Abstract

A husband is obliged to take care of his family, including his wife and children. when they divorce, he doesn’t have to support his wife anymore, but he still has to support their children. With the compilation of Islamic Law, statute no 1 of 1974 and circular letter of Supreme Court, Courts decide how much the father needs to pay for child support after a divorce through judge’s consideration. But sometime, fathers don’t follow this decision.  In Indonesia, a 2021 circular letter from the Supreme Court allows the court to take the husband's property to ensure the children get the support they need after the divorce. This research aims to determine the concept of confiscation of husband's property as a guarantee for child support after divorce from a maqāṣid al-sharī'ah perspective.  The method used in this research is a normative juridical method which is descriptive. Data was collected through in-depth interviews and religious court studies. The research results show that the concept of including the ex-husband's assets as collateral for post-divorce child support is included in the execution submitted to the Religious Court for the father's husband's negligence in implementing the provisions regarding child consent in the divorce decision. This process can be submitted by the ex-wife or child's mother or child's guardian to the Religious Court. The concept of confiscating the husband's property as a guarantee for children's support after divorce can provide benefits for children in the form of hifdz nafs (protecting themselves) and hifdz aql(protecting reason), as well as benefits for fathers in the form of hifdz nafs (protecting offspring) and hifdz maal(protecting assets).

Abstract

The Indonesian Islamic nomocracy paradigm has a long history and a cultural relationship with the national struggle that coincides with political and religious orientations. The Islamic nomocracy is inseparable from the relationship between Islam and the state rather than being linked to Islamic doctrine and power. This research employed the normative sociological method. It used a philosophical approach from Barbour’s paradigm of the relationship between religion and science and Habermas’ thought on religion in public spaces. This research strives to analyze the Islamic nomocratic paradigm pattern prior to Indonesian independence as a crucial stage that influences the following eras, namely the post-independence era, the Old Order Era, the New Order Era, and the Post-Reformation era up to now. This research aims to find the basics and the development of the Islamic nomocracy in the Indonesian legal system. The roots of the Islamic nomocracy legal thought in Indonesia can be traced to the pre-independence era. In the development of Islamic kingdoms, there was a dialog and integration process between the Islamic nomocracy and the kingdom government. After the War of Java, the conflict and independence pattern was formed. Before Indonesian independence, the Islamic nomocracy thought developed into Pan Islamism which tended to be conical to legal formalization through the caliphate system. After Indonesia’s independence, some of the Islamic nomocracy legal thought recognized the state as one of the legal systems in Indonesia besides customary law and positive law. Then, Indonesia became a partly-Islamic Legal State with a constant up-and-down relationship with the state. The authors also completed this paper with perspectives of Spain and Russia as both have been ruled under Muslim governance.

Abstract

The advocate profession in the early Islamic treasury is not formally institutionalized so that it needs to explore prophetic values in the history of Islamic civilization and objectified into the advocate profession. This study aims to reveal the advocate profession from the perspective of prophetic science and trace prophetic values into the foundation of the advocate profession. This study uses a normative research model through library materials or literature literature as a written source. The results of the study show, first, Islam respects human rights in defending their interests in court. Islam guarantees justice in a trial, equality of rights, and guarantees the right to defend the rights both alone and through legal counsel in accordance with the wakalah system. Second, prophetic values as the foundation of the advocate profession are upholding justice, being a peacemaker, the concept of submitting affairs to the experts leave the matter to the expert / knowledgeable, the concept of mutual help, and advocate ethics. These values are not only human dimensions but also transcendental.

Abstract

This article aims to answer the position of revelation as a prophetic-based ontology of legal science. If the West issues revelations in science and more specifically in the formation of positive law, and glorifies human reason more, then this article explains that these revelations are part of positive law without ignoring human potential, and placing human potential proportionally. By using philosophical methods and approaches, this article shows that revelation in the study of prophetic law occupies a very high position, revelation functions to provide direction and guidance for reason in understanding reality and the formation of positive law. Law is interpreted by the will of Allah SWT which is based on the Koran and the Sunnah of the Prophet Muhammad. Revelation functions as a guide containing norms, values and rules, while reason is tasked with finding laws based on revelation's direction. For this reason, revelation, reason and the senses never come into conflict between the two, instead they become one unit, mutually reinforcing and reinforcing each other. The combination of revelation with reason and human life is then known as the Islamic moderation paradigm which synergizes things that are permanent with things that are flexible, combines the understanding of the Salaf with contemporary reforms (tajdid), is not jumud and liberal, and understand Islam comprehensively. Conflict between revelation and reason will only occur if one of them is fixed and the other is flexible, then of course the fixed one is superior to the flexible one, or both are equally flexible, so even if one is determined by interpreting the view of reason.

