Abstract

This study examines the role of local ecological wisdom as an alternative model for sustainable development amid the dominance of modern industrialization, which often leads to environmental degradation and social inequality. The research adopts a qualitative approach using a literature-based study design, combining conceptual analysis with a political ecology perspective to explore the relationships among industrialization, power dynamics, and natural resource governance. The findings indicate that local ecological wisdom embedded in indigenous communities—such as customary norms, conservation traditions, and community-based resource management systems—plays a significant role in maintaining ecological balance, strengthening social cohesion, and preserving cultural identity. Integrating local wisdom into development policies is therefore considered relevant for mitigating the negative impacts of industrialization and promoting more just, inclusive, and sustainable development. This study provides analytical and normative contributions to the discourse on sustainable development and environmental governance rather than generalizable empirical conclusions.

Abstract

Penelitian ini bertujuan untuk mengkaji bagaimana disinformasi digital memengaruhi pembentukan kesadaran hukum ideal dalam masyarakat, ditinjau dari perspektif normatif Soerjono Soekanto. Kajian ini berupaya menjelaskan bagaimana penyebaran informasi hukum yang keliru dapat melemahkan pengetahuan, sikap, dan perilaku hukum masyarakat, serta menawarkan strategi normatif-sosiologis untuk membangun kembali kesadaran hukum di era digital. Penelitian ini menggunakan pendekatan kualitatif dengan metode hukum normatif-sosiologis (socio-legal research). Data diperoleh dari sumber sekunder yang mencakup bahan hukum primer, karya-karya Soerjono Soekanto tentang kesadaran hukum, serta literatur akademik relevan. Analisis data dilakukan melalui tahapan reduksi, klasifikasi, interpretasi teoretis, dan analisis normatif-sosiologis. Hasil penelitian menunjukkan bahwa disinformasi digital melemahkan tiga komponen utama kesadaran hukum, yaitu pengetahuan, sikap, dan perilaku hukum. Kondisi ini menurunkan tingkat kepercayaan publik terhadap hukum dan lembaga penegak hukum, sekaligus menormalkan tindakan menyimpang di ruang digital. Penelitian ini menegaskan bahwa pembentukan kesadaran hukum ideal memerlukan strategi terpadu yang mencakup penguatan literasi hukum dan digital, transparansi kelembagaan, serta partisipasi aktif masyarakat. Hasil penelitian ini memberikan kontribusi konseptual dan praktis bagi pembuat kebijakan, pendidik hukum, dan pengelola platform digital dalam merancang model pendidikan dan komunikasi hukum yang efektif. Penelitian ini menawarkan integrasi baru antara teori normatif kesadaran hukum Soerjono Soekanto dengan fenomena kontemporer disinformasi digital. Pendekatan ini menjembatani pemikiran klasik sosiologi hukum dengan tantangan era informasi.

Abstract

This study aims to analyze the integration of local wisdom and the principle of substantive justice in the financing practice of Musyarakah Mutanaqisah (MMQ) in Bankaltimtara Syariah, East Kalimantan. The central problem is the empirical-normative gap between formal sharia compliance (Sharia Compliance) and the effectiveness of integrating local wisdom (deliberation, cooperation) as an instrument of social law. Using a socio-legal approach (sociological jurisprudence with a descriptive qualitative method), this study is supported by the triangulation of data from in-depth interviews, observations, and document studies. The theoretical significance confirms that Islamic banking practices operate within a legal pluralist framework, demonstrating that the integration of local wisdom serves as a social mechanism of compliance, thereby strengthening the legitimacy of Islamic law. Results show that the integration of local values has been proven to strengthen customer compliance and realize distributive justice through proportional risk sharing and contract transparency. Substantive justice is achieved through dialogue-based dispute resolution and flexible payment options. Effective MMQ governance requires an adaptive and contextual model that prioritizes the principles of raḥmah and adl, ensuring the well-being of customers (hifz al-nafs and hifz al-māl) and the sustainability of partnerships, going beyond formal compliance.

Abstract

Revolusi Industri 1.0 menandai perubahan besar dalam struktur produksi dan ekonomi dunia yang menjadi momentum penting dalam pembentukan sistem hukum perikatan. Sejarah hukum perikatan bermula dari aturan perjanjian bangsa Ibrani dan berkembang pesat melalui hukum Romawi, yang menjadi dasar banyak tradisi hukum perdata modern. Era Revolusi Industri 1.0 membawa mekanisasi dan produksi massal, menciptakan kebutuhan terhadap regulasi kontrak yang lebih kompleks dalam perdagangan global. Artikel ini menggunakan pendekatan historis dan sosiologi hukum untuk menelaah evolusi sistem hukum perikatan dari akar awal hingga pembentukan sistem modern yang mengakomodasi dinamika bisnis internasional. Sistem hukum ini memberikan kepastian hukum yang penting bagi pelaku bisnis dan mendukung perluasan perdagangan lintas negara. Kepastian hukum tersebut memfasilitasi integrasi pasar global dan perkembangan ekonomi internasional. Kesimpulannya, Revolusi Industri 1.0 adalah fondasi utama evolusi hukum kontrak perdagangan modern yang terus beradaptasi dengan globalisasi dan kompleksitas hubungan bisnis internasional.

