Abstract

ABSTRACT Basically, same with the civil settlement in the District Court, peace in thesettlement of bankruptcy cases is required to be implemented. The article of130 of HIR / 154 HIR concerning the obligation to reconcile the two sides havebeen concreted through Perma No 1, year 2016. However, this Perma can’t beapplied to the settlement of bankruptcy cases in the Commercial Court. This study want to know the juridical reasons the peace achieved through Mediation In Court based on Perma no. 1 of 2016 can’t be applied in the settlement of bankruptcy disputes in the Commercial Court and the juridical consequences that distinguish between the peace achieved through mediation in Court and the bankruptcy proceedings and PKPU related to certainty as the purpose of law Peace institutions through Perma No1, year 2016 pursued by means of mediation can not be applied to bankruptcy cases because bankruptcy is included in the volunteer domain whereas mediation in court is implemented in contentiosa case. Therefore, peace in the settlement of bankruptcy cases can’t be executed at the beginning of the investigation of bankruptcy cases in the Commercial Court, as new peace can be applied if the debtor's status is clear as a bankrupt party. Although mediation can’t be implemented in order to achieve peace in the bankruptcy case in the Commercial Court, the concept of a win-win solution remains in the implementation of peace in the Commercial Court is apeace that can provide balanced benefits for both parties as business actors.Keywords: bankruptcy, peace, win-win Solution

Abstract

One of the absolute competencies of the Religious Court revolves around resolving sharia economy disputes. Quick, simple and inexpensive principles of the court must persist within Religious Court procedures, such as in sharia economy disputes relating to business disputes as regulated in Supreme Court Decree No. 14 of 2016 on Procedures in Sharia Economic Disputes. The solution in this way should be able to speed up commercial Shia dispute, but in fact, various obstacles were found. This article reviews the resolution of sharia economy disputes in Religious Court within the perspective of Small Claims Court implied through SC Decree No. 14 of 2016, along with the possible issues of Small Claims Court in Religious Court procedures. This research was conducted with a normative approach. Juridically SC Decree No. 14 of 2016 conforms with SC Decree No. 2 of 2015, now replaced with SC Decree No. 4 of 2019, permits parties to resolve certain nominal claims through a quicker dispute settlement procedure. Judges participate actively throughout the dispute resolution as Small Claims Court provides flexible interaction within formal courts. In practice, limitations such as the amount of sharia economy certified judges show that sharia economy cases are better resolved through standard procedure within the Civil Court. Other limitations, such as the insufficient electronic court (e-court) systems, limit dispute resolution capacity with further substantial limitations such as executorial clauses that are not yet regulated and can take more than 25 (twenty-five days).

Abstract

One of the alternatives to renew the law is by forming regulations and the litigation institutions that can accommodate the society. In private litigation proceeding, manifestation of ideas in litigation reform can be seen through by the Supreme Court Regulation (PerMA) No. 2 Year 2015. This fast procedural mechanism is called small claims court (SCC). This article discusses the effectiveness of SCC implementation in Indonesia as one of the states that enacts civil law system, and its regulation in order to renew civil law procedures. Research methodology used juridical-normative while the results show that SCC is effectively enacted in Indonesia. The prevailing regulation currently in PerMA is to fill the gap of law, considering that the legislation process takes time to establish an act. Thus, it is best for Indonesia to establish SCC within a certain act in the future, to pursue the unification of law within the regime of private law procedures.Keywords : effectiveness, civil law, small-claims court, renewal of law

Abstract

Berinvestasi di pasar modal dalam bentuk saham merupakan salah satu pilihan investasi. Investasi saham menjadi alternatif pembiyaan bagi perusahaan di tanah air, khususnya perusahaan terbuka di pasar modal, namun berinvestasi di pasar modal dalam bentuk saham selain memberikan peluang keuntungan juga memiliki resiko antara lain kepailitan, khususnya bagi para investor yang berinvestasi pada perusahaan terbuka yang mengalami pailit. Abstract

Komisi Pengawas Persaingan Usaha adalah suatu lembaga khusus yang dibentuk berdasarkan Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat untuk menegakkan hukum persaingan usaha. Tidak berkedudukan sebagai 'lembaga penegak hukum' yang sesungguhnya menyebabkan KPPU tidak memiliki daya paksa dalam hal pemanggilan para pihak maupun dalam pelaksanaan eksekusi. Selain itu, banyaknya putusan KPPU yang dibatalkan dalam proses upaya huku (yang disebut sebagai keberatan) yang diajukan pihak pelanggar pada akhirnya menyebabkan tidak terciptanya kepastian hukum bagi para pihak. Tulisan ini berupaya memperlihatkan gambaran pelaksanaan putusan persaingan usaha dalam praktik dalam tinjauan Undang-Undang Nomor 5 tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat serta mengindentifikasi kendala-kendala dan upaya dalam penegakkan hukum persaingan usaha di Indonesia agar tercipta kepastian hukumThe Problem of Law Enforcement in Business Competition in Establishing Legal CertaintyAbtractThe Commission for the Supervision of Business Competition (Komisi Persaingan Usaha) is a special institution established by Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Competition for enforcing competition law. Not functioning as a 'law enforcement agency' has led to KPPU to have no power to either forcibly summon the parties or execute its decisions. Moreover, a lot of KPPU's decisions are cancelled due to further legal action filed by the offender and thus undermining the legal centainty for the parties. The purpose of this article is to seek and analyze the enforcement of KPPU's decision in disputes regarding monopolistic practices and unfair competition as regulated in Law Number 5 of 1999. Abstract

