Abstract

The partner's problem is that the youth of the Tenayan Industrial sub-district, who are a strategic part of the community, do not know and understand the importance of participation in election supervision so that they are of higher quality. The target of community service activities is to increase knowledge and understanding of the importance of participation in election supervision so that they are of higher quality. Solutions agreed upon by the proposing team and partners to address priority issues need to be socialized in the form of counseling and face-to-face discussions. The method of implementing lectures, delivering material, on this occasion the participants were free to ask and answer. The details of this method are, 1. Submission of material, 2. Interactive dialogue, this dialogue serves as brainstorming from participants to obtain input in the form of problems, aspirations, suggestions, ideas and solutions. Partner participation provides time and mobilizes youth participants with both student and student status as the target audience. The output is expected to increase knowledge, understand the target audience of the importance of participatory oversight of the 2024 election, for those proposing the output achieved is in the form of a scientific article.

Abstract

Berdasarkan Pasal 42 Peraturan Pemerintah Nomor 27 Tahun 2014 tentang Pengelolaan Barang Milik Negara/Daerah diatur bahwa Kepala Daerah sebagai pemegang kekuasaan pengelolaan barang milik daerah wajib melakukan pengamanan barang milik daerah yang meliputi pengamanan administrasi, pengamanan fisik, dan pengamanan hukum. Namun, terdapat beberapa bidang tanah yang merupakan aset daerah milik Pemerintah Kota Pekanbaru saat ini dikuasai oleh pihak lain tanpa izin. Metode yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis. Hasil penelitian ini adalah berdasarkan Pasal 43 Peraturan Pemerintah Nomor 27 Tahun 2014 tentang Pengelolaan Barang Milik Negara/Daerah ditegaskan bahwa barang milik daerah berupa tanah harus disertipikatkan atas nama pemerintah daerah. Implementasi pengelolaan aset daerah berupa tanah oleh Badan Pengelola Keuangandan Aset Daerah Kota Pekanbaru belum terlaksana dengan baik. Hambatannya adalah lemahnya pendataan dan inventarisasi aset daerah Pemerintah Kota Pekanbaru yang dilakukan oleh Badan Pengelola Keuangan dan Aset Daerah Kota Pekanbaru serta terbatasnya jumlah pegawai yang bertugas melakukan inventarisasi aset daerah pada Bidang Pengelolaan Aset. Upaya yang dapat dilakukan oleh Badan Pengelola Keuangan dan Aset Daerah Kota Pekanbaru adalah melakukan pendataan ulang dan inventarisasi semua aset-aset daerah Pemerintah Kota Pekanbaru, baik yang masih digunakan maupun yang sudah tidak digunakan lagi.

Abstract

Strategic district roads are roads that are prioritized to serve the interests of the district based on considerations to stimulate economic growth, welfare and security of the district, while city roads are roads located within the autonomous city area as referred to in the law on regional government. see the explanation of Article 9 (4) of Law Number 38 of 2004 concerning Roads. The purpose of this study is to analyze the implementation of government responsibility for road maintenance in Bengkalis Regency based on Law Number 38 of 2004 concerning Roads, to find obstacles and efforts to overcome obstacles in the implementation of government responsibility for road maintenance in Bengkalis Regency based on Law Number 38 of 2004 concerning Roads. The method used is sociological legal research. Based on the research results, it is known that the Implementation of Government Responsibility for Road Maintenance in Bengkalis Regency Based on Law Number 38 of 2004 concerning Roads has not run as it should, because in Bengkalis Regency there are still several damaged roads, this is certainly contrary to Law Number 38 of 2004 concerning Roads, which is a crucial aspect in ensuring connectivity and transportation security for the community.

Abstract

Regional regulations are written regulations containing generally binding legal norms established by the Regional People's Representative Council with the joint approval of the Regional Head. The regional legislation program has an important and strategic position in the formation of regional regulations. However, most local regulations actually get rejection from the community until they are revoked by the government. The method used in this research is normative legal research. The process of making local regulations rarely involves the community so that local regulations that are born are often not accepted by the community. The Regional Government and the Regional People's Legislative Assembly should first prepare a regional legislation program to determine the needs of the region and the needs of the community, then make regional regulations that are in accordance with the Regional Medium-Term Development Plan or Regional Strategic Plan. Therefore, there must be political will from the Regional Government and the Regional House of Representatives to establish cooperation with universities in conducting studies on a problem so that it becomes an academic text that is ready to be ratified into a regional regulation.

