Abstract

The fast litigation procedure stipulates under the Supreme Court Regulation No. 2 year of 2015. That mechanism only requires small amount of permitted claim, it is 200 million Rupiah in maximum, it also settles claims in a very fast manner, 25 days in maximum. This fast procedural mechanism allocated to settle private dispute is called as “the small claims court”, in which, it is already implemented either in states with the civil law system or the common law system. The research methodology used in this article is juridical-normative and juridical kualitative analyze, to aim the SCC phisophy in Indonesia and the effectivity in enacting this mechanism of small claims court as one of the states that enact the civil judicial system. The results shows that the SCC  in indonesia is an advancement as a means of access to justice, in short it is a simple and inexpensive procedure.  that the fast litigation procedure stipulates under the Supreme Court Regulation No. 2 year of 2015 is effectively enacted in civil judicial system in Indonesia. With society needs nowadays, the effort to increasing good services towards justice seeker, it’s inclusive because of the different mechanism of general judicial system under  HIR/RBG, it is not just about time but also with a judge investigation, simple evidentiary, and without legal effort

Abstract

The relationship between concurrent positions and price-fixing is explained in the Business Competition Supervisory Commission ("KPPU") Regulation Number 4 of 2011 regarding price-fixing behavior as regulated under Article 5 of Law Number 5 of 1999 will be efficiently conducted if competing companies have concurrent positions. This issue can potentially harm the business competition environment and severely impact the business situation in Indonesia. Although there are laws prohibiting concurrent positions, the practice of concurrent positions is still common, particularly for members of the Board of Directors ("BoD") in State-Owned Enterprises ("SOE"), which are supposed to manage public benefits and public welfare. The problems that will be discussed in this research are the legal certainty of the practice of concurrent positions by SOE directors and how the implications of the practice of concurrent positions of SOE directors on violation of price agreements in the case of increasing airfare prices. This study constitutes legal uncertainty regarding concurrent positions of the BoD in SOEs, and the Minister of SOE Regulation Number 3 of 2015 allows a member of the BoD of SOE to have concurrent positions. However, this contradicts the above regulations, which prohibit such practices. Therefore, there has been an inconsistency of norms between the Law and its implementing regulations, which violate the provisions in the higher hierarchy resulting in the practice of having concurrent positions that cause direct implications for the violation of the price-fixing agreement in the related case

Abstract

AbstractThe development of buying and selling both conventional and online transactions has an impact on the need for effective dispute resolution when there is a loss to consumers. Fast, simple, and low-cost consumer dispute resolution is needed to speed up the way the dispute is resolved. This article is part of the results of fundamental research conducted in a normative juridical method. The results showed that consumer dispute resolution in the court with a small claim value was not balanced with the mechanism of proceedings in the court, while the power of the decision through BPSK resolution was not final and binding. Small Claims Procedures are solutions that integrate informal and formal mechanisms as one of the concrete steps to achieve legal certainty in resolving consumer disputes in Indonesia.             AbstrakPerkembangan jual beli baik transaksi secara konvensional maupun online berdampak pada kebutuhan penyelesaian sengketa yang efektif ketika terjadinya kerugian pada konsumen. Penyelesaian sengketa  konsumen secara cepat, sederhana, dan berbiaya ringan diperlukan dengan mempercepat cara penyelesaian sengketa. Artikel ini merupakan bagian dari hasil penelitian fundamental yang dilakukan secara yuridis normatif. Hasil penelitian menunjukkan bahwa penyelesaian sengketa konsumen di pengadilan dengan nilai gugatan yang kecil tidak seimbang dengan mekanisme beracara di pengadilan, sementara itu penyelesaian melalui BPSK kekuatan putusannya tidak bersifat final and binding. Small Claims Procedures merupakan solusi yang memadukan mekanisme informal dan formal sebagai salah satu langkah konkret dalam rangka tercapainya kepastian hukum dalam penyelesaian sengketa konsumen di Indonesia.