Abstract

This paper analyzes and provides advice on legal protection for rape victims in Indonesia in transcendental, restorative law, and responsive law perspectives. These perspectives are compared and combined in an effort to seek an ideal concept. The implication of this paper is to provide advice for an ideal concept of legal protection for victims of rape in an Indonesian context. This paper uses a normative juridical approach with a legal interpretation method. This paper concludes that law enforcement against perpetrators of rape in the Indonesian context can employ transcendental, restorative law, and responsive law approaches. However, in an effort to find an ideal concept, the transcendental perspective of maṣlaḥah mursalah which considers benefits for the public and prevents harm is more suitable for use in Indonesia’s pluralistic society. This is because, in addition to emphasizing moral, ethical, and religious values ​​in law enforcement, the approach will prevent recurrence of cases through handing out severe punishment to perpetrators of rape and providing physical and psychological rehabilitation to victims to make it in line with restorative justice in which victims get the right to recover physically and mentally without reducing the punishment for rape perpetrators.

Abstract

"Prophetic Paradigm" generally refers to a framework or approach that emphasizes the role of prophecy or prophetic figures in shaping religious, spiritual, or social understanding. This paradigm is often discussed in religious contexts, particularly within Christianity, Islam, and Judaism, where prophets are seen as key messengers of divine will, providing guidance, correction, and insight to communities. This article critiques the ethical principles of the epistemological basis of the relationship between law and morality in Herbert Leonel Adolphus Hart's (H.L.A. Hart) rational paradigm, which is founded on the prophetic paradigm via the lens of the Medina Charter. It employs a philosophical approach to investigate the fundamental assumptions of the epistemological foundation of legal science by connecting legal science to prophetic science. This study's data are collected from literature. This analysis shows that Hart's proposed separation of law and morality is inappropriate. Some rules are both legal and moral. Thus, the criticism of morality in the Medina Charter demonstrates that the distinction between law and morality established by Hart cannot be generally implemented and must be evaluated by taking into account social context and moral ideals considered significant by the society.

Abstract

Introduction: The recognition of customary land rights based on local values has undergone several shifts in value, giving rise to state doubts about its existence. Purposes of the Research: Therefore, this research aimed to examine the recognition of customary land rights of the Pusu customary community in Sumbawa based on the value of 'krik slamat'.Methods of the Research: This non-doctrinal research was conducted using a sociological approach to investigate the formation and functioning of the law. This method also discovers the philosophical values embodied in empirical law by objectifying the values that live in society, in this context the objectification of values is carried out with the concept of recognizing norms that live in society.Results of the Research: The results showed that, first, the recognition of land rights of the Pusu community was conducted with 'rpulung' based on the value of 'krik slamat' containing elements of religion, democracy, and justice. Second, in 'krik slamat', which serves as a philosophical foundation in the formation of the law, hence, 'pulung' is born in the form of norms.