Abstract

The State Administrative Court has the authority to adjudicate General Election Process Disputes based on Perma No. 5/2017. Types of evidence in General Election disputes are: letters or writings, witness statements, expert statements, confessions of the parties, the judge's knowledge and other evidence in the form of electronic information or electronic documents. Meanwhile, in its development, this electronic document is known and considered as evidence in procedural legal processes, especially in the evidentiary stage. From this problem, the formulation of the problem raised is how to carry out a juridical analysis regarding the verification of electronic information and electronic documents in disputes over the general election process in the state administrative court based on Perma No. 5/2017. The research method used is normative juridical with a statutory approach. The results found that from a formal juridical perspective, the law of evidence in Indonesia, in this case the state administrative court procedural law, does not yet accommodate electronic documents as evidence. Meanwhile, several new laws have regulated and recognized electronic evidence as valid evidence. Then in Perma No. 5/2017 also mentions electronic information or electronic documents as a type of evidence for general election process disputes. The benchmark given by the judge in assessing electronic evidence in the trial of State Administrative disputes at the State Administrative Court is that as long as the judge uses two types of evidence as regulated in the Law, obtained legally and can be convincing then the judge can decide the case with those evidence.

Abstract

Permasalahan mitra dalam hal ini para panitia pengawas pemilu tingkat kecamatan yang ada dikota Pekanbaru belum begitu memahami apa saja yang menjadi pelanggaran pemilu dan berpotensi menjadi sengketa pemilu, sengketa pemilu dan penyelesaiannya, oleh karenanya perlu dilakukan upaya peningkatan pengetahuan dan pemahaman terkait sengketa pemilu dalam bentuk penyuluhan hukum. Target kegiatan pengabdian kepada masyarakat ini adalah para panitia pengawas pemilu timgkat kecamatan dengan harapan meningkat pengetahuan dan pemahaman khalayak sasaran tentang pentingnya peran mereka dalam memahami sengketa pemilu.Solusi yang ditawarkan dan di sepakati oleh tim pengusul dan pihak mitra dalam mengatasi persoalan prioritas yang di hadapi mitra adalah perlu dilakukan sosialisasi ataupun penyampaian materi dalam bentuk penyuluhan dan diskusi secara tatap muka.Metode pelaksanaan kegiatan menggunakan metode ceramah. Dalam metode ini penceramah menyampaikan materi, dalam kesempatan itu, peserta dibebaskan untuk bertanya jawab dengan penceramah. Rincian dari metode ini adalah, 1. Penyampaian materi, 2. Dialog interaktif, dialog ini sebagai curah pendapat (brainstorming) dari peserta untuk memperoleh masukan berupa persoalan, aspirasi, usulan, gagasan dan solusi. Partisipasi mitra dalam kegiatan ini menyatakan kesediaan, menyediakan waktu dan tempat, serta memobilisasi khalayak sasaran. Luaran yang akan dihasilkan sesuai rencana kegiatan pengabdian kepada masyarakat ini adalah : bagi mitra tentunya peningkatan pemahaman mengenai sengketa pemilu. Sedangkan bagi pengusul luaran yang akan dicapai adalah berupa draft artikel ilmiah, dan bagian dari Tri Darma Perguruan Tinggi.

Abstract

Health centers in the JKN/BPJS system have a major role in BPJS health participants. Quality services are services that must have basic requirements, namely, available and sustainable, easily accessible, easily accessible, acceptable and reasonable, and of good quality. The decline in the quality of FKTP can affect the calculation of capitation payments for FKTP. According to Article 4 of BPJS Regulation Number 7 of 2019 concerning Instructions for Implementation of Performance-Based Capitation Payments at first-level health facilities, the contact number is one indicator to see the utilization of the Puskesmas. If the quality of FKTP services decreases, it will certainly have an impact on the number of patient contacts with FKTP. Other impacts that arise are such as reduced capitation payments which have an effect on labor intensiveness in FKTP. This can cause a sense of injustice to the rights that should be obtained. This study aims to analyze the relationship between the Puskesmas and the Social Security Administering Body based on the Regulation of the Social Security Administering Body Article 4 Number 7 of 2019 and to find out the ideal concept of the relationship between the Puskesmas and the Social Security Administering Body based on Indonesian Positive Law. The research method used by the author is normative research which is carried out by finding the rule of law, legal principles, or legal doctrines, as well as searching literature using data bases to answer legal issues faced in writing. The application of the tariff applied by BPJS to Puskesmas is a capitation system, in which the payment of claims in advance every month at health facilities is based on the number of patients who register at the health facility without calculating the type and number of health services provided. This system is effective but pressures health facilities to serve with claims below the basic cost of health services so that health facilities are resistant and provide services that are meager and tend to be poor. Therefore, more effective policies are needed so that equality occurs in order to create good quality in health services. Policies related to the relationship between Puskesmas and BPJS must be based on the basis of the obligations of the State of Indonesia in guaranteeing the right of the people to obtain proper health services in accordance with Article 28 H and Article 34 of the 1945 Constitution of the Republic of Indonesia, as well as reviewing the responsibilities of the Government and the Government. Regions to provide health facilities that meet these standards and cooperate with BPJS Health in accordance with Articles 35 and 36 of Presidential Regulation Number 111 of 2013 concerning JKN.

