Abstract

The management of drinking water at the district or city level can take the form of a regional drinking water company (PDAM) and even in some districts or cities, now the regional drinking water company has changed its name to the regional public drinking water company (Perumda Air Drinking). Given the significant importance of the responsibility of the Regional Drinking Water Company (PDAM), the Regional Company must work professionally and efficiently in carrying out its business. The purpose of this research is to examine and examine how the regulation and implementation of the accountability of the Regional Public Water Company in meeting the demand for clean water in Kuningan Regency is related to regional regulations and Law no. 40 of 2007 concerning Limited Liability Companies. This research method uses an empirical juridical approach and collection techniques with primary, secondary and tertiary data, as well as data collection tools by means of observation and interviews, qualitative data analysis. The results of the study show that the Regional Water Supply Company in Kuningan Regency has implemented corporate social responsibility to the community in tackling the clean water crisis by providing assistance to fulfill clean water through tanker services as well as providing compensation in the form of cost reductions and providing a means for complaints to the public for services , making efforts to obtain new water sources and guarding and caring for a number of springs in Kuningan Regency carrying out a program of replanting tree species as a source of underground water storage.

Abstract

Keberadaan sumber daya alam merupakan anugrah Tuhan dan pesan tersebut tertuang dalam Pasal 33 ayat (3) Undang-Undang Dasar Negara Republik Indonesia 1945 yang menyatakan bahwa bumi dan air dan kekayaan alam yang terkandung di dalamnya dikuasai oleh negara dan digunakan sebesar-besarnya untuk kemakmuran rakyat. Salah satu sumber daya alam yang  keberadaanya bisa di optimalkan oleh Pemerintah daerah adalah pertambangan pasir. Pemanfaatan Galian C beriringan dengan dampak lingkungan dan sosial yang harus diperhatikan, Mengingat mineral dan batu bara sebagai kekayaan alam yang terkandung di dalam bumi merupakan sumber daya alam yang tidak terbarukan. Tujuan penelitian ini untuk mengetahui seperti apa pengaturan pengawasan pemerintah daerah terhadap pertambangan Galian C di Kecamatan Luragung. Metode peneliatan yang digunakan adalah Empiris Yuridis dengan menggunakan data primer dan sekunder serta alat pengumpul  data yang digunakan  melalui wawancara langsung, Observasi, dan studi. Hasil penelitian ini adalah pengaturan pengawasan pemerintah daerah terhadap galian C diatur dalam Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyeleggaran Perlindungan dan Pengelolan Lingkungan Hidup . Simpulan Kewenangan Pemerintah Daerah dalam perizinan memang beralih akan tetapi pengawasan harus tetap dilakukan demi lingkungan yang lestari dan masa depan Kabupaten Kuningan yang lebih baik.

Abstract

Pembayaran melalui cek giro kosong adalah merupakan salah satu cara tindak pidana kejahatan modern dewasa ini. Sebagai tindak pidana kejahatan maka pembayaran melalui cek kosong dapat diklasifikasikan dan dimasukkan ke dalam kejahatan penipuan. Tindak pidana penipuan (bedrog) dimuat dalam Bab XXV Buku II KUHP dari Pasal 378 sampai dengan Pasal 395. Permasalahan dalam penelitian ini adalah bagaimana regulasi perundang-undangan yang mengatur tentangpertanggung jawaban tindak pidana ekonomi Cek dalam pembayaran hutang yang menimbulkan Onrechmatigdaad (perbuatan melawan hukum), bagaimana peranan penegak hukum dalam menangani tindak pidana Cek dalam pembayaran hutang yang menimbulkan Onrechmatigdaad dan hambatan apa saja yang dihadapi penegak hukum dalam menangani tindak pidana Cek dalam pembayaran hutang sehingga terjadinya pemberhentian penanganan perkara, Metode penelitian, penelitian hukum yuridis empiris. Pengaturan cek diatur dalam Pasal 178 sampai dengan Pasal 229 KUH Dagang. Aturan hukum pertanggung jawaban tindak pidana Cek dalam pembayaran hutang yang menimbulkan Onrech-matigdaad (perbuatan melawan hukum). Dilihat dari perspektif hukum pidana penerbitan cek kosong termasuk dalam tindak pidana penipuan.

