novelty of this research contributes to the discourse on legal certainty and justice for customary law communities by clarifying the extent of the authority of customary villages in resolving customary law violations. The results of the study indicate that customary villages in Bali have legal authority to resolve customary law violations, as stipulated in Article 104(d) of the Village Law and Article 24(l) of the Bali Customary Village Regulation. This affirms their role in maintaining order through customary law traditions. In conclusion traditional villages in Indonesia, including in Bali, are constitutionally recognized and granted autonomy in governance and dispute resolution. To enhance legal certainty, traditional villages should establish clear procedural guidelines (awig-awig) for resolving disputes through traditional deliberative assemblies (paruman adat). This approach can ensure justice while maintaining environmental and social harmony within the customary legal system.

Abstract

Increasing the number of accidents every year in Indonesia has forced the government to make efforts to reduce the number of accidents that result in the loss of someone's life. The government, by using the Safety Riding method in driving on the highway, hopes to reduce the number of accidents that occur in the community by paying attention to completeness and safety in traffic on the highway. As for the problems that arise, how is Safety Riding implemented in rescue efforts in society? The aim of community service is through socialization carried out by the community, especially the younger generation, to be able to have awareness of driving on the highway by remembering the importance of safety for themselves and others as well as feeling safe and comfortable when driving. The use of Safety Riding cannot be separated from the role of the Government, Companies and the community in forming synergy in efforts to save traffic. The implementation of Safety Riding is present in society to prevent the number of accidents so that UULLAJ is implemented as a suggestion for legal protection in society.