Abstract

Purpose of the study: This article aims to find out how the divorce conditions in the Kangean Islands are and to see how the factors that influence it and the legal reasoning used by the judge in deciding the divorce case. Methods: the method used in this study is a normative juridical method with a decision approach, the data used is secondary data, namely the decisions of the religious courts in 2020-2022, which every year 30% of the decisions are taken, the data are analyzed descriptively Results: From the research conducted, it was found that the majority of divorces in Kangean Island were carried out by a contested divorce mechanism, while the factors behind the majority were due to disputes, then followed by economic factors, legal reasoning judges were divided into empathy, namely the use of legal norms, conformity between facts and norms. , interpretation of problems and norms, as well as the use of the rules of Islamic law in its legal opinion Applications of this study: This article is useful to support research on divorce and legal opinions, especially on Kangean Island and Indonesia in general Novelty: The novelty of this research is that there are still very few people doing research on the Kangean Islands, as well as the discovery of several legal reasoning concepts for judges at the Kangean Religious Court.   ABSTRAK   Tujuan Penelitian: Artikel ini bertujuan untuk mengetahui bagaimana kondisi perceraian di Kepulauan Kangean dan melihat bagaimana faktor-faktor yang mempengaruhinya serta alasan hukum yang digunakan hakim dalam memutus perkara perceraian. Metode : Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan pendekatan putusan, data yang digunakan adalah data sekunder yaitu putusan pengadilan agama tahun 2020-2022 yang setiap tahun diambil 30% putusannya, data tersebut dianalisis secara deskriptif Hasil: Dari penelitian yang dilakukan diketahui bahwa mayoritas perceraian di Pulau Kangean dilakukan dengan mekanisme cerai gugat, sedangkan faktor penyebab mayoritas adalah karena perselisihan, kemudian disusul faktor ekonomi, pertimbangan hukum hakim terbagi menjadi empati, yaitu penggunaan norma hukum, kesesuaian antara fakta dan norma. , interpretasi masalah dan norma, serta penggunaan aturan hukum Islam dalam opini hukumnya Aplikasi penelitian ini: Artikel ini bermanfaat untuk mendukung penelitian tentang perceraian dan opini hukum khususnya di Pulau Kangean dan Indonesia pada umumnya Kebaruan: Kebaruan dari penelitian ini adalah masih sedikitnya orang yang melakukan penelitian di Kepulauan Kangean, serta ditemukannya beberapa konsep penalaran hukum bagi hakim di Pengadilan Agama Kangean.

Abstract

ABSTRACT Purpose of the study: This research aimed to analyze the judicial rationing behind Decision No. 262/Pid.B/2018/Pn.Skt. According to Article 170 of the Indonesian Criminal Code in the legal event of a mass violence crime that occurred in Surakarta City.  Methodology: This was normative legal research that used the case approach. It emphasized the legal consideration of judges in deciding and giving a verdict upon a case. Results: This research analyzed Decision No. 262/Pid.B/2018/Pn.Skt. Judges considered that the actions committed by the group of perpetrators originated from the aggressive nature of humans due to their animal power that can cause law-violating actions. This aggressive human nature in a group caused a sense of affection and bond creates similarities in desires, goals, and ideas. It resulted in a sense of solidarity in the group according to the ashobiyah terminology. Applications of this study: to provide knowledge on: (1) the judicial analysis based on the factors that influence the occurrence of mass violence; and (2) the judicial consideration in deciding upon a case of mass violence in Surakarta City based on the judicial rationing in Decision No. 262/Pid.B/2018/PN.Skt. Novelty/Originality of this study: This paper provided new information on the action of mass violence on Decision No. 262/Pid.B/2018/PN.Skt correlated with Ibnu Khaldun’s ashobiyah terminology. Keywords: judicial reasoning, mass violence, aggressivity, ashobiyah    ABSTRAK  Tujuan: Penelitian ini bertujuan untuk menganalisis pertimbangan yuridis di balik Putusan Nomor 262/Pid.B/2018/Pn.Skt. Menurut Pasal 170 KUHP dalam peristiwa hukum tersebut, tindak pidana kekerasan massal terjadi di Kota Surakarta.  Metodologi: Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan kasus. Ditekankan pada pertimbangan hukum hakim dalam memutus dan memberikan putusan atas suatu perkara.  Hasil: Penelitian ini menganalisis Keputusan No. 262/Pid.B/2018/Pn.Skt. Hakim menilai bahwa perbuatan yang dilakukan oleh kelompok pelaku tersebut berawal dari sifat agresif manusia karena animal power yang dapat menimbulkan perbuatan melanggar hukum. Sifat agresif manusia dalam suatu kelompok menimbulkan rasa kasih sayang dan ikatan yang menimbulkan kesamaan keinginan, tujuan, dan gagasan. Hal itu mengakibatkan rasa solidaritas dalam kelompok menurut terminologi ashobiyah.  Aplikasi penelitian ini: memberikan pengetahuan tentang (1)analisis yuridis berdasarkan faktor-faktor yang mempengaruhi terjadinya kekerasan massal, (2)pertimbangan yuridis dalam memutus perkara kekerasan massal di Kota Surakarta berdasarkan yuridis rationing dalam Putusan No. 262/Pid.B/2018/PN.Skt.  Kebaruan/Orisinalitas: Tulisan ini memberikan informasi baru tentang aksi kekerasan massal pada Putusan No. 262/Pid.B/2018/PN.Skt yang berkorelasi dengan terminologi ashobiyah Ibnu Khaldun.  Kata kunci: penalaran yudisial, kekerasan massal, agresivitas, ashobiyah