Abstract

The purpose of this paper is to determine the role and function as well as the driving and inhibiting factors of the Bawaslu of West Java Province in preventing general election violations. The Election Supervisory Body is an organ for organizing general elections in Indonesia which has the task of maintaining the quality of democracy through general elections. In this paper, the method used is through a normative juridical approach. The results show that the functions of Bawaslu in preventing election violations include identifying and mapping election violations, coordinating, supervising, guiding, monitoring and evaluating the implementation of elections, coordinating with relevant government agencies and increasing public participation in election supervision. As a driving factor, there is an increase in the position and strengthening of Bawaslu's functionality. The inhibiting factors are the uncertainty and various interpretations of technical regulations, the planning system has not been well consolidated and the Election Supervisory Body (Bawaslu) of West Java Province does not yet have an effective strategy in preventing transactional politics and community participation in supervision which is still relatively low.Tujuan dari penulisan ini untuk mengetahui peran dan fungsi serta faktor pendorong dan penghambat Bawaslu Provinsi Jawa Barat dalam melakukan pencegahan pelanggaran pemilihan umum. Badan Pengawas Pemilu merupakan organ penyelenggaraan pemilihan umum di Indonesia yang memiliki tugas menjaga kualitas demokrasi melalui adanya pemilihan umum. Dalam penulisan ini, metode yang digunakan adalah melalui pendekatan yuridis normatif. Hasil penelitian menunjukan bahwa fungsi Bawaslu dalam melakukan pencegahan pelanggaran pemilu meliputi identifikasi dan pemetaan pelanggaran pemilu, mengoordinasikan, mensupervisi, membimbing, memantau dan mengevaluasi penyelenggaraan pemilu, berkoordinasi dengan instansi pemerintah terkait dan meningkatkan partisipasi masyarakat dalam pengawasan pemilu. Sebagai faktor pendorong yaitu adanya peningkatan kedudukan dan penguatan fungsionalitas Bawaslu. Faktor penghambat yaitu adanya ketidakpastian dan interpretasi yang beragam dari peraturan teknis, sistem perencanaan belum terkonsolidasi dengan baik dan Badan Pengawas Pemilu (Bawaslu) Provinsi Jawa Barat belum memiliki strategi efektif dalam mencegah politik transaksional serta partisifasi masyarakat dalam pengawasan yang masih tergolong rendah.

Abstract

The increasing development of the tourism sector in Kuningan Regency reflects the progress and development of the area. By looking at the licensing and spatial planning perspectives, a study on the development of the tourism sector in Kuningan Regency is needed. Hence, this study aims to analyze tourism licensing mechanism and tourism law enforcement concerning spatial planning and licensing in Kuningan Regency. This study applied an empirical juridical research method in which the primary and secondary data used were collected through interviews, observation, and literature study. As result, it was found that the licensing mechanism for tourism development in Kuningan Regency is divided into two categories, namely licensing carried out at the Investment Agency and One-Stop Integrated Service and the Gunung Ciremai National Park Office. It is because Kuningan Regency has an area included in the National Park zone, so the licensing process should directly go to the Ministry of Environment and Forestry. Preventive law enforcement efforts have been carried out by law enforcement officers, including drafting legal opinions, holding meetings, as well as avoiding violations during the licensing process. Thus, it can be concluded that the policy and the implementation of law enforcement in the licensing and spatial planning for tourism development in Kuningan Regency are carried out well by the Regional Government and law enforcement officers. Yet, a renewal on Kuningan Regency Regional Regulation on a Detailed Spatial Planning as a basis for determining licenses is needed.

Abstract

Indonesia has enacted a number of regulations dealing with issues of mining governance, and governance. However, the issuance of these various laws and regulations has resulted in illegal mining crimes resulting in environmental damage. The purpose of this study is to analyze sustainable mining governance policies in Indonesia, Africa and Germany. This research method uses a doctrinal legal approach. Resources have been compiled through an examination of mineral and coal mining laws and regulations, governance and environmental governance regulations, as well as reports from various authorities on the same subject. The results of this study show how Indonesia's previous mining law policies recognized local governments as the authority for licensing and monitoring mining activities. This policy was revoked based on the latest governance regulations and had an impact on the vacancy in monitoring mining activities at the district/city level, as a result of this vacancy there was environmental damage due to illegal mining and bad mining activities so that it was necessary to strengthen government policies in monitoring mineral and coal mining. Mining governance policies in Indonesia, Africa and Germany are currently starting to lead to environmental sustainability.