Abstract

Abstract Corporate environmental responsibility (CER) is an increasingly significant concept in the modern era, especially in Indonesia, which has abundant natural resources but is vulnerable to exploitation. CER is not only understood as a legal and ethical obligation, but also as a new paradigm that places ecological awareness at the core of business activities. This study aims to analyse a model of corporate environmental responsibility based on ecocentric principles that emphasise balance and harmony between humans and nature. The ecocentric approach requires corporations to go beyond a profit-only orientation by considering the social and environmental impacts of their operational activities. Through normative analysis and case studies in the mining and plantation sectors in Indonesia, this study explores how ecocentric values can be integrated into sustainable business strategies. The results show that the implementation of ecocentric CER has the potential to enhance corporate reputation, strengthen social relations with local communities, and support sustainable environmental conservation. Furthermore, the effectiveness of CER implementation is greatly influenced by government policies and regulations, such as incentives for the application of environmentally friendly technologies and the enforcement of sanctions for environmental violations. Collaboration between the government, corporations, and the community is key to building a business ecosystem that is ecologically just and oriented towards sustainability. In conclusion, CER is not only a moral responsibility, but also a business strategy that is adaptive to market demands and global awareness of environmental issues. Integrating ecocentric values into corporate governance is a strategic step in realising sustainable development that is in line with the principles of ecological justice and shared prosperity. [Tanggung jawab lingkungan korporasi (CER) merupakan konsep yang semakin penting di era modern, terutama di Indonesia yang kaya akan sumber daya alam namun rentan terhadap eksploitasi. CER tidak hanya dipahami sebagai kewajiban hukum dan etika, tetapi juga sebagai paradigma baru yang menempatkan kesadaran ekologis sebagai inti dari aktivitas bisnis. Studi ini bertujuan untuk menganalisis model tanggung jawab lingkungan korporasi berdasarkan prinsip-prinsip ekosentris yang menekankan keseimbangan dan harmoni antara manusia dan alam. Pendekatan ekosentris mengharuskan perusahaan untuk melampaui orientasi profit semata dengan mempertimbangkan dampak sosial dan lingkungan dari aktivitas operasional mereka. Melalui analisis normatif dan studi kasus di sektor pertambangan dan perkebunan di Indonesia, penelitian ini mengeksplorasi bagaimana nilai-nilai ekosentris dapat diintegrasikan ke dalam strategi bisnis berkelanjutan. Hasil penelitian menunjukkan bahwa implementasi CER ekosentris berpotensi meningkatkan reputasi korporasi, memperkuat hubungan sosial dengan komunitas lokal, dan mendukung konservasi lingkungan yang berkelanjutan. Selain itu, efektivitas implementasi CER sangat dipengaruhi oleh kebijakan dan regulasi pemerintah, seperti insentif untuk penerapan teknologi ramah lingkungan dan penegakan sanksi terhadap pelanggaran lingkungan. Kerja sama antara pemerintah, korporasi, dan masyarakat merupakan kunci dalam membangun ekosistem bisnis yang adil secara ekologis dan berorientasi pada keberlanjutan. Kesimpulannya, CER bukan hanya tanggung jawab moral, tetapi juga strategi bisnis yang adaptif terhadap permintaan pasar dan kesadaran global terhadap isu lingkungan. Mengintegrasikan nilai-nilai ekosentris ke dalam tata kelola korporasi merupakan langkah strategis dalam mewujudkan pembangunan berkelanjutan yang sejalan dengan prinsip keadilan ekologis dan kemakmuran bersama.]