Abstract

ABSTRACT  Purpose of the study: This study aims to understand the lawsuit of the Samin Community in Rembang Regency against Governor's Decree No. 660.1/17/2012, which permits the development and exploitation of natural resources in the Kendeng Mountains. This dispute not only shows a lawsuit but, more broadly, is the counter-hegemonic movement between local law and national law, which is marked by the victory of the Samin Community at the level of Judicial Review at the Supreme Court. Methodology: The research was carried out through observation, interview, and literature review to explain local and national legal disputes, which were analyzed qualitatively using legislation, unwritten law, and the Gramsci Counter Hegemony approach. Results: The study revealed that: first, local law disputes against national law in Rembang Regency occurred because of the dominance of national law over local law, which recognizes indigenous people only when stated in the law. Second, the Samin Indigenous people still adhere to traditions, myths, and ecological principles called Saminism, which only allow them to farm and serve as a cultural identity. Therefore, they may not be able to survive if they have another profession. Third, the judge's decision in the form of a caliph on earth is influenced by the soul of the mother earth community of the Samin Community and forms a new norm so that it becomes a new hegemony against national law. Application of the study: This research can be used by law enforcers so that their legal decisions rely on not only legal positivism values but also transcendental local legal concepts. Novelty/Originality of research: No previous research has linked the dispute over permits for constructing a cement factory in the Rembang Regency and Decision No. 99/PK/TUN/2016 with a counter-hegemonic approach and transcendental-based local laws. Keywords: legal comparison, legal reasoning, environmental law, court judgment   ABSTRAK  Tujuan Kajian: Kajian ini bertujuan untuk memahami gugatan masyarakat Samin di Kabupaten Rembang terhadap Keputusan Gubernur No. 660.1/17/2012 yang mengizinkan pembangunan dan ekspolitasi sumber daya alam di pegunungan Kendeng. Sengketa ini tidak hanya menunjukan gugatan hukum namun yang lebih luas adalah gerakan kontra hegemoni antara hukum lokal dengan hukum nasional yang ditandai dengan kemenangan masyarakat Samin pada tingkat Peninjauan Kembali di Mahkamah Agung. Metodologi: Penelitian dilaksanakan dengan melakukan observasi, wawancara, dan kajian literatur yang dimaksudkan untuk menjelaskan sengketa hukum lokal dan nasional yang dianalisis secara kualitatif dengan menggunakan perundang-undangan, hukum tidak tertulis dan pendekatan Kontra Hegemoni Gramsci. Hasil-hasil: Hasil Penelitian ini menunjukan bahwa pertama, Sengketa hukum lokal melawan hukum nasional di Kabupaten Rembang terjadi karena adanya dominasi hukum nasional atas hukum lokal yang hanya mengakui masyarakat adat hanya jika disebutkan oleh Undang-Undang. Kedua, masyarakat Adat Samin masih berpegang pada tradisi, mitos dan prinsip-prinsip ekologis yang disebut Saminisme yang yang hanya mengizinkan mereka untuk bertani saja dan sebagai identitas budaya, sebab itu mereka tidak mungkin mampu bertahan hidup apabila berprofesi lain; dan Ketiga, Amar putusan hakim berupa khalifah di muka bumi dipengaruhi oleh jiwa masyarakat ibu bumi masyarakat Samin dan membentuk norma baru sehingga menjadi hegemoni baru melawan hukum nasional. Aplikasi Kajian: Penelitian ini dapat digunakan bagi penegak hukum agar putusan hukumnya tidak hanya bersandar pada nilai-nilai positivisme hukum, namun juga konsep hukum lokal yang bersifat transendental. Kebaruan/Originalitas Penelitian: Belum ada penelitian sebelumnya yang menghubungkan sengketa izin pembangunan Pabrik Semen di Kabupaten Rembang dan putusan No. 99/PK/TUN/2016 dengan pendekatan kontra hegemoni dan hukum local berbasis transendental.