Abstract

Surat kuasa khusus dalam hukum acara perdata Indonesia merupakan hal yang sangat penting agar seseorang dapat diwakilkan kuasa hukum di pengadilan. Surat kuasa khusus harus sah secara hukum agar seseorang kuasa hukum mempunyai legal standing dalam perwakilan seseorang, namun pada praktiknya surat kuasa khusus yang ditandatangani tunanetra seringkali dianggap tidak sah oleh hakim karena keterbatasan penglihatan yang dimiliki tunanetra, yang menimbulkan permasalahan tunanetra tidak dapat diwakilkan oleh seorang kuasa hukum dalam beracara. Penelitian ini dibuat bertujuan untuk mengetahui mengenai keabsahan surat kuasa khusus berdasarkan hukum positif di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan mengkaitkan ketentuan-ketentuan hukum yang berlaku dalam penerapan secara praktik. Spesifikasi penelitian yang dilakukan adalah deskriptif analitis yaitu penulisan yang menggambarkan dan menerangkan secara jelas situasi atau peristiwa terkait dengan keabsahan surat kuasa khusus untuk tunanetra dengan data-data yang penulis peroleh melalui studi kepustakaan dan wawancara. Hasil yang diperoleh dari peneilitian ini adalah surat kuasa khusus untuk tunanetra berdasarkan peraturan perundang-undangan sah secara hukum apabila tidak dilakukan oleh seorang tunanetra yang belum ditetapkan sebagai curatele berdasarkan putusan pengadilan dan telah memenuhi ketentuan sesuai dengan peraturan perundang-undangan dan tidak perlu dilakukan di hadapan notaris.

Abstract

In principle, the settlement of business disputes in Indonesia can be done amicably either through the court or outside the court. The court proceeding usually takes a long time, impacting overall case costs in comparison to dispute settlement outside the court. Arbitration as an alternative dispute resolution offers advantages compared to mediation, conciliation, and negotiation as it has an identical adjudicative nature to court proceedings. Therefore, arbitration is the preferred method for settling business disputes due to its perceived effectiveness and efficiency, resulting in win-win solutions. In addition, within the Indonesian legal framework, arbitration closely parallels court proceedings for dispute resolution, and its decisions carry the same level of binding authority and enforceability. This article relies on secondary data analyzed using a qualitative-juridical method to examine the jurisdiction of district court and arbitration. The findings reveal that arbitration has absolute jurisdiction when there exists an arbitration clause or an underlying arbitration agreement, thereby excluding the jurisdiction of the district court.

Abstract

Kerja sama antara Notaris dengan konsultan hukum yang pada hakekatnya bertindak sebagai perantara untuk mencari atau mendapatkan klien dilarang didalam Pasal 4 ayat (4) Kode Etik Notaris. Kerja sama antara Notaris dengan konsultan hukum ini kian marak beberapa tahun ke belakang, karena Pemerintah sedang berupaya untuk memulihkan keadaan ekonomi negara setelah pandemi dengan cara mempermudah legalitas dan perizinan berusaha agar masyarakat dapat melakukan kegiatan berusaha. Banyak konsultan hukum yang secara terang-terangan melakukan promosi di media sosial terhadap beberapa produk berupa akta Notaris seperti pendirian PT, CV dan Yayasan. Pengawasan Notaris dilakukan oleh Menteri Hukum dan Hak Asasi Manusia dan untuk pelaksanaannya Menteri membentuk Majelis Pengawas Notaris. Majelis Pengawas Notaris merupakan suatu badan yang mempunyai kewenangan dan kewajiban terhadap pembinaan dan pengawasan terhadap Notaris. Majelis Pengawas Notaris ini terdiri dari Majelis Pengawas Daerah (MPD) untuk setiap Kabupaten/Kota, Majelis Pengawas Wilayah (MPW) untuk setiap Provinsi dan Majelis Pengawas Pusat yang terletak di Ibukota Negara, Metode penelitian dilakukan secara yuridis normatif, dengan data sekunder sebagai data utama dengan didukung data primer. Abstract