Abstract

Penelitian ini bertujuan untuk menganalisis karakteristik regulasi adaptif di Indonesia dan Jepang dalam konteks perkembangan teknologi di era Revolusi Industri 5.0, sambil mengidentifikasi model regulasi yang berpotensi diterapkan dalam sistem hukum Indonesia. Metode penelitian menggunakan pendekatan hukum normatif dengan tiga pendekatan utama, yaitu pendekatan legislatif, pendekatan konseptual, dan pendekatan komparatif. Pendekatan legislatif digunakan untuk mengkaji kerangka hukum digital di kedua negara, sementara pendekatan konseptual bertujuan untuk membangun landasan teoretis mengenai regulasi adaptif, regulasi netral teknologi, Society 5.0, dan regulasi responsif. Pendekatan komparatif digunakan untuk menilai kesamaan dan perbedaan antara regulasi adaptif Indonesia dan Jepang dalam hal fleksibilitas kebijakan, kecepatan adaptasi, dan pola kolaborasi pemerintah-industri. Hasil penelitian menunjukkan bahwa Jepang telah menerapkan model regulasi adaptif yang proaktif, prediktif, dan berorientasi pada tata kelola berpusat pada manusia melalui berbagai kebijakan seperti Undang-Undang Sandbox Regulasi dan Pedoman Tata Kelola Kecerdasan Buatan. Sementara itu, Indonesia masih menghadapi tantangan berupa regulasi reaktif, kesenjangan literasi digital, dan kapasitas birokrasi yang terbatas. Namun, Indonesia memiliki peluang besar untuk mengembangkan regulasi adaptif melalui penguatan institusi, peningkatan literasi digital, pembentukan regulatory sandboxes, dan integrasi nilai-nilai Pancasila serta kearifan lokal dalam formulasi kebijakan digital. Studi ini menyimpulkan bahwa kesuksesan regulasi adaptif tidak hanya ditentukan oleh kesiapan teknologi, tetapi juga oleh kualitas tata kelola hukum, partisipasi publik, dan keberlanjutan nilai-nilai manusia dalam kebijakan.

Abstract

This study aims to; first, identify the problems and needs of the East Kalimantan Province in an effort to implement regional autonomy. Second, to formulate a regional autonomy policy model based on the fulfillment of regional and territorial needs in East Kalimantan Province. The research method used is sociological legal research (empirical juridical). Where the research location is at the East Kalimantan Provincial Government office and the East Kalimantan Provincial DPRD located in Samarinda city. The types and sources of data used are primary data and secondary data. The primary data collection techniques are interviews and public discussion forums or FGDs with related apparatus. Literature study to complement secondary data and data analysis in this study is classified as qualitative with deductive inference. The impact of the implementation of regional autonomy has an impact on the determination of regional policies in responding to all the problems that arise so that a regional autonomy implementation strategy is needed in accordance with the needs of the region and the conditions of the region. Regional autonomy must be in accordance with regional needs so that it has an impact on regional independence, community welfare, justice in terms of natural resource management, regional financial capacity and environmental damage, democracy and upholding human rights in accordance with the constitution and equity in terms of economy and infrastructure.

Abstract

Economic development will develop quickly if a green economic system is adopted. a green economic system that is oriented towards the relationship between ecosystem nature and the presence of human resource elements by prioritizing knowledge and technology. Changes in the economy from previously only about profit and welfare to a green economy that has environmental principles. Samarinda, as a supporting city for IKN, is one of the cities in East Kalimantan Province which is the center of attention for rice competitions. It cannot be denied that many immigrants who come do not bring the skills to become PMKS in Samarinda City. Referring to the principles of a green economy, namely prioritize quality, follow nature, waste can be recycled etc. The problem formulation of this research is regarding the legal arrangements for handling and handling empowerment people with social welfare problems in the form of policing in green spaces and what form of policy the Samarinda City Government takes in empowering people with social welfare problems through a green economy approach that prioritizes a livable city structure. The aim of this research is to find out legal regulations from an administrative and criminal perspective even civil law due to the relationship between the Samarinda City Government and the Community Incumbent Social Welfare Issues. Apart from that, to analyze the policy formulation of the Samarinda City government which prioritizes structuring room cities to reduce the risk of environmental damage. The conclusion of this research is that in terms of the legal structure it is adequate, where the Samarinda City Social Service is to assist in terms of empowerment while the Satpol-PP is tasked with carrying out handling. Substance the law is still there Not yet adequate, one of which is that the old regional regulations are still used and there are no guardians. Abstract

Meaningful participation in lawmaking can be understood as important input or suggestions to ensure the validity and relevance of legal products. The idea of meaningful participation emphasizes the importance of the community's role in the law-making process, especially in the formation of ideal local regulations (Perda) to support the implementation of regional autonomy. This research aims to examine the application and implications of meaningful participation in the formation of ideal local regulations, using a juridical-normative approach through three approaches: 1) statutory approach, by examining relevant regulations; 2) conceptual approach, by examining the values contained in the underlying legal concepts. This research uses primary, secondary, and tertiary legal materials to produce an ideal local regulation model in the implementation of regional autonomy. The results show that meaningful community participation is a crucial element in creating local policies that are inclusive, transparent, and responsive to community needs. The process of local regulation formation must substantially involve the community, expand public participation mechanisms, and increase transparency and the role of the legislature. Thus, meaningful participation will strengthen the legal and social legitimacy of regulations, and support the creation of democratic and accountable regional autonomy. The formation of ideal local regulations not only ensures the achievement of effective and transparent governance, but also strengthens public trust in local governments. Public participation is not just a procedure, but must be understood as the core of democracy that emphasizes the right of the people to be heard, considered, and explained for the decisions taken.