Abstract

Tulisan ini bertujuan untuk menganalisis penegakan hukum bagi pelaku pelanggar ketentuan pengangkutan dan niaga Bahan Bakar Minyak Bersubsidi di Kabupaten Rokan Hulu berdasarkan Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi; serta merumuskan faktor penghambat dan upaya mengatasi hambatan.Tulisan ini merujuk pada Teori Negara Hukum, Teori Penegakan Hukum dan Teori Efektivitas Hukum. Populasi dan sampel berasal dari narasumber–narasumber yang relevan dengan penelitian. Sumber data yang digunakan adalah primer, sekunder dan tersier; teknik pengumpulan data: observasi, wawancara terstruktur dan studi dokumen (kepustakaan). Hasil penelitian diketahui bahwa Pasal 55 Undang – Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi yang menyatakan bahwa “Setiap orang yang menyalahgunakan Pengangkutan dan/ atau Niaga Bahan Bakar Minyak yang disubsidi Pemerintah dipidana dengan pidana penjara paling lama 6 (enam) tahun dan denda paling tinggi Rp.60.000.000.000,00 (enam puluh miliar rupiah)” pada tahun 2022 dan 2023 belum dilaksanakan dengan baik terutama di di Kecamatan Ujung Batu, Tandun, Tambusai, Kabun dan Kunto Darusalam. Dikarenakan kendala tertentu yaitu belum tertangkapnya beberapa pelaku terutama pelaku utama dalam jaringan pengangkutan dan perniagaan BBM bersubsidi Minyak Solar (Gas Oil) tidak berizin, mengingat pelaku yang melakukan pengangkutan dan perniagaan dalam skala yang tidak begitu besar yang berhasil ditangkap sulit untuk membantu pihak kepolisian dalam mengungkap jaringan mereka. Kemudian penjatuhan vonis hukuman oleh Pengadilan Negeri Pasir Pengaraian terhadap pelaku yang sudah tertangkap juga terlalu ringan dari tuntutan Jaksa dan batasan aturan pemidanaa dalam regulasi

Abstract

On September 3, 2022, fuel prices were raised by President Joko Widodo, with advocates arguing that the increase is necessary to safeguard the State Revenue and Expenditure Budget. Dissenting groups contended the hike was inappropriate, citing a dissonance between the identified problem and the proposed solution. Therefore, this study aims to analyze the legal aspects, policies and the role of the government in ensuring the welfare of Indonesian citizens through oil and gas management. Using a normative legal study methodology, the study used both statutory and analytical methods. The results showed a discrepancy between the increase in fuel price and the principles outlined in Article 33 and the Preamble of the 1945 Constitution of the Republic of Indonesia. The government, as the representative of the state, holds the authority to manage the mining sector's economy, aiming to maximize prosperity for citizens. Adhering to the ideology of a welfare state, the responsibility to provide basic social needs and foster prosperity is assigned to the government.

Abstract

Penelitian ini bertujuan untuk mengkaji penerapan hukum terhadap penanggung jawab aksi unjuk rasa yang melakukan tindak pidana di Provinsi Riau, dengan landasan Undang-Undang Nomor 9 Tahun 1998 tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum. Menggunakan pendekatan hukum sosiologis, penelitian ini mengeksplorasi bagaimana hukum diterapkan pada penanggung jawab aksi unjuk rasa yang melanggar hukum, serta hambatan yang dihadapi dalam proses penegakannya. Selain itu, penelitian ini juga membahas upaya-upaya yang dapat dilakukan untuk mengatasi hambatan tersebut agar penerapan hukum dapat berjalan lebih efektif. Adapun rumusan masalah dalam penelitian ini meliputi: (1) bagaimana penerapan hukum terhadap penanggung jawab aksi unjuk rasa yang melakukan tindak pidana di Provinsi Riau; (2) hambatan apa saja yang terjadi dalam penerapan hukum tersebut; dan (3) upaya yang dapat dilakukan untuk mengatasi hambatan-hambatan tersebut. Hasil penelitian diharapkan dapat memberikan kontribusi terhadap peningkatan efektivitas penegakan hukum dalam kegiatan unjuk rasa di Indonesia, khususnya di wilayah Provinsi Riau.