Limited Liability Company (PT) as a Business Entity must have permits to carry out its business activities legally. Risk-based Online Single Submission (OSS) is designated as a Business Licensing portal based on the level of risk of a business activity in determining the type of business licensing. The purpose of this research is to find out how much influence the implementation of business licensing through the risk-based OSS system has in the business licensing of Limited Liability Companies and to formulate the legal consequences that arise if the Limited Liability Company does not comply with the standards of its business activities. The research method used is a normative juridical approach with analytical descriptive research specifications. Data analysis was carried out using qualitative normative methods. The results of the study show that the implementation of business licensing through the risk-based OSS system in practice has implications for limited liability company business licensing, namely providing convenience for limited liability companies in managing business licensing, because permits are issued at the beginning then the government as the authority will verify compliance with business activity standards. legal consequences that arise if the Limited Liability Company does not fulfill the standards of its business activities is the imposition of administrative sanctions on the Limited Liability Company.

Abstract

The implementation of buying and selling is often carried out on cash or credit, which often has an impact if something happens to the debtor, especially if the debtor is bankrupt. In bankruptcy, the Debtor’s asset are collateral for creditors to obtain payment of the bills that has been registered. This research will answer the question whether assets in the form of four-wheeled motorised vehicles that have not been paid in full by bankrupt debtors can be withdrawn into bankruptcy assets in bankruptcy? And when does the ownership right to a movable object transfer in a sale and purchase that overrides Article 1458 of the Civil Code with an agreement?. As for the truth in connection with these questions, the results of the discussion are obtained in the form of an explanation that motorised vehicles purchased on credit can still be part of the bankruptcy estate, even though it has not been paid in full by the debtor. As for the transfer of property rights itself, it is actually based on Article 612 of the Civil Code.

Abstract

Indirect evidence is used by the Competition Supervisory Commission to determine the existence of violations of competition law by business actors. Indirect evidence consists of communication evidence and economic evidence. The application of indirect evidence in competition cases presents a unique challenge due to the difficulty in interpreting it. This research aims to understand and examine the validity of indirect evidence used in cases related to airline price-fixing and cartels, in the case of the Supreme Court Decision Number 1811 K/Pdt.Sus-KPPU/2022. The research uses a normative juridical approach method with analytical descriptive research specifications. The research results show that the considerations in the Supreme Court's Decision regarding the existence of an implied contract among the Reported Parties, which is proven through indirect evidence, are in accordance with Law Number 5 of 1999. The validity of indirect evidence to prove violations of the competition law is equivalent to the evidence categorized as bukti petunjuk which is regulated in Article 42 of Law Number 5 of 1999.

Abstract

Tanggung jawab Camat selaku PPATS dalam pembatalan Akta Hibah yang dibuatnya karena mengandung cacat hukum sehingga tidak terpenuhi nya asas kepastian hukum dalam peralihan hak atas tanah melalui Hibah. Penelitian ini dilakukan melalui studi kepustakaan. Menggunakan metode penelitian Yuridis Normatif, spesifikasi penelitian yang digunakan adalah Deskriptif Analitis dengan metode analisis normatif kualitatif. Bahwa akibat hukum terhadap kedudukan akta hibah yang dibuat oleh camat selaku PPATS yang mengandung cacat hukum adalah tidak memberikan kepastian hukum bagi para pihak yang bersangkutan dan masyarakat karena melanggar syarat sahnya perjanjian baik secara subjektif yang menyebabkan akta dapat dibatalkan maupun syarat objektif yang berakibat akta batal demi hukum berdasarkan Pasal 1320 KUHPerdata. PPATS dapat dimintakan pertanggungjawaban terhadap akta hibah yang cacat hukum dikarenakan kelalaian, ketidakcermatan, maupun kesalahan, terhadap objek tanah yang dialihkan melalui hibah berdasarkan Peraturan Jabatan PPAT adalah berupa tanggung jawab secara administratif maupun perdata.