The fast litigation procedure stipulates under the Supreme Court Regulation No. 2 year of 2015. That mechanism only requires small amount of permitted claim, it is 200 million Rupiah in maximum, it also settles claims in a very fast manner, 25 days in maximum. This fast procedural mechanism allocated to settle private dispute is called as “the small claims court”, in which, it is already implemented either in states with the civil law system or the common law system. The research methodology used in this article is juridical-normative and juridical kualitative analyze, to aim the SCC phisophy in Indonesia and the effectivity in enacting this mechanism of small claims court as one of the states that enact the civil judicial system. The results shows that the SCC  in indonesia is an advancement as a means of access to justice, in short it is a simple and inexpensive procedure.  that the fast litigation procedure stipulates under the Supreme Court Regulation No. 2 year of 2015 is effectively enacted in civil judicial system in Indonesia. With society needs nowadays, the effort to increasing good services towards justice seeker, it’s inclusive because of the different mechanism of general judicial system under  HIR/RBG, it is not just about time but also with a judge investigation, simple evidentiary, and without legal effort

Abstract

ABSTRACTEase of Doing Business (EoDB) is a business ease indicator which issued by the World Bank. There are eleven indicators that become a benchmark in measuring the ease of doing business in a country. One of the indicators is related to the settlement of investment dispute or in this case is the enforcing contracts and resolving insolvency. Based on the Doing Business of 2019 report, currently the rating of ease of business in Indonesia occupies the position of 73 (seventy three). Indonesia’s EoDB rating is still far from the target, which is ranked 40 (forty) in the world. This is due to dispute settlement in Indonesia still has a number of issues, both in terms of basic regulations, court proceedings and execution. Whereas in the business world (based on the EoDB indicator) a inexpensive, fast, and simple legal dispute settlement tool is needed. This research is a normative juridical legal research with the descriptive method of analysis, with results show that there are still no applying regulations of Law Number 25 of 2007 concerning on Investment which focused on discussing investment disputes, so that there is not clear legal certainty regarding to investment in Indonesia. In addition, there are also a number of issues related to bankruptcy cases, both of which are Law No. 37 of 2004 concerning Bankruptcy and Suspension of Obligation for Payment of Debts, some of which can lead to certain interests, length of bankruptcy court proceedings, and legal certainty after bankruptcy decisions. A breakthrough or update is needed that can support EoDB, one of which can be done in the field of investment dispute settlement especially related to the enforcing contracts and resolving insolvency by making applying regulations and revising related regulations.ABSTRAKEase of Doing Business (EoDB) merupakan indikator yang berkaitan dengan kemudahan berbisnis yang dibuat oleh Bank Dunia. Terdapat sebelas indikator yang menjadi patokan dalam mengukur kemudahan berbisnis di suatu negara. Salah satu yang menjadi indikator yaitu terkait dengan penyelesaian sengketa investasi atau dalam hal ini penegakan kontrak dan penyelesaian perkara kepailitan. Berdasarkan laporan Doing Business 2019, peringkat kemudahan berbisnis di Indonesia berada pada posisi ke 73 (tujuh puluh tiga). Peringkat EoDB Indonesia tersebut masih jauh dari target yaitu masuk peringkat 40 (empat puluh) besar dunia. Hal ini disebabkan antara lain karena penyelesaian sengketa di Indonesia masih memiliki beberapa permasalahan baik itu dari segi dasar peraturan, proses persidangan dan pelaksanaan putusan. Sedangkan dalam dunia bisnis (berdasarkan indikator EoDB) dibutuhkan sarana penyelesaian sengketa yang murah, cepat, dan sederhana. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif, dengan hasil menunjukan bahwa belum terdapat peraturan pelaksana dari Undang-undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang fokus membahas sengketa investasi sehingga belum terciptanya kepastian hukum yang kuat dalam berivestasi di Indonesia. Selain itu, terdapat beberapa masalah terkait dengan penyelesaian perkara kepailitan, antara lain bersumber dari peraturannya yaitu Undang-undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang yang beberapa Pasalnya dapat mengarahkan kepada kepentingan tertentu, lamanya proses pengadilan kepailitan, dan kepastian hukum pasca putusan kepailitan. Diperlukan suatu terobosan atau pembaruan yang dapat mendukung EoDB yaitu salah satunya dapat dilakukan pada bidang penyelesaian sengketa investasi khususnya terkait penegakan kontrak dan penyelesaian perkara kepailitan dengan cara membuat peraturan pelaksana dan merevisi peraturan terkait.