Abstract

Humanitarian Intervention dalam dunia Internasional masih menjadi perdebatan, karena satu sisi hukum Internasional menjamin hak suatu negara mengintervensi negara dalam pencegahan pelanggaran HAM, sedangkan disisi lain humanitarian intervention bertentangan dengan prinsip kedaulatan negara akan tetapi setiap warga negara memiliki hak untuk dilindungi oleh negaranya termasuk tindakan yang dilakukan pemerintah Myanmar terhadap Etnis Rohingya yang dikategorikan sebagai kejahatan kemanusiaan (crimes against humanity) yang berdampak pada hilangnya status kewarganegaraan serta diskriminasi beragama. Intervensi Kemanusiaan (Humanitarian Intervention) sebagai wujud langkah mencegah atau menghentikan kejahatan HAM berat dengan unsur-unsur tertentu (diploatic and military) dalam suatu negara. Metode Penelitian yang digunakan ialah metode penelitian hukum normative dengan sumber utama prosedur pengumpulan data ialah bahan hukum yang berisi aturan hukum yang bersifat normatif. Hasil penelitian menunjukkan bahwa pengaturan hukum Internasional terkait Humanitarian Intervention penting diselenggarakkan dan diatur dalam Piagam PBB serta berbagai konvensi tentang pencegahan dan Hukuman bagi Tindak Kejahatan Genosida 1948, dan perjanjian internasional terkait lainnya.. Sedangkan Peran office of high Commissioner for human Right (OHCHR) atau Komisi Hak Aassi Manusia yang melindungi etnis rohingya dengan menekan pemerintah untuk bertanggung jawab.

Abstract

The study aims to analyze the offenders of illegal logging in Indonesia and Nigeria from its legal liability regulations. The study employed an socio-legal approach involving literary analyses on legal materials used─the statutory regulations, scientific journals and other pertinent documents. The results shows that legal responsibility for illegal logging perpetrators  in Indonesia are under the Law on Forestry, the Law on Prevention and Eradication of Forest Destruction, and the Law on Cipta Kerja. In Nigeria, it is governed by several states, such as the Edo State Forestry (Amendment) Law 2002; Cross River State Forestry Commission Law 2010; and Taraba State Forestry Law 2010. Finally, the legal responsibility for illegal logging has been established in both countries.  Accordingly, the indonesian government is suggested to disseminate the latest laws and regulations, so that the public and corporations are aware of them. Meanwhile, Nigerian government is expected to immediately issue nationwide legislation on illegal logging, so that law enforcement is not relied solely on the requirements of each state

Abstract

The effective management of natural resources is critical in achieving environmental sustainability, and it requires a careful balance of ecological and economic interests. Therefore, this study analyzed the effectiveness of village government policy in managing post-mining land for environmental sustainability using a non-doctrinal legal approach. Primary data were collected through interviews and observations, while secondary data came from regulations, scientific journals, and papers related to post-mining land rehabilitation governance. The study was conducted in Sukageuri View, Kuningan Regency. The study found that the policy implemented by the Cisantana Village Government in managing post-mining land through the establishment of the Village-Owned Enterprise (VOE) in 2016 has been effective. The area, formerly known as Sukageuri View, is home to various flora and fauna species, with several businesses operating and over 114,000 visitors engaging in social activities in 2022. Additionally, the site has contributed to the village's original income and supported the work program of the Cisantana Village Government. In conclusion, the policy implemented by the Cisantana Village Government effectively balances ecological, social, and economic factors, meeting the criteria for environmental sustainability.

Abstract

Tujuan penelitian ini untuk mengkaji bagaimana Pengaturan Pengelolaan Anggaran Dana Desa Terhadap Pembangunan Guna Mewujudkan Pembangunan Berkelanjutan berdasarkan Undang-Undang Nomor 6 tahun 2014 tentang Desa serta Mengkaji faktor-faktor apa saja yang menghambat Efektivitas Pengelolaan Anggaran Dana Desa Terhadap Pembangunan Guna Mewujudkan Pembangunan Berkelanjutan. Metode penelitian yang digunakan adalah pendekatan yuridis empiris dengan menggunakan data hukum primer, data hukum sekunder dan data hukum tersier serta alat pengumpul data yang digunakan yaitu melalui observasi atau terjun langsung kelapangan, wawancara dan kepustakaan. Hasil penelitian ini adalah berdasarkan kajian dari Undang-Undang Dasar Republik Indonesia 1945, Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa, dan Peraturan Presiden Nomor 59 Tahun 2017 tentang Pelaksanaan Pencapaian Tujuan Pembangunan Berkelanjutan. Bahwa dalam hal pembangunan tersebut memang desa di kabupaten kuningan sudah sangat baik dan insfatruktur fasilitas desa sudah sangat baik. Strategi pembangunan yang dilakukan oleh pemerintah saat ini mengatasi ketimpangan pembangunan yaitu untuk melaksanakan pembangunan nasional yang berorientasi dan memberi perhatian besar terhadap pembangunan desa. Penghambat berjalannya pembangunan desa untuk tahun 2020-2021 ini adalah Covid-19 sehingga tertundanya visi misi yang telah dibuat desa untuk pembangunan, baik dari segi perbaikan jalan atau pun fasilitas desa lainnya