Abstract

 Penyelesaian kasus pembajakan hak cipta saat ini lebih banyak diselesaikan secara pidana, sedangkan disisi lain kerugian korban pembajakan hak cipta merupakan hal penting untuk diperhatikan. Pasal 95 ayat (4) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang berisi larangan mediasi untuk pembajakan menjadi penghambat dalam penyelesaian sengketanya. Tulisan ini mengkaji penerapan asas sederhana, cepat, dan biaya ringan dalam pengaturan mediasi untuk pembajakan hak cipta dalam Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta dan teori yang tepat digunakan untuk menentukan kewajiban mediasi terhadap penyelesaian kasus pembajakan hak cipta di Indonesia.     Artikel ini menggunakan metode yuridis normatif dan pendekatan data sekunder yang kemudian dianalisis secara normatif kualitatif dengan mengedepankan asas dan teori hukum.     Hasil penelitian menunjukkan bahwa asas sederhana, cepat dan biaya ringan belum diimplementasikan dalam penyelesaian sengketa pembajakan pada UU Hak Cipta. Larangan mediasi sebelum pengajuan tuntutan pidana terhadap pembajakan hak cipta membuat hak ekonomi korban belum tentu terpulihkan. Berdasarkan teori Economic Analysis of Law, mediasi tepat diterapkan dalam rangka memulihkan dan melindungi hak ekonomi, selain tercapainya kepastian hukum dan kemanfaatan bagi korban pembajakan, juga memberikan rasa keadilan bagi kedua belah pihak. Penyelesaian sengketa secara litigasi, baik melalui ranah perdata maupun pidana hendaknya menjadi ultimum remedium dalam hal penyelesaian kasus pembajakan hak cipta.Kata kunci: economic analysis of law, hak cipta, mediasi, pembajakan,                                 ultimum remedium.

Abstract

Indonesia merupakan salah satu negara yang hingga saat ini belum memiliki satu undang-undang yang secara khusus mengatur perlindungan data pribadi. Akhir-akhir ini banyak kasus yang ada di masyarakat mengenai penyalahgunaan data pribadi. Terlebih dengan semakin mudahnya masyarakat mengakses internet sehingga penyalahgunaan data pribadi melalui media elektronik akan menyebar dengan cepat. Di bidang pelayanan kesehatan, data pribadi pasien pun tidak terlepas dari kemungkinan penyalahgunaan. Akan lebih bahaya lagi apabila data pribadi tersebut merupakan suatu data jejak rekam medis pasien yang memang bersifat sangat rahasia. Pemanfaatan Teknologi Informasi dan Komunikasi (TIK) dalam pelayanan kesehatan bertujuan untuk meningkatkan akses, efisiensi, efektivitas, serta kualitas proses medis yang melibatkan organisasi pelayanan medis di rumah sakit, klinik, puskesmas, praktisi medis baik dokter maupun terapis, laboratorium, apotek, asuransi juga melibatkan pasien sebagai konsumen. Akan tetapi dalam proses pelayanan dengan menggunakan program E-health akan mengumpulkan sejumlah data pribadi konsumen yang merupakan data pribadi sensitif dan menimbulkan permasalahan hukum yang baru yaitu sejauhmana pihak penyelenggara jasa kesehatan dapat melindungi data pribadi pasien dapat diakses, disebarluaskan secara lebih mudah melalui kemajuan TIK. Hingga saat ini peraturan yang ada (exisiting law) belum memberikan perlindungan yang maksimal atas data pribadi pasien karena pengaturannya masih bersifat sektoral dan tersebar dalam beberapa Peraturan Perundang-undangan.

Abstract

This research is intended to assert the legal basis for Shares Guarantee Seizure implementation, and execution mechanism towards Court Judgement of Permanent Legal Force, based on positive laws as an actual legal basis in order to achieve legal certainty as a practice of Shares Guarantee Seizure. The research is conducted through normative juridical method approach with descriptive analytical research specifications, and data analysis performed with qualitative methods. This study results shown, first, the actual legal basis for the efforts of Shares Guarantee Seizure is contained in article 227 section (1) of HIR in conjunction with Article 511 of The Indonesian Civil Code, as long as its implementation fulfills the basic requirements. Secondly, there are several distinct in the execution mechanisms of Shares Guarantee Seizure towards limited companies and both mechanisms have not been asserted in HIR, therefore the rule itself became unclear, whereas rules supposed to achieve legal certainty. To obtain legal certainty, new product regulations for Procedure of Civil Law are required in legislation (wet) arrangement, which should accommodate most of legal issues dynamics in Indonesia.
